    Opis:
    The provision of quality fuels to the aircraft requires compliance with a number of procedures during the transport, storage and distribution processes. Depending on the needs and organisational conditions, the air fuel distribution process is carried out using various types of transport means. The operational procedures and specificity of the functioning of the Armed Forces and other public law enforcement entities require the use of various construction and technological solutions allowing the efficient functioning of state aviation. The means of transport should not only ensure the appropriate quality of aviation fuel delivered to the aircraft but also enables the delivery of appropriate fuel practically to any place where it is required by the specific activities of particular services or aviation types units of the Armed Forces. This paper presents specific types of transport and distribution means used in state aviation and attempts to select features that determine their suitability for particular types of state aviation.

    For years the Ohio State university has been engaged in international academic and research activities. The Institute of Aviation decided to join the ohio State University in this endeavor. The Institute of aviation strongly believes that in order to provide world class research and laboratory services requires world class competitiveness, which is composed of employee knowledge, accredited laboratories, certified processes, modern organization of the workplace. The Ohio State University, and in particular the Propulsion and Power Center, for years, has educated young engineers for the United States Aerospace Industries, and graduates immediately find employment with industry leaders like General Electric, Pratt & Whitney Aircraft, the Boeing Company, and others. The Institute of Aviation, in Warsaw, became also an important Ge business partner with the creation in 2000 of the Engineering Design Center. This position achieved by the Institute of Aviation brought OSU and the Institute to closer cooperation, which started with the jointly organized Polish American Conference on Science and Technology held in 2012 in olumbus, ohio and in 2013 in Washington, d.c. The Institute of Aviation has a long tradition in organizing Polish-American Conferences on Science and Technology. The first conference was held in Washington, d.c. in March 2002, organized together with the Center for Strategic and International Studies (cSIS), a famous Washington based think tank.

    Pomoc publiczna wprowadzona już w latach 50. XX wieku bez wątpienia odgrywa kluczową rolę w gospodarce oraz związanym z nią prawie konkurencji zarówno na gruncie prawa krajowego i europejskiego. Od wielu lat beneficjentem korzystającym czynnie z pomocy publicznej jest także sektor lotnictwa cywilnego, który w okresie epidemii COVID–19 stał się jednym z wielu skazanych na rekordowe straty związane z zawieszeniem połączeń pomiędzy państwami. Celem autorów jest ukazanie znaczenia pomocy publicznej w okresie epidemii COVID–19 oraz szczególnego wpływu tej instytucji na sektor lotnictwa cywilnego, który bez wątpienia znacząco ucierpiał zarówno w kontekście ekonomicznym i gospodarczym w dobie epidemii, ponosząc straty na miliony dolarów. Autorzy kolejno pochylają się nad instytucją pomocy publicznej, jej definicją legalnej, wyjątkach wynikających z art. 107 TFUE oraz konsekwencjach zwianych z naruszeniem zasad rynku wewnętrznego. Rozważania zostają zakończone omówieniem problematyki omawianej instytucji oraz jej wpływu na pomoc związaną z przywróceniem sektora lotniczego do stanu sprzed epidemii COVID–19.
    Public aid, introduced as early as in the 1950s, undoubtedly plays a key role in the economy and the related competition law, both under national and European law. For many years, the civil aviation sector has also been an active beneficiary of public aid, which during the COVID–19 epidemic became one of the many sectors doomed to record losses related to the suspension of connections between countries. The aim of the authors is to show the importance of public aid during the COVID–19 epidemic and the special impact of this institution on the civil aviation sector, which undoubtedly suffered significantly both in the economic and economic context during the epidemic, collecting losses in the millions of dollars. The authors will turn to the institution of public aid, its legal definition, exceptions resulting from Art. 107 TFEU and the consequences of violating the rules of the internal market. The considerations will be concluded with a discussion of the issues of the institution in question and its impact on the assistance related to restoring the aviation sector to the state before the COVID–19 epidemic.

