Opis:: Indian Reservations have suffered from high crash rates that lead to fatal and incapacitating injuries for years. Among numerous issues, resource gap, rustic nature of the reservations, cross jurisdictional issues, and scarce crash data, act as obstacles in an effort to reduce the number of these fatal and serious crashes. Numerous organizations have recognized the importance of addressing issues on Indian reservations and improving roadway safety. Wyoming Technology Transfer Center / Local Technical Assistance Program (WYT2/LTAP) center developed a safety toolkit for tribal communities to ascertain high-risk crash locations and determine the low-cost safety improvement countermeasures. This safety toolkit acts as a guideline providing information, field examples, and resources in key topic areas to improve roadway safety through the use of the five-step methodology from Wyoming Rural Road Safety Program. These steps included compiling and crash data analysis, level I field evaluation, combined ranking, level II field evaluation, and benefit-cost analysis. In this study, the safety toolkit was implemented on the Fort Peck Indian Reservation (FPIR), Montana, to provide the tribes with a real-life example. This study reveals that low-cost safety countermeasures have significant impacts in reducing the number of fatal and serious injury crashes on the FPIR. This methodology with slight modification can be applied to other Indian reservations or similar entities to improve roadway safety.

Opis:: There are abundant methods to mitigate PAPR in OFDM signals among which algorithm based tone reservation is of great popularity owing to its low complexity as well as decent BER. Here we have put forward a new distinct algorithm based Tone Reservation technique which is not only less complex and calculates its own threshold as well as PRT signal (unlike other algorithms requiring predetermined threshold and PRT) but also aptly modifies the data by bit by bit comparison with a modified copy of itself (algorithm modified) thus scaling the peaks as and providing a decent BER and good PAPR reduction.

Opis:: We consider the downlink of an orthogonal frequency division multiplexing (OFDM) based cell that accommodates calls from different service-classes with different resource requirements. We assume that calls arrive in the cell according to a quasi-random process, i.e., calls are generated by a finite number of sources. To calculate the most important performance metrics in this OFDM-based cell, i.e., congestion probabilities and resource utilization, we model it as a multirate loss model, show that the steady-state probabilities have a product form solution (PFS) and propose recursive formulas which reduce the complexity of the calculations. In addition, we study the bandwidth reservation (BR) policy which can be used in order to reserve subcarriers in favor of calls with high subcarrier requirements. The existence of the BR policy destroys the PFS of the steady-state probabilities. However, it is shown that there are recursive formulas for the determination of the various performance measures. The accuracy of the proposed formulas is verified via simulation and found to be satisfactory.

Opis:: This article provides a comparative analysis of gender gaps in observable and reservation wages. The analysis shows that women are able to accept lower wages than men before entering the labour market. Men’s and wom-en’s differences in observable characteristics are not at all sufficient to ex-plain the gaps both in observable and reservation wages. The article thus concludes that the prevalence of gender wage gap may be a result of wom-en’s lower self-valuation and not necessarily labour market discrimination against women.

Opis:: In this note we provide a statistical interpretation of the Marshallian market demand curve of a commodity that obeys the law of demand and which has a finite and positive level of satiation. A consequence of our approach is that in the context of two goods, we are able to obtain demand functions which are very similar to those obtained by “budget-constrained Cobb–Douglas utility maximization”, but now as a result of a “budget-constrained linear utility maximization” exercise, although our budget constraint is “slightly different” from the one that would be used for the former optimization problem.

Opis:: In this paper, a multirate loss model for the calculation of time and call congestion probabilities in a Wideband Code Division Multiple Access (W-CDMA) cell is considered. It utilizes the Bandwidth Reservation (BR) policy and supports calls generated by an infinite or finite number of users. The BR policy achieves QoS equalization by equalizing congestion probabilities among calls of dierent service-classes. In the proposed models a multiple access interference is considered, and the notion of local blocking, user's activity and interference cancelation. Although the analysis of the proposed models reveals that the steady state probabilities do not have a product form solution, the authors show that the calculation of time and call congestion probabilities can be based on approximate but recursive formulas, whose accuracy is verified through simulation and found to be quite satisfactory.

