Subject and purpose of work: The subject of the study are the elements of the Ukrainian financial control system. A combination of those elements enables formulating a concept which is directed at financial control of communes. The purpose of the study is identifying main directions of modernization of the Ukrainian financial control system over self-government units. Materials and methods: This study provides an analysis of government data and commercial statistics based on official studies, evaluation reports, program documents, website data, open research papers and promotional materials. The main elements and European experience that, in the author's opinion, are necessary for the construction of an effective finance control system of communes have been used in the construction of the concept of financial control over communes. Results: The key elements of the system of financial control over local self-government units of Poland are revealed. The improvement of financial control over communes in Ukraine and a number of organizational, economic and legal steps to optimize financial control at the local level are proposed. Conclusions: The article presents the main principles, measures and steps functioning in Polish financial control,which constitutes the basis for the formulation of a model of local finance control in Ukraine

The article is devoted to the legal bases for control in the sphere of use, reproductionand protection of the animal world. legislative support of environmental control in the fild of use, reproduction and protection of wildlife was considered. Th system and powers of state authorities and bodies of local self-government concerning the implementation of the control function in the field of use, reproduction and protection of the animal world were investigated. On the basis of the analysis of legal literature and legislation of Ukraine, the peculiarities of legal regulation of control in the fild of use, reproduction and protection of wildlife were singled out, the classifiation of environmental control in the sphere of use, reproduction and protection of the animal world by subjects of its implementation and the areas of the use of animal objects has been made. Particular attention was paid to the implementation of control in the field of fisheries as one of the types of agricultural production. It was concluded that control in the sphere of use, reproduction and protection of wildlife is one of the most important functions of the state in ensuring the right to an environment that is safe for life and health and compensation for damage caused by violation of this right, stipulated in Art. 50 of the constitution of Ukraine. Proper regulation of control activities in the fild of use, reproduction and protection of wildlife can become a guarantee of observance of the norms of the current legislation, and substantially balance the relationship between the subject and the object of control.
W artykule omówiono przepisy prawne dotyczące kontroli wykorzystania, reprodukcji i ochrony zwierząt, ze szczególnym uwzględnieniem uprawnień organów administracji państwowej i organów samorządu terytorialnego w przedmiotowym zakresie. Po przeanalizowaniu akademickiej literatury prawniczej i ukraińskiego ustawodawstwa przedstawiono specyfię regulacji kontroli w zakresie wykorzystania, reprodukcji i ochrony zwierząt oraz klasyfiację tej kontroli według kryterium podmiotu przeprowadzającego kontrolę i kryterium sposobu wykorzystania zwierząt. Ponadto opisano kontrolę w dziedzinie rybołówstwa jako jednego z rodzajów produkcji rolnej. Przeprowadzone rozważania doprowadziły do wniosku, że kontrola w zakresie wykorzystania, reprodukcji i ochrony zwierząt jest jedną z najważniejszych funkcji państwa w zakresie zapewnienia każdemu obywatelowi prawa do bezpiecznego dla życia i zdrowia środowiska oraz że w przypadku naruszenia tego prawa przysługuje odszkodowanie, co przewiduje art. 50 konstytucji Ukrainy. Nie ulega wątpliwości, że właściwa regulacja prawna kontroli w zakresie wykorzystania, reprodukcji i ochrony zwierząt jest jedną z gwarancji przestrzegania obowiązujących w tej materii przepisów, może również przyczynić się do zrównoważenia stosunków między podmiotem a przedmiotem tej kontroli.

The article studies the new legislation of the Russian Federation on public financial control. The author justifies the idea of reforming financial control through the need to fight corruption, which has obtained a warning scale in Russia and threatens the state’s foundations. The article contains an analysis of the powers vested in external and internal state financial control institutions, of entities subject to control and methods of control. The author notes that representations and ordinances issued by control and accounting institutions, based on the results of control activities, are designed to force the violators of financial discipline to eliminate the revealed violations. The author concludes that the necessary condition for effective implementation of public financial control is its clear legal regulation. The article stresses that the improvement in financial control in Russia is based on clearly stated principles, in accordance with international legal principles of independent auditing (control).

The article presents the concept of technical supervision and the issue of its location in the public administration control system. This problem is analyzed through the prism of two concepts having a well-established meaning in science: control and supervision. The authors analyzed solutions in the field of technical supervision presented in non-legal literature. The subject of considerations are also technical supervision units.

