Opis:
L’incidenza di psicosi maniaco-depressiva sul difetto di discrezione di giudizio alla luce della sentenza coram Turnaturi del 28 febbraio 1998. Il can. 1095, primo tra i vizi del consenso matrimoniale, riguarda l’incapacità proveniente dalle mancanze d’inteletto e di volontà. Come causa di questa incapacità, in presente articolo, viene segnata la psicosi maniaco- epressiva. Questa psicosi di carattere bipolare, cioè di presenza di due episodi diversi, quello maniacale e quello depressivo, viene considerata sotto l’aspetto che riguarda la sua incidenza sull’incapacità descritta nel can. 1095, 2° CIC.L’analisi fatta, in particolare quella che riguarda la sentenza coram Turnaturi del 28 febbraio 1998 ci permette di formulare una conclusione che la psicosi maniaco-depressiva è la causa dell’incapacità consensuale di cui parla il can. 1095 per quanto riguarda la mancanza del discrezione di giudizio. Questo succede nei casi di mania e di depressione grave, i quali sono presenti nel soggetto prima di compiere l’atto di matrimonio.Bisogna sottolineare che è sempre il compito del giudice di esaminare gli atti della causa e di decidere se in ogni singolo caso la psicosi è stata così grave da impedire il valido consenso matrimoniale. Per prendere ogni decisione il giudice usa le prove tra cui quella periziale, fondamentale, accanto alle dichiarazioni delle parti e dei testi, per provare l’influsso della psicosi  aniaco-depressiva sull’incapacità consensuale del nubente.

This decision refers to a marriage contracted between Bernard and Martyna on 11 October 1969 (in Paris), which lasted for about ten years and then, on 21 January 1983 the man applied to the tribunal in Paris for annulment of the marriage due to his defectus discretionis iudicii and wife’s incapacitas assumendi. On 15 January 1987 the tribunal issued the pro nullitate decision only for the latter reason. After the appeal of the defender of the matrimonial tie to the tribunal of the second instance (in Versailles), on 17 May 1989 a negative decision for the appealed reason (Martyna’s incapacitas assumendi) was issued. After that Bernard appealed to the Roman Rota and on 24 April 1991 c. Lanversin bench proceeded to trial for three reasons for annulment of the marriage: 1) the respondent’s incapacitas assumendi (examined in the third instance); 2) the petitioner’s defectus discretionis iudicii (examined in the second instance); 3) the petitioner’s gravis metus reverentialis (added reason and examined in the first instance). On 19 January 1994 the Negative ad omnia decision was issued.

The negative sentence c. Salvatori in the case under the gravis defectus discretionis iudicii (can. 1095, n. 2 CIC) on both sides, taken in the second instance, when the first ruled positively in relation to both parties, is an example of a reliable assessment of the collected material evidence. In the sentence, quite a lot of space was devoted to the role and tasks of an expert in the cases of can. 1095, n. 1-3 CIC. It is worth emphasizing here that an opinion prepared solely on the basis of the case file is not a true expert opinion. Salvatori pointed to the practice developed in rotational jurisprudence, according to which a judge should reject an expert’s conclusions when they do not comply with the case files or violate the rules of logic or go beyond the premises on which they are based, or when they are inconsistent with Christian anthropology. Ponens convincingly demonstrated the groundlessness of prof. D. (with respect to the woman) grossly inconsistent with the case files and going far beyond the premises that served him to formulate such a thesis.

Opis:
The sentence of the Roman Rota, c. Caberletti, concerns the marriage of a 34-year-old man, which was concluded in a certain haste. Therefore, from the very beginning the parties lived side by side, and after less than two years they broke up. The immediate reason for the claimant's departure was the defendant's infertility. The case for nullity was initiated by a man pointing to two grounds of nullity: a mistake as to the attribute of a woman intended directly and principally (can. 1097 § 2 CIC) and the exclusion of the indissolubility of marriage by the woman (can. 1101 § 2 CIC). After the handing down (in 2006) of a negative verdict on both headings, the man resigned from the appeal. However, wishing to regulate his civil status, after eight years (in 2014) he applied for the nullity of his marriage to another Tribunal – this time due to a grave defect of discretion of judgment the essential matrimonial tights and duties mutually to be handed over and accepted (can. 1095, n. 2 CIC). Two years later, nullity of the marriage had not been ruled, and the man appealed against it to the Roman Rota, where a positive decision was made. The opinion of an expert in a rotating instance played a significant role in the positive outcome of the case.

The author presents and comments on the Rotal decision (negative) issued in the second instance after appealing against the decision (positive) issued in the first instance (by one-man tribunal) by the respondent due to a serious lack of the evaluative analysis of both parties. The Rotal judge, after a thorough interpretation of the code-based expression discretio iudicii (including three elements), emphasizes that not always the lack of such analysis constitutes inability to come to a marital agreement. This inability shall constitute exclusively the serious lack of discretio iudicii, both in its internal and external aspects.

This case concerns a marriage concluded on 13 June 1987 in St. Nichola’s Church San Gemini in Interamnen.-Narnien.-Amerinae diocese, between a 37-years-old Paulus and 27-years-old Maria, who split up several years later.On 22 December 2009 Paulus launched an action for annulment of his marriage before the Tribunal of First Instance, providing exclusion of the indissolubility of marriage and later also lack of discretion of judgement on his side as reasons. On 28 October 2011, the Tribunal passed a pro vincula sentence in both reasons for annulment and the complainant immediately appealed to the Roman Rota.Turnus of the Rota c. Erlebach heard the case in the second instance and, on 21 July 2016, issued a decree of nullity of marriage because of both reasons. When it comes to the lack of discretion of judgement, the complainant’s lack of internal freedom (pathological jealousy and constant fear as well as dependence on his mother) has been observed. When proving the exclusion of the inseparability of marriage, the Tribunal drew attention both to the complainant’s testimony (judicial and non-judicial ones) as well as reasons for simulation and circumstances. The extensive sentences c. Erlebach is of great significance since it indicates the compatibility of two of the above mentioned reasons for nullity: defectus discretionis iudicii and simulatio consensus.

Presented sentence of the Tribunal of the Rota of the Apostolic Nunciature in Spain adjudicate definitely in II instance adjudication nulitatis matrimonii by virtue of grave defect of discretion of judgment concerning by both parties (can. 1101 § 2 CCL) and lack of the freedom internal also by both parties (can. 1095 n 2 CCL). The question which was considering concerned matrimony which was got in 15.03.1972. The libellus was lodged in 26.04.1996. Tribunal I instance in sentence of 15.11.2000 declared that there was no proved the nullity of the marriage. The petitioner lodged appeal to the Rote of the Spain. In 09.07.2009 the Rote declared the validity of the marriage.
