The article raised the subject of the analysis of land consolidation works in the years 1945-2013. The authors present in selected time intervals, the results of Land consolidation in the Leżajsk District (in the Podkarpackie Voivodeship). The study area is located on the territory of the lands historically belonging to the Austrian partition, under the influence of the principles of Austrian cadastre. These problems are described in the compilation with the changes in the law on setting up, maintaining and modernizing the Land and Buildings Registry (EGiB) in postwar Poland. The works of land consolidation are important in the process of creation of the real estate cadastre. Under current regulations the role of cadastre of real estate in Poland plays EGiB. This cadastre however has several flaws, and as a cadastral system of European standards, should constitute the backbone of a functioning real estate management and be the basis for legal, fiscal and planning actions of the state. In each of these aspects of the real estate economy important role play the configuration of borders, optimization of the shape and surface of the land and regulated legal status of the land. In the opinion of the authors land consolidation procedures, can be an effective tool for corrections of the plots geometry and regulations of the legal status of land.

On 4 November 1971, the Law of 26 October 1971 on the regulation of ownership of farms came into force. It was a one-time piece of legislation aimed at finally regulating the informal trade in agricultural real estate. Despite its incidental effect, the enfranchisement carried out over 50 years ago has had legal effects that are still relevant. The document confirming the ownership of property acquired as a result of enfranchisement is the land title deed, which is an administrative decision. The article aims to provide an overview of the possibility of verifying land title deeds in administrative and civil proceedings.

The aim of the article is to analyse the problem of spatial planning in the Wrocław district, especially regarding the evaluation of the purpose of land in municipal studies of the conditions and directions of spatial development. The analysis of purpose is significant with respect to its impact on real estate value and the forming of the relation between supply and demand on the market. The purpose of land designated for various types of development and construction is decided by local administration and municipal councils. This, however, does not ensure adherence to principles of sustainable development, as showcased by summing up the methods of land allocation in the district. It has been determined that according to the status for the end of 2012, 34% of land in the Wrocław district has been developed for housing, 26% for services and 18% for economic activity.

From the year 2014 to July 31, 2020, setting out a building was surveying work subject to the obligation to report to the locally competent district governor (starost) before it was commenced. After completion of the building setting out, the contractor of surveying works was obliged to notify the authorities of the completion of the surveying works and to submit the results of surveying works connected with the building setting out. Since July 31, 2020, following the amended Geodesic and Cartographic Law, the obligation to report the building setting out has been repealed. Despite that, the real estate owner will still be obliged to submit an appropriate application to the starost to dis close the new land use in accordance with Article 22 of the Geodesic and Cartographic Law. The author has analysed 31 documentation sets, being the results of building setting out procedures. The analysis verified the size of a land parcel on which the buildings were set out, what land use was presented before setting out and what land use was presented after the building setting out. In addition, the current state of development of the land parcel (as of July 2020) was examined using map portals, and an orthophotomap was used to check whether the building was constructed, in order to verify whether the real estate cadastre was updated further.

The article highlights some socio-economic aspects of land use planning. Effective space management requires co-ordinated programmes, the limits allowing the social space to self-regulate and the carefully calculated volume of input (not only in the economic terms) into maintaining the desired quality of this space. Disturbed balance between the space self-regulation and the disproportionate input usually results in excessive burden laid on one of these elements. Therefore, adequate proportions between the two of them should be of central importance for land use planners. To this end, it is extremely important to develop a proper land use policy, a part of which are local development plans. They create the space and its functions and, conversely, it is the space and its quality that determine the provisions of land use plans. The latter make entities behave on the market in a specific way, thus shaping, directly or indirectly, the local property prices. A local development plan, or its absence, often hinders the growth of not only the local real estate market, but also the local development in general. Effective planning, especially in terms of economic and social consequences, determines the contents of the information resource that is necessary for making right land use decisions. The deficit of micro-scale analyses leads to a situation when local plans are created on the basis of data aggregated for much larger areas (such as cities or their districts) thus making the predicted effects of land use planning burdened with error. Another equally important issue is an ex post analysis of the land use planning effects. It is also necessary to develop a coherent concept of the spatial order of the area beyond the administrative borders. Unfortunately, the areas covered by land use planning are constantly shrinking in size, which is resulting in the disturbed continuity of the spatial order and in the uncontrolled urban sprawl.Spatial development policies and land use plans should be preceded by the strategic analyses of their impact on the natural environment, of the mutual influence of the plan provisions on the neighbouring administrative units, of the economic effects of using local land and buildings (not limited to the financial consequences of a zoning fee) and, first and foremost, of the social relevance of the functions proposed for the area in question.

The correct arrangement of area use function in built-up and urbanized areas is of a crucial meaning as for the satisfaction of economical and functional needs of a city. The process of creating functional structure is not incidental, it is a consistently implemented concept included in the planning documents. The use of limited resources is conditioned by the needs linked to the proper management, based on optimal adjustment of area to determined functions. Maintaining spatial order is a result of interdependent and correlated actions of many entities. Some of these actions are regulated in law, while other arise from indirect actions of entities operating in a given area, among others, of real estate market professionals. Selected problems of the optimal shaping of built-in and urbanized areas (in particularly of cities) were presented in the study. Those processes of the real estate system and their influence on the optimal use of areas in which a significant role may be played by real estate professionals: real estate appraisers, real estate agents and real estate managers were presented.

Purpose of the following article is to draw attention to importance of the electronic land and mortgage register for the security of real estate transactions. From 1 January 2015 all paper land and mortgage registers were replaced with the modern information system, which changed the way of carring on the land and mortgage registers. The article presents reasons that leads to the conclusion that the new system of the land and mortgage register result in the increase of security of real estate transactions. This conclusion precedes analysis of regulations concerning carring on the electronic land and mortgage register, construction of the electronic land and mortgage register and construction of the system of the New Land and Mortgage Register.