    Przemysł lotniczy poszukuje innowacyjnych rozwiązań umożliwiających optymalizację kosztów oraz wymianę wiedzy. Jednym z takich rozwiązań są klastry lotnicze. Celem artykułu jest próba dowiedzenia, iż klastry lotnicze stanowią istotne narzędzie kompleksowego podejścia systemowego dla zapewnienia bezpieczeństwa państwa i regionu. W ramach artykułu przestawiona została geneza tworzenia klastrów, wraz z przytoczeniem kilku definicji klastrów przemysłowych oraz podjęta została próba zdefiniowania klastra lotniczego. Przedstawione zostały także działania polskiego rządu w ramach polityki klastrowej oraz zaprezentowana została analiza stanu realizacji polityki klastrowej w Polsce. Artykuł wskazuje również na konieczność podjęcia działań w ramach współpracy przemysłu lotniczego i rządu. Wśród działań wymagających zmian wymienia się m.in. współpracę i nadzór zarówno na poziomie krajowym, jak i samorządowym (wojewódzkim, powiatowym, gminnym). Publikacja wskazuje także obszary wymagające poprawy dla prawidłowego funkcjonowania klastrów lotniczych w Polsce. Należy podkreślić, że artykuł nie obejmuje całości problematyki związanej z tym obszarem. Autor ma jednak nadzieję, że dzięki przeprowadzonym badaniom i przedstawionemu problemowi zostaną dostrzeżone szanse i zagrożenia związane z istnieniem klastrów lotniczych dla rozwoju przemysłu lotniczego Polski oraz jej znaczenia na arenie międzynarodowej, szczególnie w kontekście powojennego potencjału ukraińskiego przemysłu lotniczego.
    The aviation industry is looking for innovative solutions to optimize costs and exchange knowledge. One of such solutions are aviation clusters. The aim of the article is to demonstrate that aviation clusters are an important tool in a comprehensive system approach to ensuring the security of the state and the region. The article outlines the origins of cluster creation, along with several definitions of industrial clusters, and an attempt is made to define an aviation cluster. It also presents the actions of the Polish government within the framework of cluster policy and provides an analysis of the current state of cluster policy implementation in Poland. The article emphasises the necessity of collaboration between the aviation industry and the government. The activities requiring changes include: cooperation and supervision at both the national and local government levels (provincial, district, municipal). The publication also indicates areas requiring improvement for the proper functioning of aviation clusters in Poland. It should be emphasized that the article does not cover all issues related to this area. However, the author hopes that the research conducted and the issues presented will highlight the opportunities and threats related to the existence of aviation clusters for the development of Poland's aviation industry and its importance on the international stage, especially in the context of the post-war potential of the Ukrainian aviation industry.

    The objective scope of the analysis encompasses special measures used in the fight against terrorism in the context of ethical and constitutional principles attributed to a democratic state ruled by law and a liberal democracy. A practical example of a special measure used in the fight against terrorism, and presented in the text, is furnished by the content of one of the articles in the Polish Aviation Law, which was found unconstitutional in 2008. The content of this article made it possible for an administrative authority to make a decision with regard to consenting to the destruction of a civil aircraft, if it was used as a means of terrorist attack. The main purpose of the paper is to consider the acceptable scope of radical measures in the fight against terrorism, while taking into account the reinterpretation of priorities in the hierarchy of legal principles. In order to elaborate the objective scope of the analysis, the following research question is phrased: To what extent is it possible to sacrifice the well-being of the individual (dignity, rights and freedoms) for the sake of the common good (security)? The adopted analysis methodology is based on a thought experiment consisting in the reinterpretation of ethical principles and the values of the constitutional norms in a democratic state ruled by law and a liberal democracy. With the benefit of essentialist reduction, it is posited that the two competing constitutional principles are the principle of dignity and the principle of the common good; they can be reduced to, for instance, protection of the life of an individual or of members of the community as a whole.
    Zakres przedmiotowy analizy obejmuje zagadnienie szczególnych środków walki z terroryzmem w kontekście zasad etycznych i konstytucyjnych przypisanych demokratycznemu państwu prawa i demokracji liberalnej. Przykładem praktycznym szczególnego środka walki z terroryzmem zaprezentowanym w tekście jest treść jednego z artykułów polskiego Prawa lotniczego, który został uznany za niekonstytucyjny w 2008 roku. Treść artykułu dawała możliwość podjęcia decyzji przez organ administracji publicznej w zakresie wyrażenia zgody zniszczenia cywilnego statku powietrznego w sytuacji, gdy ten użyty jest jako środek ataku terrorystycznego. Głównym celem pracy jest rozważanie zakresu dopuszczalności stosowania radykalnych środków walki z terroryzmem przy uwzględnieniu reinterpretacji priorytetów w hierarchii zasad prawnych. W celu uszczegółowienia zakresu przedmiotowego analizy zaprezentowano następujące pytanie badawcze: W jakim zakresie możliwe jest poświęcenie dobra jednostki (godności, praw i wolności) na rzecz dobra wspólnego (bezpieczeństwa)? Metoda analizy opiera się na eksperymencie myślowym polegającym na reinterpretacji zasad etycznych i wartości norm konstytucyjnych w demokratycznym państwie prawa i demokracji liberalnej. Przyjęto za pomocą redukcji esencjonalnej, że dwie rywalizujące ze sobą zasady konstytucyjne, to zasada godności i zasada dobra wspólnego, które mogą być sprowadzone np. do ochrony życia jednostki lub członków wspólnoty jako całości.
