W Motu proprio Mitis Iudex Dominus Iesus z 15 sierpnia 2015 r. Franciszek przypomniał biskupom diecezjalnym, że zgodnie z kan. 383 § 1 KPK obowiązani są do opieki nad małżonkami pozostającymi w separacji lub rozwiedzionymi. Troska ustawodawcy o łatwy dostęp do pomocy prawnej i duszpasterskiej dla rozwiedzionych małżonków znajduje odzwierciedlenie w wielu inicjatywach mających na celu towarzyszenie takim osobom w ich życiu i ułatwienie dostępu do sądu. Włoskie archidiecezje Trani–Barletta–Bisceglie i Pescara–Penne są przykładami pożytecznych inicjatyw, które mają pomóc rozwiedzionym małżonkom w rozeznaniu ich sytuacji życiowej oraz we wniesieniu powództwa o unieważnienie małżeństwa. Podjęto tam cenne instytucjonalne formy pomocy tym małżonkom.
In the Motu proprio Mitis Iudex Dominus Iesus of August 15, 2015, Francis reminded the diocesan bishops that under can. 383 § 1 of the CIC are obliged to care for separated or divorced spouses. The legislator's concern for easy access to legal and pastoral assistance for divorced spouses is reflected in many initiatives aimed at accompanying such people on their way of life and facilitating their access to court. The Italian archdioceses of Trani–Barletta–Bisceglie and Pescara–Penne are examples of useful initiatives to help divorced spouses discern their life situation and to assist them in bringing proceedings for annulment of their marriage. Valuable institutional forms of helping these spouses have been undertaken there.

Aim: The main goal of the article is to showcase how husbands performed the role of caregivers for their wives after breast cancer diagnosis. The researchers analysed this issue by comparing the perspectives of the male caregivers with their wives’ opinions. The wives were active members of Amazon clubs. Background: Partners of women with breast cancer are expected to assume responsibility for taking care of their wives. Simultaneously, however, they are not prepared to fulfil their new duties, nor are they being provided with any professional support in this regard. Method: Semi-structured interviews were conducted with eight married couples, separately with wives and husbands. Results: Husbands perceive their role in their wives’ struggles as primarily supportive and channel any negative emotions via undertaken actions. They support their wives in four ways: by focusing on their wives’ feelings and caring about her, taking part in the healing process, manag- ing the household during the period of their wives’ recovery, and by bringing back normalcy into their lives. Conclusions: Limited knowledge about oncological diseases, deficiencies in the assistance services offered to husbands of women with breast cancer and stereotypes about gender roles contribute to the difficulties men face when taking care of their sick wives. Even the wives active participation in the Amazon movement does not seem to mitigate their problems.

Benedict XVI, in encyclic Deus caritas est, showed the ideal of conjugal love. He reminded ancient words: eros, amor, philia, agape, caritas and explained their meaning. He discussed the issue of conjugal love in the context of Christian love, taking into consideration love as a divine gift and its sacramental dimension and reflecting the love of Jesus Christ to the Church. He himself makes a perfect sacrifice, dies for his Church. So also, the spouses make a sacrifice for the other, beloved person. The Christian approach to love, with its moral aspects, presents it as a way to holiness, taking into account the sinfulness of human nature. The anthropological dimension of conjugal love is sanctified when the spouses renounce their „I” direct themselves to „you”, and transform into „we” by the grace and blessing received from God. The Eucharist is the source of conjugal love. An important aspect of marriage is social reference, understood as caritas.

