Opis:
The Four-Year Sejm (diet) was held from October 6th, 1788 to May 29th, 1792 and resulted in significant changes in the composition of parliament, both the Chamber of Deputies and the Senate. To 177 members elected by the regional diets in August 1788 joined 182 new members elected by regional diets in November 1790. Finally, there were 359 deputies. But such number of deputies never worked together because at the time of a single deliberations several members of parliament died, and other were promoted to the senate. In total, during the sessions of the Four-Year Sejm died at least 10 members (8 of the first term and second term of The Sejm), and 15 members (14 first term of the Sejm, including deputy of Bielsko J. K. Ossolinski, whose nomination has been not thoroughly explained, and one during second term of the Sejm) were promoted to the senate. Major changes also occurred in the composition of the senate. During the sessions of the Sejm 38 senator’s seats became vacant. 22 senators died, thus 23 senatorial offices became vacant (two ministries, two bishoprics, 8 provinces (voivodeship) and 11 castellanies). 14 senators resigned from offices (a minister, four voivodes and 9 castellans). A sentence of the Sejm court deprived Grand Treasurer of the Crown of the office. Uniate Metropolitan entered Senate but the resolution of Sejm deprived Field Crown Hetman of the office thereby abolishing offices of the field Hetman. During the Four-Year-Sejm King Stanislaw August nominated 57 senators, including 16 people who were promoted within the Senate. Not all senators joined the confederation. It was joined by 148 senators (including 15 senators who were promoted from among Sejm deputies and accession to the Confederation did as deputies) of a total of 191. Total number of persons entitled to join the Confederacy, including king Stanislaw August Poniatowski was 536 (assuming that Mr Ossoliński, deputy of Bielsko and Castellan of Podlasie Ossoliński is one person). 493 people took advantage of this right: Stanislaw August Poniatowski, all deputies and about 77% of senators.

Opis:
The opinion deals with the exercise of parliamentary oversight functions by Sejm committees. It provides an analysis of whether the representatives of State administration might be held responsible for failure to discharge their duties resulting from Article 157 of the Standing Orders of the Sejm. In the author’s view, Sejm committees have at their disposal the means to enforce only political responsibility. Moreover, as concerns suspension of work on a bill in the event of breach of the obligations specified in Article 157 by the representatives of public administration, the author believes that the legitimacy of such action cannot be assessed in abstracto. The author does not rule out that, depending on circumstances and seriousness of the infringements, suspension of work on a bill may be justified.

The opinion addresses the question of autonomy of a Sejm committee in the situation when a Deputy who is not its member – exercising his/her right to take part in a committee meeting and making motions – puts a motion to recall a member of the presidium (bureau) of that committee. The author gives her opinion, based on her own interpretation of the provisions of the Standing Orders of the Sejm, that such motion should be considered admissible, since there is no legal basis that would make that motion illegitimate.

This article provides an analysis of selected problems regarding the mechanism for convening sessions of the Sejm by its Marshal. The author criticizes the adopted legal solutions, first of all paying attention to the excessive strengthening of the role of the chair- man of the first chamber of parliament in this respect. In his opinion, doubts must be raised by the fact that under the regulations, the right to convene meetings of the Sejm has got only the Marshal, whereas such entities such like parliamentary factions, as well as the President and the government, are formally deprived of it. In addition, he also shows the dilemmas that may arise in the course of applying those provisions in systemic practice. M. in here, he indicates the problem of setting dates of a sitting of the Sejm, inviting guests and the situation when a sitting cannot be convened for objective reasons.
Niniejszy artykuł zawiera analizę wybranych zagadnień związanych z problematyką zwoływania posiedzeń Sejmu przez jego Marszałka. Autor krytykuje w nim przyjęte rozwiązania prawne, zwracając uwagę przede wszystkim na nadmierne wzmocnienie w tym zakresie roli przewodniczącego pierwszej izby parlamentu. Jego zdaniem wątpliwości musi budzić fakt, że na gruncie postanowień regulaminowych prawo do skutecznego zwoływania posiedzeń Sejmu ma jedynie Marszałek, a nie dysponują nim podmioty takie jak frakcje parlamentarne, a także Prezydent i rząd. Obok tego wskazuje on również na dylematy jakie mogą się pojawić w toku stosowania rzeczonych przepisów w praktyce ustrojowej. Sygnalizuje on m. in. tutaj problem ustalania terminu posiedzenia Sejmu, zapraszania gości oraz sytuacji, gdy posiedzenie nie może zostać zwołane z przyczyn obiektywnych.

