The discussed decision refers to the issue of constitutionality of religious symbols on public property. The Supreme Court ruled that 32-foot tall Latin cross erected nearly a century ago to commemorate soldiers who died in World War I did not violate the Establishment Clause of the First Amendment. The Court correctly holds that the religiously expressive monument me be retained for the sake of its historical significance and its place in a common cultural heritage. However, it gives rise to concerns that the Supreme Court set forth a presumption of consti- tutionality for only “longstanding” monuments, symbols, and practices. Similarly, the Court properly emphasizing the nonreligious meaning and functions of the contested cross, at the same time unduly underestimated its religious dimension. There is no need to overlook deeply Christian nature of the cross, when simultane- ously exhibiting its cultural and historical importance.

Analiza współczesnych konstytucji wskazuje, że liczba państw wyznaniowych powoli maleje. Spotykamy się jednak z tendencjami przeciwstawnymi. Ustrój państwa wyznaniowego jest charakterystyczny przede wszystkim dla krajów muzułmańskich Bliskiego i Środkowego Wschodu oraz dla szeregu państw Azji Południowo-Wschodniej. W ostatnich dziesięcioleciach wyraźnie zmalała natomiast liczba państw chrześcijańskich oraz świeckich państw ideologicznych. Stabilna pozostaje grupa państw z buddyzmem jako religią uprzywilejowaną. Przepisy wyznaniowe konstytucji państw konfesyjnych charakteryzują się z reguły dużym stopniem ogólności. Rzadko spotyka się postanowienia szczegółowe. Klauzule wyznaniowe zamieszczone są przede wszystkim wśród zasad naczelnych konstytucji. U podstaw wyznaniowego charakteru państwa leży odrzucenie neutralności światopoglądowej. Nie jest możliwe na podstawie samych tylko konstytucji zrekonstruowanie szczegółowego, uniwersalnego modelu państwa wyznaniowego. W świetle ustaw zasadniczych najczęściej spotykane cechy państw wyznaniowych to: negacja neutralności państwa w sprawach światopoglądowych, przyjęcie określonej religii jako oficjalnej, odrzucenie równości związków wyznaniowych, wymóg wyznawania przez głowę państwa określonej religii lub światopoglądu, udzielanie przez państwo wsparcia dla danej konfesji. Konstytucje większości państw wyznaniowych formalnie zapewniają wolność religijną. W ustawach zasadniczych niektórych państw muzułmańskich gwarancje dla tej wolności są jednak przemilczane. Jedność organizacyjna aparatu państwowego i wyznaniowego nie jest charakterystyczna dla sfery kultury politycznej Zachodu. Rzeczywistość społeczno-polityczna współczesnych państw wyznaniowych wskazuje, że wspomnianego modelu państwowości nie można a priori uznać za sprzeczny z zasadami demokracji oraz z prawami człowieka.
The analysis of contemporary constitutions indicates that the number of religious states is slowly decreasing. However, we are confronted with the opposite tendencies. The model of the religious state is characteristic primarily of Muslim countries of the Near and Middle East and of a number of Southeast Asian countries. In the last decades, the number of Christian states and secular ideological states has declined significantly. There is a stable group of states with Buddhism as a privileged religion. The religious constitutional norms of confessional states are generally characterized by a high degree of generality. Detailed provisions are rare. Denominational clauses are included primarily among the supreme principles of the constitution. Underlying the religious character of the state is the rejection of the neutrality of the worldview. It is not possible, on the basis of the constitution alone, to reconstruct a detailed, universal model of the religious state. In the light of fundamental laws, the most common characteristics of religious states are: the negation of the neutrality of the state in worldviews, the acceptance of a particular religion as the official religion, the rejection of the equality of religious associations, the requirement of a state religion or belief towards the head of the state, the state support for a given confession. The constitutions of the majority of religious states formally provide for religious freedom. In the fundamental laws of some Muslim states, the formal guarantees for this freedom are, however, absent. The organizational unity of the state and religious apparatus is not characteristic of the sphere of Western political culture. The socio-political reality of contemporary religious states indicates that this model of statehood can not be a priori regarded as contrary to the principles of democracy and human rights.

