Libya is highly dependent on exhaustible and volatile hydrocarbon resources, which constitute the bulk of government revenues. Although resource wealth provides the means to promote socio-economic development, procyclical fiscal policies threaten macroeconomic stability as well as fiscal sustainability and intergenerational equity. This paper provides an assessment of the cyclically adjusted fiscal stance, analyzes fiscal sustainability according the permanent income framework, and simulates various fiscal policy rules with the objective of developing a rulebased fiscal strategy that would delink the economy from oil price fluctuations, improve the management of resource wealth, and safeguard macroeconomic stability. The empirical results suggest that an “enhanced” structural fiscal balance rule would provide the strongest anchor for policymaking, accommodating for output and/or commodity price shocks, though at the cost of relative complexity.

The article studies the new legislation of the Russian Federation on public financial control. The author justifies the idea of reforming financial control through the need to fight corruption, which has obtained a warning scale in Russia and threatens the state’s foundations. The article contains an analysis of the powers vested in external and internal state financial control institutions, of entities subject to control and methods of control. The author notes that representations and ordinances issued by control and accounting institutions, based on the results of control activities, are designed to force the violators of financial discipline to eliminate the revealed violations. The author concludes that the necessary condition for effective implementation of public financial control is its clear legal regulation. The article stresses that the improvement in financial control in Russia is based on clearly stated principles, in accordance with international legal principles of independent auditing (control).

The article examines municipal assets’ management in the context of the revenue derived from assets by municipalities and cities with powiat status in Poland. The author first describes the specificity of the financial management in the public sector, with particular emphasis on the revenues obtained by local government units from assets. Next, based on the study of a sample of Polish municipalities and cities with powiat status, he describes changes to the revenue from municipal assets. In the final section, the possibilities of increasing revenue from this source are evaluated.

The paper concentrates on changes in the public finance sector in recent years: a topic of great importance from the viewpoint of maintaining stability of finan‑ cial system and from both national and EU perspective. The effects of the current financial crisis have stressed the need for action to reduce the growing deficit and public debt. Debt crisis shows that it is necessary to conduct an effective fiscal con‑ solidation to put and maintain economies of many countries on a path of sustain‑ able growth. The paper begins with a brief presentation of theory. In the following part, the paper discusses structural and cyclical causes of the rising debt. Changes in the legal environment, including key issues, were also discussed. Fiscal rules, fiscal councils and the fiscal pact were therefore analyzed in detail. The authors furthermore pay attention to certain limitations and weaknesses of fiscal policy, stressing the necessity to look at the economy from a broader perspective and to use other tools and instruments of state policy. The study includes recent data on GDP, the budget deficit, public debt and expenditure and revenue in the EU.

The aim of this study is to present and assess the methods of public management in local government units. For this purpose, the author used the dogmatic-legal method and analyzed the literature. The sources supporting the budget and its expenses have been indicated. This article describes two basic methods which are the budget and the long-term financial forecast and presents the basic assumptions of these methods.

The present analysis is devoted to the financial autonomy of communes and the ways of understanding it. The author analyzes the legal, jurisdictional and actual determinants of the commune’s financial independence and points to the consequences following from them. The author poses a hypothesis that the constitutional value in the form of the financial autonomy of communes is not full realized by the parliament in contemporary Poland, with the Constitutional Tribunal underestimating it. The increase in the revenues of communes is not adequate to the duties assigned to them by the parliament. The consequences of the ongoing process include an increased debt of the communes and their problems with realization of the needs of local communities, the latter being the goal whose realization was the reason to have established the local self-government.
Przedmiotem analizy uczyniono samodzielność finansową gminy i sposoby jej rozumienia. Autor analizuje prawne, orzecznicze i faktyczne determinanty samodzielności finansowej gminy i pokazuje wynikające z nich konsekwencje. Stawia tezę, że w Polsce wartość konstytucyjna w postaci samodzielności finansowej gminy nie jest w pełni realizowana przez parlament, że także Trybunał Konstytucyjny nie przyporządkowuje jej należnego znaczenia. Dochody gmin wzrastają nieadekwatnie do powierzanych im przez parlament zadań. Konsekwencjami zachodzącego procesu są znaczny wzrost zadłużenia gmin i problemy gmin z realizacją potrzeb lokalnych wspólnot, czyli tego celu, dla którego realizacji jest ustanowiony samorząd gminny.