The specificity of the proceedings in relation to petitions precludes the admissibility of discontinuance of the proceedings regarding consideration of a petition on the basis of appropriate application of Article 105 § 1 of the Code of Administrative Procedure. In case of withdrawal of a petition submitted to the Sejm, the body responsible for its consideration, i.e. the Petitions Committee, should make a decision about the way of proceeding with the petition. Withdrawal of the petition does not prevent its consideration. Given the open catalogue of the ways in which petitions can be proceeded, the Committee should be allowed to adopt a resolution to refuse consideration of the petition because of the applicant’s willingness to withdraw the petition

The author is of the opinion that the loss of the mandate by a Deputy, who has supported the motion to convene a sitting of the committee in accordance with Article 152 para. 2 of the Standing Orders of the Sejm, does not affect the effectiveness of the motion, even if it will result in the number of members supporting the motion (putting their signatures thereupon) being less than 1/3 of the committee membership. An obligation to establish the date and time of the sitting of the committee arises at the time of submission of the properly formulated motion, and should be satisfied immediately. It cannot be accepted that the tardiness in the implementation of the obligation, which arose at the time of submission of the motion, could have an impact on its binding efficiency.

The purpose of the opinion is to examine the possibility of referring the recommendation for election or appointment by the Sejm of individual persons to particular State offices specified in Articles 26, 27–29 of the Standing Orders of the Sejm, or dismissal therefrom, to more than one Sejm committee for their opinion thereto. In the author’s view, a flexible interpretation of Article 30 (5) is possible, as it is implied by the wording of that article which does not state that the recommendation is to be referred to “one” committee, so it does not preclude referring it to a greater number of committees.

In this article the author presents a number of essential issues concerning the endowment of the Church, which the members of the Legislative Sejm worked on. The argument begins by stating that Church possessions were confiscated illegally by the governments of the occupant states. An important deduction is made that the endowment of the Church was closely related to the hotly debated agrarian reform conducted with reference to ecclesiastical possessions. In his dissertation, the author presents opinions of many members of Parliament who insisted on a bill which would improve the material conditions of the clergy. It is worth noticing, however, that what they had in mind was the poor clergy in the eastern borderlands of the Republic of Poland. On the opposing side, the author mentions the point of view of those who were against maintaining the Church by the State. Also presented are the arguments of the supporters of the State maintenance of Catholic clergy. Their main argument was the fact that clergy has always played a major role in Polish history. Clergymen were described as promoters and advocates of Poland. The author of the text juxtaposes the opposing view of the supporters and adversaries of the bill which would regulate the discussed issues. Having investigated the above problems and analyzing them in the context of various issues, the author presents in a brief outline the material situation of Catholic clergy in the first years of the independence of the Second Republic of Poland. Debates and conclusions from the described issues, as well as the opinions of the Sejm members are also presented in the text.

The report, submitted by the Council for the Polish Language, entitled “Language of political information”, contains an analysis of the problem that is narrow in scope. In the light of the current parliamentary practice, the narrow scope of the Council’s reports is typical and this has not been questioned in the course of parliamentary work. The decision of the Culture and Media Committee, resulting in a refusal to consider the document in question, is an expression of negation of the decision of the Marshal of the Sejm to recognize this document as a report. Formally, the committee proceedings on the report had not been completed. The Committee should return to examining this document and complete its work, formulating an appropriate opinion.

