Opis:
The possibilities of influence of the Ukrainian and Polish citizens on a decisions and activity of legislators are analysed in this article. The basic legal forms of participation of citizens in law-creation are examined; the policy of law-creation are defined; the possible ways of improvement the dialog between citizens and legislators are determined. The athour analyses the Ukrainian and Polish legal acts, in which rights of citizens on an address, legislative initiative, access to public information, participation in consultations, in activity of public councils, lobbying are described. The different forms of citizens participation in social and political life are described the Ukrainian and Polish legislation, however there is a question about the effectiveness of such participation. Neither deputies nor representatives of government in Ukraine and in Poland are obliged to take into account opinion and suggestion of NGO in their final decisions or laws. They must collect information, work over it and then accept a responsible decision. The objective consideration of public opinion depends on those persons. Now it’s necessary to disseminate information among the citizens about the existent legal forms of their participation in creation of legislation. The dialog between the authority and society is necessary for development of the state. The basis of policy of law-creation must be a benefit for the most people.

Over the last dozen of years, many activities have been undertaken related to the reform of the law establishment system, however its quality still calls for improvements. The mediocre quality of the regulations established in our country has been evidenced, among others, by the position of Poland in the rankings on regulatory environment. For instance, in the Sustainable Governance Indicators (SGI) ranking done by the Bertelsmann Foundation, in the item related to the application of the mechanisms to identify the needs, objectives and socio-economic impact of newly introduced regulations, Poland was as low as on the 37th position out of the 41 countries subject to the ranking in 2017. In their article, the authors analyse the law establishment process from the perspective of the correctness of forecasting socio-economic effects (impact assessment) of drafted regulations. The examination was based on the findings of the NIK audit conducted in the area in the government legislative process.

W procesie formułowania polityki publicznej Unii Europejskiej istotną rolę odgrywają mechanizmy deliberatywne, które mają rekompensować niedostatek demokracji przedstawicielskiej. Jednym z nich są konsultacje społeczne prowadzone głównie przez Komisję Europejską. Artykuł zawiera analizę roli otwartych konsultacji publicznych w programowaniu i realizacji unijnej polityki sektorowej. Wyraźnie widoczny jest wzrost ich znaczenia i częstość stosowania w odniesieniu do różnych rodzajów polityki gospodarczej. Konsultacje pełnią różne funkcje, przede wszystkim służą jako instrument legitymizacji podejmowanych przez Komisję decyzji oraz jako ważne źródło informacji o opiniach i stanowiskach interesariuszy. Szczegółowo analizowany jest wypadek konsultacji społecznych dotyczących umowy transatlantyckiej TTIP ze względu na jej wagę dla wszystkich Europejczyków oraz masowe protesty społeczne, które już występowały i mogą również mieć miejsce w przyszłości.
Public deliberation mechanisms play an important role in the process of the EU public policy making because they are to compensate the shortage of representative democracy. One of them is social consultation carried out mainly by the European Commission. The paper consists of the analysis of open public consultation role in designing and implementing the EU sector policies. Their growing importance and frequency of use with regard to the economic policy and its kinds is clearly visible. The aims of such consultations are various. They are primarily used as an instrument of legitimacy of decisions taken by the Commission as well as an important source of information about the stakeholders’ opinions and stance. Opis:
The subject of this article is the use of public consultations in the process of planning a participatory museum. The authors start by mentioning current discussions about participation in culture and debates among museum curators, culture experts, and sociologists concerning a new type of museum. In this context, they present Nina Simon’s idea of a participatory museum, which is a theoretic frame of reference for the long-term activities of the Józef Piłsudski Museum in Sulejówek, an institution desiring to establish a modern participatory museum in a certain social context. At the end, the results of the public consultations are presented. The data shows that one condition for the creation of a participatory museum is an effective, institutionalized, interactive system of communication. Three areas connected with the local community in which the museum could develop participatory projects were also indicated: the joint creation of memorial sites, community integration, and exhibition and educational activities.

The problem addressed in the article concerns the influence of specific conditions of hydrotechnical investments on the planning of works. The aim of the paper is to discuss the environmental factors of key importance in planning and organising hydrotechnical works on inland waters. A case study method with analysis of documentation was used as an example of an investment project consisting in reconstruction of the Odra river regulation structure on the section from Ścinawa to the mouth of Nysa Łużycka river, carried out within a complex investment programme named Odra – Vistula Flood Management Programme.