W artykule przedstawiono analizę ram prawnych funkcjonowania CRS i ewolucje Systemu.
An important share of airlines reservation is made through Computerised Reservation Systems (CRS). Such systems provide an important and useful service to air carriers and travel agents, but first of all to passengers by affording an easy access to information on flights, fares and available seats. Market development in the 70's and the 80's contributed to a broad exploitation of this system and that involved the necessity of defining the legal framework of its functioning. This article presents the analysis of legal framework of CRS' functioning and the evolution of the system.

Opis:: This paper proposes multirate teletraffic loss models of a link that accommodates different service-classes of elastic and adaptive calls. Calls follow a Poisson process, can tolerate bandwidth compression and have an exponentially distributed service time. When bandwidth compression occurs, the service time of new and in-service elastic calls increases. Adaptive calls do not alter their service time. All calls compete for the available link bandwidth under the combination of the Threshold (TH) and the Bandwidth Reservation (BR) policies. The TH policy can provide different QoS among service-classes by limiting the number of calls of a service-class up to a predefined threshold, which can be different for each service-class. The BR policy reserves part of the available link bandwidth to benefit calls of high bandwidth requirements. The analysis of the proposed models is based on approximate but recursive formulas, whereby authors determine call blocking probabilities and link utilization. The accuracy of the proposed formulas is verified through simulation and found to be very satisfactory.

Opis:: Unemployment benefits are benefits paid during the job search. The impact of these benefits on the labour market is not clear. It is often stated in the literature that one of the basic channels of impact of unemployment benefits on the labour market is based on the reservation wage. This paper attempts to answer the question whether the reservation wages in Poland are changing under the influence of unemployment benefits. The survey was conducted based on individual data from the Polish Labour Force Survey (BAEL). The results confirm the influence of the benefits system, both on the reservation wages and on the wages obtained after the job search. Unemployment benefits in Poland raise the average reservation wages for job seekers, and this effect persists even after the end of the benefit period. Job seekers who receive unemployment benefits obtain slightly higher wages than other unemployed.

Opis:: The Elastic Optical Networks (EON) provide a solution to the massive demand for connections and extremely high data traffic with the Routing Modulation and Spectrum Assignment (RMSA) as a challenge. In previous RMSA research, there was a high blocking probability because the route to be passed by the K-SP method with a deep neural network approach used the First Fit policy, and the modulation problem was solved with Modulation Format Identification (MFI) or BPSK using Deep Reinforcement Learning. The issue might be apparent in spectrum assignment because of the influence of Advanced Reservation (AR) and Resource Periodic Arrangement (RPA), which is a decision block on a connection request path with both idle and active data traffic. The study’s limitation begins with determining the modulation of m = 1 and m = 4, followed by the placement of frequencies, namely 13 with a combination of standard block frequencies 41224–24412, so that the simulation results are less than 0.0199, due to the combination of block frequency slices with spectrum allocation rule techniques.

Opis:: Over the past few years, a significant increase in network traffic volumes has been observed. The ever growing bandwidth demands mean that a reliable and optimum service level needs to be ensured in communication systems for specific traffic categories. Optimal allocation and use of resources may be achieved through the use of call admission control (CAC) mechanisms implemented in network systems. The resource reservation mechanism and the threshold mechanism are two of the most popular CAC methods. In the reservation mechanisms, a certain number of resources is reserved for selected (predefined) services only. In the case of threshold mechanisms, the number of resources allocated to individual traffic classes depends on the network load. This article discusses the results of simulations verifying the impact of applied CAC mechanisms on the traffic characteristics in elastic optical network (EON) nodes with a Clos structure. Loss probability results obtained with the use of the simulator are presented as well.

Opis:: Finding a reserved seat on long-distance train travel is supported by aids on platforms and within the train in order to keep the passenger’s journey as short as possible and to minimise unnecessary walking within the train. The allocation of a seat to a carriage number on the reservation and the consideration of the carriage position indicator devices on the platform provide the opportunity to wait for the arrival of the train on a section of the platform that is close to the reserved seat. Nevertheless, there are various situations in reality in which this can only be achieved to a limited extent. Varying carriage order, the provision of a replacement train or tight transfer connection can lead to the train being entered at an unfavourable position. This is followed by the passenger trying to find a seat on the train which can amount to considerable traffic. Equipped with a flexible seat reservation procedure, this kind of traffic could be drastically reduced. The solution provides the opportunity to reallocate reserved seats in order to minimize the way a passenger has to walk inside the train to his seat. By means of microscopic simulations, various boarding scenarios demonstrate the effectiveness of this approach. Less passenger movement on the train results in an increase in passenger comfort and reduces the space that is required for such movement, which could instead be used for other purposes. On the platform, this procedure means that passengers no longer need to wait for the arrival of the train at a location that is closest to the allocated seat. Instead, passengers can choose a place on the platform convenient to them, without this having a disruptive effect on system performance.

