In order to live a human being needs other people and they in return need him or her. This general truth acquires particular significance when a person has to face some critical situation and becomes dependant on the help from others, be it for bad health condition, for social, economic or other reasons. The primary and fundamental precondition of successful handling of any critical situation therefore is the knowledge of the mystery of human being, his/her value and dignity. This, in my opinion, can only be achieved via thorough application of basic social principles in everyday praxis. The values stemming from these principles are derived from and reflect human nature; they aren’t mere objects of a certain faith but appear comprehensible by reason too.

Pandemia koronawirusa jako swoistego rodzaju sytuacja kryzysowa wpłynęła na koncepcję duszpasterstwa, realizowaną w łonie Kościoła katolickiego. Dotychczasowa działalność Kościoła, oparta na rzeczywistym kontakcie z wiernymi, została w pewnej mierze zredukowana do relacji wirtualnych w czasie lockdownu. Ten stan rzeczy odpowiada idei społeczeństwa wirtualnego, w ramach której przedefiniowano wartości prawdy, solidarności i dobra wspólnego. Każda ze wskazanych wartości (będących jednocześnie zasadami społecznymi) zmierza do ochrony człowieka w aspekcie godności osobowej i nienaruszalnych praw. Mając na uwadze niebezpieczeństwa, jakie kryją się w wirtualnej rzeczywistości, należy traktować łączność internetową jako szansę dla duszpasterstwa, przy jednoczesnym uwzględnieniu fundamentalnego znaczenia realnego kontaktu z wiernymi. Pandemia koronawirusa jest „znakiem czasu”, który intensyfikuje doświadczenie wspólnoty jako Kościoła stanowiącego źródło otuchy w dobie kryzysu.
The coronavirus pandemic as a type of crisis influenced the vision of pastoral care carried out by the Catholic Church. During the lockdown, the activity of the Church, based on real contact with the faithful, has been partly reduced to virtual relations. This situation reflects the idea of a virtual society where the values of truth, solidarity, and the common good have been redefined. Each of the indicated values (which are also social principles) aims to protect human beings, their dignity, and inviolable rights. Bearing in mind the dangers that virtual reality entails, Internet connectivity should be treated as an opportunity for pastoral care while allowing for the fundamental importance of real contact with the faithful. The coronavirus pandemic appears to be a “sign of the times” that intensifies the experience of the Church as the community, acting as the source of reassurance in times of crisis.

In the political space there are often references to the notion of „principle.” This category appears against the backdrop of various contexts, so that it seems to loose its semantic clarity. The lexicons and encyclopaedias of political science do not this concept precise in their narration. In view of a genetic and contextual analysis the paper seeks to show such an understanding of the notion of „principle” that is characteristic of political science. A typology of political principles and their relations have also been proposed. Starting from the concept of arche/principium, the author presents briefly the evolution of the category of „principle” in the political space. He shows the semantic relation between the principle and arche as to that which is basic and fundamental. Then he remarks that we should distinguish ontological and functional principles, with respect to the degree how essential the problem is for a political community to which the notion of „principle” refers. In respect with the types of political issues defined by the category of principle the author lists three types of political principles: normative, regulative, and postulative-critical. He also remarks that in the narration of political science the category of principle is sometimes discussed to define metapolitical principles, closely related to the political space, especially social principles that may become an inspiration for political principles. The last part of the paper is devoted to the relations between particular types of principles. Three kinds of such relations have been distinguished. Two of them (evolution and transposition of principles) deal with the relations that occur within political principles. The relation named as a borrowing deals with the relation between political and metapolitical principles.

