The 2008 issue of YARS contained an overview of EU law developments in the period of time from 2004 to 2007. This overview covers the years 2008-2009. It confirms that State aid cases remained numerous (6 in total) and that the Commission’s enforcement activities in the area of State aid control continued at a similar pace as before. With respect to other areas of competition law and policy, the overall picture shows a relatively high level of scrutiny in mergers (5) and antitrust cases or inquiries (2). Moreover, EU Courts adopted several decisions in Polish cases, notably in the regulatory field (electronic communications) and State aid control (partial annulment in Huta Częstochowa (Operator) as well as the rejection of a request for interim measures in Technologie Buczek). The regulatory court cases show the Commission’s consistency in pursuing Member States in their failure to implement or to correctly implement the EU Electronic Communications package. In the state aid related Huta Częstochowa (Operator) judgement, the General Court (GC, formerly the Court of First Instance, CFI) partially annulled the scrutinised Commission decision since the Commission failed to identify the actual benefit related to the receipt of the aid in question. The jury is still out in the case concerning Technologie Buczek because the interim measures judgement says little about the potential outcome of the pending main appeals.
Le YARS de 2008 contenait un aperçu des développements du droit de l'UE pendant la période de 2004 à 2007, alors que celui-ci couvre les années 2008-2009. Il confirme que les cas d'aides d'État sont restés nombreux (6 au total) et que la mise en œuvre du contrôle des aides d'État par la Commission a continué au même rythme. En ce qui concerne les autres secteurs du droit de la concurrence et de la politique de concurrence, le nombre de contrôles des concentrations et des cas ou des enquêtes antitrust est relativement élevé (2). En outre, les cours de l'UE ont rendu plusieurs arrêts dans des cas polonais, notamment dans le domaine réglementaire (communications électroniques) et du contrôle d'aides d'État (l'annulation partielle dans Huta Częstochowa (opérateur) ainsi que le rejet d'une demande de mesures provisoires dans Technologie Buczek). Les arrêts dans le domaine réglementaire montrent la cohérence de la Commission dans les actions contre les États membres qui ont manqué à leur obligation de mettre en oeuvre, ou de mettre en œuvre correctement, le Paquet Télécom de l'UE. Dans l'arrêt Huta Częstochowa (opérateur) concernant les aides d'État, le Tribunal (précédemment le Tribunal de Première Instance, TPI) a partiellement annulé la décision de la Commission puisque la Commission n'a pas réussi à identifier l'avantage réel de la réception de l'aide en question. Le jury est toujours en train de délibérer dans le cas concernant Technologie Buczek parce que l'arrêt sur les mesures provisoires dit peu sur les résultats potentiels des appels principaux en cours.