An analysis of contemporary constitutions indicates that the number of denominational states is slowly decreasing. However, we also encounter opposite tendencies. The model of a denominational, or a religious state is primarily characteristic for Muslim countries of the Near and Middle East and for a number of Southeast Asian countries. In the last decades, the number of Christian states and secular ideological states has declined signifi cantly. There is a stable group of states with Buddhism as a privileged religion. The religious constitutional norms of states of confession are generally characterised by a high degree of generality. Detailed provisions are seldom and denominational clauses are primarily included among the principles of the supreme constitution. Underlying the religious character of the state lies the rejection of the neutrality of the worldview. It is not possible, on the basis of the constitution alone, to reconstruct a detailed, universal model of a religious state. In the light of fundamental laws, the most common characteristics of religious states are: the negation of the neutrality of the state in worldviews, the acceptance of a particular religion as the offi cial religion, the rejection of the equality of religious associations, the requirement of a head of state to follow the state religion or belief, and the state support for a given confession. The constitutions of most religious states formally provide for religious freedom. In the fundamental laws of some Muslim states, the guarantees for this freedom are, however, silent. The Western political culture fails the characteristics of an organisational unity of the state or the religious apparatus. The socio-political reality of contemporary religious states indicates that this model of statehood cannot be a priori regarded as contrary to the principles of democracy and human rights.

The confession of Hungarian minority in the Slovak State only slightly differed from the confession of Slovak majority, however, there were different views on confessional issue of Hungarian minority that reflected unhealthy Czech-Slovak-Hungarian relationships. A religious sphere relating to the Hungarian minority reflected political and social development and an overall ratio of the state and churches. In reconstruction of this relationship, the study was based on a contradictory attitude of the first Republic towards churches. The study, therefore, apart from the period of 1939–1945, records the course of events in the Czechoslovak Republic during the interwar period. There was a change after 1939, when the most significant church in Slovakia – the Roman Catholic – became a support of political regime. Even in the ecclesiastical area associated with Hungarian community, the principle of reciprocity applied between Slovakia and Hungary was a decisive one. A conflict relationship of state apparatus or majority population towards the public worships in the Hungarian language was substantial. The results of this work are mainly based on the archive research, as well as the research of press at the time.
Wyznanie mniejszości węgierskiej na Słowacji tylko w niewielkim stopniu różniło się od wyznania większości słowackiej. Istniały jednak różne opinie na kwestię wyznaniową mniejszości węgierskiej, które odzwierciedlały niezdrowe relacje między Czechami, Słowacją i Węgrami. Sfera religijna odnosząca się do mniejszości węgierskiej odzwierciedlała polityczny i społeczny rozwój i ogólną relację państwa i kościoła. W celu ukazania tej sytuacji, artykuł został oparty na przedstawieniu sprzecznej postawy pierwszej Republiki wobec kościoła. W opracowaniu – oprócz lat 1939–1945 – przedstawiono ciąg wydarzeń mających miejsce w Republice Czechosłowackiej w okresie międzywojennym. Po roku 1939 nastąpiła zmiana, kiedy to najważniejszy kościół w Słowacji (rzymskokatolicki) wsparł polityczny reżim. Nawet na terenach kościelnych mających związek ze społecznością węgierską zasada wzajemności między Słowacją a Węgrami była decydująca. Konfliktowa postawa aparatu państwa czy ludności stanowiącej większość wobec kultu publicznego obecnego w języku węgierskim była znacząca. Wyniki opracowania są oparte na badaniach archiwalnych oraz na analizie ówczesnej prasy.

The 9th National Symposium on Church-State Law “Churches and other religious organizations in the service of the common good,” Jagiellonian University, Krakow 17–20 May 2012 The host of the 9th National Symposium on Church-State Law combined with the Congress of Chairs and Lecturers on Church-State Law was the Department of Ecclesiastical Law and Law on Religious Denominations at the Faculty of Law and Administration of the Jagiellonian University in Krakow. The symposium was held in Krakow from 17th to 20th May 2012, and its theme was: “Churches and other religious organizations in the service of the common good.” The deliberations of the Symposium brought together over 50 participants from 15 academic centres in Poland and two professors from the University of Toulouse. Out of this group, over 30 participants presented their speeches. The opening session of the symposium took place on Friday, 18th May, 2012, in Aula Jagiellońska of the Collegium Maius of the Jagiellonian University. The opening speaker was prof. dr hab. Wacław Uruszczak, Head of the Department of Ecclesiastical Law and Law on Religious Denominations at the Jagiellonian University in Krakow, the host of the symposium, who in his speech referred to Article 25 Paragraph 3 of the Polish Constitution of 1997, which provides for the principle of cooperation between the State and the Church for the sake of common good. Next, prof. dr hab. Dorota Malec, Vice Dean for Administrational Studies at the Faculty of Law and Administration of the Jagiellonian University, greeted the participants. The opening ceremony was concluded by President of the Polish Association of Church-State Law, prof. ChAT dr. hab. Tadeusz J. Zieliński. The first introductory session of the Symposium also took place in Aula Jagiellońska, while all the following sessions were held at the “Chopin” Hotel in Krakow, divided into sections concerning the following themes: “Churches and other religious organizations in the service of the family,” “Churches and other religious organizations in the service of the common good in the historical and international context – part I and II,” and “Churches and other religious organizations in the service of society, culture and education.” The concluding session of the Symposium took place in the afternoon on 19th May, 2012. It consisted of a single presentation by mec. Karol Tatar, a solicitor from Krakow and the Vice President of the Ars Legis Association of St. Ivo Helory, the Patron of Lawyers. At the same time, prof. dr hab. Wacław Uruszczak invited the participants to join the celebrations of the 9th Lawyers’ Day organized by the Ars Legis Association. After prof. Tatar’s presentation the host of the Symposium, prof. dr hab. Wacław Uruszczak thanked all the speakers and the audience for their  participation in the Symposium. At the end, ks. prof. KUL dr hab. Piotr Stanisz made a speech in which he summarized the Symposium and discussed by the participants.

