    The author of the opinion claims that heads of provincial sanitary inspections cannot be considered as employees “serving” provincial governor within the meaning of Article 268a of the Code of Administrative Procedure. That interpretation is supported by the wording of Article 19 of the Law on Provincial Governors. According to the author, since the legislature pointed out in a separate provision, in what situations and whom the provincial governor may authorize to exercise his powers, it must be assumed that in other situations such authorization is not permitted. That interpretation is also consistent with the principle of constitutional legality which is the fundamental principle of administrative law. The author gives a conclusion that the province governor cannot authorize provincial health inspectors to conduct, on his behalf, administrative enforcement of non-cash obligations related to preventive vaccination.

    Powstanie samorządu terytorialnego jest wynikiem procesów decentralizacyjnych państwa, które rozpoczęły się w 1990 roku. Wtedy to reaktywowano samorząd terytorialny na poziomie gmin. Struktury wojewódzkie pozostały elementami administracji rządowej, zachowując swój dotychczasowy charakter. W rezultacie pojawił się dwustopniowy sposób sprawowania władzy państwowej. Dalszą decentralizację zadań i kompetencji na rzecz samorządu terytorialnego wprowadziła reforma administracyjna z 1998 roku. W jej wyniku powstały powiaty i województwa. Ukształtował się nowy system administracji publicznej w terenie, którego podstawą był samorząd terytorialny funkcjonujący na każdym szczeblu podziału terytorialnego. Samorząd terytorialny, złożony z gmin, powiatów i województw, stanowi strukturę poziomą, w której kolejne szczeble realizują zadania na coraz większym obszarze i nie pozostają względem siebie w układzie hierarchicznej podległości. Natomiast administrację rządową ograniczono tylko do szczebla wojewódzkiego. Relacje między administracją rządową i samorządową reguluje m.in. konstytucyjna zasada pomocniczości, odrzucająca zależność hierarchiczną. Wynika to z faktu, że w obecnej strukturze państwa nie ma jednostki „niższej”, która byłaby podporządkowana jednostce „wyższej”. Takie podejście ma fundamentalne znaczenie, ponieważ nawet w obecnej chwili zdarzają się sytuacje, kiedy starosta uważa się za zwierzchnika wójta, a minister – ich obu. Podobna relacja występuje między wojewodą a jednostkami samorządowymi, wojewoda wyposażony jest jednak w uprawnienia nadrzędne i nadzorcze wobec szczebla podstawowego. Jednak nie tylko zlecone zadania i polecenia wojewody są dodatkowymi uprawnieniami, które dają mu możliwość władczej ingerencji w sprawy jednostek samorządowych. W niniejszym artykule przytoczono praktyczne przykłady, jak te uprawnienia wojewody w istotny sposób mogą ograniczać niezależność samorządu.
    The creation of local government is the result of the state decentralization process that started in 1990. Then local government at the municipal level was reactivated. The provincial structures remained the elements of the state government, while maintaining their existing character. The result was as a two–step exercise of state power. Further decentralization of tasks and responsibilities for local government was introduced by the administrative reform in 1998. As a result, poviats and provinces emerged. A new government system on the basis of the system of local government functioning at every level of the territorial division was formed. Local government consisting of municipalities, poviats and provinces is a horizontal structure in which each successive level carries out tasks in a wider area, without being subordinate to one another in a hierarchical system. The central administration was limited to the provincial level. The relationship between central and local governments is regulated by the constitutional principle of subsidiarity. The subsidiarity principle rejects the hierarchical relationship. This is due to the fact that the current structure of the state is not “lower”, which would be subordinate to the “higher” unit. This approach is fundamental, because even at present time there are situations in which a district governor is considered superior to a mayor, and a minister to the two of them. A similar relationship exists between a governor and local government units. However, a province governor is equipped with overriding and supervisory powers to the local government. These powers give him the right to intervene in the affairs of local government. The essence of the issue discussed in this article is to show how these powers of a province governor significantly restrict the autonomy of local governments.

    In the Second Polish Republic there were new administrative structures. As a result of the unification process, central and territorial administrations were created. Territorial administration was divided into government and self-government administration. Government administration was created by general and special administration. A particular organ in the administration of the Second Polish Republic was the voivod who performed two functions. On the one hand, he was the representative of the Government in the area of the voivodship, on the other hand he was the head of the general administration. The character of the authority of the provincial governor and his office, which assisted him in performing his tasks, was presented on the example of the Provincial Office in Krakow of the 1932.
    W artykule podjęto próbę scharakteryzowania ustroju Urzędu Wojewódzkiego Krakowskiego w świetle Statutu organizacyjnego i szczegółowego podziału czynności wprowadzonego zarządzeniem Wojewody Krakowskiego z 21 grudnia 1931 r. Na potrzeby artykułu dokonano również skrótowego przedstawienia struktury aparatu administracji publicznej w II Rzeczypospolitej, ze szczególnym uwzględnieniem funkcji wojewody jako przedstawiciela rządu oraz szefa administracji ogólnej.

