Opis:
The article critically assesses the decision of the Polish Supreme Court in Natoniewski v. Federal Republic of Germany. It argues that the decision as such reflects contemporary international law practice. Consequently, the holding of the Supreme Court that State immunity is applicable to acts de iure imperii committed on the territory of the forum State during an armed conflict even though they may amount to war crimes seems to be correct. This conclusion also means that the Court refused to engage in law-making activity by declining to endorse interpretation, which would permit to reject State immunity by attaching superior importance to human rights. Although the article recognizes that the reasoning of the Supreme Court as well as the choice of arguments is well-balanced and convincing, it also identifies certain instances in which the Court is not entirely persuasive. In the opinion of the author, one of the most important drawbacks in the reasoning relates to the characterization of State immunity as a procedural, rather than substantive, issue.

International relationships are very complicated. There is a tension between the demands of duties of the states like protection of integrity, safety and peace (both internal and international), which require a lot of effectiveness, and demands of human dignity, justice and protection of human rights. In fact, this is a kind of conflict between pragmatism and ethics. Although there is no easy answer to that, one has to remember, that even when the war is inevitable, it becomes a setback. Even a just war is an unfair one.

Przedstawione są poglądy Thomasa More'a na temat wojny i pokoju. Podejmuje się analizę statusu wojny w Utopii wobec wskazania przez Morusa na pokój jako na prawo natury. Wyróżnia się dwie powiązane z sobą niekonsekwencje koncepcji Morusa i nazywa się je - niekonsekwencją pokoju i niekonsekwencją wymiany niepieniężnej. Dyskutuje się realność obu niekonsekwencji w perspektywie etyki chrześcijańskiej, etyki utylitarystycznej i praktyki polityki międzynarodowej, także współczesnej.
The article presents the views of Thomas More on war and peace. It analyses the status of war in Utopia with regard to More's indication on peace as the law of nature. Two inconsistences of More's concept are found and called as the following: the peace inconsistency and the non-monetary exchange inconsistency. They are related to each other. The reality of both inconsistences is discussed in the light of the Christian and utilitarian ethics and political practice.

Dzielący los całej ówczesnej prasy polskiej „Magazyn” miał wówczas wykazać szczególną ofensywność w polemice z przeżywającym Millennium Chrztu Polski Kościołem katolickim, promując świecką wizję historii narodowej. Szczegółowa analiza wszystkich numerów „Magazynu” z 1966 r. wykazała jednak, że poza ideologiczno-propagandowym oddziaływaniem tygodnik ten spełnił również pozytywną rolę. This article examines the role of the ‘Magazyn’ supplement of the Kielce daily Słowo Ludu in popularizing Polish history in the last year of the celebrations of Poland’s Millennium (1966). Like the rest of the Polish press the Magazyn was expected to take part in the ideological offensive against the Catholic Church’s idea of the Millennium. Although the Magazyn did adopt the outlines of the secular narrative sanctioned by the authorities, it also managed to bring in a lot of material dealing with the history of the region. In this way it did a good job of raising the historical awareness of the residents of Kielce and its environs