The article aims to estimate the current level of public finance sustainability in the European Union, taking into account the starting fiscal position, the possibility of withdrawing fiscal impulses, the future costs of population aging, and possible financial market responses. The author achieves this objective by using an indicator method similar to that used by the European Commission. However, this method has been modified by diversifying projected GDP growth rates and public debt interest rates, Gajewski says. The assumption is that the interest rate may vary depending on the response of financial markets to the debt-to-GDP ratio. The author demonstrates that almost all EU countries have lost their medium- and long-term fiscal sustainability. Greece and Ireland appear to be the worst off among the analyzed countries, Gajewski says. Both these economies suffer from a high structural budget deficit and potentially high costs of population aging. Most other countries will also be forced to make strong fiscal adjustments to achieve primary surpluses far exceeding those in the period before the financial crisis. The calculations also show that Sweden, Estonia and Bulgaria boast the highest levels of public finance sustainability in the European Union, the author concludes.

Goal – The authors undertake to assess the scale and form of anti-crisis state assistance in the context of restoring the stability of the financial system in the EU. Such assistance is a form of intervention undertaken independently by EU Member States under the conditions of admissibility applicable in the EU. The applied instruments include: state aid (discussed in detail in this paper) and financial assistance on general terms applied in the form of unconventional instruments. The authors attempt to answer two basic questions: Was anti-crisis assistance necessary in the EU in order to maintain the stability of the financial system? What are the long-term consequences of implementing such measures at the EU level and in individual EU Member States? Research methodology – The study uses the method of analysis of partial phenomena and identification of causal changes occurring in the financial system. On this basis, theoretical inference is carried out allowing to determine whether the anti-crisis measures used by EU financial policy have brought tangible results for the financial system and the real economy. In order to formulate final conclusions, available statistical data and the results of research conducted on an international level are analyzed. Next, the current value of financial aid is estimated and the adopted assumptions and efficiency of the implemented instruments of state financial policy are analyzed and assessed. Score – In view of the objective and scope of the conducted research, it is expected that the obtained results will allow the authors to identify the scale of public aid and the assistance provided in the form of unconventional financial policy instruments implemented during the global financial crisis. This approach will make it possible to perform an appraisal of the use of selected mechanisms for stabilizing the financial system. The conducted research should enable the authors to assess the impact of anti-crisis aid on the state of public finances and the stability of the market financial system.

The article looks at the relations between the financial law in Poland and various public management theories. The author claims that institutional design of the Polish financial law seems to be rooted in administrative law and orthodox conceptions of bureaucracy, although new ideas and institutions that are implemented might stem from the New Public Management. The author argues that such implementation without prior substantial systemic changes may result in counter-productive effects. Although changes are unquestionably necessary, current reform proposals lack holistic vision of the public finance sector and aim at short-term political benefits.

The subject of this article are the issues related to the Polish financial law. They aim at answering the questions whether the financial law should be considered as a separate branch of law. The research on the scope of the financial law subject as such as well as its elements (mainly public finances) contribute to this analysis. The study of the aim and the subject of the law and financial regulation as well as the standards functioning within the field of financial law will enable the research on the codifying and separatist trends existing in this area of law.
Przedmiotem artykułu są kwestie związane z polskim prawem finansowym. Jest on próbą odpowiedzi na pytania czy prawo finansowe powinno być sklasyfikowane jako osobna dziedzina prawa. Badanie w zakresie przedmiotu prawa finansowego jak również jego składników (głownie finansów publicznych) zostały ujęte w tej analizie. Zbadanie celu oraz przedmiotu prawa i regulacji finansowych, jak również standardów funkcjonujących w obszarze prawa finansowego umożliwią prowadzenie badań nad skodyfikowaniem i trendami separatystycznymi istniejącymi w tym obszarze prawa.

