Since the beginning of 1999 a fundamental reorganization of the social security system was introduced, which has substantially changed the existing mechanisms of its functioning. Within this reform a situation of the main social security performer, The Social Security Institution, had undergone a great changement in executive as well as organizational and legal form. As a consequence of the above mentioned rarely commented on and considered outcomes have appeared and determined further functioning of the Institution. Filling this gap, hereby the author takes upon a subject of the transformation of The Social Security Institution into the state administration body, equipped with legal personality, as well as issues related to the “transfer” of the employees of the state administration into the new unit, and endowment of the newly formed entity with possessions. He also does not leave unmentioned the subject of the liability and legal responsibility for the predecessor. The situation of the Institution as a legal successor of social insurance institutions, operating sine 1950, and as a successor of the further organizational units competent in the matters of pensions and annuities was also discussed. The author analyzes the organizationally and legally transformed institution, and puts a big emphasis on its legal status as a legal personality, introducing a conclusion by mentioning that the Social Security Institution is primarily a state organization unit and only then a legal personality and that its dualistic character can favourably affect the fulfillment of its statutory assigned tasks.

The subject of this study is to analyze the legal arrangements for indexation of social security benefits. Now indexation is a legal and economic formal adjustment mechanism specified by the law, aimed at maintaining the real value of cash benefits performed annually and based on inflation rate, less frequently on the rate of payroll. It is provided for all the entitled persons and has a rather broad scope, including the provision of short and long term benefits. The paper provides the analysis of the nature of rights to indexation of cash benefits taking into account their legal guarantees. Functions of indexation affect the universality of its application, which entails significant financial implications for the state budget. Thus, the aim of this paper is also to discuss the issue of financing indexation.

Dynamiczne zmiany na rynku pracy w pierwszej dekadzie XXI w. doprowadziły do wzrostu liczby osób zatrudnionych na podstawie umów cywilnoprawnych i innych elastycznych form zatrudnienia. Dochody z części z tych umów są wyłączone z podstawy wymiaru składki na ubezpieczenia społeczne, w tym na ubezpieczenie emerytalne. W efekcie coraz większa liczba osób uzyskujących bieżące dochody z pracy i uczestniczących w rynku pracy może na starość być wykluczona społecznie z powodu zbyt niskiego zabezpieczenia emerytalnego. W niniejszym artykuł nie przedstawiono badań społecznej skali tego zjawiska, a jedynie próbę wyjaśnienia - przy pomocy analizy przepisów prawa oraz symulacji zabezpieczenia dochodu na starość opartej na biografiach ryzyka - wpływu elastycznych form zatrudnienia na zabezpieczenie dochodu na starość oraz na ryzyko emerytalne. Przy obecnym sposobie obejmowania obowiązkowym ubezpieczeniem społecznym należy wysnuć wniosek, że elastyczne formy zatrudnienia prowadzą do zwiększenia negatywnych skutków ekonomicznych i społecznych ryzyka emerytalnego. Nie zapewniają bezpieczeństwa socjalnego. W konkluzji sformułowano postulaty de legeferenda.
The dynamic changes in the labour market in the first decade of the century have led to an increase in the number of people employed on the basis of civil law contracts and other flexible forms of employment. The revenues from these contracts are excluded from the contribution assessment basis, including old age pension insurance. As a result, an increasing number of people receiving income and participating in the labour market may be socially excluded in their old age due to low pension assets. This article does not examine the social scale of the phenomenon. Instead, analyzing legal documents and using microsimulation of old age income security based on risk biographies, it aims at explaining the impact of flexible employment on income security in old age. The analysis of the current mandatory social insurance coverage leads to the conclusion that flexible forms of employment may cause an increase in negative economic and social effects of the old age risk. It docs not provide a social safety net. In their conclusion, the author suggests some legal changes.

