Globalizacja ma obiektywny charakter i wywiera istotny wpływ na tradycyjne funkcje państwa. Na skutek militarnej potęgi supermocarstw, państwa są bezradne w razie konfliktu militarnego, a ich suwerenność jest drastycznie ograniczona. Internet, i środki masowego przekazu ograniczają wpływ tradycyjnych instytucji wychowawczych, rodziny, kościoła i państwa. Rozpowszechniane treści są determinowane nieubłaganymi prawami kapitalistycznego rynku. W tych warunkach, państwo musi szukać nowych instrumentów dla wywiązania się z naturalnych zadań i obrony suwerenności.
Globalisation has an objective character and has a significant impact on traditional functions of state. The co-authors of economic policy are global corporations controlling capitals that exceeds the wealth and national product of most countries. Their advantage is causing a decomposition of the system legal protections of workers. Private banks and loan institutions are co-authors of monetary policy. The dollar, as the world’s anchor currency, allows to burden other countries at the expense of the US trade deficit. As a result of military might of superpowers, countries are powerless in terms of military conflict and their sovereignty is drastically reduced. The Internet and mass media reduce the influence of traditional educational institutions: family, church and nation. The disseminated content is determined by the relentless laws of the capitalist market. Under these conditions, the state must seek for new instruments to discharge its natural tasks and defend its sovereignty.

The paper presents an iterative identification method dedicated for industrial processes. The method consists of two steps. In the first step, a MISO system is identified with the Modulating Functions Method to obtain sub-models with a common denominator. In the second step, the obtained subsystems are re-identified. This procedure enables to obtain the set of models with different denominators of the transfer functions. The algorithm was used for on-line identification of a glass conditioning process. Identification window is divided into intervals, in which the models can be updated based on recent process data, with the use of the integral state observer. Results of the performed simulations for the identified models are compared with the historical process data.

Celem artykułu jest propozycja metody identyfikacji i pomiaru kosztów społecznej odpowiedzialności Lasów Państwowych w kontekście zadań związanych z pozaprodukcyjnymi funkcjami lasów. Cel artykułu osiągnięto poprzez studia literaturowe i przeprowadzone studium przypadku na wybranej jednostce organizacyjnej Lasów Państwowych. We wstępie autorka wskazała na niektóre bieżące problemy Lasów Państwowych, określiła potrzebę identyfikacji i pomiaru kosztów społecznej odpowiedzialności ponoszonych w Lasach Państwowych oraz przestawiła główne informacje o kosztach w systemie rachunkowości tego podmiotu. Następnie przedstawiła fragmenty studium przypadku z propozycją pomiaru dotyczącego sposobu identyfikacji kosztów społecznej odpowiedzialności w działalności administracyjnej Lasów Państwowych. W podsumowaniu autorka podkreśliła konieczność identyfikacji i pomiaru kosztów społecznej odpowiedzialności Lasów Państwowych. Słowa kluczowe: Lasy Państwowe, pozaprodukcyjne funkcje lasu, system rachunkowości Lasów Państwowych, koszty społecznej odpowiedzialności.
The purpose of this article is to propose a method for identifying and measuring the costs of social responsibility of the State Forests in the context of tasks related to non-productive functions of forests. The purpose of the article was achieved through literature studies and a case study on a selected organizational unit of the State Forests. In the introduction, the author indicated some current problems of the State Forests, defined the need for identification and measurement of social responsibility costs incurred in the State Forests and presented the main cost information in the accounting system of this entity. Then she presented fragments of a case study with a measurement proposal on how to identify social responsibility costs in the administrative activities of the State Forests. In conclusion, the author emphasizes the need to identify and measure the costs of social responsibility of the State Forests.

Opis:
Purpose Develop a method for determining and evaluating the stress-strain state, particularly the distribution of thermomechanical stresses in the materials of individual rotating parts of vehicles. Design/methodology/approach The proposed method is based on the principle of gradual approximations of the solution when the boundary conditions are satisfied on the curvilinear limiting surfaces of the disk body. Findings The proposed method of determining and estimating the distribution of thermomechanical stresses in the disk material makes it possible to take into account the variable geometry: thickness and presence of a hole in the central part of the disk, also correctly determine stress-strain state at any point of unevenly heated rotating axial body. Research limitations/implications The work uses generally accepted assumptions and limitations for thermomechanical calculations. Originality/value It is proved that in real disks, the stress-strain state is spatial, and the well - known method based on the hypotheses of the plane-stress state does not provide the possibility of calculating the values of stresses in the thickness of the disk. The obtained results can be used to improve the methodology of auto technical examination of road accidents. In addition, they can be taken into account by bus drivers on urban routes when choosing a safe distance in heavy traffic, as well as design engineers of car brake systems.