The article presents the results of research which main aim was to determine and compare the Mincer-wage type models for group of polish academics in public universities. The data used for the analysis came from a national survey carried out in the spring of 2012. Compared models were related to salary actually received and the reservation wage for the hypothetical contract with no extra work condition.

Opis:: Artykuł poświęcony jest analizie wybranych utworów literackich Shermana Alexie. W jego utworach proces redefiniowania pojęcia „domu” można przedstawić metaforycznie jako proces przekraczania granic rezerwatu. We wczesnej prozie Alexiego rezerwat to przestrzeń będąca jednocześnie domem i „więzieniem”, odseparowującym ludność indiańską od białej Ameryki. Natomiast utwory publikowane od roku 2000 dokumentują już istotną zmianę w tematyce twórczości pisarza. Podejmowane w nich tematy to przede wszystkim miejskie doświadczenie współczesnych, zasymilowanych Indian, poszukiwanie tożsamości i nowe określenie własnego miejsca w Ameryce. Doświadczenie wielokulturowej Ameryki prowadzi do kwestionowania własnej tożsamości przez bohaterów indiańskich i tym samym prowokuje pytania o „indiańskość” w XXI wieku. Słabnące (w późniejszej twórczości) zainteresowanie Alexiego problematyką rezerwatu można traktować symbolicznie jako początek procesu przekraczania granic, odrzucania kolonialnej idei rezerwatu jako ograniczającej wolność i rozwój kultur indiańskich. Alexie przedstawia wielokulturową, miejską Amerykę jako dom dla zasymilowanej, panindiańskiej społeczności, tym samym poszerzając granice swego powieściowego świata. Kwestionując rasowe, klasowe i kulturowe podziały we współczesnych społeczeństwach, Alexie wzywa do globalnej solidarności, niezbędnej dla przetrwania i rozwoju ludzkości.
The article analyzes the theme of transcending borders in the selected works by Sherman Alexie. In my analysis the borders are understood literally, as geopolitical constructs, as well as symbolically, as social, cultural, and racial lines that separate individuals, communities, and nations. It is in the presence of these borders that individuals’ world-view and self-perception are formed. The process of transcending the real and metaphorical reservation borders observable in Alexie’s work reflects his gradual distancing from Indian-centric and racially charged themes. Explored extensively in his early writing, the reservation represents Indian homeland, and is portrayed as a place which, although embraced as home by his Indian characters, entails also geographical and mental confinement. Yet Alexie’s post-2000 work demonstrates that he has expanded the borders of his fictional world. This change is manifested in the author’s progressive detachment from the reservation-centered themes, and his growing interest in the multiethnic American setting. Accordingly, his recent work centers on “a mental and emotional landscape” of human relations in American society.

Celem niniejszego artykułu jest przeprowadzenie analizy w sprawie możliwości za-stosowania wykładni, zgodnie z którą opłaty za rezerwację częstotliwości powinny być wnoszone dopiero od momentu, gdy częstotliwość faktycznie będzie mogła być wykorzystywana przez ope-ratora multipleksu do rozpowszechniania programów oraz ocena zgodności rozwiązania przyję-tego w przepisach o wnoszeniu opłat za częstotliwości z Konstytucją na wypadek negatywnych wyników takiej wykładni.
The commencement of the dissemination of TV programmes in a multiplex is conditional upon: fi rst, obtaining a reservation of frequencies by a multiplex operator and second, obtaining licenses to broadcast by the broadcasters. The purpose of this article is to analyze the possibility of supporting an interpretation whereby the fees for the reservation of frequencies should only be paid by the multiplex operator starting from the time when the frequencies could actually be used by that multiplex operator to distribute programmes. The Article aims also to assess, in the event of disproving the above interpretation, the conformity of the solutions adopted in the provisions on frequencies’ reservation fees with the Polish Constitution.

