Autor będący pracownikiem Miejskiej Pracowni Urbanistycznej w Krakowie opisuje proces obejmowania planami zagospodarowania przestrzennego obszaru Krakowa, który został wpisany na listę Światowego Dziedzictwa UNESCO. Opis procesu rozpoczyna rok 2003, kiedy obowiązujące w Polsce plany ogólne utraciły moc, a kończy - 2020, w którym obszar UNESCO jest chroniony planami miejscowymi w całości, jednak około 50% jego strefy buforowej wciąż pozostaje bez ochrony planistycznej. W artykule zwrócono również uwagę na kwestię, kto faktycznie - w imieniu Prezydenta Miasta Krakowa - sporządza poszczególne dokumenty planistyczne. Aspekt ten, po zderegulowaniu Izby Urbanistów jest istotną kwestią dokumentacyjną.
The author is an employee of the City Spatial Planning Office of Kraków and describes the process of adopting Local Spatial Management Plans of the area in Krakow, which was inscribed on the UNESCO World Heritage List. The description begins in 2003 with no Local Spatial Managements Plans in valid, and ends in 2020, when the UNESCO area is completely protected by local spatial plans, however 50% of the buffer zone stays without any spatial law protection. The article focused on the authors of Local Plans, who - on behalf of the Mayor of the City of Krakow - drawn up the spatial documents. The documentation of this aspect is tremendously important, after deregulation of the profession of urban planners.

Activity connected directly with preventing results of environmental degradation that are negative for health creates for public authority a sphere of action which combines both environmental protection and health protection. Environmental protection is a legal term with its definition in Art. 3 of Environmental Protection Act of 27 April 2001. Direct connection between environmental protection and health protection finds its reflection in the Act of 28 July 2005 on medical care, health care, health care protection areas and health care communities (called the Act on health resorts). This article contains an analysis of legal conditions connected with awarding a community the status of a health resort, according to the provisions of the Act of 27 March 2003 on spatial planning and development, as well as to the provisions of the above mentioned Act on health resorts.

The study discusses the topic of planning decisions taken for the purposes of studies prepared on the municipality level and related to the development of landslide areas in Poland. The aim of the research is to demonstrate the scale of the issue consisting in designating areas at risk of subsidence of soil masses for investment purposes. The research emphasises the essential role of planning documentation in the prevention of investment in such areas. Other vital factors also include the SOPO (Landslide Counteracting System) database as well as the staroste, who, in the course of preparation of planning documentation and issuing decisions on development conditions, issues opinions or agrees (depending on the type of document or decision) on the planned investment in areas at risk of landslides. The study shows the complexity of the spatial planning and development system in Poland and the significant influence of bodies and institutions on the planned development of areas prone to the subsidence of soil masses.

The binding spatial planning system in Poland includes the protection of scenic values in an insufficient way. The progressive, rapid urbanization threatens the existing points and planes of passive exposure, lowering the scenic and landscape values. The paper compares various definitions of landscape and landscape values and analyzes the provisions of the current Study of Conditions and Directions of Spatial Development of the municipality of Rzeszów in terms of the identification and protection of scenic values and compares attractive landscapes with the coverage of the Local Spatial Development Plan.

In the article, the author presents the concept of public interest in spatial planning and development from the perspective of selected specific regulations. The subject of the analysis are certain requirements of environmental protection, including water management and protection of agricultural and forest land; requirements of protection of cultural heritage and monuments, as well as contemporary cultural assets, and the need to ensure an adequate quantity and quality of water for the purpose of supplying the population. The author is of the opinion that the statutory definition of public interest does not capture its essence. Therefore, the reconstruction of this concept should be made from the perspective of the designations of public interest which can be decoded by means of laws from the sphere of substantive administrative law.

Nowadays, noise is considered as one of the most significant factors polluting the environment. It is classified in the first place among the indicators of the comfort of home, leisure and work. Therefore, more and more attention is paid to the need to study the sources and effects of noise on the environment and to develop effective methods of protection against nuisance and harmful sounds. Analysis of environmental factors is an especially important part of the process of spatial planning. The article covers characteristics of spatial and temporal differentiation of acoustic phenomena occurring within selected district of Lublin – the largest Polish city east of the Vistula River. Field measurements and analytical operations, which enable mapping noise, and consequently measuring the exposure of residents to the impact of abnormal sound levels, were made. There was also an attempt to evaluate the spatial development and its relationship with prevailing acoustic conditions. The collected results allowed developing recommendations for planning the city centre area acting as a standard. The need to design buffer zones to reduce the sound level near roads or locating residential areas away from sources of noise was underlined. The study should prove helpful in forecasting changes in the acoustic conditions and spatial planning and deciding on protection measures in urban areas.