Kontrola wewnętrzna w administracji publicznej jest z jednej strony rodzajem wielu kontroli występujących w sferze publicznej, ale z drugiej – instrumentem sprawnego zarządzania w tej sferze. Autor przedstawia specyfikę kontroli wewnętrznej w administracji publicznej, korzysta-jąc zarówno z teorii kontroli, jak i porównań do kontroli wewnętrznej w sektorze prywatnym, i w tym celu wykorzystuje w szczególności metodę krytycznej analizy źródeł. Stawiając za cel udowodnienie niemożności bezrefleksyjnego stosowania przepisów ustawy z dnia 15 lipca 2011 r. o kontroli w administracji rządowej do klasycznej kontroli wewnętrznej, będącej swego rodzaju samokontrolą organu administracyjnego, porównuje w różnych płaszczyznach działanie orga-nów administracyjnych, będących z jednej strony kontrolującym, a z drugiej kontrolowanym do charakterystyki kontroli wewnętrznej, w której kontrolującym i kontrolowanym jest ten sam organ (jednostka). W tym celu posiłkuje się przede wszystkim metodą dogmatyczno-prawną, charakterystyczną dla egzegezy zawiłości działania administracji rządowej.
Internal control in public administration represents, on the one hand, numerous controls in the public sphere, and, at the same time, it constitutes an instrument for effective management in this sphere. The author presents the specificity of internal control in public administration, availing himself both of the theory of control and comparisons with internal control in the private sector and, for this purpose, he applies, in particular, the method of critical analysis of sources. In order to prove the impossibility of thoughtless application of provisions of the Act of 15 July 2011 on control in government administration to classical internal control, which is a specific style of self-control of an administrative body, the author compares, in different planes the activity of administrative bodies which act, on the one hand, as a controller, and, on the other hand, as the controlled, with the profile of internal control in which the controller and the controlled is the same body (unit). In this respect, the author uses, primarily, the dogmatic and legal method, characteristic of the exegesis of the complexity of the operation of government administration.

Evaluation of the quality of 52 health-related websites, created with wiki technologyThe emergence of Web 2.0 philosophy of using Internet as a platform generated by all Internet users could have many implications for the future of healthcare. While application of the Web 2.0 tools, such as wikis, blogs, podcast and social networks to medicine and healthcare has definitely many benefits (e.g. to develop communication in healthcare and education), there is a growing concern about the quality of the sources of information built using these tools. According to general philosophy of the web 2.0 every Internet user could be the author of Internet’s content. Such a practice could be especially dangerous in case of sources of health related information, where the reliability and accuracy are especially crucial, because there is to much risk to harm the patient if inaccurate and misleading information was posted. The aim of the following study was to assess the quality of the sources of information, built with wiki technology (which is one of the web 2.0 applications).

The paper deals with the issue of control of the municipal social welfare center performed by the commune council revision commission. The proper considerations were preceded by remarks regarding the principles of organization and functioning of the local government administration in the commune. Against this background, the legal position of the social welfare center, its manager, self-government employees, including social workers was characterized. The legal nature of the revision committee was also referred to and the legal basis for its operation was presented. The rights of the revision committee to the social assistance center were discussed, and the principles and course of the control made by it were approximated. Attention was paid to the diversity of control items. In particular, a significant problem of protection of personal data of the manager and employees of the center during the control was pointed out.

The aim of the article was to measure the level of effectiveness of Management Control using a survey method among employees of educational institutions in selected aspects of management practice. The article discusses the basics of the Management Control System in the context of considering its effectiveness in shaping the quality of educational services. The basic understanding of Management Control in the public sector was presented and similarities and inspirations from management methods used in business practice were analysed. The next part of the article presents the results of research among employees of educational institutions in the Mazowieckie Voivodeship. Conclusions from the research results concerned the perspective of the effectiveness of the Management Control System in public educational institutions.  The final conclusions discuss the weaknesses of Management Control and development elements constituting the basis for improving both the organizational aspects of educational institutions, as well as the level of human resources management.