The objective of this study is to present the principles and methodology of drawing up a land value map, which consists of economic layers, such as a layer of transaction price monitoring, layer of purchaser preferences, layer of uniform value zones. Celem niniejszego studium jest prezentacja zasad i metodologii sporządzania mapy wartości gruntów, która zawiera warstwy ekonomiczne, takie jak: warstwa obserwacji cen transakcyjnych, warstwa preferencji nabywców, warstwa stref jednorodnych wartości. Podczas sporządzania map wartości szczególną wagę przywiązano do analizy przestrzennej czynników kształtujących ceny i wartość nieruchomości. Efektem badań jest opracowanie mapy wartości gruntów składającej się z warstwy monitoringu cen transakcyjnych, warstwy preferencji nabywców oraz warstwy stref jednorodnych wartości

30 April 2016 saw the entering into force of the Act of 14 April 2016 on the Suspension of Sale of Land of the Agricultural Property Stock of the State Treasury and on Amending Numerous Acts . The amendments pertained to, inter alia, the Act of 11 April 2003 on the Formation of the Agricultural System , and introduced a variety of alterations thereto, thus restricting significantly the freedom of trading in agricultural land. This article provides an analysis of conformity of Polish legislation with European Union legislation and also explains the liability of the State Treasury in case of violations of EU law.

In all legal systems with private property, the government provides a mechanism for owners and lenders to make a public record of their rights. In most countries, the gov-ernment restricts access to this public record and allows entries into it only after a public official approves it. By contrast, no government entity in the United States regulates, confirms, or guarantees the typical real estate ownership transfer. How this works is not readily understood even within the United States, where owners and lenders rely on attorneys and other professionals to examine and understand the public record and to record instruments that protect their clients’ property rights. This article describes the laws and legal customs that underlie this self-regulating system, including how they dif-fer fundamentally from land registration in other countries, and the emerging challenges to its reliability.

Real estate market analyses are the basis for making many investment decisions, including residential land market. Residential lands may have different planning conditions, which in the literature are also called states planning space. In the paper the authors diagnose conditions of planning and carry out an analysis of transaction prices of land designated for residential development and residential services. The purpose of the article was an attempt to answer the question whether planning conditions affect prices of undeveloped land allocated for housing development in the rural district of Bydgoszcz. Based on transaction price data from the years 2011-2012 there were calculated average transaction prices and examined their variability. In order to assess the impact of planning conditions on undeveloped land prices two-way analysis of variance test and the test for two means were used. The results indicate that the planning conditions have an impact on the price of undeveloped land in most communes of district of Bydgoszcz.

W artykule poddano analizie proces suburbanizacji na przykładzie miasta Bielska- Białej i gmin powiatu bielskiego. Coraz częstszym kierunkiem migracji są tereny gmin wiejskich, nie tylko jako przejaw preferencji opartej na modzie, ale również na racjonalności ekonomicznej i lepszej jakości przestrzeni. Przyczynia się do tego wzrost podaży gruntów w atrakcyjnych gminach podmiejskich, co związane jest z przekształcaniem terenów rolnych w budowlane poprzez uchwalanie planów miejscowych z przeznaczeniem gruntów rolnych pod zabudowę, bez określania koncepcji urbanistycznych dla nowych stref zabudowy. Jedną z przyczyn suburbanizacji jest więc sytuacja na rynku nieruchomości gruntowych.
The article analyzes the process of suburbanization on the example of the city of Bielsko- Biała and Bielsko District. Areas of rural boroughs are frequent direction of the migration, not only as an expression of preference based on fashionable, but also on economic rationality and better quality space. Contributes to the increase in the supply of land in attractive suburban communities, which is related to the transformation of agricultural land in the building by adopting local plans for use of agricultural land for development, without specifying the concept of urban areas for new development. One of the reasons it is so suburbanization situation in the real estate market.

The aim of the presented article is to explain and describe the role of the surveyor in delimitation of a real estate in administrative and legal proceedings. This two-stage procedure, whose purpose is the location of boundaries course, is an important and difficult problem in contemporary surveying. The paper discusses the problems of the administrative procedure, with particular regard to the scope of activities performed by a surveyor, who plays many roles. Among them one can indicate the function of the representative body of the public administration, conducting the proceedings on the real estate delimitation, a specialist in the field of surveying, mediator or quasi-judge, before who boundary settlement can be concluded. It also presents situations where it is acceptable to carry a case of delimitation before a common court. In such proceedings, the surveyor is an expert in the field of surveying, and his opinion is a very important, crucial evidence.
W artykule przeprowadzono analizę roli geodety w rozgraniczaniu nieruchomości w trybie administracyjnym i sądowym. Ta dwuetapowa procedura mająca na celu ustalenie przebiegu granic jest ważnym, ale też i trudnym zagadnieniem współczesnej geodezji. W pracy omówiona została problematyka postępowania administracyjnego, ze szczególnym uwzględnieniem zakresu czynności wykonywanych przez geodetę, który w toku postępowania odgrywa wiele ról. Wśród nich możemy wskazać funkcję przedstawiciela organu administracji publicznej, prowadzącego postępowanie o rozgraniczeniu nieruchomości, specjalisty z zakresu geodezji, mediatora czy quasi--sędziego, przed którym może zostać zawarta ugoda graniczna. Przedstawiono również sytuacje, w których dopuszczalne jest przeprowadzenie sprawy o rozgraniczenie nieruchomości przed sądem powszechnym. W takim postępowaniu geodeta występuje jako biegły z zakresu geodezji, a jego opinia jest szczególnym środkiem dowodowym.