Social enterprises perceive social and environmental issues as primary objectives of their hybrid socio-economic activities. They believe that financial stability is a prerequisite, not a goal. This approach is similar to Catholic social teaching (CST). The detailed content of the social encyclicals is a valuable means of deeper exploration and enrichment of the moral dimension of social enterprise management. The following article analyses social entrepreneurship from the point of view of the fundamental principles of CST and theological premises. The reference to the management of a social enterprise of the supreme personalistic standard and principles such as the common good, subsidiarity, and solidarity allows the moral dimension of this process to be understood more deeply. The paper was created based on a method appropriate to research focused on moral theology and CST. First, the content of selected literature on the subject (social entrepreneurship) and carefully selected theological-moral sources (especially papal documents and publications by CST researchers) were analysed. Subsequently, the results of the analysis were subjected to inference and conceptual work in relation to the adopted general research objective and specific research tasks: the phenomenon of social enterprises was described; the specific features and limitations of the social enterprise management process were identified; the fundamental principles of Catholic social teaching as normative criteria for social enterprise management were reviewed; the possibility of applying the aforementioned CST principles to social enterprise practice was discussed and presented, and the final conclusions were formulated.

The presented gloss discusses the judgement file ref. no. IV CSK 598/12 dated November 23, 2012, issued by the Supreme Court concerning the possibility of recognizing the acquirer of a bankrupt undertaking as its legal successor, and the impact of the amount of contractual payments made to date on the validity of a decision issued in connection with the amount of remuneration for the non-contractual use of the leased thing. The Supreme Court underscores that the disposal of an undertaking of a bankrupt company in the course of bankruptcy proceedings with a winding-up option gives rise to events appropriate for universal succession. The position indicating lack of effect of legal succession on the part of the acquirer concerns the case of acquisition of a bankrupt undertaking which retains its legal existence after bankruptcy proceedings are over. However, this does not apply to the special situation connected with the disposal of an entire undertaking of the company in the course of completed bankruptcy proceedings. The Supreme Court found that in assessing the validity of the contested contractual provision, the extent of the contractual performances made to date in the form of lease payments, cannot play a decisive role. The disproportion in payments cannot be contravene the principles of social intercourse. The presented gloss accepts the arguments of the judgement of the Supreme Court; however, attention is drawn to the principle of proportionality between creditors and a debtor, as well as the import of Article 5 of the Civil Code.

The purpose of the article: General clauses are an important element of the legal system. They supplement the law regulations taking into account moral norms commonly accepted in society. Their general nature means that they are the subject of both discussions in the legal literature and comments and references in court decisions. The specificity of general clauses and the need to precise them in each case in which they are applied, result in a certain unpredictability of judgments. One of the most famous general clauses is the clause of principles of social coexistence. It appeared in the Polish legal system after World War II along with the new political system. It replaced the principle of good manners used in the Second Polish Republic. Since 1990, the return of the name of this principle to the Polish legal system has been visible. On the other hand, in legal regulations relating to the capital market, the clause of the principles of fair trade is used. It can be considered that the nature of the three clauses mentioned above is similar. The aim of the article is to analyze the nature and similarity of these general clauses with particular emphasis on the clause of the principles of fair trade in the capital market. Methodology: The study is theoretical and empirical in nature. The theoretical part was based on a review of the literature. The empirical part is realized by the analysis of the court decisions. Results of the research: The results show that the finding by the Polish Financial Supervision Authority a violation of the principles of fair trade as a basis for imposing administrative sanctions should be supported by a reference to the specific standard of conduct and be precisely described. It cannot be defined in general terms only. Otherwise, it may be effectively challenged by way of a complaint to an administrative court. On the other hand, in court judgments, in cases referring to the principles of social coexistence (the principles of fair trade), discrepancies in application can be noticed resulting from the specificity of general clauses.