Opis:
Environmental governance has been marked by the rise of novel forms of institutions within the last three decades. In this paper, a growing proportion of those institutional innovations is supplied by non-state actors creating specific regulatory structures, referred to as transnational environmental regimes (TER). The purpose of the article is to identify their functional correlations with states, seen through the lenses of the state’s constitutional functions. The study is divided into three sections. The first one explains the rationale for analyzing TER in the constitutional context. The second section covers the essence of TER. The third aims at delineating patterns of relations between TER and the constitutional functions of states.
Tendencją charakterystyczną dla struktur sterowania ochroną środowiska w ciągu ostatnich trzech dekad było powstawanie nowych form instytucji. Rosnącym na znaczeniu źródłem tych instytucjonalnych innowacji są podmioty niepaństwowe tworzące specyficzne struktury regulacji, w niniejszym opracowaniu określone mianem transnarodowych reżimów ekologicznych (TRE). Celem artykułu jest identyfikacja ich funkcjonalnych powiązań z państwami, rozpatrywanych przez pryzmat konstytucyjnych funkcji państwa. Studium zostało podzielone na trzy części. Pierwsza wyjaśnia zasadność analizowania TRE w kontekście konstytucyjnym. Druga dotyczy istoty TRE. W trzeciej podjęto próbę nakreślenia wzorców relacji między TRE i konstytucyjnymi funkcjami państw.

The paper presents new concepts of the identification method based on modulating functions and exact state observers with its application for identification of a real continuous-time industrial process. The method enables transformation of a system of differential equations into an algebraic one with the same parameters. Then, these parameters can be estimated using the least-squares approach. The main problem is the nonlinearity of the MISO process and its noticeable transport delays. It requires specific modifications to be introduced into the basic identification algorithm. The main goal of the method is to obtain on-line a temporary linear model of the process around the selected operating point, because fast methods for tuning PID controller parameters for such a model are well known. Hence, a special adaptive identification approach with a moving window is proposed, which involves using on-line registered input and output process data. An optimal identification method for a MISO model assuming decomposition to many inner SISO systems is presented. Additionally, a special version of the modulating functions method, in which both model parameters and unknown delays are identified, is tested on real data sets collected from a glass melting installation.

In this paper, the author raised the question of whether the separation of powers is a useless concept. It summarizes some critical arguments against the tripartite separation of powers. The paper deals with application issues related to the separation of powers and distinguishes several attitudes toward them, which it then analyses in more detail. Great attention is dedicated to formalism and functionalism. Eventually, the author wonders whether it would be better to innovate the idea of separation of powers, or to dismiss and replace it with some other principle. He concludes that the separation of powers has problems, but we need to evaluate this idea in relation to its possible alternatives. In such a light it still sounds promising.

This article examines the extent to which state officials are subject to prosecution in foreign domestic courts for international crimes. We consider the different types of immunity that international law accords to state officials, the reasons for the conferment of this immunity and whether they apply in cases in which it is alleged that the official has committed an international crime.
W tym artykule przestawiono, w jakim stopniu urzędnicy państwowi podlegająściganiu w zagranicznych sądach krajowych za zbrodnie międzynarodowe. Zostały rozważone różne rodzaje immunitetu, jakie prawo międzynarodowe przyznaje urzędnikom państwowym, powo-dy przyznania tego immunitetu i czy mają zastosowanie w przypadkach, w których zarzuca się, że urzędnik popełnił przestępstwo międzynarodowe.

Opis:
A growing need to lead a healthy lifestyle and to spend more time in nature causes an increased pressure on forests, which renders their social functions more and more important. In order to meet people’s expectations, the State Forests undertake several actions to make forests more available to the public including the organization of running events in forests and the development of a network of recreational and running paths. In order to describe these actions, an online survey was conducted among the workers of forest districts. Additional data such as information published on the State Forests’ website, Facebook and runners’ blogs, was included in the analysis as well. 283 forest districts participated in the electronic survey. The results indicate that the State Forests actively participated in promoting running events in forests totaling 488 running events in 2014 and 779 between January and October 2017, which constitutes an increase by approximately 60%. The average number of running events in the forest districts during the analyzed period was 9.5. Most of them took place in forest districts within city agglomerations and in the mountains. The State Forests supported over 20% of running events organized in the areas they administer. They had also started numerous initiatives (such as "Wolność w naturze", "Zielony punkt kontrolny" and "BiegamBoLubię Lasy") that were evaluated positively by their participants (according to Facebook). In conclusion, it is clear that the State Forests do promote recreation in forests and forest education by supporting public events.

