    Opis:
    The article provides an overview of approaches to the organization of religious education in secondary schools of Ukraine during the period of its independence, which complements the European experience of studying this issue. Attention is paid both to the historical circumstances of the beginning of school religious education in the interaction of religious, state and educational institutions, and to modern issues related to the policy of introducing subjects of religious and moral orientation in Ukrainian schools. The current legislation in the field of religious education in a secular school, the real practice of its implementation, and the challenges that give an idea of the specifics of Ukraine in this matter in the European space, are analyzed. The legislative work of Ukraine on resolving the issue of legal regulation of the possibility of establishing educational institutions of different levels of accreditation by religious organizations is generalized. Statistical data on the state of teaching religious and moral subjects in schools of Ukraine are analyzed. Prospects and possibilities of further teaching of religious education in the Ukrainian public school are considered.

    Opracowanie koncentruje się na ogłoszonych w lipcu 2013 r. wytycznych w sprawie realizacji przez Komisję Europejską art. 17 ust. 3 Traktatu o funkcjonowaniu Unii Europejskiej, który zobowiązuje Unię Europejską do prowadzenia otwartego, przejrzystego i regularnego dialogu z kościołami, innymi stowarzyszeniami lub wspólnotami religijnymi oraz organizacjami światopoglądowymi i niewyznaniowymi. Najważniejszą część opracowania stanowi tłumaczenie tego dokumentu na język polski. W celu wyjaśnienia przyczyn powstania wytycznych, omówiono również decyzję Europejskiego Rzecznika Praw Obywatelskich z 25 stycznia 2013 r. (2097/2011/RA). Negatywnie oceniając odrzucenie przez Komisję możliwości realizacji wniosku Europejskiej Federacji Humanistycznej o zorganizowanie seminarium dialogu na zaproponowany przez nią temat, Rzecznik wezwał bowiem Komisję do właściwszego realizowania art. 17 ust. 3 TFUE i zasugerował sprecyzowanie stosowanych w tym zakresie praktyk i zasad, a zwłaszcza przemyślenie potrzeby opracowania wiążących wytycznych.
    The study deals with the Guidelines on the Implementation of Article 17(3) TFEU by the European Commission, published in July 2013, for setting the framework for open, transparent and regular dialogue with churches, religious associations or communities, and philosophical and non-confessional organisations. The Polish translation of the document constitutes the main part of the text. It is preceded by an overview of the decision of the European Ombudsman of 25 January 2013 in his inquiry into complaint 2097/2011/RA against the European Commission. The Ombudsman, while negatively assessing the Commission’s rejection of the proposal of the European Humanist Federation for a dialogue seminar on the topic Competing Rights Issues in Europe, suggested clarifying the Commission’s “practices and rules in this area”, and drawing up “guidelines in terms of how exactly it plans to implement Article 17 TFEU”.