Rozważania zawarte w artykule dotyczą konstytucyjnych uwarunkowań sądowej kontroli administracji publicznej. Zostały opisane konstytucyjne rozwiązania przyjęte przez takie kraje jak Austria, Niemcy i Polska. W artykule przedstawione są kwestie związane z rozwojem i funkcjonowaniem sądownictwa administracyjnego we wspomnianych krajach. Szczególna uwaga poświęcona jest nowelizacji Konstytucji Austrii, która weszła w życie w dniu 1 stycznia 2014 roku, w ramach której stworzono dwuinstancyjne sądownictwo administracyjne i wyposażono austriackie sądy w szerokie kompetencje do merytorycznego orzekania. W artykule omówiono także kwestię zgodności rozwiązań przyjętych w Ustawie o zmianie ustawy prawo o postępowaniu przed sądami administracyjnymi z dnia 9 kwietnia 2015 roku z Konstytucją RP. Zmiany te w swoich założeniach wpisują się w trend rozszerzania merytorycznych uprawnień orzeczniczych sądów administracyjnych. W treści artykułu zwrócono także uwagę na problem związany ze skutecznością sądowoadministracyjnej kontroli działań administracji publicznej.
The subject matter of the article is the constitutional conditions of judicial review of public administration. Constitutional solutions chosen by countries like Austria, Germany and Poland are discussed. The article presents issues related to the development and functioning of the administrative judiciary in these countries. Particular attention is paid to the amendment of the Constitution of Austria which entered into force on 1st January 2014, and which introduced two-instance administrative judiciary and provided Austrian courts with broad competences for substantive adjudication. Also discussed in the article is the issue of the compatibility of the solutions adopted in the amendment to the Law on Proceedings before Administrative Courts of April 9, 2015, with the Constitution of the Republic of Poland. These changes follow the trend of broadening the authorization of the administrative courts for substantive judgment. Finally, attention is devoted to the problem of the effectiveness of the judicial control of the operation of the public administration authorities.

The aim of the study is to analyse two selected supervision institutions: the management control in the public finance sector and the internal control system in banks as examples of regulatory and supervision institutions, having regard to their functional similarities in the two areas of financial law: public finance law and financial market law, and banking law. The study was inspired by the desire to answer the question about the essence of internal control in public finance (management control), which shows, at least in terms of the control objectives, many elements characteristic for internal control systems operating in banks. The aim of the article is also to answer the question about the way of understanding the notion of “internal control” under the banking law and public finance law, its essence, objectives, functions, as well as the coherence of the understanding of the objectives and criteria of internal control in the widely understood financial law areas. However, the research objective is also to show the differences between management control and internal control as supervision institutions, which due to the specificity of the controlled financial matters are separate and thereby allow to present the functions of control institutions related to the needs specific to particular areas of the broadly understood financial law and a multi-faceted approach to the most effective use of control institutions.

Introduction: The World Health Organization (WHO)estimates that together tobacco and alcohol kill about 9 million people annually despite aggressive and widespread public health controls. These legal industries persist because of the demand for their products and their substantial economic influence, which is magnified by the concentration of wealth in the executives of leading corporations that profit from increased legal drug sales.Materials and methods: This preliminary study quantifies the link between global premature deaths from these legal addictive drugs as a function of executive compensation in order to provide the necessary data to make more effective policy recommendations for preventing legal drug-related deaths.Results: The results indicate a need to incentivize chief executive officers(CEOs), such that they have a constant marginal utility per life saved.Conclusions: An executive compensation incentive that moves to eliminate tobacco use is achieved by a pay structure that increases exponentially with the number of lives saved.Key words:tobacco control; alcohol control; global public health; executive compensation

The article presents an overview of changes in law concerning management assessment in Poland, as it pertains to public financial institutions in accordance to the implementation of relevant European Union treaties. The subject of examination is the amendment of Public Finances Act from the year 2001. Partial evaluation will be performed on the application of a bill dated from 2009. According to the author, this is mistake, as the original American bill (Sarbanes-Oxley Act) that inspired the European legislation, only requires the management of private firms to file such declarations. Meanwhile Poland decided to have the law apply to public sector as well. The article attempts to evaluate the last 15 years of the currently functioning legal system. Studies have shown that the current supervision system of management assessment is ineffective, ineffectual and largely useless forcing the employees to needlessly rely on risk analysis and resort to costly control mechanisms and procedures.

This paper deals with the administrative and legal elements of both the establishing and the implementation of risk management mechanisms in public administration, as well as indicating how important this process is for supporting the proper functioning of each entity in the public finance sector. At the same time, it highlights the need to constantly update the applicable formula of organisational management, especially in terms of efficiency, effectiveness and optimisation of the means to improve the quality of public services provided. The constantly growing awareness of an entity’s management regarding threats to accomplishing set objectives can also be observed. Therefore, it becomes necessary to develop risk management mechanisms limiting the adverse impact of various factors on proper task implementation.