In the last several years a new approach to city management can be observed in Polish cities, and it takes into account elements of public participation (participatory governance). New, often non-statutory forms of the participation and representation of citizens are also being introduced into the decision-making process relating to spatial planning. The purpose of this article is to show the current state of the socialization of the local planning process in Poland. The article tries to answer the question of how to strike a balance between the specialized knowledge of the planners and the contribution that inhabitants bring to the process. Taking the example of Poznań City, the existing forms of public consultations and their impact on the content of planning documents were evaluated. To achieve this goal, the results of participants’ observations during the public consultations and their surveys were used. A diverse activity of the city inhabitants was observed, depending on the type of local development plans and interests, often of particular residents and their representative social organizations. The need to improve the decision-making process in urban planning was highlighted, taking into account alongside the traditional the new forms and tools of social participation (e.g. public participatory GIS ). Their use will increase the range of consultations and inclusion of so far under-representedgroups of residents of the City.
Efektem liberalizacji gospodarki przestrzennej w Polsce jest pojawianie się konfliktów przestrzennych na obszarach podlegających intensywnym procesom urbanizacji, szczególnie w dużych miastach. Towarzyszy temu wzrost świadomości i aktywności społecznej w zakresie zagospodarowania przestrzeni miejskiej. Według Davida Harveya („Bunt miast, prawo do miasta i miejska rewolucja”, 2012) „prawo do miasta” oznacza nie tylko prawo dostępu do jego zasobów i dobrego miejskiego życia w najróżniejszych jego aspektach, lecz także możliwość decydowania przez mieszkańców o tym, co w ich mieście się dzieje i w jakim kierunku się ono rozwija. Od kilku lat w polskich miastach daje się zauważyć nowe podejście do zarządzania, uwzględniające elementy realizacji ww. prawa poprzez dialog społeczny (participatory governance). Nowe, często pozaustawowe formy uczestnictwa mieszkańców i ich reprezentacji wprowadzane są także do procesu decyzyjnego, jakim jest planowanie przestrzenne. Celem artykułu jest przedstawienie stanu uspołecznienia procesu lokalnego planowania przestrzennego w Polsce. W artykule podejmuje się próbę odpowiedzi na pytanie: Jak osiągnąć równowagę miedzy specjalistyczną wiedzą planistów a wkładem, jaki wnoszą do procesu planistycznego mieszkańcy? Na przykładzie Poznania ocenie poddano dotychczasowe formy konsultacji społecznych oraz ich wpływ na treść dokumentów planistycznych, a tym samym kształtowanie przestrzeni miejskiej. Aby osiągnąć zakładany cel, wykorzystano wyniki obserwacji uczestniczącej w trakcie konsultacji społecznych, badania ankietowe ich uczestników oraz mieszkańców obszarów objętych miejscowymi planami zagospodarowania przestrzennego. Zwrócono uwagę na potrzebę doskonalenia procesu decyzyjnego w miejskim planowaniu przestrzennym, uwzględniającego obok tradycyjnych także nowe formy i narzędzia partycypacji społecznej (m.in. participatory public GIS).

The goal of the work is the presentation of a method of design whose effect is an architectural and urban concept that creatively utilises the results of public consultations. The analysis includes a case study with particular emphasis on trailing the train of thought used during the analysis and conceptual work. The work argues that a public consultations report can be a significant source of knowledge and a valuable inspiration for the designers of public spaces and the urban landscape. The concept that has been presented shows a model of an innovative approach to public participation, understood as involvement in design, as well as participation in the creation and transformation of one's own place.
Celem pracy jest prezentacja metody projektowania, której efektem jest koncept architektoniczno- urbanistyczny twórczo wykorzystujący wyniki konsultacji społecznych. Analiza obejmuje studium przypadku ze szczególnym naciskiem na śledzenie ciągu myśli wykorzystywanego podczas analizy i prac koncepcyjnych. Praca dowodzi, że raport z konsultacji publicznych może być znaczącym źródłem wiedzy i cenną inspiracją dla projektantów przestrzeni publicznych i miejskiego krajobrazu. Przedstawiona koncepcja pokazuje model innowacyjnego podejścia do partycypacji społecznej, rozumianej nie jako uczestnictwo w projektowaniu, ale jako uczestnictwo w tworzeniu i przekształcaniu własnego miejsca.

