Opis:
The study aimed to recognise the preferences of various stakeholder groups representing three regions of Poland towards the most important forest ecosystem services and to determine the threats to performing these functions resulting from the occurrence of extreme weather phenomena. The study was based on surveys conducted in 2019 among various stakeholders in three regions of Poland. The respondents assigned a point weight value to each of the seven indicated forest functions and reported the occurrence of extreme weather events causing damage to forests owned or supervised by them. The survey results indicate that for all stakeholders, the most important function of the forest is timber production. However, respondents from the southern region paid more attention to water protection through forests than respondents from other regions.
Celem artykułu jest określenie preferencji różnych grup interesariuszy reprezentujących trzy regiony Polski wobec najważniejszych leśnych usług ekosystemowych oraz określenie zagrożeń dla pełnienia tych funkcji wynikających z występowania ekstremalnych zjawisk pogodowych. Opinie zostały zebrane w badaniach ankietowych przeprowadzonych w 2019 r. Respondenci przypisali wartość wagową każdej z siedmiu wymienionych funkcji lasu oraz zgłaszali występowanie ekstremalnych zjawisk pogodowych powodujących szkody w lasach będących ich własnością lub przez nich nadzorowanych. Wyniki oceny istotności funkcji wskazują, że dla przedstawicieli wszystkich grup interesariuszy najważniejszą funkcją lasu była produkcja drewna. Respondenci z regionu południowego przykładali większą wagę do ochrony wód przez lasy, niż respondenci z innych regionów.

The paper presents declarative opinions of 239 tourists who visited the area of the Krynki Forest District in July−September 2013. The opinions were collected in direct interviews using of a questionnaire. The analysis distinguished two groups of respondents: 135 people (56,5%) who visited the forest district for the first time, and 104 respondents (43,5%) for whom it was the subsequent visit. We analysed the opinion of tourists on such problems as: (1) anthropogenic threats to the forest ecosystem, (2) factors constituting a threat to visitors to forest areas, and (3) forms of recreation and rest that can be implemented in forest areas. To examine the significance of mean differences between analysed groups of respondents that differ in experience and hypothetical readiness to declare the amount of WTP> 0, the Mann−Whitney test was used. Respondents considered forest fires and garbage left in the forest as the greatest threat to forest ecosystems, while among factors threatening people resting in forest areas, respondents pointed to the natural factors such as vipers, ticks and mosquitoes. Respondents considered that admissible forms of recreation and rest in forest areas are sport and cross−country races, horse riding and cycling, while ones that pose a threat to forest ecosystems, e.g. organization of mass events or bonfires and family events with barbecue, should be prohibited. No impact on differences in the opinions declared by the respondents, their tourist experience or readiness to declare the amount of WTP was disclosed.

The functioning of forest districts in Poland should be based on their mutual cooperation with local authorities in order to achieve social interest, one of the examples of which is construction or reconstruction of roads. Due to the fact that achieving mutual investments encounter real legal problems arising from underspecified and unclear concepts, an assessment should be made of whether the construction and reconstruction of forest roads is a public purpose and also answer, what is a forest and forest road within the meaning of the provisions of the Act. It is necessary to present views of legal science and jurisdiction of administrative courts. The judicial direction of administrative courts is not beneficial for achieving investments; it does not even take into account that one of the investors’ purposes – forest districts – is nature management. Presenting the contrary argumentation to judicature positions should help courts make a proper assessment in the interpretation of provisions.

Opis:
The forestry communication system is included in larger transport areas through forest roads connections mainly with public roads, but also with internal ones. The possibility of realization of these connections and defining their technical parameters is very important, as it concerns the cooperation of various property owners as well as interference of the State Forest units into other land (road lane). The aim of the research was to analyse the exits, i.e. connections of forest roads with public or other internal roads, necessary to ensure the functioning of the communication system of the forest district. We investigated existing as well as the planned to be built exits. The research was carried out based on the developed information sheet regarding the scale and scope of issues related to the operation of the exits. We received back 412 information sheets and analysed the data according to the category of the road and the regional directorates of the State Forests (RDSFs). The total number of functioning exits the State Forests equals 108,239. The exits number varies from 2505 in RDSF Piła to 12,341 in RDSF Olsztyn and depends on the number of forest districts and their area, which is confirmed by the high number of exits in RDSF Bialystok, Szczecin and Wroclaw (tab. 1). The highest number of exits (53,455) was found for junctions with commune roads, and then district roads (31,190). A large number of exits (8111) was recorded for roads that do not have the status of a public road. More than a half of the surveyed forest districts (262) demonstrated the need to build 9072 new exits from various road categories, indicating primarily exits from communal roads and district roads (tab. 2). No need of building the exits to national roads was exhibited by 320 forest districts, and by 253 units for regional, 183 for district and 211 for communal roads.

