Opis:
Low trust to politicians, political and public institutions in Ukraine is a widely discussed problem. Basing on comparative data that came from Hungary, Poland and Russia, the authoress explores the reasons of cross-national similarities and differences in the level of trust. Results show that low trust to some institutions (like Parliament) and high trust to others (like Church and Army) is rather a common feature of post-communist countries that can be taken either as a proof of cultural as well as institutional theory of trust.

Celem artykułu jest przedstawienie sposobów pomiaru jakości i efektywności funkcjonowania instytucji publicznych i procesów rządzenia. Wskaźniki zaprezentowane w tekście, przygotowane przez niezależne, międzynarodowe organizacje, posłużyły do opracowania rankingów krajów, pozwalających na identyfikację różnic w jakości sprawowania władzy przez polityków. Artykuł prezentuje najbardziej popularne wskaźniki, za pomocą których dokonano oceny omawianego zjawiska w Polsce, na tle państw członkowskich UE. Polska zajmuje w tych zestawieniach bardzo niską lokatę, co potwierdza złą jakość zarządzania krajem. Umocnienie polskiej pozycji w strukturach UE wymaga przeprojektowania instytucji publicznych, reform ekonomicznych i naprawy życia politycznego.
The focus of the article was to describe the process of measurements due to the quality and efficiency of public institutions and government. The indicators described in the text, created by independent international organizations, were used to elaborate country rankings, which helped to identify the differences between quality of government processes. The article presents the most popular indexes, which estimate the scale of this phenomenon in Poland against the background of the European Union. Poland is placed on very low position in this comparison, which means the country is wrongly managed. Strengthening of Poland's position in the European Union structures requires redesigning of many public institutions, economic reforms, and "remedying" political life.

This article presents evaluation of the development of public administration in Poland in 2002-2006 years, from the point of view of the advancement of the process of transferring public services on the electronic services platform as well as development of informatization of the central and regional public administration offices (ministries, province offices, district offices and municipality offices) and the public institutions (libraries, ZUS - Social Insurance Institution, fiscal offices) too.

The paper deals with different forms of political impact on the constitutional justice. The main subject of presentation is the analysis of recent Polish experiences which can help to identify better the threats to the independence of the constitutional justice in democratic space. The first part takes the effort to describe the specific phenomenon of political pressure exerted on the constitutional justice through indirect influence (so called “political mobbing”). The argumentation developed in the paper proves that even such indirect and sometimes subtle interferences from the political elite create the very danger for accountability of constitutional justice and have a negative impact on constitutional awareness of the society. The second part deals with typical reasons (ongoing in all constitutional courts) of inevitable “politization” of the constitutional review, first of all the political procedure of appointments of the judges and the political nature of constitutional cases. The thesis is defended through the analysis of Polish experiences which indicate that the presence of politics, inherent element of the constitutional justice, cannot be automatically identified with lack of the objective and independent judgments issued by the judges. Internal independence and formal external guarantees of it allow us to avoid the pathological impact of politics. Two factors have a particularly great impact on the attitudes of judges and support them in fulfilling their responsibility: the continuity of jurisprudential lines, accumulation of constitutional experience (acquis constitutionnel) and the permanent dialogue between the constitutional courts and the international courts or among the constitutional courts in the European space.

Danish Public Service Broadcasting has gone through two consecutive transitions. The first in the late 1980s and early 1990s was a transition from a paternalistic public service monopoly, Danmarks Radio, to a so-called Danish model with two dominating non-profit public service stations in a competitive television system. The second is an ongoing transition from public service broadcasting in an increasingly politicised and competitive television system to public service media in a complex digital media environment. The article analyses the transition processes in a media system and media policy approach with focus on political, juridical, economic, and institutional perspectives. The article presents two main arguments. Firstly, the institution Danmarks Radio, the politicians, and most of the national cultural elite experienced the first transition as revolutionary, and in respect to agenda setting, mode of address, and institutional changes the transition was revolutionary, but the ‘real’ revolutionary transition is the current transition to a digital media environment where the original idea of broadcasting is challenged by fundamental changes in the relation between media institutions and media users. Hence the whole concept of public service has to be reconsidered, and the public service institutions will have to reinvent new positions for themselves. Secondly, Danish media policy in general and public service broadcasting in particular has historically been dominated by a national cultural and political paradigm, but in the current situation are (national) cultural issues marginalised and the media policy is governed within international economic and legal paradigms.

W artykule przedstawiono kilka aspektów związanych z gromadzeniem zbiorów w bibliotece uczelni wyższej oraz zaprezentowano elektroniczny system wspomagający zarządzanie zasobami informacyjnymi w bibliotece uczelni niepublicznej. Zaprojektowany i wdrożony system nie rozwiązuje wszystkich problemów związanych z gromadzeniem zasobów, ale umożliwia sprawniejsze i efektywniejsze zarządzanie zasobami informacyjnymi oraz racjonalne dopasowanie zbiorów dydaktycznych do potrzeb studentów.
The article discusses several aspects related to library acquisition in a library of an institution of higher learning and presents an electronic system supporting information resources management in a non-public university. Apparently, the designed and implemented system does not solve all problems related to resource acquisition, but enables a more effective management of information resources and efficient adjustment of didactic resources to the needs of students.

The main objection to the empowermet theory in management education here is the fact of concealing fundamental violence that defi nes relations within institution of academy. Removal of the question of conflict from the concept of empowerment deprives it from real emancipating power. In contrast to empowerment, Harol Bloom’s idea of subjectivity as an agon is presented.

