    Opis:
    The paper describes the legal grounds of prequalifi cation proceedings allowing certain categories of energy producers to participate in the Polish auction system, and thus to create a new system responsible for supporting the development of renewable energy sources (RES). These procedures are of administrative proceedings character but are modifi ed by specifi c legal provisions under the RES regulations. The legislator diff erentiated between two types of these procedures. Although they diff er in specifi c legal provisions, they both pursue to achieve common targets that will subsequently contribute to a speedy development of the RES plants in Poland. Among the main objectives of the prequalifi cation proceeding, the necessity of the regulatory authority to obtain the basic information about the RES installation project must be mentioned. This information not only allows to check the legitimacy of the accession to the RES auctions system but also allows to check the investment documentation of the project, and consequently implement and start the RES installation on time as prescribed by the law. In the initial period, the measures taken by the RES are to be aimed at eliminating form the auction these energy producers who could theoretically win the RES auction but would not, due to legal, technical or fi nancial reasons manage to complete the investment (build and start up the RES installation) within the time prescribed. This would not only impede a competitive conduct of the RES auction but would also prevent realisation of the EU climate and energy policy due to the failure to produce enough electricity to meet the required volume contracted for each new RES installations according the RES auctions.

    Celem niniejszego artykułu jest analiza wybranych zmian prawnych w przedmiocie systemów wsparcia odnawialnych źródeł energii, wprowadzonych ustawą z 19.07.2019 r. o zmianie ustawy o odnawialnych źródłach energii oraz niektórych innych ustaw, pod kątem realizacji unijnego celu energetyczno-klimatycznego, tj. osiągnięcia 15-procentowego udziału odnawialnych źródeł w końcowym zużyciu energii brutto przez Polskę w 2020 r. Zastosowane przez autora metody badawcze opierały się na metodzie formalno- dogmatycznej oraz komparatystycznej. Komentując wprowadzone zmiany prawne, autor uwzględnił również aspekty ekonomicznej analizy prawa. Treść niniejszego artykułu odnosi się w szczególności do analizy prosumenckiego systemu wsparcia oraz aukcyjnego systemu wsparcia, jako obecnie najpopularniejszych mechanizmów promowania energetyki odnawialnej w Polsce. Zgodnie ze stanowiskiem autora wprowadzone zmiany prawne nie powinny w istotny sposób przełożyć się na wzrost mocy zainstalowanej odnawialnych źródeł energii w 2020 roku, choć z pewnością przyczynią się do poprawy sytuacji prawnej wytwórców oraz mogą wpłynąć na wzrost atrakcyjności polskiego rynku odnawialnych źródeł energii. Autor wskazuje ponadto na konieczność harmonizacji polskiego ustawodawstwa z unijną dyrektywą 2018/2001 w sprawie promowania stosowania energii ze źródeł odnawialnych, przewidującą konieczność dynamizacji rozwoju odnawialnych źródeł energii w perspektywie kolejnego celu energetyczno- klimatycznego, wyznaczonego na 2030 r.
    The purpose of this study is to analyse selected legal changes concerning support schemes for renewable energy sources, introduced by the Act of 19 July 2019 amending the Act on Renewable Energy Sources and certain other acts, in terms of achieving the EU's energy and climate target, i.e. achieving a 15% share of renewable sources in Poland's gross final energy consumption in 2020. The research methods used by the author were based on formal-dogmatic and comparative methods. Commenting on the introduced legal changes, the author also took into account aspects of economic analysis of the law. The study refers, in particular, to the analysis of the prosumer support system and the auction support system, as currently the leading mechanisms for promoting renewable energy in Poland. According to the author's position, the introduced legal changes should not significantly contribute to an increase in installed capacity of renewable energy sources in 2020, although they will certainly improve the legal situation of energy producers and may increase the attractiveness of the Polish renewable energy sources market. The author also points to the need to harmonize Polish legislation with the EU Directive 2018/2001 on the promotion of the use of energy from renewable sources, which provides for the need to dynamize the development of renewable energy sources in the perspective of the next energy and climate target set for 2030.