In the academic debates on the relationship between the State and religious communities in Estonia there are two standpoints. The first one emphasizes the role of religious communities, particularly the Christian ones, in the formation of Estonian statehood as well as the history of the country. The activity of the churches in the sphere of charity and social welfare is perceived positively. At the same time, academics draw attention to the fact that Estonians are not very religious, thus all forms of privileging religious communities are considered debatable. The second approach also emphasizes the historical significance of religious communities, but simultaneously approves of their increased activity, especially in the context of rebuilding Estonian identity after the era of Soviet domination.The goal of this article is to analyse the main assumptions of religious policy in Estonia after 1991, as well as the main factors that determined the current solutions. The conducted research is supposed to answer the question: why does the government of a country with one of the longest traditions of separation of state and religion in the region make many symbolic acts towards churches and religious associations? Furthermore, it will enable the verification of the hypothesis which assumes that the religious policy of contemporary Estonia is influenced by the conviction about the role of churches and religious associations in the history of the country, as well as by the recognition of religion as a factor in building the identity of the post-Soviet state.The text is divided into three parts. In the first part will be analysed the issues of changes in the denominational structure of Estonia. The second part will present the results of the research on the historical conditions of Estonia's denominational policy. The last part will analyse the legal solutions in Estonia concerning the state-religious community relations.

The issue of wearing of religious symbols by employees in the workplace and manifestation of their affiliation calls for an assessment of situations and circumstances. The case laws of the Court speak of the principle of proportionality – whether there is a balance between the manifestation of their religion and, for example, the image of the workplace and the need to keep safety rules. Religious freedom must be respected in the workplace, but only to the extent that it does not violate the rights of others. Strasbourg judicial decision was also called upon to settle the cases in which a given state uses religious symbolism. The manifestation of such an attitude by the state exposes it to be called “confessional state” and to the charge of undermining the principle of worldview neutrality. However, finding a solution to the problem is complex, and also consists in the recognition by the Court of a wide margin of discretion, appurtenant to the Member States in matters of religion. Each state, when formulating the principle of secularism or lack of religious beliefs of the state, must combine them with distinctive national traditions and create its own model, which can be difficult or even impossible to transfer to another country. The European Court of Human Rights seeks solutions that could meet the criteria and be implemented in all countries. However, the diversity of religious traditions of the Member States does not allow to draw conclusions common to the whole European community.

The Order of the Hospital of St. John of Jerusalem is one of the oldest religious and charitable organisations in the world. In its long and tumultuous history it played the role of a hospital fraternity, and a knight order fighting against the „infidel”. When the Franks lost the Holy Land and the Jerusalem Kingdom fell in 1291, a new stage was opened in the history of the three largest knight orders – Templars, Knights of the Order of St. John of Jerusalem, and Teutonic Knights. For the first from the list it was „the beginning of an end,” while for the remaining two an occasion to build an independent power and independent economic policy in the lands under their jurisdiction. Having gained Rhodes at the turn of 1309/1310, St. John's Knights started to build an administrative structure on the island, among inhabitants dominated by people of Greek origin. They laid foundations under an effective economy, whose integral part was a monetary system. Hospitallers introduced a clear and effective monetary system based on the best European models. It became an essential element of Europe's economic system in that period. Its influence was even bigger, as it dealt with one of the most important trade routes in the Mediterranean See, and economic relations with the rich St. John's Knights' commanderies in the west of Europe.