This third overview of EU competition and sector-specific regulatory jurisprudential and case law developments with a nexus to Poland covers the years 2010 and 2011. This period of time is worth noting for several reasons. First, EU courts delivered a significant number of judgments in ‘Polish’ cases including an increased number of preliminary rulings. Second, 2010-2011 developments were dominated by judgments and decisions concerning telecoms. Finally, the Commission adopted only a handful of Polish State aid decisions following a formal investigation procedure under Article 108(2) TFEU. The main developments in telecoms relate to the Court of Justice's preliminary reference judgment in Tele 2 Polska focusing on the interpretation of Regulation 1/2003 and the PTC v UKE ruling that dealt with number portability charges. Relevant is also the antitrust prohibition decision issued by the Commission against Telekomunikacja Polska S.A. for its refusal to grant access to its wholesale broadband services. In other fields, the Court of Justice delivered three State aid judgments (including two appeals against pre-2010 judgments of the General Court) and two judgments in infringement proceedings (regarding pre EU Accession marketing authorisations for medicines and the reutilisation of data from the public sector). The General Court ruled on appeal in the butadiene rubber cartel case (e.g. in Trade-Stomil v Commission). Finally, the Commission dealt with a merger case with a truly Polish specificity (Kraft Foods/ Cadbury), approved subject to divestiture of the E. Wedel brand.
Ce troisième aperçu portant sur les développements de la réglementation relative au droit de la concurrence de l’UE et droit séctoriel, ainsi qu’à la jurisprudence ayant un lien imporatnt avec la Pologne, couvre les années 2010 et 2011. Cette période vaut l’intérêt pour plusieurs raisons. Premièrement, les tribunaux de l'UE ont délivré un nombre important d'arrêts dans les cas « polonais » dont un nombre croissant de questions préjudicielles. Deuxièmement, les développements en 2010-2011 ont été dominés par les jugements et décisions concernant les télécommunications (télécoms). Enfin, la Commission n’a adopté qu’un petit nombre de décisions sur les aides de l’État polonais à la suite d'une procédure formelle d'examen conformément à l'article 108 (2) du TFUE. Les développements principaux dans les télécoms se rapportent au renvoi préjudiciel de la Cour de justice dans le cas Tele 2 Polska portant sur l'interprétation du règlement 1/2003 et celui relatif au cas UKE v PTC sur les frais de portabilité des numéros. La décision concernant une infraction en application adoptée par la Commission contre Telekomunikacja Polska SA pour son refus d'accorder l'accès à ses services de gros de la large bande est également pertinente. Dans les autres domaines, la CJCE a rendu trois arrêts sur les aides d'État (deux recours contre les arrêts rendus par le Tribunal de première instance avant 2010) et deux arrêts dans une procédure d'infraction (en ce qui concerne les autorisations de marketing pour la médecine préalables à l'adhésion à l’UE et la réutilisation des données du secteur public). Le Tribunal de première instance a statué sur le recours dans le cas de cartel caoutchouc butadiène (par exemple le cas Trade-Stomil v Commission). Enfin, la Commission a traité un cas de fusion avec une spécificité typiquement polonaise (Kraft Foods / Cadbury), approuvé assujetti à la cession de la marque E. Wedel.

The aim of this paper is to investigate how EU how EU state aid policy addresses the problem the problem of the additionality of state aid for research, development and innovation. The methods used include a literature review of both theoretical and practical studies and document analysis. The formalistic approach taken in the majority of cases in the ex-ante state aid control requires further studies on the actual effects of implemented state aid measures. A variety of methods have been developed to identify the causal impact of aid and to address the problem of selection bias properly. Recent studies largely apply propensity score matching and strive to identify different types of additionality as well as the relationships between them, acknowledging that behavioural additionality plays a critical role in understanding the long-term impact of public interventions.
Celem niniejszej pracy jest ustalenie, jak kontrola unijna podchodzi do problemu wsparcia państwa na badania, rozwój i innowacje. Zastosowano metody zarówno analizy literaturowej jak badań praktycznych i analizy dokumentacji. Formalistyczne podejście przyjęte w większości przypadków kontroli ex-ante pomocy państwa wymaga dalszych badań na temat rzeczywistych skutków wprowadzonych środków. Zostało opracowanych wiele metod w celu określenia wpływu doraźnej pomocy i rozwiązania problemu stronniczej selekcji. Najnowsze badania stosuje się głównie po to, aby dążyć do identyfikacji różnych typów wsparcia, a także relacji między nimi, uznając, że zasada behawioralnego wsparcia odgrywa kluczową rolę w zrozumieniu wpływu długotrwałej interwencji publicznej.

The article aims to assess the adequacy of state aid provided to Polish enterprises during the COVID-19 pandemic. The research sample encompasses 21,687 non-financial enterprises classified as large, medium, and small, accounting for 32.7% of all non-financial enterprises in Poland falling into these groups. The article develops an original method for measuring the justification and accuracy of state aid directed to enterprises in response to the COVID-19 pandemic, utilising changes in firms’ sales revenues. The conducted analyses confirmed that the level of effectiveness of support policies varied significantly across economic sectors. In the first year of the pandemic, support policies were most effective in sectors P (education), Q (healthcare and social assistance), and I (accommodation and food service activities). In the second and third years of the pandemic, sectors Q and E (water supply; sewerage, waste management, and remediation activities) exhibited the highest effectiveness. The analyses also led to the conclusion that sectors with lower average firm size measured by sales revenues demonstrated higher effectiveness of support policies.