Idea partycypacji obywatelskiej, choć nienowa, wciąż jest silnie akcentowana we współczesnych koncepcjach zarządzania publicznego. Jednym z jej przejawów jest udział w konsultacjach społecznych, którym poświęcono szczególną uwagę w artykule. Konsultacje ewoluują wraz z postępem cyfryzacji administracji publicznej. W związku z tym wielu badaczy stara się uchwycić potencjał technologii informacyjno-komunikacyjnych (ICT) w zakresie doskonalenia konsultacji społecznych i związanych z nimi procesów decyzyjnych w administracji publicznej. W artykule przedstawiono wyniki badań mających na celu identyfikację rozwiązań informatycznych, które mogą być stosowane w procesach konsultacji społecznych na etapie zgłoszenia inicjatywy ich przeprowadzenia i etapie ich realizacji. W badaniach wykorzystano metodę analizy źródeł wtórnych, którymi były uchwały określające zasady i tryb przeprowadzania konsultacji społecznych z mieszkańcami, przyjęte w gminach województwa śląskiego (140 uchwał). Zidentyfikowano 11 podmiotów (grup podmiotów), które w świetle uchwał mają prawo wystąpienia z inicjatywą przeprowadzenia konsultacji. Były to najczęściej organy wykonawcze, grupy mieszkańców i rady gmin. Tylko w przypadku jednej gminy w uchwale zapisano możliwość zgłoszenia takiej inicjatywy drogą elektroniczną. Najpowszechniejszymi metodami prowadzenia konsultacji w świetle analizowanych uchwał są: badania ankietowe, otwarte spotkania z mieszkańcami i zbieranie zapisanych uwag i opinii. 79% badanych jednostek zadeklarowało zastosowanie przynajmniej jednej metody prowadzenia konsultacji wiążącej się z zastosowaniem narzędzi informatycznych. W 11% jednostek w uchwale zadeklarowano wdrożenie gminnej platformy poświęconej konsultacjom społecznym. Tylko jedna jednostka wskazała w uchwale możliwość użycia specjalnej aplikacji mobilnej do tego celu.
The concept of citizen participation, although not new, continues to be prominently emphasized in contemporary public management theories. One manifestation of citizen participation is involvement in public consultations, which is the focus of this article. The consultation processes evolve alongside the advancing digitalization of public administration. Consequently, many researchers strive to capture the potential of information and communication technologies (ICT) in enhancing public consultation processes and the related decision-making processes in administration. The article presents the results of research aimed at identifying IT solutions that can be utilized in public consultation processes, at the stages of initiating a consultation and conducting the consultation itself. The research was conducted using secondary source analysis. The analyzed sources were resolutions outlining the principles and procedures for conducting public consultations with citizens, adopted in the municipalities of the Śląskie Voivodship, Poland (140 resolutions). Eleven entities (or groups of entities) were identified that, according to the resolutions, have the right to initiate consultations. Most commonly, this right is granted to executive bodies, groups of residents, and municipal councils. Only in one municipality's resolution was the possibility of submitting such an initiative electronically mentioned. The most frequently used methods of conducting consultations, as indicated by the analyzed resolutions, are: surveys, open meetings with residents, and collecting written comments and opinions. 79% of the surveyed units declared the use of at least one method involving IT tools for conducting consultations. 11% of the units declared in their resolutions the implementation of a municipal platform dedicated to public consultations. Only one unit declared the use of a special mobile application for public consultations.

7 maja 2010 Komisja Europejska zainicjowała konsultacje społeczne nad dokumentem „W kierunku nowej strategii energetycznej dla Europy 2011-2020”. 10 listopada 2010 r. KE przedstawiła nową strategię dotyczącą konkurencyjnej, zrównoważonej i bezpiecznej energii. Zaprezentowano priorytety w zakresie energii na najbliższe 10 lat i przedstawiono działania, które należy podjąć w celu osiągnięcia oszczędności energii, utworzenia rynku o konkurencyjnych cenach i „pewnych” dostawach, wzmocnienia przywództwa technologicznego i skutecznych negocjacji z partnerami międzynarodowymi. W związku z powyższym w niniejszym artykule postanowiłem odnieść się do prezentowanych propozycji KE. W opracowaniu zarysowujemy wstępne zapisy projektu SRK do 2020 r., jak również omówiłem elementy strategii Europa 2020, które obejmują „inicjatywę flagową” na rzecz promowania „efektywnej surowcowo Europy”. W opracowaniu zaprezentowałem proces konsultacji społecznych, mający na celu przygotowanie ostatecznej wersji Strategii Energia 2020. W artykule szczegółowo omówiłem pięć priorytetów strategii, którymi zostały innowacje technologiczne, nowoczesny, zintegrowany system energetyczny, dążenie do systemu energii niskowęglowej, silna i skoordynowana zewnętrzna polityka energetyczna, ochrona obywateli UE. W trakcie omawiania poszczególnych zagadnień staram się odnieść do poszczególnych postulatów. Według mojej oceny strategia jest potrzebna UE, powstaje jednak pytanie o możliwości jej sfinansowania szczególnie w krajach uboższych Unii.
On May 7th,,2010, the European Commission launched a public consultation of the document "Towards a new energy strategy for Europe 2011-2020". On November 10th, 2010 the European Commission adapted a document “Energy 2020 - strategy for a competitive, sustainable and secure energy”. The strategy presented priorities in the field of energy for the next 10 years, and outlined actions to be taken in order to achieve energy savings, create a market characterized by competitive prices and "secure" supplies of energy, strengthening of technological leadership and effective negotiation with international partners. In this paper, author take into account these European Union documents and comment on both the provisions of the preliminary draft of the Polish National Development Strategy 2011-2020 and on selected aspects of the Europe 2020 strategy, including the "flagship initiative" aimed at promoting “resource efficient Europe”. The paper presents also the results of a consultation process which led to the elaboration of the final version of the “Energy 2020”. The paper discusses in detail five priorities of this strategy, which encompass: technological innovation, modern, integrated energy system, the quest for low-carbon energy system, a strong and coordinated external energy policy and protection of energy needs of EU citizens. While discussing these issues, author attempt to present their opinions on the individual postulates. In author assessment such a strategy constitutes a welcome step for the EU; however, the questions related to the possibilities of financing the strategy, particularly by the poorer EU countries.