Dyskusja nad reformą systemu dotowania instytucji kościelnych toczy się w Polsce od kilkunastu lat. Potrzeba zmiany funkcjonującego modelu uzasadniona jest zarówno z uwagi na anachroniczny charakter obowiązujących rozwiązań, jak i ze względu na konieczność ograniczania wydatków publicznych. Projektowanie jakichkolwiek zmian powinno być jednak poprzedzone gruntowną analizą obowiązujących unormowań prawnych, w szczególności w kontekście ich zgodności z zasadami konstytucyjnymi, a także wielkości samych transferów z budżetu państwa, realizowanych w oparciu o obowiązujące przepisy. Jednym z istotnych wymiarów działalności kościołów i innych związków wyznaniowych jest edukacja na poziomie szkół wyższych. Ocena przyjętych w tym zakresie rozwiązań nastręcza wiele trudności, z uwagi na rozległy zakres regulacji normatywnej, rozproszenie unormowań w licznych aktach prawnych oraz złożoność samej materii. Podstawowym celem niniejszego artykułu jest przedstawienie regulacji prawnych dotyczących finansowania uczelni kościelnych ze środków publicznych. Analizie poddano przepisy tworzące normatywne podstawy finansowania uczelni kościelnych ze środków budżetu państwa, w tym regulacje stanowiące tytuły dotacyjne na gruncie ustawy prawo o szkolnictwie wyższym oraz przepisy umożliwiające przekazywanie na rzecz tych uczelni innych niż dotacje środków budżetowych.
The debate over the reform of the system of subsidising church institutions has been in progress in Poland for over a decade. The need to change the current model is justified both by the anachronistic nature of the binding legal solutions and the necessity to reduce public spending. Any change proposals, however, should be preceded by a thorough analysis of the binding legal provisions, particularly in the context of their conformity to constitutional principles and the volume of transfers from the government budget based on the binding regulations. One of the significant aspect of the activity of churches and other religious associations is education at the tertiary level. The evaluation of the solutions in this area gives rise to difficulties, due to the wide scope of normative regulations, the fact that the provisions are dispersed over numerous legislative acts and the complexity of the subject matter itself. The primary aim of his article is to present the legal regulations concerning the public financing of church institutions of higher education. The provisions constituting the normative bases of financing church higher education institutions from the government budget have been analysed, including the regulations that constitute subsidy entitlements in accordance with the Higher Education Act, as well as the provisions allowing these institutions to receive budgetary funds other than subsidies.

The subject of this article is identification of the structure of key issues related to the assessment of effectiveness of public procurement. These issues are generally discussed in two dimensions: (1) as a narrower question of the appropriate choice of evaluation criteria in individual orders, and (2) as a broader problem of assessing the effectiveness of the entire public procurement institutional systems. When it comes to evaluation criteria in individual orders, the subject of discussions are primarily two issues: (1.1) selection and proper definition of economic effectiveness criteria, and (1.2) the admissibility of non-economic criteria. The effectiveness of procurement systems as a whole may be assessed: (2.1) in a comparative manner, as one of alternative ways of delivery of public services, and (2.2) separately, for each individual system, related to its internal goals, functional and structural criteria.

Financial institutions are commonly known as institutions of public trust and they are fundamental for activities of other economic entities. The level of trust determines the competitive position of financial institutions. That is why care about the best standards is the most important task for these institutions. Financial institutions are called institutions of public trust and thus high professionalism and more responsibility is demanded from them. This article presents basic problems concerning trust and institutions of public trust. The article is also an attempt to verify the statement that financial institutions are institutions of public trust.
Instytucje finansowe powszechnie uznawane za instytucje zaufania publicznego są ważnymi instytucjami wspierającymi działalność pozostałych uczestników rynku. Poziom zaufania z pewnością decyduje o pozycji konkurencyjnej instytucji finansowej. W związku z tym dbałość o jak najwyższe standardy jakości jest w przypadku tych instytucji pierwszoplanowym zadaniem. Nazywanie instytucji finansowych instytucjami zaufania publicznego skutkuje tym, że instytucjom tym stawiane są podwyższone wymagania odnośnie do ich profesjonalizmu czy odpowiedzialności. W artykule przedstawione zostały podstawowe zagadnienia związane z zaufaniem i instytucjami zaufania publicznego. Podjęto także próbę zweryfikowania powszechnie panującego przeświadczenia o tym, że instytucje finansowe są instytucjami zaufania publicznego.

The paper aims at presenting the status of informal institutions in Poland as well as indicating to what degree informal components of an institutional system are a good ground for the development of market economy. In Polish society, institutions associated with self-expression values prevail over those associated with survival values, which contributes to actuating the economic activity. However, the rationalism level is low and results from much stronger connections with tradition than in the case of citizens of many highly developed countries. Low level of trust in people is an indication of relatively poor efficiency of institutions, while great inclinations for non-observance of law reflect the inconsistence of informal vs. formal institutions.

The article proposes an ambidextrous organization adaptation in public universities. The essence of the proposal is to change the organization of HEI of "90 °", i.e. one in which the faculties create an organization axis and research teams the coordination axis to which the roles are reversed. In ambidextrous university faculties are mainly engaged in mass education on the first level and research teams educate elites of students at the level II and III, conducted R&D activities simultaneously. According to the author, this proposal creates conditions for more effective use of human resources in HEIs.