Artykuł prezentuje bieżące działania Komisji Europejskiej w obszarze zabezpieczenia społecznego. Przedstawia się w nim inicjatywy KE związane z promocją aktywności osób starszych. W skrócie omówiono Białą Księgę z 2012 r. oraz zalecenia Komisji dotyczące reform systemów emerytalnych. Zaprezentowano również rozporządzenie PE i Rady 465/2012 z dnia 22 maja 2012 r. zmieniające rozporządzenie nr 883/2004 w sprawie koordynacji systemów zabezpieczenia społecznego oraz rozporządzenie nr 987/2009 dotyczące wykonywania rozporządzenia nr 883/2004.
The article analyzes current activities of the European Commission in the field of social security. It presents the initiatives of the Commission related to promotion of active ageing. Briefly discussed the White Paper of 2012 and the Commission’s recommendations for reform of pension systems. Also presented the Regulation 465/2012 of 22 May 2012 amending the Regulation 883/2004 on the coordination of social security system and Regulation 987/2009 on the implementation of Regulation 883/2004.

The present day Internet provides a wide range of services users can benefit from. Some of the services require gathering, processing and presenting data that come from many users in order to deliver additional information. The suitable example can be social networking service. The more valuable data it stores and processes, the more profitable it can become. Users’ personal data can constitute significant value. One of the issues of social networking is storing and processing data by only one entity. Users cannot choose the most suitable security policy because there is only one provided for certain social network. Being part of it, means accepting the risk of unauthorized data distribution and data leakage because of application vulnerabilities. This paper presents new architecture of social network, which provides mechanisms for dividing data between more than one entity and combining independent data repositories in order to deliver one social network with clearly defined interfaces used to connect new data sources.

In Norwegian legal system the model of employees security is typical and occurs on two levels. Accordingly to first, it’s provides the special employment protection, in the meantime the second guarantees the right to remuneration for illness period, as well as to benefit from the social security. The mentioned matters are governed by the following: the Act on Labour Law of 17 June 2005 and the Act on Benefits of Social Security of 28 February 1997. Both of them are analyzed by Authors. Act on Labour Law regulates the scope of the employment protection and conditions that allows the termination of the employment contract, while the Law on Benefits, provides the social security provisions, specifying the mode and the rules for the granting remuneration/allowances, periods of their payment and the workers entitled. An analysis of the provisions of Norwegian statutory regulations (taking into account the protection of employment contract during the illness) shows the restrictive solutions in this field. However, the employment protection against dismissals during the period of 12 months of illness, is not rigid, whereas the termination during the period of incapacity for work is permitted with applying the general conditions of the termination of employment contract. The special attention must be given to the institution of egenmelding, which must be understood as the specific employee’s entitlement for justified absence at work (due to illness) based on the principle of loyalty of the both parts of employment relationship.

One of the broadly discussed issues, in particular in societies with poor infrastructure of formal care of dependent people (i.e. Poland), is the effect of the ageing process on the efficiency of informal care of the elderly by family members, friends, neighbors, and local communities. The complex situation of elderly care resulting from dropping fertility is further complicated when the emigration rate is high in a given country, such as Poland. The problem is often conceptualized in terms of moral panic. It needs to be emphasized that intergenerational transfers are not unidirectional and not always necessary, as exemplified by parents often helping their children working abroad, and not all elderly parents need care. In this article, I will emphasize the point of view of the parents of migrants, by focusing on the functioning of the transnational system of social security that consists of different actors (migrating and relatively immobile) in both sending and receiving societies. Quantitative and qualitative data from the field studies carried out from 2010–2012 will be used for the purpose of this text.