The author provides an analysis of the provisions of Article 10a, para. 4 of the Standing Orders of the Sejm in the context of the time period within which it should consider a motion to recall the Marshal of the Sejm. She points out that the opportunity to recall the Marshal of the Sejm is complicated as compared to the election procedure,. The character of the time limit for consideration of the motion to recall the Marshal of the Sejm is not indicative, but mandatory. From an analysis of the concept of ‘the next sitting of the Sejm, it follows that the consideration of the motion and the putting thereof to a vote at the sitting that is “the first one after 7 days of its submission”.

The Sejm’s participation in drafting of the EU law is mainly expressed indirectly, i.e. through the implementation of EU law on a national level. The main role in the process is played by a specialized body of the Sejm: the European Union Affairs Committee. The subject of activity of this Committee is analysing documents drafted by EU institutions. These include, in particular, draft EU legislative acts to be adopted, according to direct treaty basis, directly by the Council and the European Parliament. The Committee uses its competences by means of a legal and factual analysis of documents, both of EU and national origin, related to EU legislation.

The opinion was drawn up in the context of the work of Sejm committees on the Concept for Town and Country Planning 2030 (Paper No. 169). The author finds the occurrence of procedural inconsistency in the conduct of the committee’s procedures and the ineffectiveness of the election of a Deputy‑Rapporteur. She claims that the formal requirements provided in Article 43 (2) of the Standing Orders for the adoption by the committee of a report on a bill (draft resolution) should also be applied to other committee resolutions relating to reports, information or other documents supposed to be discussed by the Sejm, as well as committee desiderata and opinions. The lack of support from the majority of Deputies participating in the vote does not necessarily mean support for the motion to the contrary. Therefore, in the author’s view, the committees have not finished their work on the above‑mentioned draft resolution.

The author presents three different, legally permissible positions concerning the date of the first sitting of the Sejm. The first of them is based on a strict interpretation of the four-year term of office of the Sejm. The second allows it to be extended because of certain constitutional provisions. The third points out, that a four-year term of office does not imply a rigid definition of the starting and ending dates of powers of the Sejm of a current term. In the author’s opinion, tordering of the elections to the Sejm and Senate to be held on 13th October 2019 implies the application of the last concept.

Notification to committee members about a committee sitting (date and agenda) should take place at least three days before the sitting, unless the meeting was convened as a result of decisions taken at the sitting of the Sejm. The discussed rule allows each member of the committee to plan a calendar of activities taking into account all individual responsibilities. The author emphasizes that with Article 152 para. 5 of the Standing Orders of the Sejm causes a few interpretation concerns, what indicates a need of its amendment.

Sponsors of the petition called upon “the Town Council of Z. to consider the petition and to urgently adopt a resolution” with the content indicated therein. The Town Council considered itself not competent to consider the petition and forwarded it to the Sejm. When assessing the competence of the Sejm to consider the petition, it was pointed out that its formal addressee, i.e. the Town Council of Z., should be distinguished from the entity competent to consider the petition. Moreover, it was pointed out that the petition demanded the expression of the position on the policy directions of the Council of Ministers on vaccination against COVID-19, and the members of the Council of Ministers bear political responsibility before the Sejm. Therefore, it was considered that the subject of this petition falls within the tasks and competences of the Sejm.