The provisions of the Act on Forests apply to all forests in Poland, irrespective of their ownership. They impose on owners and administrators the obligation to draw up Forest Management Plans (FMP) or Simplified FMP (SFMP). While the media are loudly protesting the adoption of some FMP for state forests, especially for some urban forests or semi−primeval forests, analogous documents for private forests do not attract such interest. Supervision of forest management in the area of forests owned by natural persons and land communities is carried out by the regional authorities, who also has commissioned the documentation of the equipment. Forest owners are informed about the preparation of SFMP for their sites. As a rule, they do not finance these works and there are no procedures for obtaining their direct approval of the plan. Owners, however, have the opportunity to participate in the creation of management documents and should use this opportunity. Especially because the effect of the management works is also the determination of incompatibility in the land use category. In this way, spontaneous woodlots can be reclassified into forest, which has serious consequences for the future of this property. Removal of trees growing on it and the restoration of agricultural use become very difficult in such a situation. The nature and manner of obtaining direct payments to the owned land will also change. Durable subsidies for agricultural crops are changing into possible and temporary limited payments for young forests silviculture and protection. The SFMP also regulates all economic activities that can be undertaken in the private forest in the next 10 years, including the amount of wood that can be harvested and used for its needs or commercialized. The serious consequences of the adopted plan suggest that social participation in the resulting document should be high. The level of this participation in the process of creating simplified plans in selected municipalities was analyzed. The study analyzed the level of public participation in the process of creating simplified forest management plans in four selected municipalities (Gródek nad Dunajcem, Kotuń, Lipnica and Szamotuły, S, E, N and W Poland respectively), which differ in terms of location, ownership history, the size of lots and other features. The level of interest of owners was characterized, the aspects of interest were identified, and it was shown that they may depend on some features of the area.

The economic development of the country is very much dependent on the development of the transport infrastructure, which is one of the main priorities of the state policy included in the planning and development documents. Ensuring a efficiently functioning transport system, primarily the network of roads, involves the need to improve the technical characteristics of existing roads or to build new sections. With the linear nature of road investments, we deal with interference in significant areas that have direct and indirect effects. The aim of the study was to analyze the impact of investments realized for different categories of public roads on the area of land needed to be excluded from forest production. The structure and area of the land as well as the number of forest superintendents transferred areas were also analyzed. The study was conducted for forest areas managed by the State Forests National Forest Holding (SF NFH). Data on the area of the transferred forest land was obtained from SF NFH units and the General Directorate of National Roads and Motorways (GDDKiA). In the years 2012−2015, SF NFH units transferred the land into the management of GDDKiA 203 times with the total area of 617 ha. In the same period, the transfer of the land ownership to local government for voivodship, county and municipal roads took place in 388 cases and covered 556.6 ha. Since 2003 (i.e when special act on road investments came into force), the area of the transferred land amounted to 282.7 ha in Toruń, 78.6 ha in Gdańsk and 558.4 ha in Poznań regional directorates of the State Forests. There was a decrease in the area of the transferred lands depending on the category of public roads, while the highest number of events for municipal roads was observed. There is a great variability in the time, number and area of property transferred to public roads.

Przedmiotem artykułu jest status prawny strażników leśnych w prawie karnym materialnym. Analiza ustawy o lasach oraz kodeksu karnego, wsparta wypowiedziami doktryny i judykatury, doprowadziła do konstatacji, że strażnicy leśni nie są funkcjonariuszami publicznymi, lecz korzystają z ochrony prawnokarnej przewidzianej dla funkcjonariuszy publicznych w węższym od nich zakresie, gdyż tylko przy wykonywaniu czynności służbowych. Pełnią jednak funkcję publiczną, gdyż wykonują swoje zadania w ramach instytucji państwowej, działającej na podstawie przepisów prawa publicznego oraz dysponującą środkami publicznymi.
The article discusses the legal status of forest rangers in the substantive criminal law. The analysis of the Act on forests and the Criminal Code, supported by the statements of the doctrine and the judicature, leads to a conclusion that forest rangers are not public officers but take advantage of legal protection envisaged for public officers, yet on a smaller scale because only when they perform their job-related tasks. However, they perform public functions as they perform their tasks while working for a state institution operating based on the regulations of public law and financed from public funds.