Opis:
The process of consultations with civil society is important as it contributes to a transparent legislative process and a good balance of interests in the legislative proposals. In the European Union works on the consultations with stakeholders have accelerated with the publication of the White Paper on European Governance in 2001. In Poland, we have been observing a number of initiatives concerning public consultations and dialogue with civil society in recent years, both on the side of the central administration and the non-governmental organisations. In this context, the analysis of the European consultation standards is even more important. It seems that the European experience in that area constitutes a good reference for the national solutions. This article analyses the EU standards concerning the process of consultations with interested parties. Having in mind effectiveness of EU lobbying groups as well as certain weak points of the Commission consultation process, this article seeks, in particular, to evaluate the Commission new “Stakeholder Consultation Guidelines”. The article concludes also with some reflections on how the EU standards could apply for the Polish consultation practices in the legislative works.

W artykule podjęto problem badawczy, uwzględniania potrzeb strategicznych całej gminy i potrzeb lokalnej społeczności, w koncepcjach krajobrazowych, opracowywanych w ramach poszerzonych konsultacji społecznych dokumentów planistycznych. Zadano pytanie o łączne uwzględnianie tych różnych perspektyw. Zagadnienie przebadano na przykładzie opracowanej w 2022 r. koncepcji „Centrum plenerowej fotografii ślubnej”, dla zespołu pałacowo - parkowego w Sławikowie. Zastosowano studium przypadku, metodę badania przez projektowanie oraz obserwację uczestniczącą. Koncepcja została oparta na wcześniejszych etapach poszerzonych konsultacji społecznych i sformułowanych oczekiwaniach interesariuszy, co wpłynęło na akceptację proponowanych rozwiązań przez organy gminy i lokalną społeczność (codziennych użytkowników). Wykazano, że równoległe uwzględnienie potrzeb strategicznych całej gminy i lokalnej społeczności w koncepcjach krajobrazowych, daje szanse na rozpoczęcie ciągłego procesu rewitalizacji, jak i wypracowanie odpowiednich zapisów konsultowanego projektu dokumentu planistycznego.
This article addresses the research problem of taking into account the strategic needs of the whole urban or rural commune (gmina) and the needs of the local community in landscape concepts developed as part of extended public consultation on spatial planning documents. A question was asked about the joint consideration of these different perspectives. The issue was examined using the example of the concept of Outdoor Wedding Photography Centre for the palace and park complex in Sławików, developed in 2022. The methods of case study, research by design, and participatory observation were used. The concept was based on earlier stages of extended public consultation and formulated expectations of stakeholders, resulting in the acceptance of the proposed solutions from the perspective of the commune authorities and the local community (everyday users). It has been found that the parallel incorporation of the strategic needs of the commune and the local community into landscape concepts provides an opportunity to initiate a continuous revitalization process and to develop appropriate provisions for the consulted draft spatial planning document.

From the point of view of social policy, the need of security is considered as the indispensable part of functioning and development of every society. Citizens’ participation avers that the inhabitants will have the possibility of taking part in making decisions about their own surrounding, which results in development of the sense of security. The actions taken in the social space initiate the existence of the selfaware civil society. This article’s main aim is to discuss the possibilities of assuring the social security through civil commitment and their active participation in the public life. The formal instruments that occur in the system of Polish law (i.e. a participation in the open debate, a participation in the elections, a legislative initiative) have been analyzed. Those instruments enable to the residents the participation and codecision making and, what follows, they contribute towards forming broadly defined security.