The article focuses on the issues and problems caused by the economic crisis of 2008 for public-private partnership (PPP). The challenges faced are presented from the point of view of a public entity, a private partner and a financial institution, as well as the relationships between these parties and the influence of economic issues on these relations. The most crucial of these challenges seems to be: the pressure on public finance and growing difficulties in financing the public infrastructural investments, the rise of the economic risk of investments and the necessity of sufficient and appropriate transfer and management of risk, and finally – the lack of interest of financial institutions to finance long-term liabilities. The aim of the author is to provide a precise description and diagnosis of the issues mentioned above, which might improve the strategic management of PPP market as well as management of projects. The article is based on experience, documents and working papers concerning the countries and markets of the European Union but the presented conclusions should be of more universal nature.

Purpose: The purpose of this article is to confirm the thesis that the amount of public funds expenditure has no impact on the effectiveness of state functioning, which – to a greater extent – is dependent on the efficiency of these funds. In the article, the author claims that in the case of the European Union there is no explicit evidence concerning the efficiency of public funds in Member States – both on the micro and macro level. Methodology: A literature review conducted on the basis of collections of academic and scientific articles and an analysis of particular solutions implemented in the European Union and in OECD Member States as well as concerning the consolidation of public funds in the context of the effectiveness of state functioning. Originality: The author of this work – on the basis of the (performed) analysis presented in the article, explains that the optimal fiscal policy should use appropriately selected tools allowing to achieve the best (optimal) method for the management of public funds, in particular the external and internal position of the economy of the given country. The key factors that decide on the effectiveness (excluding non-financial factors) are neither universal (absolute) nor relative extent of public spending. The author concludes that the level of effectiveness is either dependent on the structure of this spending and procedures connected with public expenditure planning, executing, accounting and reporting processes, or the level (quality) of the effectiveness and efficiency evaluation system.

The purpose of the article is to analyse how to balance public interests with the protection of privacy in the tax field. It has not been an easy task especially in the context of access to financial information. In this area, the compromise to achieve transparency needs to pay regard to the principle of proportionality, as reinforced by recent case law of the ECJ, and align with specific legislation such as the EU General Data Protection Regulation and recently enacted EU Digital Services Act. It is extremely important to investigate the possible consequences of acting against fundamental rights that are attributed to European citizens (and not only), such as the right to privacy and the protection of personal data. The paper aims to provide relevant and further insight to paths that lead to a fair way to handle such relevant information. Every citizen, every academically inclined and dedicated individual, every public official, every judicial agent, must question whether the public interest can ever, or at least, recurrently, surpass a fundamental right to privacy, specially, in a sensible area as the financial information of an individual. Such actions can often lead, if mistakes are made along the way, to dangerous outcomes, such as public humiliation, and can even harm the person’s professional and personal life. Methodology. In the course of the paper, an analysis is made of public decisions taken in cases across the European continent. Additionally, some considerations are made about the recent legislation that is produced by competent authorities, particularly the European Institutions. Results of the research. The authors offer a personal insight regarding the information that has been gathered, confirming some significant concerns. What is of crucial importance, as stated in the title of this article, is a well established balance between the public interest and the protection of privacy, with explained and defined possible paths to follow.

Theoretical background: The SARS-CoV-2 pandemic has caused violent reactions from the governments of almost all countries in the world. The attempt to contain a pandemic by restricting the mobility of society has had a huge impact on people and some businesses. As a result of COVID-19 restrictions, it became necessary to introduce special state aid programs for those businesses that were most affected by these restrictions. This was also the case in Poland. We based our analysis on welfare economics (Harberger, 1971), in which government support for enterprises is legitimized when their situation would have been worse without these interventions.Purpose of the article: The aim of this article is to assess the impact of public aid granted to large companies in Poland on their financial condition. The research problem is to answer the question whether the companies that received the aid needed it. In assessing the appropriateness of aid, liquidity, debt level and profitability indices were used, which directly resulted from the objectives of COVID-19 aid granted in Poland. The added value of the study is combining the analysis of data from financial statements with information on state aid published by the Office of Competition and Consumer Protection (UOKiK).Research methods: The research sample consisted of 1,201 large Polish enterprises from the non-financial sector. The study used non-parametric statistical tests and quartile analysis.Main findings: The results show that the aid went to entities that were already in a worse financial situation before the pandemic. At the same time, it was demonstrated that the aid did not distort the market mechanism, i.e. it neither excessively improved the situation of supported entities nor significantly worsened the situation of entities that did not benefit from the aid.
