    Opis:
    This paper focuses on the issue of the different constructions of the law of civil procedure and criminal proceedings in reference to protection of the seal of confession. The analysis includes a review of the basic constitutional condition of the guarantee of the freedom of conscience and religion, as well as the detailed problems concerning the procedural status of clergy of various churches and religious associations within which there is individual confession. Furthermore, the authors also discuss the significant issue of the procedural status of other persons who have consciously or accidentally obtained information relayed to a member of the clergy during confession and the need to regulate their rights and obligations as witnesses in civil and criminal cases.

    Opis:
    The amendment of art. 240 of the Criminal Code, effective as of 13 July 2017, has replaced the previous social obligation (art. 304 of the Code of Criminal Procedure) with the denouncement obligation under criminal law with reference to sex crimes. Expanding the substantive scope of the related obligation has been justified with the need to increase the protection of the victims of such crimes, especially minors and people who are inept due to their mental and physical condition. Recognizing the abovementioned purpose of the amendment as ne-cessary and socially important, it is worth asking the question about the relationship between the obligation under the analyzed legal norm and the freedom of conscience and religion, as guaranteed by the constitution as well as the right to privacy, including the right to discretion related to spiritual life and religious practice. Does the obligation to notify law enforcement authorities refer also to clergy and religious, who have obtained this kind of information while performing religious service? Does this obligation arise even when the victim expressly states during a spiritual conversation that they don’t want the police or prosecutor to be informed and when there are reasons to suspect that a possible notification and its procedural consequences may have an adverse effect on the victim’s psyche? The article will attempt to answer these questions.

    Opis:
    The issue was discussed primarily on the grounds of the legal acts and documents of the Magisterium and the legislation of the Republic of Poland. Additionally, there were presented theological and canonical views, as well as those referring to the doctrine of the Polish law. At first, the theological and canonical aspect of the Sacrament of Penance was presented within the said issue. Then, there were discussed problems relating to the protection of the sanctity of the Sacrament of Penance on the basis of the canon law. With this respect, the essence of the mystery and secrecy of confession was explained in the beginning, then there were shown forms of its infringement. Furthermore, we presented crimes which might be committed in the administration and reception of the Sacrament of Penance and canonical sanctions resulting from such commission. In the context of the presented issue, it was also essential to emphasize the protection of secrecy of confession in the Polish law, particularly on the grounds of the Polish procedural law, mainly with respect to the existing inadmissibility of evidence relating to information received under the seal of confession in the criminal, civil and administrative procedures. The paper also addressed the possibility of taking a legal responsibility before Church Court for violating the seal of confession in the Polish law.

    W niniejszym artykule, wychodząc od pojęcia przestępstwa, rozwinięto zagadnienie bezpośredniego lub pośredniego naruszenia tajemnicy sakramentalnej, o czym mowa w kan. 1388 § 1 KPK/83. Omówione również zostało przestępstwo polegające na nagrywaniu za pomocą jakichkolwiek urządzeń technicznych albo na rozpowszechnianiu w złych zamiarach w środkach społecznego przekazu tego, co zostało powiedziane przez spowiednika lub penitenta w spowiedzi sakramentalnej, prawdziwej lub fałszywej.
    This paper, using the concept of offence as a starting point, elaborates on the issue of direct or indirect violation of the sacramental seal, as referred to in can. 1388 § 1 CIC/83. The author also discusses an offence consisting in the recording with any technical device or dissemination to the media of what was communicated by a confessor or penitent in a sacramental confession, real or false, with malicious intent.

Jednocześnie sprecyzowano te prawa i obowiązki, które mają szczególny związek z ogólnym statusem osoby duchownej, mając na uwadze możliwość odpowiedniego stosowania procedury karnej uregulowanej aktem normatywnym rangi ustawowej, z uwagi na konstytucyjną i międzynarodową zasadę poszanowania autonomii i niezależności Kościoła i państwa każdego w swoim zakresie.
    This article aims to present an overview of the current rights and obligations of religious ministers in cases when they are the injured party in ordinary criminal proceedings. First, the concepts of the injured party and religious minister are explained. The main part of the study deals with the rights and obligations that are connected with the general status of the religious minister. Special attention is devoted to the possibility of applying the statutory rules of criminal proceedings, taking into account the constitutional and international principle of respect for the autonomy and independence of the Church and the state in their own spheres.