Maritime spatial planning has become on of the fundamental instruments of managing human activity at the sea. It is mostly due to the rising competition for marine space, which is a consequence of rising number and variety of uses of the sea. Among the principles of marine spatial planning ecosystem approach as well as the taking into account the interaction between land and sea seem to play the most important role. First one is more general and axiological in it’s nature, while the second functions more as technical guide for planners. Together they can be called guiding principles of marine spatial planning. Ecosystem approach is a concept closely related to ecosystem services. It’s main aim is to sustain the productivity of ecosystems in the field of ecosystem services, what is often connotated with the health of the marine ecosystem. Multiple correlations between land and sea can be easily seen in the managerial goals of the marine ecosystem. Trophic relations seems to be reflected in legal regulations, but the question remains if the marine spatial planning regime really reflects the interactions between land and the sea.

The paper discusses the issue of the “A”, “B”, “C” zones of spa protection regulated by “The law on spa treatment, health resorts and its protected areas, and on health resort administrative districts” (2005) as part of the spa area or spa protection area, defined in a spa statute, established in order to protect healing medical properties and natural medical resources in the respect of values of environment protection and spa facilities. The aim of the research, the results of which arepresented in the paper, was to identify the problems related to the functioning of protection zones in spas in Polish. In addition, an attempt was made to assess the efficiency of zoning as an instrument of landscape protection, defined by the European Landscape Convention as a geographical-psychological reality perceived in a multi-sensory way. In the course of the research, selected planning and strategic documents were analysed, including spa statutes. On their basis, the cities in Poland with the largest and smallest area of the A zone of spa protection and health resorts in Poland according to the size of the area of different types of spa protection zones were compared. The outcomes of the research were juxtaposed with the conclusions drawn in the report of the Supreme Audit Office (2016). It was shown that the spa protection zones, due to their protection, the function that determines the preservation of the therapeutic qualities of the landscape should be treated as an indispensable tool for protecting the landscape of spa resorts.

The paper presents the territorial differences in the implementation of ”soil and water protection” agri-environmental package within the scope of the Rural Development Plans, RDP 2004-2006 and RDP 2007-2013, in Poland. The research material involved data provided by the Management Information System of the Agency for Restructuring and Modernisation of Agriculture developed on 16.04.2010 by the Department of Analyses and Reporting. The main beneficiaries were farmers in the voivodships in the north-western part of the country. The most interesting variant for farmers was the ”stubble catch crop”. The greatest interest in cereals and cruciferous was noted for catch crops. Ratio of area covered by the implementation of the package in the RDP 2004-2006 to agricultural land in farms (%) was positively correlated with the average area of arable land per farm (ha), percentage share of cereals in cropping area and negatively correlated with cattle stock in head per 100 ha of AL. In RDP 2007-2013 this ratio was positively correlated with consumption of nitrogenous fertilizers per 1 ha of AL (kg), average economic size of farm (ESU) and Standard Gross Margin (SGM) of farm (PLN).

The problem of landscape protection is an important element of the spatial policy of administrative communes. This is determined, among other things, on the basis of assumptions included in a local spatial development plans. At present, institutions responsible for landscape protection are not required by law to present, within their statutory duties, documents on directions of the development of an administrative commune.

