    The aim of the paper is to analyse controversial situations in the Polish judicial practice relating to performing incidental paid activities in times of sick leave, both by the insured – employees and persons not being employees, especially entrepreneurs. According to the Author’s opinion only social activities or incidental and mainly formal occupational activities can be qualified as the exceptions from the rule of the loss of the right to sickness benefit. Such view is justified by the public character and formality of the system of social security. Situations resulting in a possible loss of sickness benefit should be assessed each time in the context of the principle of proportionality.

    W glosowanym orzeczeniu Sąd Najwyższy podniósł, że jeśli spełnione są zarówno przesłanki zwrotu po stronie osoby, która pobrała nienależne świadczenie, jak też pobranie nienależnego świadczenia zostało spowodowane przekazaniem przez płatnika składek bądź inny podmiot nieprawdziwych danych, mających wpływ na prawo do świadczeń lub na ich wysokość (zachodzą więc równocześnie sytuacje przewidziane w art. 84 ust. 1, 2 oraz ust. 6 ustawy z dnia 13 października 1998 r. o systemie ubezpieczeń społecznych), wówczas Zakład Ubezpieczeń Społecznych ma wybór, kogo obciąży obowiązkiem zwrotu. Stanowisko takie budzi wątpliwości.
    : In the commented judgment the Supreme Court held that if the conditions of the recovery of undue benefits are fulfiled by the person who received a benefit unduly (art. 84 [1], [2] of the Act of 13 October 1998 on the social insurance system) as well as by the contribution payer or the other person due to the fact that some false data affecting entitlement to benefits or their amount have been passed by the contribution payer or by the other person (art. 84 [6] of the Act on the social insurance system), then the Polish Social Insurance Institution (ZUS) has the choice of who will charge the obligation to return the benefit. The opinion of the Supreme Court expressed in the commented judgment raises doubts.

    Opis:
    The purpose of this article is to discuss the issue of provision work during the period of sick leave in the context the principle of employee loyalty. On the basis of the doctrine and case law, the author characterized the principle of loyalty to the employee and the fundamental duties of the employee. The author indicates the work during the sick leave as a serious violation of the employee’s fundamental duties. The article discusses the effects of the employee’s use the sick leave contrary to its intended purpose, resulting from the Labour Code and the Act of benefits from social insurance in case of illness and maternity. The author also mentions examples of performing work during a sick leave, which are not constituted as a violation of basic principles to the employer. In conclusions, the author indicates that the principle of employee loyalty towards the employer is the basis of relations between the parties to the employment relation.
    Celem opracowania jest omówienie kwestii świadczenia pracy w okresie zwolnienia lekarskiego w kontekście obowiązku lojalności pracownika wobec pracodawcy. Na podstawie doktryny i orzecznictwa sądowego autorka: charakteryzuje zasadę lojalności pracownika względem pracodawcy w kontekście podstawowych obowiązków pracownika względem pracodawcy; wskazuje na świadczenie pracy w okresie zwolnienia lekarskiego jako ciężkie naruszenie podstawowych obowiązków pracownika względem pracodawcy; omawia skutki wykorzystywania przez pracownika zwolnienia lekarskiego niezgodnie z jego przeznaczeniem, wynikające zarówno z przepisów Kodeksu pracy, jak i ustawy o świadczeniach pieniężnych z ubezpieczenia społecznego w razie choroby i macierzyństwa. Autorka wymienia także przykłady wykonywania przez pracownika pracy w trakcie zwolnienia lekarskiego, które nie stanowią naruszenia podstawowych obowiązków wobec pracodawcy. W konkluzjach wskazano, że zasada lojalności pracownika względem pracodawcy stanowi podstawę relacji między stronami stosunku pracy.