Zaprezentowana glosa dotyczy wyroku Sądu Najwyższego z dnia 23 listopada 2012 r. sygn. akt IV CSK 598/12 w przedmiocie dopuszczalności uznania nabywcy przedsiębiorstwa upadłego za jego następcę prawnego oraz wpływu rozmiaru dotychczas spełnionych w ramach umowy świadczeń na ważność postanowienia w sprawie wysokości wynagrodzenia za bezumowne korzystanie z rzeczy. Sąd Najwyższy podkreśla, że zbycie przedsiębiorstwa upadłej spółki kapitałowej w toku postępowania upadłościowego z opcją likwidacyjną, wywołuje zdarzenia właściwe dla następstwa prawnego pod tytułem ogólnym. Stanowisko wskazujące na brak skutku następstwa prawnego po stronie nabywcy odnosi się do przypadku nabycia przedsiębiorstwa upadłego, które zachowuje byt prawny po zakończeniu postępowania upadłościowego. Nie ma jednak zastosowania do sytuacji szczególnej związanej ze zbyciem całego przedsiębiorstwa spółki w prawomocnie zakończonym postępowaniu upadłościowym. Sąd Najwyższy uznał, że przy ocenie ważności spornego postanowienia umownego nie może mieć decydującego znaczenia rozmiar dotychczas spełnionych w ramach umowy świadczeń w postaci opłat leasingowych. Sama dysproporcja świadczeń nie musi być sprzeczna z normami współżycia społecznego. Niniejsza glosa aprobuje argumentacje zawartą w wyroku Sądu Najwyższego, jednocześnie jednak zwracając uwagę na zasadę proporcjonalności pomiędzy wierzycielami a dłużnikiem oraz rangę art. 5 Kodeksu cywilnego.
The presented gloss refers to Verdict IV CSK 598/12 issued on 23rd November 2012 by the Supreme Court concerning the admissibility of recognizing the acquirer of the bankrupt’s business as his legal successor, and the impact of the extent of the heretofore provided contractual performances on the validity of the decision concerning the amount of the remuneration for the non-contractual use of a thing. The Supreme Court underlines that the disposal of an enterprise of a bankrupt company in the course of bankruptcy proceedings with a winding-up option, results in the events appropriate for a universal succession. The position indicating lack of effect of legal succession on the part of the acquirer refers to the case of acquisition of the bankrupt’s enterprise  that remains its legal existence after the end of the bankruptcy proceedings. However, it shall not apply to the special situation connected with the disposal of the entire enterprise of the company in the finally completed bankruptcy proceedings. The Supreme Court found that in assessing the validity of the contested contractual provision, the extent of the contractual performances heretofore provided in the form of leasing fees, cannot be decisive. The disproportion in performances cannot be contrary to the principles of social coexistence. The present gloss accepts the arguments contained in the verdict of the Supreme Court, however, it also draws attention to the principle of proportionality  between the creditors and the debtor, and the importance of Article 5 of the Civil Code.

Social economy and the Church's social teaching are joined not only by a similar object of interest, i. e. a common axiological foundation in the form of certain values and principles. It seems that the existence of such connections on the axiological level is not very well known, which can be proven, among others, by the fact that it is hard to find any studies or even mentions connected with it in the literature on the subject. Hence an attempt seems justified to look closely and to analyze this connection in order to indicate the details of mutual implications, and so to show the possibilities of mutual enriching these two domains of human reflection on social life. The article analyzes particular principles of social life that are preached by the Church as part of its social teaching, with respect to their presence or the necessity of considering them in social economy. First it points to (1) the source and foundation of all the social principles, which is the human person, and then it shows (2) the dignity of work and the call to be enterprising. Next, the following principles are analyzed: (3) the common good, the general allotment of goods and preferential option for the poor, and finally (4) solidarity, subsidiariness and participation.

Cultural and social changes may affect the methodology adopted by the courts at a certain time in interpreting and applying the law, in particular provisions containing general clauses. These clauses make the law more flexible, enabling it to adapt to changing conditions. They are treated as a kind of “safety valve” to avoid solutions that are unjust, or ethically and morally unacceptable in society. From this perspective, this article will consider the significance of the general clause of the principles of social coexistence in adjudicating a divorce from the perspective of Polish law. The purpose of this article is to answer the question whether, and in what direction, the cultural and social changes that may be taken into account through the general clause of Article 56 of the Family and Guardianship Code affect the dissolution of a marriage by divorce, namely whether or not they hinder the pronouncement of a divorce where the other prerequisites for divorce are met.