Opis:: Pojęcie płacy progowej różni się zarówno koncepcyjnie, jak i empirycznie od kategorii oczekiwań płacowych. Celem artykułu jest przedstawienie metody oceny adekwatności obu typów oczekiwań dotyczących płac osób, które nie pracują. Metoda ta jest użyta do zweryfikowania hipotezy o adekwatności płac progowych i oczekiwań płacowych bezrobotnych w Polsce. W artykule przeanalizowano, w jakim stopniu płace progowe oraz oczekiwania płacowe osób bezrobotnych są uzasadnione rynkową wyceną pracy osób o identycznych charakterystykach. W analizie wykorzystane zostały dane o oczekiwaniach płacowych (ankieta Narodowego Banku Polskiego) oraz płacach progowych (Badania Aktywności Ekonomicznej Ludności). Do oceny adekwatności oczekiwań płacowych użyto metod parametrycznych i nieparametrycznych umożliwiających porównanie rozkładów płac progowych, oczekiwań płacowych oraz skonstruowanych płac kontrfaktycznych. Wyniki analizy wskazują, że płace oczekiwane pozostają wyższe od płac progowych oraz są dodatnio skorelowane z presją płacową w gospodarce. Ponadto wyniki potwierdzają hipotezę, że oczekiwania płacowe osób bezrobotnych w Polsce w latach 2011–2014 nie były nadmierne. Wynik ten jest ważny, gdyż w przypadku, gdy oczekiwania płacowe osób bezrobotnych są wyższe niż ich wycena rynkowa, stanowi to źródło zjawiska bezrobocia i współwystępującej presji płacowej.
Reservation wages and expected wages constitute different categories, both conceptually and empirically. The aim of this article is the construction of a method for inferring the adequacy of both kinds of wage expectations among persons who are not employed. This method is used to verify the hypothesis about the adequacy of reservation wages and expected wages among the unemployed in Poland. The key element of the analysis in this study is to what extent the reservation wages and wage expectations of the unemployed are in alignment with market conditions. We exploit a unique source of data on expected wages (National Bank of Poland survey) as well as data on reservation wages (Labour Force Survey) and develop a series of parametric and non-parametric counterfactual distributions for the registered unemployed. Our results indicate that expected wages are higher than reservation wages and continue to be positively correlated with wage pressure. We find that reservation wages in Poland from 2011 to 2014 were not excessive. This is important because if the wage expectations of the unemployed are in excess of market evaluation, unemployment and wage pressures prevail.

Opis:: Ubogie domostwa, rozsiane po pustkowiu przyczepy zamieszkane przez zdegenerowanych ludzi, pokryte kurzem drogi, po których poruszają się zdezelowane samochody – pejzaż indiańskiego rezerwatu we współczesnej kulturze audiowizualnej naznaczony jest świadectwami upadku. Równocześnie jednak przestrzeń, w której tak wyraziście manifestują się liczne problemy społeczne, na czele z alkoholizmem oraz bezrobociem, stanowi część dyskursów dotyczących marginalizacji, nietolerancji, alienacji i społecznej stygmatyzacji. Filmowy i komiksowy pejzaż „rezu” stanowi krzywe zwierciadło oficjalnej amerykańskiej kultury, symbolizowanej przez Mount Rushmore, w której cieniu kryje się rezerwat plemienia Lakota w Pine Ridge. Analizując wybrane przykłady filmowe oraz komiksowe, autorka ukazuje różne aspekty symboliki i kulturowych kontekstów „rezu”. Z jednej strony – w filmach takich jak Skins Chrisa Eyre’a lub Za głosem serca Michaela Apteda oraz w komiksowej serii Skalp Jasona Aarona i R.M. Guéry – mamy do czynienia z wizją rezerwatu stanowiącego krajobraz nieomalże apokaliptyczny, utożsamiający ciemną stronę Ameryki; z drugiej – w realizacjach pokroju Sygnałów dymnych Eyre’a czy Piętna przodków Michaela Linna – rezerwat jawi się jako przestrzeń mityczna, obszar kontaktu ze wcześniejszymi pokoleniami.
Poor houses, trailers scattered in wilderness, inhabited by degenerated people, dusty roads full of old cars – the landscape of Indian reservation in contemporary audiovisual culture is marked with symptoms of degradation. In the same time, places where social problems – especially alcoholism and unemployment – have been so vividly manifested, become a part of various discourses of marginalization, intolerance, alienation and social stigmatization. “Rez’s” landscape in film and comic books becomes a dark mirror for the official American culture symbolized by Mount Rushmore, in whose shadow lies the Lakota Pine Ridge reservation. In her analysis of selected films and comic books, theauthor shows different aspects of rez’s symbols and cultural contexts. In such films as Chris Eyre’s Skins or Michael Apted’s Thunderheart and Jason Aaron and R.M. Guéra’s comic book series Scalped, Indian reservation is shown almost as an apocalyptic territory and – in the same time – as a dark side of America. On the other hand, in Eyre’s Smoke Signals or Michael Linn’s Imprint, rez is a mythic place of cross-generation encounters.