Each presidential candidate in modern political campaigns in the United States needs to have a spouse behind their back. The involvement of recent candidates’ spouses like Michelle Obama and Melania Trump provides researchers with a fresh picture of how a future first lady should or should not behave during campaigning. The interesting matter would be in this article to compare those two candidates’ spouses. Their activities and behavior during their first presidential campaigns in 2008 and 2016 will show the differences in Democratic and Republican form of campaigning. The study aims to observe certain regularity in the treatment of spouses during presidential campaigns in the United States. Its goal is to answer what kind of future presidential spousal behavior during campaign is more desirable in order to achieve as many votes as possible. The paper is based on qualitative analysis of already existing data compiled during both elections, as well as critical reading of the literature of the subject. To elaborate, the author will mostly compare the political positions of those two future first ladies – Michelle Obama and Melania Trump – during the mentioned campaigning periods, and also by statistics relating to their presence in media and public appearances.
Każdy kandydat na prezydenta w Stanach Zjednoczonych powinien pokazywać się podczas kampanii wyborczej z żoną u boku. Zaangażowanie pierwszych dam takich jak Michelle Obama czy Melania Trump w kampanie prezydenckie ich mężów daje badaczom współczesny obraz przyszłej pierwszej damy i możliwość badania bardziej lub mniej pożądanych zachowań podczas kampanii wyborczych. Celem niniejszego artykułu będzie porównanie obu wymienionych wyżej żon kandydatów na urząd prezydenta w Stanach Zjednoczonych. Porównanie ich działalności i zachowań podczas pierwszych prezydenckich kampanii ich mężów tj. w 2008 roku i 2016 roku unaoczni różnice w traktowaniu żony kandydata podczas kampanii prezydenckiej w obozie Demokratów i Republikanów. Celem badania jest zaobserwowanie pewnych prawidłowości w sposobie traktowania żon kandydatów na prezydenta podczas kampanii wyborczych, jak również odpowiedź na pytanie czy istnieje bardziej lub mniej pożądane zachowanie „pierwszych żon”, które to przysparza kandydatowi jak najwięcej wyborczych głosów. Artykuł oparty jest na jakościowej analizie istniejących danych zgromadzonych podczas wyborów w 2008 roku oraz w 2016 roku, jak również na krytycznej analizie istniejącej literatury przedmiotu. W celu rozwinięcia powyższych metod autor dokona porównania politycznych pozycji przyszłych pierwszych dam – Michelle Obamy i Melanii Trump podczas wspomnianego okresu kampanii prezydenckich, także poprzez zebranie statystyk obrazujących ich obecność w mediach oraz podczas publicznych wystąpień.

The experience of spouses’ loneliness and strategies of coping with itThe main purpose of the research is the analysis of the relationship between the experience of spouses’ loneliness and preferred strategies of coping with loneliness. The research is based on Ami Rokach’s classification of strategies which people use in the process of coping with loneliness. She proposes the following strategies: Self-Development and Understanding, Reflection and Acceptance, Distancing and Denial, Religion and Faith, Social Support Network, Increased Activity. Sixty married couples were examined. Respondents’ age ranged between 22 and 67. The youngest couple has been married for 3 months, the eldest – for 43 years. A dependent variable is the preferred strategy of coping with loneliness. The main independent variable is the experience of loneliness, while other independent variables were controlled: spouses’ gender, age and marriage duration. Rokach’s questionnaire (The Experience of Loneliness-coping with Loneliness) was used in order to examine the preferred strategies. UCLA Loneliness Scale-Version 3 was used in order to examine the experience of loneliness. Data gathered indicates that spouses feel lonely because of the lack of intimate relationships. The experience of loneliness depends on spouses’ age and marriage duration: the older spouses are, the lonelier they feel. The most preferred strategy is Building Social Bridges. The choice of strategies depends on spouses’ gender, age, marriage duration, and the experience of loneliness.

The article concerns contemporary perspectives on early education, early, emergent and visual literacy, and concepts of the development of cognitive, linguistic, and socio-emotional competencies by using picturebooks in the dialogic reading method. Picturebooks for small children, especially earlyconcept picturebooks, which present nouns, verbs, or adjectives and are aesthetically designed, have a great potential, and are important for the gaining of cognitive, emotional, and visual codes and ideas by the child, especially when they are introduced by an adult (parent at home or teacher in a preschool institution) through an active, dialogic manner of reading. Dialogic reading is shown and described by G.J. Whitehurst and other researchers as an interactive and stimulating method of cognitive and socio-emotional development, which enhances the children’s speaking and reading competencies independently of their class, race, or gender – which is of emancipatory significance. The main aim of the text is to turn the reader’s attention to the significance of interactive reading of precisely selected, high-quality picturebooks by parents and early education teachers in the context of children’s development.

