The article presents the case of Dr. Aleck Bourne, which the author proposes to include in the catalog of borderline cases constituting the basis for in-depth discussions on ethical and legal aspects of human life with regard to the development of biology and medicine. The starting point is the presentation of the worldwide models for regulating the practice of abortion as well as the Polish regulation, together with a discussion on the role of the Constitutional Tribunal in shaping current legal provisions. The author notes that the interpretation of the right to life adopted by the Tribunal encourages the repeal of the indication model and the introduction of a complete ban on abortion, which will have significant consequences for ordinary legislation. Apart from describing the facts in the Bourne case, the strategy adopted by the defense and the sentence itself, the possible further areas of considerations regarding the limits of permissibility of termination of pregnancy have been signaled. Then, the conclusions resulting from legal analysis of the case were transferred to the exegesis of the constitutional principles of the right to life and the right to healthcare. Their constitutional form, interpretation resulting from the rulings of the Constitutional Tribunal and the ordinary legislation have been presented. The author indicates the main terminological deficiencies identified in this respect: the lack of any definition of the beginning of a human being, the existence of two separate criteria for determining death, which could lead to different results and the lack of an unambiguous definition of disease adopted by the legislator. Based on the concepts presented in the case, the right to healthcare has been defined as a legal right resulting from the right to life. The final thesis is that there are no grounds for hierarchizing these rights, as they are intertwined in content and function.

The euthanasia is a quite old phenomenon. This phenomenon could be met in the ancient cultures of the ancient world. Today, the euthanasia has been legalized in many European countries and also among others in Canada. In addition, the moral assessment of euthanasia changed, what raises far-reaching doctrinal, political and social divisions. The euthanasia itself is not a unequivocal phenomenon because in practice it is difficult to distinguish and evaluate many phenomena similar to euthanasia. This makes that the legal solutions resonate many doubts and even denial. Together with the development of medicine, it becomes possible to define the biological barriers of life and death. The study is to present different recently conducted disputes on the phenomenon of euthanasia.
Eutanazja jest zjawiskiem dość dawnym. Można z nim spotkać się w dawnych kulturach antycznego świata. Współcześnie eutanazja została zalegalizowana w wielu krajach europejskich, a także m.in. w Kanadzie. Zmieniła się również ocena moralna eutanazji, co budzi daleko idące podziały doktrynalne, polityczne i społeczne. Sama eutanazja nie jest też zjawiskiem jednoznacznym, gdyż w praktyce trudno jest odróż- nić i ocenić wiele zjawisk podobnych do niej. To sprawia, że rozwiązania prawne budzą wiele wątpliwości czy nawet negacji. W miarę rozwoju medycyny coraz bardziej staje się możliwe zdefiniowanie biologicznej bariery życia i śmierci. Przedmiotem opracowania jest przedstawienie różnych współcześnie prowadzonych sporów nad zjawiskiem eutanazji.

The authors analyse the 2021 ruling by the Polish Supreme Court, which refused to acknowledge the right to live in a clean environment as a personal interest. The purpose of the paper is not only to evaluate the quality of the Supreme Court’s argumentation, but also to highlight the implicit premises that were missing from the grounds of the decision. Based on these findings, the authors draw broader conclusions about the circumstances that increase the likelihood of pro-environmental (including pro-climate) court decisions and breakthroughs in interpretation. The authors use the latter term to describe the situation of challenging the previous, widely accepted interpretation of certain legal provisions, favouring a different interpretation that considers societal changes in values and beliefs. The authors evaluate the Supreme Court’s arguments and put forward the thesis that the construction of personal interests was not the primary reason for rejecting the recognition of the right to live in a clean environment as a new personal interest. The authors used two methods to search for the hidden premises of the Supreme Court’s resolution: (i) they examined the discourse supporting the rejection of the right to live in a clean environment as a personal interest, and (ii) they placed the resolution in its socio-political context. The authors identify four conditions that increase the likelihood of pro-environmental (and pro-climate) court judgments: (i) the condition of costs’ expediency, (ii) the condition of individualization of responsibility, (iii) the condition of respect for the judiciary and (iv) the condition of public support. The last two conditions apply to interpretative breakthroughs in general, regardless of the subject matter.