Zgodnie z założeniami umowy partnerstwa, w okresie programowania 2014-2020 nastąpi zwiększenie wykorzystania instrumentów zwrotnych, w tym instrumentów poręczeniowych. Docelowa wartość portfela poręczeniowo-gwarancyjnego w przyszłym okresie programowania może przekroczyć nawet 10 mld PLN. Konieczne jest więc podejmowanie analiz efektywności zastosowanych instrumentów poręczeniowych współfinansowanych ze środków europejskich, w szczególności w perspektywie 2007-2013. Bazując na danych dotyczących pomocy de minimis udzielonej w ramach systemów poręczeniowych, przeprowadzono m.in. analizę tempa wdrażania i korzyści dla MŚP wynikających z udzielonych gwarancji. Zaprezentowane wyniki odniesiono do zmian prawnych oraz innych wydarzeń mogących mieć wpływ na analizowane zmienne.
In accordance with the assumptions underlying the Partnership Agreement, in the programming period 2014-2020 there will be an increased use of refundable instruments, including credit guarantee instruments. The target value of the credit guarantee portfolio in the future programming period may exceed as much as PLN 10 billion. Thus it is necessary to perform efficiency analyses of the applied credit guarantee instruments co-financed with EU funds, in particular within the Financial Framework 2007-2013. Relying on the data relating to the de minimis support granted within the guarantee systems, an analysis has been performed on the implementation time and benefits of the provided guarantees for SMEs. The presented results were referred to legal changes and other events that may affect the analysed variables.

The legal basis the European Commission (EC) choses for its actions when it finds a Member State’s action (or inaction) to be in breach of its obligations stemming from its EU membership vary in different fields of law. This is particularly visible in State aid on one side, and general infringement proceedings on the other. But the line between the general character of a possible infringement and that of State aid law is sometimes blurred and difficult to establish. This article analyses if the EC does not abuse its powers when it chooses Article 108(2) TFEU, instead of Article 258 TFEU. A positive answer to that question is difficult to find and controversial. However, given the benefits the EC gains by taking action under Article 108(2) TFEU, it is visible that the EC’s choice can be biased because of those benefits.
La base juridique choisie par la Commission européenne en cas de procédures de violation des obligations du pays membre varie selon le domaine du droit. C’est particulièrement visible dans le domaine du droit des aides d’état d’un côté et en cas des procédures générales d’infraction de l’autre.La différence entre la violation du droit des aides d’état et l’infraction de caractère général est pourtant vague et difficile à préciser.L’objectif de cet article est d’analyser si la Commission ne dépasse pas ses compétences en choisissant l’article 108 alinéa 2 du Traité – et non l’article 258 –comme base juridique de la procédure d’infraction. Cette analyse prend en compte des possibles avantages que la Commission peut tirer du choix de l’article 108 alinéa 2 du Traité plutôt que de l’article 258 du Traité.

Rzeczpospolita Polska2 (podatek od sprzedaży detalicznej), wraz z omówieniem dotychczasowego dorobku orzecznictwa. Artykuł odnosi się do stanu prawa i orzecznictwa na dzień 31 marca 2021 r.
This paper addresses the issue of assessing the criterion of selectivity of an aid scheme which is an aid measure subject to Article 107 (1) TFEU. At the same time, this work provides case commentary on the hitherto newest decision of the Court of Justice in that regard, i.e. the Judgment of the Court of 16 March 2021 in C-562/19 P European Commission v the Republic of Poland (Polish tax on the retail sector, EU:C:2021:201), together with a summary of the case-law of the Court on selectivity until now. The law is stated as it stood on 31 March 2021.