National states, in search of their national identity, refer to symbols, among which religious symbols occupy one of the main places. For many decades, the presence of religious symbols, which were also national symbols, constituted an important element of upbringing and strengthening the sense of citizenship and belonging to a given state. In recent years new trends have emerged that question the presence of religious symbols as a national or state symbol. Attempts are made to reduce the rank of a religious symbol or its denial from the presence of the nation’s life. However, this sense of national identity, strengthening by the symbols present in the life of the nation, build the state understood as the common good of the whole nation.

The article deals with the church and religious life of Ukrainians in the context of national and political processes during the 1960s and 1970s. The author characterizes the anti-religious policy of the Soviet government, shows its directions, forms, and methods, studies the attitude of Ukraine’s title nation representatives to religious persecution and to manipulation of religious consciousness by the communist leadership, and highlights comprehensive atheistic activities and the elimination of the ways for reviving religiosity among people. The author reveals the essence, the process of creating and artificially enforcing the new Soviet ritualism in Ukrainians’ lives. This ritualism has become a convenient tool for popularizing communist ideology in the Ukrainian SSR, destroying historical memory and undermining the national identity of the Ukrainian people. The new Soviet ritualism was also a means for implementing the policy of denationalizing Ukrainians, beginning with the age-old religious oppression of Ukrainian customs, traditions, and rituals. The model of state-church policy of the Soviet power in the described period was based on the use of a variety of forms and methods of struggle against religion, including: a comprehensive control over clergy activities, destruction of religious sites and sacred objects, as well as administrative, moral, and political pressure on believers. Displacing religion, the Soviet totalitarian state destroyed not only native religious customs of the Ukrainian people, but also violated the principles of the centuries-old traditional culture and undermined the national fortitude of Ukrainians.

This paper contains the genesis and functioning of the State/Federal Commission for Religious Affairs in Yugoslavia under Josip Broz-Tito. In 1945–71, Commission’s main task was to coordinate the state policy towards religion. In fact, the main decision-making centre was personally Marshal himself and later the superior of security police Aleksandar Ranković. Purpose of presented article is to analyse the evolution and Commission activities in Yugoslavia.
W niniejszym artykule przedstawiona została geneza powstania i funkcjonowania Państwowej/ Związkowej Komisji ds. Wyznań w państwie rządzonym przez Josipa Broz-Titę. W latach 1945–1971 organ ten koordynował politykę państwa wobec religii, choć głównym ośrodkiem decyzyjnym w tym zakresie pozostawał najpierw sam marszałek, a potem szef bezpieki Aleksandar Ranković. Głównym celem prezentowanego tekstu jest ukazanie ewolucji i zasad działania Komisji w realiach jugosłowiańskich.

The Ethiopian Ortodox Tewahedo Church played a significant role in the history of Ethiopia from ancient times, providing ideological legitimization for her emperors and influencing every sphere in the lives of the Christian population. After the revolution in 1974, the Church lost its privileged position in the country. In 1991 the new regime of EPRDF established ethnically based federalism, under which religion was effectively banned from politics. This situation poses a number of challenges for the EOTC. The Church has since suffered two major institutional crises: after separating with the Eritrean Orthodox Church and after the schism in the Ethiopian diaspora in the US. Without the previous support from the state, it has had to face competition from Pentecostal churches which have been gaining popularity over the last decades. It also seeks to reinvent its relations with the faithful, among whom appear movements (such as Mahbärä Qəddusan) which to some extent contest the teaching of the bishops.

The subject of the author’s interest is the problem of the relationship between religious fundamentalism and political fundamentalism. The author starts with the adopted doctrinal and theoretical findings to proceed to the analysis of selected practical solutions related to Polish socio-political reality in recent times. The attention is focused on the issues of the relations between the state and the Catholic Church in Poland. He concludes his considerations with a message (very current) from J. Turowicz about the Catholics’ responsibility for the implementation and observance of ethical standards in social and political life.

The author’s aim is to present an interdisciplinary reflection combining the contents common to the topics associated with religious freedom of every individual and the sense of security in the state which he postulates to be a subject of research in the area of security psychology. The author believes that the religion related subjective sense of security of individuals living on state territory should be taken into account when creating national security. The study fits into the framework of research on Poland’s national security, which draws on the output of such sciences as politology, law, psychology, philosophy.