Today we observe the dynamic changes in relations between the sexes in the family, which appear as a result of economic, cultural, and social transformation, the growth of women’s economic strength, as well as the level of their education, and the development of the ideas of the equal rights of women and men in the labour market and in social life. Hitherto existing research results show that Poles are increasingly in favour of the egalitarian family model and declare their wish to build their relationships based on equality. In the article I will characterise our cultural context, in which the egalitarian relation of a man and a woman in a family is both an educational space of confrontation between the “old” concept of family life, often rooted in Parsons’ concept of the nuclear family, and the “new” one, specific for the socio-cultural breakthrough in Poland. I will also present the involvement of formal education in fixing stereotypical images of family life, which are in opposition to the changes observed in relations between women and men. At the end I will present my own concept of education for equality in the marital relations, as well as the frame of equality between spouses in marital relations as a value of upbringing, which are a response to the needs of contemporary women and men.

Although marital satisfaction is intensively explored in the psychological literature at present, there are few papers strictly focused on spouse fit in late adulthood. The aim of the present study was to determine whether spouses’ personality fit and values fit are associated with marital satisfaction. To test this, we examined 60 Polish married couples (120 participants) aged 60-75. We used the following measures: NEO-PI-R (as adapted by J. Siuta), Scheler Values Scale (P. Brzozowski), and the Well-Matched Marriage Questionnaire (Plopa & Rostowski). Due to the nonindependence of dyads, data was analyzed in the single-level paradigm, and the level of fit was estimated by Gower Agreement Index (J. C. Gower). The results yielded by SEM path analysis indicate that spouses’ personality fit is associated with the satisfaction of both spouses, while spouses’ values fit, under-stood objectively in accordance with Scheler’s theory, is not related to their satisfaction. The findings may be useful in psychological practice such as marriage counselling and marital therapy.

Opis:
The release of the apostolic exhortation Amoris Laetitia revealed the need in the universal Church to accompany spouses in the initial years of marriage. The First Instruction of the Polish Episcopate for the Clergy on Preparation of the Faithful for the Sacrament of Marriage and on Pastoral Care of the Family introduced in Poland in the late sixties highlighted the fact that leaving young spouses alone in the initial stage of their life in marriage is disadvantageous. Therefore, Christian community should gain profound knowledge of the difficulties faced by young spouses in order to provide them with proper aid. St. John Paul II also highlighted the need to accompany young spouses in his apostolic exhortation Familiaris Consortio (cf. FC, 65). Pope Francis, concerned about the irresponsible attitude of fiancés towards contracting sacramental marriage, teaches in his apostolic exhortation Amoris Laetitia that “the initial years of marriage are a vital and sensitive period during which couples become more aware of the challenges and meaning of married life” (AL, 223). The Pope higlights the greatest opportunity of help in accompanying young spouses after the celebration of the sacrament of marriage. He encourages pastoral workers to assist young couples in order to help them complete the unfinished process of becoming mature in order to face the responsibility to contract sacramental marriage. The author of the article attempts to explain what accompanying is, what issues should be discussed during meetings with the spouses in the initial years of marriage and what subjects should actively participate in assissting young spouses.

The legal assessment of misappropriation of property belonging to community property by one of the spouses constitutes a heavily contested issue in criminal law. The article analyzes a well-established opinion, according to which such property can be the object of the crime of misappropriation, and which cites the rules of the civil law. The article focuses on the issue of the possibility of assuming in such cases an attack on property, i.e. a violation of the object of the offence, discussed from the perspective of family law, which allows spouses to dispose of such property without the permission of the other spouse, on the basis of the rule of independent property management. Moreover, the author verifies the prerequisite for the seizure of third-party property, given that the property in question belongs also to the defendant, in accordance with the rules of community property. In addition to that, the author discusses the issue of meeting the prerequisites for the subjective aspect and the rule for evaluating the damage inflicted by the offence. The latter issue has been identified as particularly controversial, given that determining the scope of the possible restitution claims according to the value of property which constitutes the object of the offence in a situation where the property belongs also to the defendant is contrary to the intuition of criminal law scholars.

This article concerns the influence of a marital property regime on execution proceedings against spouses. In the first place, the legal character of a marital agreement was depicted, taking into consideration its statutory types. Then, the paper discusses the problems of financial liability of spouses, the situation of their creditors and the scope of execution against spouses bound by a contractual property regime.

