Opis:
How might migration legislation and policies contribute to modern enslavement of migrants in Australia? Migration law and policy are a shield in the sense that they have been used and have the potential to be used to shield or protect trafficked individuals and those subject to modern slavery. Nevertheless, the state could be complicit in modern slavery through its migration law and policies exemplified by English language requirements for visas and for entering into certain professions. By placing the English language barrier between migrants and their economic and professional aspirations in obvious cases when a demand for proof of English language proficiency must not be made in the first place, the Australian Government and institutions create the environment conducive for excluding migrants from the professions and exposing them to economic abuse and exploitation. The stated basis of the English language requirements for Australian visas is that English language ‘is critical to getting a job’ and safely practising a profession and participating in Australian society. Yet migrants from non-exempt countries are required to sit for an English test when they apply for permanent resident visas (such as Subclass 186) and temporary visas (such as Subclass 485), even when they are present and already employed in Australia. Educational qualifications in English awarded by Australian and non-Australian tertiary educational institutions that satisfy the Australian study and qualification requirements are not the acceptable proof of competency in the English language. The effect of non-recognition of educational qualifications in English as proof of the English language ability is that visa applicants from non-exempt countries, even those present and working in Australia and/or who have completed a course of study in Australia, have to sit for an English language test. The content of this test bears no connection whatsoever with the English language used in practice. The test has an expiry date thereby tying migrants’ English language ability to the test expiry date, suggesting that once the test expires, so does their competency in English. Failing one component of the test requires resitting all the four components. Whereas an Australian educational qualification in English is required for admission to the legal, medical and nursing professions, the English language competence of migrants from non-exempt countries who hold the qualification is extracted from this qualification. Therefore, migrants cannot rely on the qualification as prove of their competency in English, even though the practice boards accept this same qualification as meeting the standards for admission to practise. The evidence disallowed or required to prove the English language capability both for Australian visas and to enter into the professions thus belies the stated purposes of the English language requirements. English is a global language that is spoken by different nationalities in different parts of the world. Therefore, taking a blanket approach that proficient speakers of English originate in the nations that are exempt from the English language requirements ignores the reality of English language usage. In these circumstances, the English language would seem a disguised legal and policy tool for gatekeeping, exclusion and nationality-based discrimination. The deliberate denial of the English language abilities of certain migrants and the stipulation of absurd and inexplicable evidentiary requirements as proof of the English language competency deprive such migrants of opportunity to enter into professions of their choice, ridicule and expose them to exploitation and modern slavery contrary to Australian values and legislation on equality and fair play.

The subject of this study is the international protection of human rights in the context of human trafficking and slavery. Human trafficking and slavery are one of the most vivid examples of the violation of the individual's right to freedom, integrity and security, and of the denial of human dignity, which is the main pillar of the international system for the protection of human rights. Therefore, trade in live goods and other crimes related to the exploitation of prostitution have become the subject of several international conventions. International communities have decided to prevent and combat this phenomenon with the help of criminal law instruments. The study contains explanations of statutory concepts related to the protection of human rights and human trafficking. In addition, it discusses the forms of protection of human rights. The theoretical nature of this paper is based on publications in the field of international law, criminal law, and constitutional law.