Opis:: The main focus of the paper is the protest against the construction of the Dakota Access Pipeline (DAPL) near Standing Rock Indian Reservation in North Dakota in 2016. The strategies employed by the opponents and supporters of the project are analyzed in the wider context of the relations between the US federal government and Native American nations. Counter-terrorism rhetoric, methods, and measures used in the process of pacification of that fundamentally peaceful protest is not only an example of how the US government deals with its citizens’ resistance but also sheds more light on the current, unfavorable situation and status of Native Americans in contemporary America.
W artykule przedstawiono wydarzenia związane z protestem przeciwko budowie rurociągu Dakota Access Pipeline (DAPL) w okolicach rezerwatu Standing Rock w Dakocie Północnej w 2016 r. Taktyki stosowane przez przeciwników i zwolenników projektu są analizowane w kontekście polityki rządu amerykańskiego w stosunku do rdzennych mieszkańców Stanów Zjednoczonych. Użycie retoryki, praktyk i środków z zakresu obrony antyterrorystycznej w celu pacyfikacji z założenia pokojowego protestu jest nie tylko przykładem reakcji rządu amerykańskiego na problematyczne działania własnych obywateli, ale również rzuca więcej światła na status i faktyczną niekorzystną sytuację Indian we współczesnej Ameryce

Opis:: Subject and purpose of work: The article presents the diversity of the use of EU funds for tourism in Poland in the region of Eastern Poland in the years 2014–2020. The focus was on indicating the regional differentiation of the size and type structure of projects. Materials and methods: The information base was data on projects co-financed from EU funds, collected in the National Information System (KSI SIMIK 2014-2020). Results: In all voivodships, both in terms of the number of projects and their values, projects in the field of culture (cultural heritage, cultural institutions, cultural events) definitely dominated. They constituted over 50% of the total number of all projects and 65% of their total value. Conclusions: In the years 2014-2020 tourism was included in the Regional Operational Programs indirectly, which impacted on the nature of implemented projects. Between them dominated projects related to the modernization and preservation of tourism resources, especially cultural projects.

Opis:: In accordance with the current wording of Article 162 of Code of Civil Procedure, the parties represented by professional proxies are, as a rule, obliged to raise objections that are recorded to the minutes in order to note the court’s observed procedural deficiencies - on pain of losing the right to invoke these deficiencies at a later date. This rigour applies even if subsequently a party terminates or withdraws the power of attorney. The article analyses the institution of Article 162 of the Civil Procedure Code in both its new and previous form. It was pointed out that the current content of Article 162 of the Code of Civil Procedure may give way to a number of doubts concerning interpretation, since the objections raised by the parties acting independently in the civil case are treated differently then those represented by proxies. In the article it was stated that there is a need to consider introducing certain legislative changes - in order to mitigate the excessive rigour of the current provisions.
Zgodnie z obecnym brzmieniem art. 162 k.p.c. strony reprezentowane przez profesjonalnych pełnomocników co do zasady mają obowiązek zgłaszania zastrzeżeń do protokołu celem odnotowania dostrzeżonych uchybień procesowych sądu – pod rygorem utraty prawa powoływania się na te uchybienia w czasie późniejszym. Owy rygor stosowany jest nawet jeśli następczo strona wypowie lub cofnie pełnomocnictwo. W artykule analizie poddano instytucję art. 162 k.p.c. zarówno w nowym, jak i w poprzednim kształcie. Zwrócono uwagę, iż aktualna treść art. 162 k.p.c. może budzić szereg wątpliwości interpretacyjnych, skoro odmiennie traktuje się zgłaszanie zastrzeżeń przez strony występujące w procesie samodzielnie w odróżnieniu od tych, które są reprezentowane przez zawodowych pełnomocników. W artykule zaakcentowano potrzebę wprowadzenia określonych zmian legislacyjnych – celem łagodzenia nadmiernego rygoryzmu tej regulacji.