One of important moral problems that priests in confessional encounter is the question of using contraception. The Church has always taught us that contraception is an intrinsically evil action and moral offenses in this area are objectively speaking seriously sinful. There are such spouses who want to be faithful to the teachings of the Church, but they cannot meet their requirements. This is particularly true when there appear difficult and exceptional situations that disrupt the regularity of the intercourse, when natural family planning is hindered or seems to be impossible. A confessor, while meeting in the confessional Catholic spouses who experience difficulties in a sexual sphere, but who honestly want to keep the teachings of the Church, should give them advice which will gradually encourage them to move forward on their way to sanctity of their married life. Giving them advice, he should apply the pastoral law of gradualness which will make them aware that having the determination to break with sins and constant, though gradual aspiration to achieve full reunification with the requirements of God’s will, despite a moral decline, they are still on their way to God.

No. P 40/12), in which, after examining the issue of the legal question presented in the High Administrative Court, on the regulation of Art. 12 paragraph. 4 of the Act, the Court held that this provision to the extent that does not provide for the admissibility of individual identification numbers given to each of the spouses in a situation where there is division of marital property and they own separate farms, is at variance with Art. 32 paragraph. 1 in conjunction with Art. 18 of the Constitution. This article is an attempt to evaluate the effectiveness of the implementation by the legislator of the guidelines made by the Constitutional Court in support of the decision in the light of the threat, under the new legal framework, of creating by the spouses artificial conditions for obtaining public assistance.

Opis:
The purpose of the paper is to analyze the issue of the division of the joint property of spouses in the scope of individual components of this joint property – partnership rights due to participation in a registered partnership and shares in a limited liability company. While many studies have been written on the subject of partnership rights belonging to the property of spouses, the issue of the division of the spouses’ property including these rights is only beginning to appear in deliberations of few authors. An independent interpretation of the law as well as an analysis and critical look at the literature were adopted as the basic research method. The subject of the research involves a registered partnership (as a model partnership) and a limited liability company (because in many places regulations concerning a limited liability company and a joint-stock company are similar). Although the issues of the division of the joint property of spouses are regulated by the provisions of the Family and Guardianship Code (Articles 45 and 46 FGC) and the Civil Code, one can find norms concerning the operation of companies and partnerships (Article 1 § 1 CCC) which modify general principles regarding the manner of division of joint property and are applied as a special rule. The civil division of a partnership share in a registered partnership (Article 62 CCC) and the division in kind of a single share in a capital company (Article 333 § 1 CCC) are not possible. It is the my belief – although I am aware that this is a controversial thesis – that it is possible to divide a partnership share in a general partnership. Restrictions on the method of the division are provided for in Articles 10, 1831, 3321 CCC, which, in my opinion, apply to the division of the joint property of spouses.

In the last quarter of the 19th century in Western Pomerania some demographic and socio-economic processes took place at the same time: stabilisation of death rate and a decrease in reproduction, an agricultural crisis and a migration fever. After pulling down the city walls Szczecin (German: Stettin) started spreading in all directions. The main objective of the research has been to grasp the process of demographic changes, which were parallel to the socio-economic development of the Szczecin suburbs, as well as to present the effects of the accelerated urbanisation and industrialisation of Pomorzany (German: Pommerens-dorf), one of the Szczecin suburbs, in comparison to neighbouring settlements, where such changes occurred not so fast or even did not happen at all. For that reason on the basis of the Register Office’s certificates a list was made, which included 1357 matrimonies contracted in the years 1875–1906 within the jurisdiction of the Gumieńce Register Office (German: Standesamtbezirk Scheune). The aggregate method has been used to determine the annual numbers of matrimonies, seasonality of matrimonies and an average age of newly-weds. The research indicates that in the years 1875–1906, parallel to an increase of the inhabitants, in Pomorzany the number of contracted matrimonies and the matrimonial rate were increasing regularly, whereas the annual seasonality rate was decreasing. In more remote settlements, in Gumieńce, Mierzyn (Möhringen) and Stobno (Stöven) agriculture was dominant, the number of matrimonies did not change significantly, and the annual seasonality rate had big fluctuations from month to month.