W nawiązaniu do przedrozbiorowej tradycji, zgodnie z którą sejmy Rzeczpospolitej rozpoczynały się Mszą świętą w kościele i wygłoszonym tam kazaniem, także Polski Sejm Dzielnicowy w Poznaniu w 1918 roku zainaugurowała Msza święta odprawiona przez prymasa Edmunda Dalbora 3 grudnia w farze poznańskiej i kazanie wygłoszone przez jej proboszcza, ks. Antoniego Stychla, wybitnego kapłana oraz działacza narodowego i społecznego. Tekst kazania, liczący w edycji z 2018 roku dziewięć stron, ma dość czytelną strukturę. Składa się z trzech części. Pierwsza poświęcona jest zasadniczo refleksji na temat przyczyn utraty przez Polskę niepodległości, jak też wyrażeniu radości z nadchodzącego wyzwolenia. Druga partia - najdłuższa - ma z jednej strony unaocznić wszystkim, że Polacy cierpieniem wysłużyli sobie u Boga wskrzeszenie ojczyzny, a z drugiej - pokrzepić Polaków w tej radosnej dziejowej chwili, że dzięki długiemu cierpieniu i wytrwaniu są godni wyzwolenia. Trzecia, ostatnia, część poświęcona jest najpierw dziękczynieniu Bogu za to, że położył kres wielowiekowej niewoli, z którym zostaje powiązane wezwanie do pracy nad sobą i pracy dla wspólnego dobra, ażeby w ten sposób naród zasłużył na trwałość wolności i dar pomyślnego rozwoju ojczyzny. Kazanie kończy modlitwa do Boga i swoista „litania narodu” do najważniejszych polskich świętych, którzy mają wyprosić Polakom potrzebne Boże łaski. Kazanie ks. Stychla wpisuje się w wielką i długą tradycję polskiego kaznodziejstwa patriotycznego. Wzoruje się ono przede wszystkim na najwybitniejszych kazaniach sejmowych wielkich kaznodziejów polskich takich jak Hieronim Powodowski czy Piotr Skarga. Podobnie jak oni ks. Stychel uświadamia delegowanym na Polski Sejm Dzielnicowy, jak wielkie zobowiązanie moralne spoczywa na nich wobec tych, którzy walczyli, cierpieli i oddali życie za wolny i sprawiedliwy kraj. Apeluje do ich sumień i serc, ażeby obradując i podejmując uchwały, kierowali się wyłącznie dobrem ogółu. Do nich i do wszystkich Polaków kaznodzieja zwraca się z wezwaniem do wykorzenienia wad narodowych i formowania cnót, przede wszystkim zaś do niezmarnowania daru powracającej niezawisłości.
In accordance with the pre-partition tradition in which the Sejms of the Republic of Poland were inaugurated with the Holy Mass and a sermon delivered in church, the Polish District Sejm in Poznań in 1918 was also commenced in the same manner. The Holy Mass was celebrated by Cardinal Edmund Dalbor, the Primate of Poland, on December 3rd in the Basilica of Our Lady of Perpetual Help, Mary Magdalene and St Stanislaus (Poznań Parish Church) and a sermon was delivered by its parish priest, Rev. Antoni Stychel, an outstanding priest and a national and social activist. The text of the sermon, consisting of 9 pages in the 2018 edition, has a fairly clear structure. It is divided into three parts. The first part is essentially devoted to a reflection on the causes of Poland’s loss of independence and to expressing the joy of the forthcoming liberation. The second longest part aims, on the one hand, to show everyone that Poles, through their suffering, earned with God the resurrection of their homeland, and on the other hand, to enhearten Poles in this joyful historic moment stating that this is thanks to their prolonged anguish and steadfast perseverance that they are worthy of deliverance. The last third part is devoted to offering thanksgiving to God for putting an end to the centuries-old bondage, which is tied with a call to work on oneself and work for the common good so that the nation could deserve the durability of freedom and the gift of the successful development of the motherland. The sermon ends with a prayer to God and a specific “litany of the nation” to the most important Polish saints who are to plead with God to shower Poles with His grace. The sermon delivered by Rev. Antoni Stychel inscribes itself into the great and long tradition of Polish patriotic preaching. It is based primarily on the most outstanding Sejm sermons of great Polish preachers such as Hieronim Powodowski or Piotr Skarga. Like them, Rev. Antoni Stychel makes the Polish District Sejm delegates aware of how much moral obligation rests on them towards those who fought, suffered and gave their lives for a free and just country. He appeals to their consciences and hearts to be guided only by the common good when holding sessions and adopting resolutions. The preacher calls on them and all Poles to uproot national flaws, to form virtues and, above all, not to waste the gift of returning independence.