Opis:
Member States do not need to use state resources when they accomplish their mission. They may employ resources of private undertakings by imposing on them obligations to provide services of general interest (SGI). The latter choice provides Member States with many benefits. But Member States need to be sure that the scheme they created complies with the rules on State aid law. Some Member States make sure that private undertakings carrying out SGI do not obtain the full remuneration for their services. However, the Court’s judgment in Lux Express Estonia has the potential to change this mechanism, especially as the Court stated that Member States must pay compensation for obligations they impose on private undertakings. What is more, Member States need to be certain they pay the right amount of compensation. Not a penny more, not a penny less.
Les États Membres n’ont pas besoin d’utiliser des ressources d’État pour accomplir leur mission. Ils peuvent utiliser les ressources d’entreprises privées en leur imposant l’obligation de fournir des services d’intérêt général (SIG). Ce dernier choix leur offre de nombreux avantages. Mais ils doivent s’assurer que le régime ainsi créé est conforme aux règles relatives à la législation sur les aides d’État. Certains États Membres veillent à ce que les entreprises privées fournissant des SIG n’obtiennent pas la pleine rémunération de leurs services. Toutefois, l’arrêt de la Cour dans l’affaire Lux Express Estonia pourrait modifier ce mécanisme, d’autant plus que la Cour a déclaré que les États Membres doivent payer une compensation pour les obligations qu’ils imposent aux entreprises privées. De plus, les États Membres doivent s’assurer qu’ils versent le bon montant de compensation. Ni un sou de plus, ni un sou de moins.

The recently introduced regulations of the New Investment Promotion Act of 10 V 2018 are in line with the trend of the economic legislator’s actions aimed at modernizing the Polish economy and are a direct continuation of the modernization processes initiated by the Act of 20 X 1994 on Special Economic Zones. The legal regulations analyzed in the article constitute an attempt to adjust legal instruments to the changing social and economic reality. The economic administration’s wider use of the legal instruments set out in the New Investment Promotion Act can contribute to faster economic recovery from the crisis caused by the COVID-19 pandemic. The analysis in this article compares the objectives of the New Investment Promotion Act with those of the Act on Special Economic Zones. The research carried out allows the conclusion that the legislator has significantly modernized the objectives of granting support in the New Investment Promotion Act in relation to the objectives indicated in the Act on special economic zones. At the same time, it was decided not to repeal the Act on Special Economic Zones. The reasons for this decision were the continuation of validity of permits issued under the Act on Special Economic Zones, and performance by entities managing Special Economic Zones of tasks specified in the New Investment Promotion Act. As in the Act on Special Economic Zones, the emphasis is placed on issues related to economic transformation, just as in the New Investment Promotion Act the emphasis is placed on the implementation of objectives related to building an innovative, knowledge-based economy. The objectives of the New Investment Promotion Act should be directly expressed in the Act, although the Act on supporting new investments refers many times to strategic documents in the field of development policy.

At the beginning of 2020 Lithuania, and many other European countries, introduced quarantine and began restricting movement across the country’s borders. The imposed restrictive measures have greatly impacted and led to the stagnation of tourism sector. Due to the COVID-19 pandemic and travel restrictions, the number of international tourist arrivals sharply decreased. In 2021 the majority of restrictions have been eased due to the decreasing morbidity, but it did not reinstate the tourism into the previous level. According to statistics, the decline in tourist flows in Lithuania in 2021 still continued, albeit the decrease was smaller. The increase in the number of local tourists (especially in 2021) has somewhat compensated the loss of international tourism, but has not changed it. The tourism business is still going through a difficult period. This article emphasizes the issues of local and inbound tourism business in Lithuania in the context of Covid-19 pandemic. The greatest attention is placed on the instruments proposed by the Lithuanian Government to mitigate the negative consequences of the pandemic on tourism service. The research combines secondary and primary data sources. Secondary data was used for the analysis of official Lithuanian statistics in order to introduce general trends of the development of tourism sector during the last decade. Primary data was received using the methods of focus group and survey (a questionnaire to collect data sets from tourism business enterprises in Lithuania). The statistical analysis revealed that the difficult situation was noticed in all fields of tourism sector, however, the main losers of the pandemic were those relying on the international tourist. The analysis of official documents disclosed, that even though the tourism business was able to benefit from the variety of offered governmental aid packages in 2020–2021, the quantity and quality of support was not enough and strongly criticized. Our survey results pointed out the instruments that were most effective among the tourism enterprises. Moreover, from the collected answers we noticed, that at least part of tourism enterprises took the opportunity to use the support not only for compensation of pandemic related costs but also to look forward and the received financial support invested in innovative solutions in the tourism business, so pandemic potentially had some positive effects as well. Also, the survey results reviled that there are considerable opportunities for tourism related development of the nature rich, non-metropolitan regions, though at the moment these activities quite often remain outside the market relations and do not produce new incomes and jobs.