Kształtowanie środowiska i gospodarowanie jego zasobami zgodnie z zasadą zrównoważonego rozwoju jest jednym z wielu aspektów ochrony środowiska. Jest ona obowiązkiem władz publicznych, a jej efektywność będzie uzależniona od stosowania przymusu wobec podmiotów prawa i kształtowania świadomości znaczenia działań przyjaznych środowisku. Władze publiczne są zobowiązane do: zapobiegania negatywnym dla zdrowia skutkom degradacji środowiska, prowadzenia polityki zapewniającej bezpieczeństwo ekologiczne współczesnym i przyszłym pokoleniom, udzielania informacji o stanie i ochronie środowiska, wspierania działań obywateli na rzecz ochrony i poprawy stanu środowiska. Ład przestrzenny i zrównoważony rozwój przyjęto jako podstawę kształtowania polityki przestrzennej, określania zakresu i sposobów postępowania w sprawach przeznaczania terenów na określone cele oraz ustalania zasad ich zagospodarowania i zabudowy, ponadto stanowią one podstawę do sporządzania i aktualizacji koncepcji przestrzennego zagospodarowania kraju, strategii rozwoju województw, planów zagospodarowania przestrzennego województw, studiów uwarunkowań i kierunków zagospodarowania przestrzennego gmin oraz miejscowych planów zagospodarowania przestrzennego. W szczególności działania te winny obejmować: określenie rozwiązań niezbędnych do zapobiegania powstawaniu zanieczyszczeń, zapewnienia ochrony przed powstającymi zanieczyszczeniami, a także przywracania środowiska do właściwego stanu oraz ustalanie warunków realizacji przedsięwzięć umożliwiających uzyskanie optymalnych efektów w zakresie ochrony środowiska.
Sustaining the environment and managing its resources in accordance with the principle of sustainable development is one of many aspects of environmental protection. It is the responsibility of the public authorities, and its effectiveness will depend on the use of coercion towards legal entities and the awareness of the importance of environmentally friendly actions. Public authorities are required to: prevent adverse health effects of environmental degradation, pursue policies that ensure ecological safety for modern and future generations, provide information on the state and the environment, support citizens' actions for the protection and improvement of the environment. Spatial planning and sustainable development have been adopted as the basis for shaping spatial policy, defining the scope and ways of dealing with issues related to the allocation of land for specific purposes and establishing the principles of their management. Moreover, they are the basis for drawing up and updating the concept of spatial development of the country, the development strategy of voivodeships, spatial development plans of voivodeships, studies of conditions and directions of spatial development of municipalities and local spatial development plans. In particular, these actions should include: identifying the solutions needed to prevent pollution, ensuring protection from emerging pollutants and restoring the environment to the right condition and setting the conditions for the implementation of projects that will achieve optimum environmental performance.

The purpose of this publication is to analyze air pollution on the example of the city of Krakow, as well as to consider the possibility of using geodata for environmental protection. In addition to case study analysis as the leading research method, the article also uses the observation, analysis, and statistical methods. The article presents the concept of using GIS spatial analyzes and spatial planning as an element of the Green New Deal in the process of ventilating the city of Krakow. When developing a project related to city ventilation, it is extremely important to have the most accurate data on the strength, direction of the wind, type of pollution, and the number of emitters. Spatial analyzes are also able to indicate the main ventilation corridors of the city. These include, above all, areas located on the Vistula River, but also the widest city streets. Such results make it possible to more consciously manage space.

Kluczowym problemem omawianym w artykule jest ochrona pozostałości przedurbanizacyjnego krajobrazu kulturowego na terenach miast. Autor zwraca uwagę na wartość struktur i elementów dawnych podmiejskich wsi w przestrzeni współczesnych miast. Stawia tezę, że kluczowe komponenty dawnego rozplanowania nie są ani należycie identyfikowane, ani waloryzowane – skutkiem czego ich ochrona jako obiektów dziedzictwa jest wybiórcza i powierzchowna. Postuluje konieczność skorygowania dotychczasowej teorii i praktyki postępowania zarówno w badaniach krajobrazu historycznego, jak też w praktyce ochrony zabytków i planowania przestrzennego. Tezy artykułu zostały zilustrowane przykładami z terenu Wrocławia.
The key problem discussed in this paper is the protection of the relic of pre-urbanized culturallandscape in urban areas. The author draws attention to the value of structures and elements of suburban villages in contemporary urban spaces. He argues that the key components of the former layout are neither well-identified nor valued – for this reason their protection is selective and superficial. The author believes that it is necessary to correct both the methodology of historical landscape research and the practice of cultural landscape, in particular the practice of spatial planning protection. The theses are illustrated by examples from the area of Wrocław.

Analiza ta pozwoliła na sformułowanie szeregu stwierdzeń, dotyczących genezy ochrony przyrody w Polsce, zmian legislacyjnych oraz związków między przepisami z zakresu ochrony przyrody, środowiska oraz ochrony gruntów rolnych i leśnych z planowaniem i zagospodarowaniem przestrzennym. Wnioski te należy traktować jako przyczynek do opracowania formuły merytorycznej i prawnej ochrony wartości przyrodniczych w miejscowych planach zagospodarowania przestrzennego.
The article is a general introduction into issues of protection of environmental values. It contains an analysis of effective regulations concerning the problem, with a reference to changes introduced in them throughout last years. This analysis led to formulating a series of statements concerning the genesis of nature protection in Poland, legislative changes and connections between regulations concerning protection of environment, nature, agricultural land and forest land with spatial planning and land development. These conclusions should be treated as a contribution to developing a substantive and legal formula of protection of environmental values in master plans.
