For many years author of this paper was dealing with the co-operation with people and properties protection companies as he was performing important functions in Police. After the police career of his, he became an auditor of these entities. He was given an important function of the vice-chairman of the Polish Association for Employers „Security” – Department in Małopolska [pol. - Polski Związek Pracodawców „Ochrona”- Oddział Małopolska]. This paper is an effect of the research programme, managed by the author, which was finished this year. The main objective of the conducted researches, which were both theoretical and empirical was establishing wheter it is possible in Poland to increase the level of usage of the private security sector for providing security. To answer this important question, first we had to determine the curent level of usage of these entities. In the paper one will find detailed data, which are an evaluation of the current level of engagement of these companies in the public security. This evaluation serves to indicate specific solutions that can allow for more effective participation of the private security sector within this socially important mission.

Opis:
This paper presents the characteristics of community care workers, their working conditions and the currently applicable regulations concerning the protection of employees and property in Poland. Services which are presented in the article by performing their assignments influence to some extent public safety. The political transformation that took place in the 1990s led to the privatization of a number of areas in the sphere of security and public order in Poland. The author presents the responsibilities and privileges of qualified security personnel professionals who are bodyguards in Poland and the method by which they acquire their professional qualifications.

In Norwegian legal system the model of employees security is typical and occurs on two levels. Accordingly to first, it’s provides the special employment protection, in the meantime the second guarantees the right to remuneration for illness period, as well as to benefit from the social security. The mentioned matters are governed by the following: the Act on Labour Law of 17 June 2005 and the Act on Benefits of Social Security of 28 February 1997. Both of them are analyzed by Authors. Act on Labour Law regulates the scope of the employment protection and conditions that allows the termination of the employment contract, while the Law on Benefits, provides the social security provisions, specifying the mode and the rules for the granting remuneration/allowances, periods of their payment and the workers entitled. An analysis of the provisions of Norwegian statutory regulations (taking into account the protection of employment contract during the illness) shows the restrictive solutions in this field. However, the employment protection against dismissals during the period of 12 months of illness, is not rigid, whereas the termination during the period of incapacity for work is permitted with applying the general conditions of the termination of employment contract. The special attention must be given to the institution of egenmelding, which must be understood as the specific employee’s entitlement for justified absence at work (due to illness) based on the principle of loyalty of the both parts of employment relationship.

Opis:
The legal system of the Polish state in the first years after regaining independence (the so called “liberation”) was based in its fundamental part on the basic regulations created during the Second Republic. They were adapted to the structure of state machinery typical for that time, in which case the public administration and internal security functions were concentrated in the Ministry of Internal Affairs. In July 1944, in the framework of PKWN, these competences became subordinated to two separate bodies: the ministry of public administration and the ministry of internal security. This resulted in the appearance of conflicts of jurisdiction between the two new departments. The conflicts were aggravated with the entry of these departments into the composition of the Provisional Government of National Unity led by Stanislaw Mikolajczyk’s PSL (Polish Peasant Party). The Ministry of Public Administration was headed by Wladyslaw Kiernik (who was related to the populists), and the Ministry of Public Security was led by Stanisław Radkiewicz, a PPR (Polish Workers’ Party) representative. With the intensification of political conflict between the PSL and leftist political parties, cooperation was becoming increasingly difficult between the two ministries, which eventually almost evolved in the form of open competition. The Ministry of Public Security even sought to dominate this competitive power center and gain control over civilian administration. The Ministry sought to achieve this goal both with through political means and by using the subordinated force structures. These means were an effective tool to exert pressure on the organs of civil administration. Attempts to defend the independence of the institutions subordinated to civil administration, taken by successive ministers of public administration, all failed. The key here was the importance of the special position of the security machinery in the then system of authority, as well as the fact that it was led by a representative of the dominant party in the country, the PPR. Any conflict of interest was therefore destined to be determined in favor of the Ministry of Public Security.