Niniejszy artykuł koncentruje się na krótkiej analizie zmian wybranych elementów polskiego systemu zabezpieczenia emerytalnego w kontekście dostosowywania jego kształtu do zmian ustrojowych, demograficznych i społecznych. Przedstawiono analizę tych instrumentów, które bezpośrednio lub pośrednio gwarantować mają bezpieczeństwo socjalne osobom starszym (dotkniętym ryzykiem emerytalnym), z uwzględnieniem uzależnienia systemu emerytalnego od zmian demograficznych. Pokazany zostanie również szerszy kontekst rozszerzania zakresów podmiotowego i przedmiotowego, a także wyłączania pewnych grup pracowników z powszechnego systemu. Artykuł opiera się na analizie literatury przedmiotu, polskiego ustawodawstwa z zakresu zabezpieczenia społecznego oraz danych statystycznych zagregowanych na poziomie kraju.
The article concentrates on short analyses of polish social security system’s chosen elements, in context of adjusting its shape to regime changes, as well as demographical and social changes in Poland. The analyse will focus mainly on those instruments, which directly or indirectly are supposed to guarantee social security to old people (pension system). The analyse will show also wider context of extending of subjective and objective scope of social system as well as exclusion of some groups of employers from the common system. The article is based on literature regarding social security, polish and international legislation, as well as statistics.

The article contains the comparative analysis of functioning of public funds of the social insurance in Poland. It turns out that significant disproportions exist in amounts of contributions paid by policy holders into ZUS and the KRUS. Unfortunately, an introduced reform of the insurance plan does not get rid of these irregularities. According to the author, it would be essential to include numerous group of farmers into the universal system. It should be an effect of taken action: increasing income to FUS, lowering the amount of transferred subsidies to the fund from the state budget, the efficiency rise of the farm labour, the rise of average size of agricultural farm and curbing the "hidden unemployment" in the farming. 145-152

W artykule zaprezentowano wybrane socjologiczne aspekty badań empirycznych nad Państwową Strażą Pożarną, dokonanych w Instytucie Socjologii Uniwersytetu Wrocławskiego. Usytuowanie tych badań we wrocławskim ośrodku akademickim zbiegło się z jubileuszem XX-lecia Państwowej Straży Pożarnej (PSP). Główną osią rozważań zamieszczonych w artykule jest prezentacja wzoru społecznego funkcjonariusza PSP jako przedstawiciela paramilitarnej formacji systemu bezpieczeństwa. Jest to osoba podejmująca trud codziennej służby, zapewniając szeroko rozumiane bezpieczeństwo w przestrzeni metropolitalnej.
This article presents selected empirical sociological aspects of the State Fire Service, carried out at the Institute of Sociology at the University of Wroclaw. The location of these studies in Wroclaw academic center coincided with the celebration of twenty anniversary of the State Fire Service (SFS) existence. The main axis of the considerations contained in the article is to present the social model of a firefighter as a representative of paramilitary formations of safety system. This is the person who takes the trouble of daily service providing safety understood as the safety the metropolitan area.

Treść artykułu podejmuje problematykę zasadności podniesienia wieku emerytalnego w Polsce w kontekście starzenia się społeczeństwa oraz koncepcji bezpieczeństwa socjalnego. System zabezpieczenia społecznego ma bowiem za zadanie gwarantować obywatelom poczucie bezpieczeństwa socjalnego. Wydaje się to szczególnie ważne w sytuacji, w której system emerytalny w dużym stopniu uwrażliwiony jest na zmiany demograficzne, a sytuacja demograficzna w społeczeństwie nie jest korzystna.
The article content takes the issue merits of raising the retirement age in Poland in the context of an aging society and the concept of social security. The social security system has the aim to guarantee citizens a sense of social security. This is particularly important when the pension scheme is highly sensitized to demographic changes and the demographic situation in society is not favorable.

In this article previous output in the field of (employers) social risk in the light of social security and labour law was presented. However, the most important aim was to emphasize on similarities and differences of social risk definitions. In the next step, the new definition of employer's social risk was introduced which is more suitable in the economic approach. The author, based on formulated definition, made the hypothesis which lets to answer the question: "do and how employer's social risk impact on situation in the labour market. In this context, the most valuable will be empirical verification of relation between the scope of employment protection legislation and the employment rate of fragile group in the labour market.