Opis:: In this article we present an analysis of implementations of a chatbot - a program which simulates an intelligent conversation with webpage visitors, dedicated to hotels and guesthouses (hotel chatbot, in short: HC). We obtained unique data from five various webpages exhibiting various configurations, containing a total of 17413 user statements in 4165 conversations. HC informative function was confirmed for more than 56% of the conversations. Moreover, 63% of users prefer to interact with HC if it suggests at least one clickable option to choose as an alternative to typing. The results indicate that the implementation of speech synthesis increases the percentage of users who decide to start a conversation with the HC and it may have a positive impact on the percentage of users that book rooms online.

Opis:: Temat dotyczy problematyki istotnej zarówno z teoretycznego jak i praktycznego punktu widzenia. Problema-tyka tematu dotyczy refleksji odnoszącej się do obowiązującego od 15 kwietnia 2016r. nowego systemu rozpatrywania zgłoszeń znaków towarowych, tzw. systemu sprzeciwowego, który znacznie ułatwia i przyśpiesza rozpatrywanie podań o udzielenie prawa ochronnego na znak towarowy. Ukazanie problematyki powyższego tematu należało jednak poprzedzić rozważaniami dotyczącymi podstawowych zagadnień związanych z instytucją znaku towarowego. Wskazane zostały najważniejsze korzyści płynące z rejestracji nazwy/logo firmy jako znaku towarowego, formy w jakich powinna nastąpić ich prawna rejestracja, a także zasięg jej terytorialnej ochrony. Swoistą klamrę spinającą przedmiotową problema-tykę jest podsumowanie w którym zostały zawarte wnioski wynikające z przeprowa-dzonej analizy, a także wskazanie sposobu ochrony nazwy/logo firmy w przypadku braku dokonania jego rejestracji jako znaku towarowego. Temat należało uznać za trafny i w pełni uzasadniony, ponieważ stanowi w zakresie objętej nią problematy-ką tematykę nowatorską na gruncie prawa polskiego
This subject deals with the issues significant both from a theoretical and practical point of view. The issue concerns the topic regarding a new system that examines trademark applications - appli-cable from 15 April 2016 - also known as the opposition system, which greatly simplifies and speeds up the processing of applications for the right to protect a selected trademark. In presenting the issues above, it was necessary for this subject to preceded all of this by other considerations about basic issues related to the institution of the trademark. There were pointed the most important advantages of registration of name / logo as trademark, forms in which their legal registration should occur, as well as the extent of its territorial protection. A kind of brace holding together previously presented objects is a summary that in-cludes conclusions from the analysis, and an indication of how to protect the name / logo of the company in the absence or failure of a trade mark registration process. Subject should be regarded as accurate and fully justified because it is - in the field covered – a truly novel subject under the Polish law.

Opis:: Glosowany wyrok NSA z dnia 27 listopada 2018 r., II GSK 3446/16, dotyczy ustalenia podstaw prawnych poddania się istotnemu obowiązkowi uiszczania rocznych opłat za prawo do dysponowania częstotliwością. W wyroku tym Naczelny Sąd Administracyjny dokonał wykładni przepisu art. 185 ust. 1 ustawy Prawo telekomunikacyjne w zw. z art. 114 ust. 1 oraz art. 123 ust. 1 pkt 1 i 3 tej ustawy w kontekście ustalenia powstania obowiązku zapłaty opłaty za prawo do dysponowania częstotliwością. Duża skala działalności telekomunikacyjnej prowadzona z wykorzystaniem częstotliwości, jak również brak definicji legalnych terminów „dysponowanie częstotliwością” oraz „prawo do dysponowania częstotliwością” czynią to zagadnienie istotnym z punktu widzenia bezpieczeństwa obrotu prawnego.
The judgement of the Supreme Administrative Court of 27 August 2018, II GSK 3446/16, subject of this gloss concerns the determination of an important obligation to pay an annual fee for the right to use a radio frequency. In this judgement, the Supreme Administrative Court set out the interpretation of Article 185 par. 1 of the TL in connection with Article 114 par. 1 and Article 123 par. 1 subpar. 1 and 3 of the TL in the context of determining the establishment of the obligation to make payments of the fee for using a radio frequency. The large scale of telecommunications activity conducted with the use of radio frequencies as well as lack of legal definitions of the terms: “use of a radio frequency” and “the right to use a radio frequency” make this an important issue from the perspective of legal security.