An analytical-numerical method to determine the one-dimensional stationary thermal state of simple geometry multilayer structures for arbitrary dependences of heat-conductivity factors on temperature is proposed (the multilayer bodies of thermosensitive materials, referred to one of the classical orthogonal coordinate systems are considered, the thermal state caused by thermal load is characterized by a onedimensional stationary temperature field. Approbation of the methodology by studying the stationary thermal state of a two-layer cylinder is realized. The cases of existence of a closed-form analytic solutions for the nonlinear heat conduction problem are considered.

States, being the fundamental forms of political organization of contemporary societies, are presently undergoing dynamic transformations connected with the processes of globalization and integration, among others in the field of the functions exercised by them, as well as the way of their performing. This has considerable significance, especially in the context of state security, for its assuring to citizens, both in the internal and external dimensions, is still one of the most important objectives of emerging and lasting of such a community. Key is also here the problem of the new comprehension of sovereignty. Among the most essential factors influencing this substance are undoubtedly globalization and regional integration processes. Thus, the 21st century states in the whole world are facing totally different, unknown hitherto challenges, requiring from them to adapt their tasks and, in consequence, also their legal orders to the constantly changing political and legal reality.
Państwa, będące podstawowymi formami politycznej organizacji współczesnych społeczeństw, obecnie ulegają dynamicznym przemianom związanym z procesami globalizacji i integracji, m.in. w zakresie realizowanych przez siebie funkcji, jak również sposobu ich wykonywania. Ma to niebagatelne znaczenie, szczególnie w kontekście bezpieczeństwa państwa, gdyż jego zapewnianie obywatelom, zarówno w wymiarze wewnętrznym, jak i zewnętrznym, wciąż stanowi jeden z najważniejszych celów powstawania i trwania takiej wspólnoty. Kluczowym pozostaje tutaj również problem nowego pojmowania suwerenności. Wśród najistotniejszych czynników oddziaływujących na tę materię znajdują się procesy globalizacji i integracji regionalnej. Przed państwami XXI w. na całym świecie stawiane są zatem zupełnie nowe, dotychczas nieznane wyzwania, wymagające dostosowywania ich zadań, a w konsekwencji również ich porządków prawnych, do wciąż zmieniającej się rzeczywistości politycznej i prawnej.

In this paper, the author raised the question of whether the separation of powers is a use-less concept. It points out to insufficient reflection of its theoretical and philosophical origins. The paper also distinguishes its components, which it then analyses in more detail. Great attention is dedicated to the tension between the system of checks and bal-ances and the institutional independence. It also examines the purpose of the separation of powers, warning that we can no longer seek it exclusively in the prevention of tyranny but rather in the optimization of government. At the end of the paper is emphasized the need to examine the question of how to solve tension between these components.

Opis:
The main purpose of this publication is to present the legal status of Budapest between 1990 and 1994 and to expound the evolution of its powers and functions between the above mentioned period. Basically legal perspective is reflected in this study therefore it follows the legislative hierarchy particularly. First of all, I will try to define what legal status really is in that context I will use it in this study. Having defined the conceptual questions, I will present the evolution of powers and functions of the capital by analysing the constitution the concerning acts and their ministerial reasonings as well.
Głównym celem tej publikacji jest przedstawienie statusu prawnego Budapesztu w latach 1990–1994 oraz wyjaśnienie ewolucji jego uprawnień i funkcji w wyżej wymienionym okresie. Zasadniczo perspektywa prawna znajduje odzwierciedlenie w tym opracowaniu, w związku z czym wynika w szczególności z hierarchii ustawodawczej. Przede wszystkim postaram się określić, jaki status prawny rzeczywiście istnieje w tym kontekście, wykorzystam go w tym badaniu. Po zdefiniowaniu pytań koncepcyjnych przedstawię ewolucję uprawnień i funkcji kapitału, analizując konstytucję także w sprawie aktów i ich rozumowań ministerialnych.