Opis:
Some consider that public aid in the private sector of the market economy disturbs the mechanism of free market competition. In the Treatise and other documents of European Union, competition is a main way to realize common economic and social ends; thus, public aid may be used. I analyze the special situation of public aid for the financial sector in 2008. The aim of the article is to the justification for public aid for the financial sector. The method of analysis is the set of principles of Catholic social thought, as Christian values were the roots of the European integration project. Common good, subsidiarity, solidarity and social justice public aid for the financial sector may be unjustifiable, especially in the context of solidarity.

Szukając nowych rozwiązań dla starych problemów, zwraca się uwagę na takie znaczące dla dobrego funkcjonowania współczesnego społeczeństwa kwestie jak sieci powiązań międzyludzkich, zaufanie czy normy. Pojęcie kapitału społecznego jest używane już od kilku dekad do opisu i wyjaśniania fenomenu zmian w sferze społeczno-politycznej i gospodarczej, zaistniałych w wyniku transformacji społeczno-ekonomicznej. Odnosi się ono również do sfery działań obejmujących m.in. budowanie partnerskich i demokratycznych relacji we wspólnotach lokalnych, w których kapitał społeczny stanowi podstawę trwałych sieci społecznego zaangażowania zaufania i wzajemności. Celem prezentowanego artykułu jest próba przedstawienia korzyści wynikających z posiadania przez wspólnotę lokalną zasobów kapitału społecznego, jak również wskazanie jego pozytywnego oddziaływania na bezpieczeństwo publiczne.
When looking for new solutions to the old social problems, people pay attention to important issues for the good functioning of today’s society, including interpersonal relations, trust, or standards. The term “social capital” has been used for several decades to describe and explain social and political as well as economic changes that took place as a result of the social and economic transformation. It also refers to activities including, among others, the creation of partnerships and democratic relations in local communities in which the social capital forms a basis of permanent networks of social involvement, trust, and mutuality. The purpose of this article is to present the benefits of the local community arising from social capital resources and their positive impact on public safety.

Celem artykułu jest analiza czynników determinujących postrzeganie kierunku instytucjonalnych przemian sektora pomocy społecznej przez pracowników socjalnych. Wyniki przeprowadzonych badań potwierdzają, że proces percepcji tak wielowymiarowego konstruktu, jak aprobata dla zmian w systemie pomocy społecznej został zdominowany przez perspektywę własnych możliwości rozwojowych i warunków osiągania sprawstwa i podmiotowości. Selektywność czynników percepcji zmian w systemie pomocy społecznej odzwierciedla orientację aksjologiczną, oczekiwania i doświadczenia pracowników socjalnych. W badaniach zidentyfikowano także dziewięć wymiarów postrzegania zmian w systemie pomocy społecznej, które wyjaśniają 61,84% całkowitej wariancji, oraz skonstruowano model pomiarowy. Dzięki niemu ustalono, że najwyżej ocenianym wymiarem zmian w systemie pomocy społecznej jest możliwość rozwoju osobistego, poczucie sprawstwa i podmiotowości. Wymiarami o nieco niższym poziomie są te odnoszące się do organizacyjnego uczenia się, nowych akcentów w zasadach pracy socjalnej, takich jak indywidualizacja, decentralizacja, nacisk na prace środowiskową, solidaryzm i wspólnotowość. Uzyskane wyniki pokazują głębokie zakorzenienie pracowników socjalnych w wartościach, na których opiera się środowiskowa praca socjalna.
The aim of this study is to analyse the factors determining the perception of the direction of institutional changes by social workers. The analysis helped confirm the hypothesis according to which the perception of as multidimensional construct as approval for changes in the social assistance system was dominated by the perspective of one’s own development capabilities and conditions for achieving agency and subjectivity. It was found that the particular factors influencing how changes are perceived reflect the axiological orientation of the respondents, their expectations and experiences. Identified were nine dimensions of how changes in the social assistance system are perceived, which account for 61.84% of the total variance. On this basis, a measurement model was constructed. The model helped establish that the highest rated change determinants were personal development opportunities, a sense of agency and subjectivity. Dimensions that scored slightly lower were those related to organizational learning, new foci in the principles of social work such as individualization, decentralization, emphasis on environmental work, solidarity and community. The results reveal the deep rooting of social workers in the values on which environmental social work is based.