    Ubezpieczenie chorobowe wchodzi w skład powszechnego systemu ubezpieczeń społecznych, który stanowi wyraz realizacji obowiązków nakładanych na ustawodawcę w art. 67 Konstytucji RP. Ubezpieczenie chorobowe chroni na wypadek ziszczenia się określonych ryzyk socjalnych. Przedmiot niniejszego opracowania stanowi ryzyko niezdolności do pracy z powodu choroby. Omówiona została kwestia podlegania ubezpieczeniu chorobowemu, która jest przedmiotem regulacji ustawy systemowej (obowiązek i dobrowolność ubezpieczenia). Problematyka przedstawiona w artykule obejmuje kwestie związane z zasiłkiem chorobowym. Poruszony został aspekt tzw. okresu wyczekiwania jako warunku nabycia prawa do tego świadczenia, a także kwesti a utraty prawa do zasiłku w kontekście art. 17 ustawy zasiłkowej.
    Sickness insurance is part of the universal social insurance system, which is an expression of the legislator's implementation of the obligations imposed on the said in art. 67 of the Constitution of the Republic of Poland. Sickness insurance protects against certain social risks. The subject of this study is the risk of work incapacity due to illness. The issue of being subject to sickness insurance, which is the subject of systemic regulation (obligatory and voluntary insurance), is discussed. The issues presented in the article cover matters related to sickness benefit. The aspect of the so-called waiting period as a condition of acquiring the benefit rights, as well as the question of losing the right to benefit in the context of art. 17 of the Benefit Act are examined.

    Celem opracowania jest omówienie obowiązków ubezpieczonych, które wynikają z przepisów związanych z realizacją prawa do zasiłku chorobowego. Problematyka prawa ubezpieczonego do tego zasiłku zwykle przedstawiana jest w ujęciu prawa podmiotowego (opisywane są przesłanki warunkujące nabycie prawa do zasiłku chorobowego), nie zaś w ujęciu obowiązków związanych z kontrolą realizacji tego prawa. W artykule omówione zostały obowiązki ubezpieczonego związane z kontrolą zaświadczenia lekarskiego o czasowej niezdolności do pracy, w podziale na rodzaje tej kontroli. Obowiązki te, jak się wydaje, nie są dla ubezpieczonych nadmierne. Jednakże sam sposób wykonywania kontroli może budzić pewne wątpliwości.
    The aim of the work is a discussion of the legal checks in force regarding insured persons’ obligations, in relation to the right to sickness benefit. Issues of an insured person’s entitlement to sickness benefit are usually discussed with regard to entitlement to the sickness benefit as a legal right throught reference to the conditions needed for eligibility and not with regard to the obligations resulting from checks and controls of this entitlement. In the article discussed are the obligations for an insured person connected with the checking of a doctor’s certifi cate issued for temporary work incapacity, divided into the types of this control. These procedures may not appear excessive in relation to insured parties, yet the manner in which they are executed may raise certain questions and doubts.

    In this position the Polish Sejm declares Article 26, para. 1 of the Act on Fire Protection to be consistent with the constitutional principle of social justice laid down in Article 2 and Article 32 para. 1 of the Constitution. In support of this argument, it was considered that a volunteer firefighter who, in connection with participation in the rescue operations or exercises, has suffered bodily injury and became temporarily unable to work, is entitled to sickness benefit equal to 80% of the base amount, and not – like members of professional firefighting units – up to 100% of the base amount of sickness benefit for an accident at work. Members of VFBs do not practice the profession of firefighter and, therefore, are not entitled to the accident insurance that guarantees 100% reimbursement of lost earnings in the event of an accident at work. In the author’s view, Article 32 para. 3 subpara. 2 of the Act on Fire Protection provides that the municipality is obliged to insure members of the volunteer fire department, therefore on a normative level their insurance is considered as sufficient.

    Background: In the period 1997–2005, the Danish government initiated a series of legislative changes aimed at facilitating RTW (return to work) in the Danish population. In the present study, we investigated the odds of being gainfully occupied ca. two years after stroke as a function of onset calendar year, 1996–2006. Methods: All previously employed 20–57 year-old stroke patients in Denmark 1996–2006 (N = 19 985) were followed prospectively through national registers. The analysis was controlled for the type of stroke and a series of demographic, structural and occupational variables. Results: The odds for RTW increased significantly during the study period (P < 0.0001). The odds at the end of the period were more than twice as high as they were at the beginning, even after post hoc control for improved survival and decreased unemployment rates. The most conspicuous increase coincided with a change in the sickness benefit act that took place in 2005. Conclusion: The study provides quite strong circumstantial evidence that the legislative changes had an effect on the odds of return to work after stroke. More direct evidence is desirable, but such can only be obtained through a randomized controlled study.