The subject of the amendment was modification of the content of the protocol. The essence of the amendment is to include in the protocol an information on the remark sent to the Marshal of the Sejm by the Deputy Chief of the Chancellery of the Sejm regarding the resumption of voting. In the author’s opinion, the amendment falls within the general framework of the amendment to the protocol set out in the Standing Orders of the Sejm and should be considered by the Sejm in the manner provided for in those provisions.

The author analyzes the normative model derived from the Standing Orders of the Sejm and confronts the theoretical assumptions with parliamentary practice accompanying the procedure for election of the Marshal of the Sejm, based on its similarity to the procedure for recall of the Marshal of the Sejm. He argues that the general principles set out in Chapter 2, “Debates of the Sejm” in Section III of the Standing Orders of the Sejm, should apply to this matter in question. The said provisions do not provide for specific powers that would give the Deputies subject to the motion for the recall of the Marshal of the Sejm the right to speak in the debate in accordance with the rules different from those defining the procedure for taking floor by other speakers. It should be assumed that in the debate on a motion to recall the Marshal of the Sejm the questions in the debate can be responded by their intended addressees, i.e. a person subject to the motion or the designated candidate. There is no specific basis in the Standing Orders that would allow giving a speech by the Deputy subject to the motion when no question has been addressed to him/her during the debate.

Opis:
The entry into force of the Constitution of the Republic of Poland of 2 April 1997 meant the Presidium of the Sejm losing its status of a constitutional body. The justification for adopting such a solution was the conviction of the Constitution creators that there is no need to include in it the contents which lie within the autonomy of the Parliament and which may be regulated in the rules and regulations of the Sejm. However, the deconstitutionalisation of the Presidium of the Sejm gave rise to some doubts when it comes to the interpretation of the constitutional provisions regulating the status of the Marshal of the Sejm. It also fundamentally influenced the process of directing the work of the Sejm. Therefore, it was a significant change in relation to the previous legal status; however, the importance of the said change (in my opinion) was not fully noticed. One of the effects of the deconstitutionalisation of the Presidium was a change in the model of directing the work of the Sejm. A single-person model was introduced in place of the previous collegial manner of decision-making, and as a result the Marshal of the Sejm became the main governing body of the Chamber. After the lapse of over twenty years of adopting such solutions the author is inclined to make an attempt of the assessment of their functioning in the Polish political realities.

The opinion concerns the decision of the Marshal of the Sejm to expel a Deputy from a sitting, taken pursuant to Article. 175 para. 5 of the Standing Orders of the Sejm. In the author’s view, such decision is not final, as the Presidium of the Sejm may quash it, having considered an appeal submitted by the Deputy and – on the other hand – is immediately applicable, because the expelled Deputy is obliged to leave the Chamber and abstain from participating in further deliberations until his/her appeal is considered (or until the end of the session of the Sejm, if the Deputy has not submitted an appeal). Therefore, the expelled member does not have the right to participate in voting. Preventing the Deputy expelled from the sitting from “entering the Chamber with the purpose of voting” is necessary in order to respect Article 176 para. 6 of the Standing Orders of the Sejm.

The Sejm, as a body of legislative power, is not a public administration body within the meaning of the Code of Administrative Procedure. Thus there is no obligation to apply the provisions of this act. The Sejm committees, which are internal organs of the chamber, also have no obligation to do so. They cannot be a party to proceedings before an administrative court. The Code of Administrative Procedure provides for the possibility of referring a complaint to the Sejm or its internal body (committee), but there are no legal provisions regulating the procedure of examining complaints against state authorities other than executive organs.

The subject of the opinion is the answer to the question whether the consent of the Presidium of the Sejm, the Chancellery of the Sejm or a committee of the Sejm is required to use the logo of the Sejm. It flows from the Rules and Regulations of Chancellery of the Sejm and a contract concerning the transfer of copyright, the right to use the logo depends on the nature of an event. In case the event is organised by an external body, a consent of the Chancellery of the Sejm is necessary. Such consent is not required when the logo is to be used in an undertaking organised by a committee of the Sejm. The consent is granted by the Chief of the Chancellery of the Sejm or a person authorised by him.