The point of departure of EU State aid policy is laid down in the Treaty establishing the European Community (hereinafter the “Treaty”). This Treaty provides that State aid is, in principle, incompatible with the common market. However, the principle of incompatibility does not amount to a full-scale prohibition. In the EU countries state aid is permissible to promote the economic development (of areas where the standard of living is abnormally low or where there is serious underemployment) and to facilitate the development of certain economic activities or certain economic areas (where such aid does not adversely affect trading conditions contrary to the common interest). The provisions of the 2000 Lisbon Strategy and the “Europe 2020” Strategy are also important in determining the directions of state aid in the European Union. According to their assumptions the member countries have been required to: reduce the level of aid relative to GDP; reduce state aid which decreases competition; reorient sectoral aid to horizontal and regional aid; and change the forms of state aid-from passive to active instruments. The purpose of this paper is to present the directions of allocation of state aid in the EU countries during 2000-2011, and answer the question whether the resolutions contained in the Lisbon Strategy have been implemented. The research hypothesis is: have the changes in the size, direction and allocation of state aid taken place in accordance with the resolutions of the Lisbon Strategy.

The bank bailouts following the global financial crisis of 2008 have been subject to prior approval of the European Commission (EC), the competition authority of the European Union. The EC was reluctant to reject rescue efforts directed at failing banks and so it consistently approved all such requests submitted by Member States. Out of the top twenty European banks, the EC authorized State aid to at least twelve entities. In this context, the paper outlines the gradually changing interpretation of EU State aid rules, the “temporary and extraordinary rules” introduced starting from late 2008, and the extension of the “no-State aid” category. The above shifts show that the EC itself deflected from relevant EU laws in order to systemically rescue important banks in Europe and restore their financial stability. The paper argues that bank bailouts and bank rescue packages by the State have led to different effects on market structures and consumer welfare in the Eurozone and non-Eurozone areas, mostly the Eastern segments of the European Union. As such, it is argued that they are inconsistent with the European common market. Although the EC tried to minimize the distortion of competition created as a result of the aforementioned case law primarily through the application of the principle of exceptionality and different compensation measures, these efforts have been at least partially unsuccessful. Massive State aid packages, the preferential treatment of the largest, or systemically important, banks through EU State aid mechanisms – almost none of which are Central and Eastern European (CEE) – may have led to the distortion of competition on the common market. That is so mainly because of the prioritization of the stability of the financial sector and the Euro. The paper argues that State aid for failing banks may have had important positive effects in the short run, such as the promotion of the stability of the banking system and the Euro. In the long-run however, it has contributed to the unprecedented sovereign indebtedness in Europe, and contributed to an increased economic and political instability of the EU, particularly in its most vulnerable CEE segment.
Les sauvetages bancaires consécutifs à la crise financière mondiale de 2008 ont été soumis à l'approbation préalable de la Commission européenne (CE), l'autorité de la concurrence de l'Union européenne. Les CE étaient réticentes à rejeter les efforts de sauvetage dirigés contre les banques défaillantes et ont donc approuvé de manière cohérente toutes les demandes présentées par les États membres. Sur les vingt premières banques européennes, la CE a autorisé des aides d'État au moins douze entités. Dans ce contexte le document souligne l'évolution progressive de l'interprétation des règles de l'UE en matière d'aides d'État, les « règles temporaires et extraordinaires » introduites à partir de la fin de 2008 et l'extension de la catégorie « sans aides d’État ». Les changements susmentionnés montrent que la CE elle-même a dévié des lois pertinentes de l'UE afin de sauver systématiquement d'importantes banques en Europe et de rétablir leur stabilité financière. L'article soutient que les plans de sauvetage bancaire et les plans de sauvetage bancaire de l'État ont eu des effets différents sur les structures du marché et sur le bien-être des consommateurs dans les zones de la zone euro et hors zone euro, principalement dans les segments orientaux de l'Union européenne. En tant que tel, il est soutenu qu'ils sont incompatibles avec le marché commun européen. Bien que les CE aient essayé de minimiser les distorsions de concurrence créées par la jurisprudence susmentionnée, principalement par l'application du principe d'exception et des mesures de compensation différentes, ces efforts ont été au moins partiellement infructueux. Les paquets massifs d'aides d'État, le traitement préférentiel des banques les plus importantes ou systématiquement importantes par le biais des mécanismes d'aide de l'UE - presque aucun d'Europe centrale et orientale (CEE) - ont entraîné une distorsion de concurrence sur le marché commun. Cela est dû principalement à la priorité accordée à la stabilité du secteur financier et de l'euro. Le document fait valoir que les aides d'État pour les banques en faillite peuvent avoir eu des effets positifs importants à court terme, comme la promotion de la stabilité du système bancaire et de l'euro. Toutefois, à long terme, elle a contribué à l'endettement souverain sans précédent en Europe et a contribué à accroître l'instabilité économique et politique de l'UE, en particulier dans son segment d'Europe centrale et orientale le plus vulnérable.

