    Opis:
    The UN Special Rapporteurs are independent experts holding mandates of special procedures established by the Human Rights Council. One of their main methods of work is conducting country visits, at the invitation of States. The article aims at assessing country visits as the way of monitoring the human rights situation at the national level. It provides an overview of the last visits in Poland, including the visit of the Special Rapporteur on independence of judges and lawyers in October 2017, focusing on the recommendations issued by Special Rapporteurs in their reports presented to the Human Rights Council and the reaction of Polish Government to the Rapporteur's findings. The Special Rapporteurs' independence and expertise turns country visits reports into a valuable source of information on the situation of human rights that can be used, inter alia, by National Human Rights Institutions and non-governmental organizations. However, the impact of the visit depend mostly on the State's will to implement the Special Rapporteurs' recommendations.

    Towar jest kluczowym elementem szeroko rozumianego prawa celnego. W perspektywie legislacyjnej Unii Europejskiej prawo celne określa zasady i tryb obrotu towarowego z państwami trzecimi. Wynikają z nich obowiązki i uprawnienia organów celnych oraz przedsiębiorców realizujących operacje importowe i eksportowe. Celem publikacji jest analiza roli i znaczenia „towaru” w obrocie towarowym z państwami trzecimi. Realizacja przyjętego celu zmierzała do przyjęcia tezy badawczej, że głównym przedmiotem obowiązujących unormowań unijnego prawa celnego jest „towar” w różnych jego aspektach: prawnych, technicznych, cech fizycznych czy też ekonomicznych.
    Goods are a key element of customs law in its broadest sense. In the legislative perspective of the European Union, customs law defines the rules and procedures for trade in goods with third countries. The duties and powers of customs authorities and economic operators carrying out import and export operations result from them. The aim of the publication is to analyse the role and significance of ‚goods’ in trade in goods with third countries. The implementation of the adopted objective aimed at the adoption of the research thesis that the main subject of the binding norms of the EU customs law is „goods” in its various aspects: legal, technical, physical or economic characteristics.

    Despite the contribution they make to the life of host countries, migrants are often subjected to inappropriate or often cruel treatment because they are third-country nationals or are in an uncertain situation. The growing interest of the international community in the subject matter of human rights means that particular attention is now being devoted to migrant rights. The activity of the UN Special Rapporteur on migrant rights, who operates within the framework of the so-called Special Procedures established by the Human Rights Council, plays a special role among the mechanisms of protection of migrant rights in international relations.
    Pomimo wkładu, jaki wnoszą w życie krajów przyjmujących, migranci są często poddawani niewłaściwemu i nierzadko najbardziej okrutnemu traktowaniu, ponieważ są cudzoziemcami lub znajdują się w niepewnej sytuacji. Rosnące zainteresowanie społeczności międzynarodowej problematyką praw człowieka sprawiło, że zaczęto zwracać szczególną uwagę na prawa migrantów. Wśród mechanizmów ochrony praw migrantów ważną rolę odgrywa w stosunkach międzynarodowych działalność Specjalnego Sprawozdawcy ONZ ds. praw migrantów, który funkcjonuje w ramach ustanowionych przez Radę Praw Człowieka tzw. procedur specjalnych.

    Opis:
    The UN human rights system is constantly growing, as new treaties are adopted and new special procedures are established. While this strengthens the protection of some human rights, the development is also criticized for blurring recognized concepts, which consequently leads to the weakening of the protection of human rights. The article analyzes the quantitative expansion of UN special procedures, with an emphasis on thematic mandates. Reasons for their growing number are examined, as well as strengths and weaknesses that this development brings. In the second part the article scrutinizes when the activities and competences of thematic special procedures and treaty bodies overlap. The two groups act complementary, but a lack of cooperation between them can lead to competition and duplication. The article closes with possible solutions of dealing with the expansion of the universal system, that would strengthen human rights protection, while making best use of available financial, administrative and technical resources.

    W artykule dokonano analizy obowiązujących w Unii Europejskiej procedur celnych. Zdaniem Autorów, unijne procedury celne stanowią kompletną i przejrzystą podstawę prawną dla współpracy unijnych przedsiębiorców z ich kontrahentami z państw trzecich. Pomimo generalnie pozytywnej oceny uregulowań prawnych w tym zakresie, wskazane zostały mankamenty przyjętych rozwiązań. Dotyczy to zwłaszcza przyjętego stanu prawnego w zakresie specjalnych procedur celnych szczególnego przeznaczenia i przetwarzania.
    The article analyzes the customs procedures in force in the European Union. According to the Authors, EU customs procedures constitute a complete and transparent legal basis for the cooperation of EU entrepreneurs with their counterparties from third countries. Despite generally positive evaluation of legal regulations in this area, shortcomings of the adopted solutions were indicated. This particularly applies to the adopted legal status regarding special customs procedures for special purposes and processing.

    Opis:
    The 20th anniversary of the World Conference against Racism, Racial Discrimination, Xenophobia and Related Intolerance, held in Durban in 2001, provides a good opportunity to look at the institutional arrangements undertaken to implement the Durban Declaration and Programme of Action, as well as to study and assess state practice in this regard. This article discusses the activities of expert bodies and the intergovernmental forms of co-operation established after the Durban Conference in order to implement its conclusions and recommendations. The author notes that while the post-Durban developments in the area of counteracting racism are substantial, structural racism, racial injustice, inequality, and discrimination still constitute a disturbing threat to both human dignity and the basic values of the United Nations. It is argued that the 20th anniversary of the Durban Conference should induce states and other relevant stakeholders to reflect on – and reinforce – the UN’s action against racism, racial discrimination, xenophobia, and related intolerance.

    The scale of immigration problems in Europe today is well-known and broadly dis-cussed. The article identifies how this issue is reflected in two Human Rights Council mechanisms: Special Procedures and the Universal Periodic Review. The Special Rap-porteur on the human rights of migrants, François Crépeau, undertook a regional study on the management of the external borders of the European Union and its impact on the human rights of migrants. The analysis of the annual and country visits’ reports allows the main immigration problems facing the EU countries and threats for the protection of human rights to be identified. The recommendations made by the Special Rapporteur are confronted with those taken up in the UPR process. Special attention is given to the EU countries’ position on the problem of immigrants. Their reluctance to raise this issue in the UPR weakens the credibility of EU Member States and puts the objectivity of the mechanism into question.