Opis:
This paper presents the relationship between adult children and their parents under the child maintenance obligation of parents towards their children. The main subject of the deliberations is mutual respect between the two parties. Other issues analysed in the paper include parents – adult children relations other than those arising from parental authority, particularly in situations in which an adult child demands financial support to meet the cost of higher education. The violation by an adult child of the principles of social coexistence against parents with parental obligations is analysed, and a possibility of exempting parents from their obligation to provide for education when an adult child fails to fulfil his or her family obligations is also considered.Particular attention has been put on the children’s obligation to inform parents as well as the possibility of parents to seek and be given information in a  situation in which they seek such exemption.
Artykuł prezentuje relację dorosłych dzieci z rodzicami zobowiązanymi do alimentacji. Przedmiotem rozważań jest kwestia obowiązku wzajemnego szacunku między dorosłymi dziećmi a rodzicami, następnie problem kontaktów realizowanych niezależnie od władzy rodzicielskiej, w szczególności w sytuacji, w której dorosłe dziecko domaga się alimentów dla zaspokojenia kosztów edukacji w ramach studiów wyższych. Autorka podejmuje problem naruszenia zasad współżycia społecznego przez dorosłe dziecko w stosunku do rodziców zobowiązanych do alimentacji. Analizie poddano także możliwość uchylenia się od alimentacji wówczas, gdy dziecko nie dopełnia obowiązków rodzinnych. Szczególne miejsce w rozważaniach zajmuje problem obowiązku informacyjnego dziecka w stosunku do rodziców oraz możliwość dochodzenia do uzyskania informacji przez rodziców w sytuacji dążenia do uchylenia obowiązku świadczeń alimentacyjnych.

Artykuł prezentuje istotne elementy teologii migracji. Przypomina ona układanie mozaiki, która dopiero w całości może stać się normatywnym fundamentem dla chrześcijańskiej etyki migracji. Elementy do mozaiki czerpać należy przede wszystkim z Pisma Świętego, tradycji, dorobku myśli teologicznej, nauczania Magisterium, katolickiej myśli społecznej czy personalizmu chrześcijańskiego. Każde z tych źródeł wnosi nowe aspekty.
The article presents the essential elements of the theology of migration. It resembles piecing together the jigsaw puzzle (mosaic), which when put together, can become the normative foundation for the Christian migration ethics. Most of all the elements for that mosaic can be taken from the Bible, the Tradition, the whole of achievements of theological thought, the Church Magisterium, the catholic social teaching and from the content of Christian personalism. Each one of these sources delivers new aspects.

The role of Catholic social teaching has been attributed to the promotion of moral values and principles that should be considered when establishing or evaluating a given social, economic, or political system. This also applies to smaller structures, specific institutions, concepts, and practical social solutions, which may include social entrepreneurship. The article aims to confirm the hypothesis that, taking into account the principles of Catholic social teaching in the process of discovering the axionormative determinants of social entrepreneurship allows its deeper understanding and more effective implementation of its praxeological goals. At the beginning of the paper, the author emphasises the common source of all general and specific axionormative criteria of the two analysed disciplines – the dignity of a human person. Further deliberations revolve around other values and principles, such as the value of human work and entrepreneurship, the common good, the universal destination of goods, the preferential option for the poor, solidarity, subsidiarity, and participation.