The development of Serbian competition law started in 2005 with the adoption of its first modern Competition Act. National competition rules are generally harmonized with European Union law, especially following the adoption of the current Competition Act of 2009. However, several problems in competition law enforcement can be identified still, the importance of which increases as the effects of the current economic crisis spread. The paper focuses mainly on three problems specific to competition law enforcement in Serbia, a country with a weak economy. The first problem identified is that of a possibly privileged treatment of state-owned companies. The Competition Authority commenced so far only two proceedings against undertakings with state-owned capital. Furthermore, the Authority seems to accord insufficient attention to some industry sectors that are of special public interest, such as the production and trade of gas or oil, dominated by undertakings with state-owned capital. Sector-specific analyses undertaken by the Competition Authority did not result in any proceedings being initiated ex officio. The second problem identified in this paper is the reluctance of the Serbian Competition Authority to enforce competition rules in certain 'sensitive' situations. Instead of taking a pro-active approach, it sometimes seems that the Authority chooses to act as an 'advisor' of undertakings rather than an enforcer of competition law. Finally, the paper analyzes the activities of the Commission for State Aid Control, notorious for its perpetually positive approach towards institutions granting state aid.
Le développement du droit serbe de la concurrence a commencé en 2005, avec l’adoption de la première loi moderne relative à la protection de la concurrence. Les règles nationales de la concurrence sont généralement harmonisées avec le droit de l’Union européenne, en particulier suite à l’adoption de la loi relative à la protection de la concurrence en 2009. Pourtant, l’auteur identifie plusieurs problèmes relatifs à la mise en œuvre des règles de concurrence, dont l’importance a augmenté pendant la crise économique actuelle. L’article se concentre en particulier sur trois problèmes relatifs à la mise en ouvre des règles de concurrence en Serbie, un pays à difficultés économiques. Le premier problème identifié par l’auteur est relatif à un possible traitement préférentiel des entreprises publiques. Jusqu’à présent, l’Autorité de la concurrence n’a initié que deux procédures contre les entreprises publiques. De plus, il paraît que l’Autorité de la concurrence n’accorde pas suffisamment d’attention aux secteurs d’intérêt général, comme celui de la production et distribution de gaz, qui sont dominés par d’entreprises publiques. Les enquêtes sectorielles entreprises par l’Autorité de la concurrence dans ces secteurs n’ont abouti à aucune procédure initiée ex officio. Le deuxième problème identifié par l’auteur est celui de la réticence de l’Autorité de la concurrence d’initier des procédures dans certaines situations « sensibles ». Au lieu d’approche proactive, l’Autorité a choisi de jouer le rôle de « conseiller » d’entreprises dans certains cas. Finalement, l’auteur analyse les activités de la Commission pour le contrôle d’aides d’Etat, fameux pour la totalité de décisions déclarant l’aide compatible avec la loi.