Topoi of historical memory in Bulgaria. Field researchThe article summarizes the preliminary results from the research project “Topoi of Memory”, which is a joint venture between the New Bulgarian University and the American University in Bulgaria.The major goal of the research team is to investigate the level of modernization of Bulgarian society using the mechanism of historical memory. Thus we are trying to answer the question: whether there exists one coherent and normative Grand Historical Narrative, inspired by “the inventors of tradition” – and how does it function. Or, whether there are diverse narratives which circulate among the various social, ethnic and religious groups, according to their own value systems.Another aim of the research is to establish the generators of memory, which are at odds between the institutional education and the traditions of the different groups.The results are quite clear: the Grand Bulgarian Historical Narrative is centered on the last decade of the Ottoman Rule in Bulgaria (the 1870’s) which presents the climax of the national liberation movement and the Liberation from the “Turkish Joke”. Still, the “joke” is marked primarily by the heroic discourse. This is in sharp distinction with Serbia, where the traumatic discourse is dominant. The heroic discourse allows much more wider deployment of the narratives of epic heroism, than the traumatic national memory of martyrdom.The leading topoi of memory among the majority of Bulgarians and the diverse minorities groups are relatively similar, still they differ on the level of repetition of these topoi. Even the representatives of the Turkish minority consider the Liberation of Bulgaria from the Ottoman rule the most important historical event. This fact does not mean that these Bulgarian Turks highlight a distinct “martyrdom memory”, or feature a high level of integration in Bulgarian society. It rather presents (in the majority of the cases) a special mimicry of the minority group versus the majority.  „Niewola turecka” jako miejsce pamięci. Wyniki badań terenowych Tekst zawiera raport z badań przeprowadzonych w ramach projektu „Toposy pamięci historycznej” realizowanego przez Nowy Uniwersytet Bułgarski i Uniwersytet Amerykański w Bułgarii. Głównym celem była ocena poziomu modernizacji społeczeństwa bułgarskiego, który byłby do uchwycenia z perspektywy mechanizmów pamięci. Czy można mówić o istnieniu jednej wielkiej narracji narodowej, inspirowanej przez „wynalazców tradycji”, czy też o cyrkulacji wielu opowieści – zależnie od systemów wartości poszczególnych grup społecznych, etnicznych, religijnych? Innym celem badania było wyznaczenie czynników tworzących pamięć (generatorów), jak powszechne wykształcenie czy tradycje rodowe.Wyniki badań jednoznacznie pokazują, że wielka bułgarska narracja narodowa – jeśli w ogóle istnieje – osadzona jest w ostatniej dekadzie panowania osmańskiego: okresie walk narodowowyzwoleńczych i wyzwolenia spod „jarzma tureckiego”. „Jarzmo” jednak nie tyle definiowane jest w kategoriach traumy (jak chociażby w Serbii), ile heroizmu. Okazuje się w większym stopniu impulsem do wielkiego zrywu niż martyrologią.W przypadku Bułgarów i poszczególnych mniejszości narodowych wiodące toposy są podobne, mimo iż pojawiają się z różną częstotliwością. Nawet mniejszość turecka uznaje wyzwolenie Bułgarii spod panowania osmańskiego za najważniejsze wydarzenie, w czym nie należy upatrywać martyrologii czy wysokiego stopnia integracji; w większości przypadków pozwala to dojrzeć w tym zjawisku tendencję do stosowania strategii mimikry.

Many people raise the question: Was the Last Supper of Jesus and the Apostles the Jewish Passover? The answer to this question is not that simple, though. This article attempts to identify the features of Jewish Passover based on characterictics of the Last Supper found in the Synoptic Gospels. However, the most important aspect for the author is to present the novelty of Eucharist in the light of rites and theology of the holy day of Pesach. This Novelty, when interpreting the descriptions of the Last Supper in the light of the Jewish Pass-over, provides us with a new theological dimension of the Eucharist, which was taken into account during the Second Vatican Council as well as liturgical re-forms. Christ died and was raised from the dead to the immortal glory so as to deliver us from the power of sin. Our Saviour crossed the borders of death and went on to the new life. In theology this passing is referred to as Pe-sach/Passover, the Mystery of Pascha, or the Paschal Mystery, since the He-brew word pesach means a passage. The ‘passage’ of Christ to the to Father’s glory was announced by the Israeli leaving the Egyptian land of slavery, sol-emnly declared at the time of Jewish celebration of Pascha/Passover. Christ’s death and His Resurrection took place right at the time of this religious feast. The introductory part of this article presents the most important elements of Jewish Pesach contained in descriptions of the Last Supper. Then we make insight into Jesus Christ and His redempting activity in the light of the Jewish Passover. And finally, the last part of this article introduces the new and pas-chal dimension of the Eucharist.