Properly conducted forest management is one of the essential conditions for the forests protection. The state of the natural element in Poland is affected, in various scale, by a number of factors, including those causing the formation of unfavorable changes in the forests condition. In this study, we would like to focus on a group of anthropogenic factors, whose negative impact, in our opinion, can be limited by the well−managed green public procurement policy. The aim of this study is to show the legal possibilities offered by the new EC directives on public procurement in relation to the protection of legal good which are forests, in order to stimulate the national legislator to proper implementation of these provisions into national legal order. Contents provided in this study are based on analysis of the provisions of normative acts and views expressed in the science of law on the ground of considered issues. At the same time, the analysis conducted in such a way allowed us to obtain the following results and conclusions. First of all, the environment protection, including forests, is becoming an increasingly important part of any modern economic policy of the state. Emphasizing the achievement of environment protection aims, including forests, through public procurement, requires the activity of the state, in particular the activation of particular groups of public entities. Only a coherent and integrated policy for public procurement in the state, can give the desired results. From our point of view, the President of the Public Procurement Office has a crucial role in the creation of public procurement environmental policy. At the same time, with the existence of legislation enabling the use of public procurement to protect the environment, including forests, the entities granting public procurement often do not benefit from these opportunities. In our opinion, there is some kind of mental barrier of people responsible for public procurement procedures that focus on the current cost of purchase, not interested in further operating costs and any maintenance and repair. It is therefore advisable to add more attention and care in the preparation of specification of terms of procurement, in order to take into account possible criteria relating not only to the current cost of purchasing, but also including subsequent operating costs. To this the new legislation contained in Directive 2014/24 EC and Directive 2014/25 EC should significantly contribute.

Forest land administered by the State Forests, National Forest Holding is sometimes used for non−forest purposes, i.e. for recreation centres, hotel service facilities or for public roads. Some of this land is developed with buildings or facilities constructed by tenants and is used by them. The paper describes the problem of evaluating the legal status of such land with regard to the ownership, Land and Property Register data, permitted use in the local plan and exclusion of the land from forest use. The case study is based on the example of the Elemis Recreation Centre located in Stare Jabłonki, Ostróda commune, whose land is administered by the Stare Jabłonki Forest District. The performed analysis defined actions leading to the organising of the legal status of such facilities. These actions include: separation of plots with different types of use, ordering the status of the register by updating the type of use, exclusion of the forest land from production, updating the local zoning plan, land development legalization.

The issue of sustainable tourism within valuable natural areas has been extensively discussed ever since the emergence of sustainable development philosophy in the 1990s. In view of growing public interest in nature recreation and tourism development, the importance of addressing this subject matter has hitherto increased significantly. The main objective of the present paper was to offer a tool for supporting development and promotion of sustainable tourism in Poland’s forests managed by the State Forests – National Forest Holding. GIS technology, and specific tools for network analysis were used in the project. During task realization, only free and open software sources were used. The work was performed based on the example of the Forest District Żołędowo (Regional Directorate of State Forests in Toruń, Poland) with the use of District’s spatial data resources. A web application was created to present information about tourist attractions and infrastructure on an interactive map with tools for route planning. As a result, there has been developed the web mapping application which provides general access to tourism related information and enables planning touristic routes by pre-specified criteria. Implemented routing algorithms can help traffic management and further protection of the areas vulnerable to anthropogenic pressures. The system created not only promotes attractive tourist sites but also, supports targeting tourist traffic, and accordingly – adds to the progress of sustainable tourism.

The paper analyses direct costs of nature conservation and biodiversity protection incurred by forest districts of the State Forests in the Mazowieckie Province in the period 2008−2011. It also examines sources of their financing. The study shows that the largest amount of money – 65% of all costs – was spent on a wide range of activities related to biodiversity protection. The most significant fund donors were forest districts themselves. They provided 68.3% of all resources for nature conservation and biodiversity protection. The research also shows that funds received for these purposes from the state budget are rather of secondary importance.

Zadania administracji publicznej w zakresie ochrony gruntów rolnych i leśnych w Polsce obejmują realizowanie przepisów prawa powszechnie obowiązującego w tej dziedzinie. W ten sposób kształtowana jest nowa rzeczywistość w rolnictwie i na obszarach wiejskich, realizująca standardy Unii Europejskiej w polskich realiach. Dotyczy to zwłaszcza ochrony środowiska oraz zgodne z przeznaczeniem korzystania z gruntów rolnych i leśnych.
Public administration tasks for the protection of agricultural and forest land in Poland include the implementation of a universally binding law. In this way, a new reality is shaped in agriculture and rural areas, implementing standards of the European Union into the Polish reality. This applies especially in reference to the protection of the environment and complying with the intended use of agricultural and forest land.