    This article presents the normative basis for the functioning of the Lublin Province Governor in the years 1944–1950. It discusses the attributions of the Province Governor as a representative of the government, the second degree general administration and the chairman of the Provincial Department. Due to the nature of the era, it was indispensable to expose the positions of the individuals who acted in the office of the Lublin Province Governor within the structures of the Polish Worker’s Party and Polish United Workers’ Party. In the realities of the so-called “Lublin’s State of Poland” the functionality of the Lublin Province Governor was of a pioneer character, because the stagnation in the fights with the Third Reich, which on the Polish part of the front of war lasted for several months, and the geopolitical repercussions resulting thereof, made the Lublin area a platform for the people’s legislator to try out new concepts concerning the political system. Progression of the actions at the front of war have implied the loss of the Lublin Province’s unique status, and the definitive end of its special rank have been caused by the seat of the highest state authorities from Lublin to Warsaw in February 1945.
    Artykuł przedstawia normatywne podstawy działalności Wojewody Lubelskiego w latach 1944–1950. Omówione zostały atrybucje wojewody jako reprezentanta rządu, organu administracji ogólnej II stopnia oraz przewodniczącego Wydziału Wojewódzkiego. Z uwagi na charakter epoki, nieodzowne stało się naświetlenie pozycji osób piastujących urząd Wojewody Lubelskiego w strukturach lubelskiego aktywu PPR i PZPR. W realiach tzw. Polski Lubelskiej działalność Wojewody Lubelskiego miała charakter pionierski, ponieważ trwający przez kilka miesięcy na odcinku polskim zastój w wojnie z III Rzeszą i wynikłe z niego geopolityczne reperkusje uczyniły z Lubelszczyzny pole do testowania przez ustawodawcę nowych koncepcji ustrojowych. Postępy na froncie skutkowały utratą przez Wojewodę Lubelskiego jego wyjątkowego statusu, a definitywny kres jego specjalnej randze przyniosło przeniesienie siedziby najwyższych władz państwowych z Lublina do Warszawy w lutym 1945 r.

    Rozwój sieci parafialnej na terenie nowotarszczyzny, a zarazem szerzenie kultu świętych, swój rozkwit przeżywało w XIV stuleciu. Jednak możemy na bazie zachowanych źródeł również dostrzec pierwsze zręby zarówno osadnictwa, jak i pierwszych parafii jeszcze w XIII wieku. Co związane było z działalnością mnichów cysterskich, którzy otrzymali w 1234 r. przywilej zagospodarowania wymienionego regionu od wojewody krakowskiego Teodora Gryfity. Część fundacji parafialnych utworzona została z inicjatywy królów polskich, którzy wspierali rozwój organizacji kościelnych na Podhalu. Pisząc o oddawaniu czci świętym nie można pominąć o ważnej roli wśród mieszkańców przede wszystkim wstawiennictwa św. Katarzyny Aleksandryjskiej, która do dziś patronuje nowotarskiej farze oraz miastu. Powierzając swe codzienne troski i prośby, mieszkańcy podhalańskiej ziemi zwracali się także do patronów Polski: śś. Wojciecha i Stanisława, biskupów męczenników, jak i do innych świętych pańskich, którzy ponieśli śmierć za wiarę w Chrystusa. Ważnym elementem pobożności ludowej stało się pielęgnowanie kultu Matki Bożej. Celebrowano w kościołach święta maryjne, które zakorzeniły się w tradycji lokalnej. Ponadto w Ludźmierzu funkcjonowało sanktuarium maryjne, do którego pielgrzymowali licznie mieszkańcy zarówno okolicznych wsi, jak i odleglejszych regionów.
    The development of a network of parishes in the region of Nowy Targ, as well as the dissemination of the cult of saints bloomed in the 14th century. However, on the basis of the remaining sources, we can observe the first foundations of both settlement and first parishes already in the 13th century. This was connected with the activity of the Cistercian Friars, who in 1234 received a privilege of administering the region from the voivode of Cracow Teodor Gryfita. Some of the parish foundations were created at the initiative of Polish kings, who supported the development of church organisations in the Podhale region. When writing about saint worship one cannot ignore the important role of the intercession of Catherine of Alexandria, until these days the saint patron of Nowy Targ and its parish church. The inhabitants of the Podhale region entrusted their everyday concerns and pleas also to saint Adalbert and saint Stanislaus, the patrons of Poland, bishop martyrs and other saints who died for their faith in Jesus Christ. An important element of people’s faith was the worship of the Virgin Mary. Marian festivities rooted in local tradition were celebrated in churches. Marian sanctuary in Ludmierz was visited by numerous pilgrims both from surrounding villages and farther regions.