This contribution centers on the notions of property and nuda potestas in Reinach’s philosophy of law. I aim to demonstrate how both terms ground an important part of Reinach’s understanding of a priori condition for civil rights. Consequently, I assess the principle of property with a comparison to Luis de Molina, since he shows in his De Iustitia et Iure how dominium and rights justify some forms of property (lay and ecclesiastical) and political power (Molina 1659, disp2 n1; Kaufmann 2014, 129). Hence, the right of the person is discussed by following the potestas. In Die apriorischen Grundlagen des bürgerlichen Rechtes, Reinach implicitly refers to the nuda potestas, which is a kind of power that can be applied only formally and not in fact to something else and for that reason, it can only be caught a priori, since acts are performed by another person within it. This is the reason why the rights of a person can be divided between more people, and it is at first just a kind of property, which can be exercised upon the individual. Consequently, I divide my contribution as follows. First, in considering the social act, I show how its characteristics of Anspruch and Verbindlichkeit result from the commitment that human beings make to one another. In doing this, I discuss the particular condition of slavery through which it is possible to find the property and the nuda potestas since there is no enjoyment of the good to which it refers. Second, I apply both concepts by showing a parallel with Luis de Molina. This comes about in consideration of the case of dominium, in which absolute rights can be ascribed to their relative claim. Third and finally, I offer a critique of Reinach, in which I show how absolute rights and relative claims cannot be assimilated.

During the Hallstatt period in Central Europe, profound cultural, economic, and social changes occurred. This is due to the emergence of new technologies ‒ primarily iron metallurgy. Another element is the vicinity of the dominant economic system, i.e., the broadly understood Mediterranean civi-lization, especially the Etruscan cities in Italy. These asymmetrical relationships forced social changes in the areas north of the Alps. An important factor was probably the slave trade, which forced violence and armed struggle. This resulted in a progressive militarization, which is visible through the construction of defensive settlements and the strengthening of farms. The consequence was extreme social stratification and the domination of aristocratic elites. Thus, the stability of such a system depended on the relationship with the dominant partner. In a situation of disruption of relationships, a crisis must have arisen, resulting in the collapse of this culture model.

The discussion of the subject is preceded by a comprehensive introduction that brings the Ewe people, inhabiting southern Togo and Benin, closer to the reader. Based on historical data and oral tradition, an outline of Ewe’s political structure is presented, starting from the 17th century to the present moment, followed by a description of the traditional social organisation of this people, along with information on the diverse social status of individuals. In this context, the available piecemeal information about the forms of modern slavery and trafficking is included. The main topic is the presentation of Ewe’s traditional kinship system and the importance of family ties. The religious and genealogical dimension of the family is subject to a detailed analysis. A reconstruction of traditional customs, based on information from the turn of the 19th and 20th centuries, is the starting point for presenting the institution of marriage. The article presents in detail the various stages of entering into a marriage: from getting to know each other and the period of engagement, negotiations regarding the size of the dowry, to the description of the wedding rituals. The article ends with information on the changes in marriage customs in the period after the creation of the independent state of Togo.

Migrant domestic workers are estimated at approximately 11.5 million persons worldwide. European women are being replaced in their household chores by immigrant women, e.g. from Africa, Asia and Eastern Europe. The paper focuses on human labour rights of domestic migrant workers, especially from the point of view of the typology which divides international standards concerning labour as a matter of human rights into four groups: rights relating to employment (eg. the prohibition of slavery and forced labour); rights deriving from employment (eg. the right to social security, the right to just and favourable conditions of work); rights concerning equal treatment and nondiscrimination, and instrumental rights (eg. the right to organise, the right to strike). The aim of this paper is to reveal insufficient effectiveness of human labour rights according to the above-mentioned typology. Thus, the author will concentrate on the issues of modern slavery, hyper-precarity and discrimination.

The Middle English “Floris and Blancheflour” idealizes slave trade and suggests that only the highly-born can be subject to enslavement. It disregards the oriental origin of the merchants who will trade in Blancheflour. The poem focuses on wealth and ignores the widespread nature of medieval poverty. Respect for the merchants in the text foreshadows the later high social status of slave traders in England. Slavery is romanticized in the poem and the reality of serfdom is not included. The text is similar to the later “mercantile romances” and it is a mercantile text responding to the worldview of merchants, who were probably the text’s audience and to whose expectations the plot was adjusted.