    The surviving sources provide very little detail on the governors of Arabia in Late Antiquity (AD 284–641). The best documented period is the late 350s and early 360s, for which most information comes from several letters of Libanius of Antioch; a number of writings by that renowned rhetorician are at the core of all present-day lists and biographical notes on the governors of Arabia in that period. A closer look at Libanius’ letters, for all their ambiguity, does nevertheless invite a revision of the current state of knowledge, either through confirming earlier findings, or correcting and supplementing them.
    Celem artykułu jest addenda et corrigenda biogramów namiestników Arabii, z najlepiej oświetlonego źródłami okresu, tj. przełomu lat pięćdziesiątych i sześćdziesiątych IV stulecia n.e. Bazę źródłową stanowią przede wszystkim listy retora Libaniusza, adresowane do namiestników Arabii. Są to teksty niełatwe w interpretacji, choć poddane już gruntowanej analizie (głównie: O. Seeck, W. Ensslin, G. Sievers, P. Petit, M. Sartre), wciąż pozwalają na oryginalne wnioskowanie. W artykule podejmuję próbę skorygowania listy namiestników Arabii, ułożonej przez M. Sartre’a, a także poszerzenia lub skorygowania naszej dotychczasowej wiedzy w zakresie tytulatury i kompetencji, pochodzenia, wykształcenia, tożsamości religijnej oraz przebiegu karier.

    Many scientific works are lack the specific historical material, but complex, multidimensional processes of Ukrainian state are often considered after simplified traditional schemes, without taking into account regional specificity, due to the prolonged stay of Ukrainian lands in the structure of other state formations. The process of the institution establishment of the provincial government attached from the Polish-Lithuanian Commonwealth territories is stipulated by the policy of the tsarist government aimed at strengthening of the centralized management of the Russian Empire. It acquired the concentrated shape in the «theory of official nationality», which envisaged the integration of autocracy, orthodoxy and nation into the «united and indivisible» Russia. The policy of the central authorities was determined as well by the struggle for spheres of influence between the «Russian imperialism» and by the Polish landowners’ elite, the attempt to tear the Ukrainian population from the Polish revolutionary movement. Catherine II considered each province as a governorship, and therefore at each of them appointed “the sovereign’s Viceroy or the Governor-General and subordinate to him «the ruler of the governorship or the Governor». Later, «the Governor of province or Governor became to be known as civil Governor. The latter had subordinated for the management of economic affairs «the Lieutenant Governor or Vice-Governor”. As a rule, the Governors-General were as well commanders of military districts. On the outskirts of the Empire, the Governor-General are not so much watched, but rather directed the state policy in a certain direction, as a kind of «repeater» of the cultural activities of the state, and in some places its founder. In the North-Western and South-Western region governors-General primarily pursued political goals: «to prevent the possibility of an armed uprising and to tighten the connection of the land with the Empire». The direct management of the province was exercised by civil governors. An important step in determining their place and role in the hierarchy of the higher ranks of the Empire, and a careful regulation of their activities was the «General instructions of the civil governors» (1837) Nicholas I. The order clearly defined the legal status of these governors primarily as «security guards inviolability of the supreme rights of the autocracy.» At the same time they had no right t to «make regulations..., install, taxes or charges», and they are not allowed to change court verdicts or to assume the functions of judges. The order stated the provisions of the welfare of the inhabitants of the province, their protection from unlawful harassment. One of the powerful levers of state policy in the Russian Empire was the Orthodox Church and faith; it is no accident that the civil Governor was given the responsibility in the ensuring favorable conditions for strengthening, protection from the split, the influence of heretical doctrines and facts of the proselytism. At the heart of the provincial institutions there was the principle of their division into administrative, judicial and financial. Full executive power belonged to the provincial government, headed by the civil Governor. The Job title of the provincial Prosecutor, the provincial solicitors for criminal and civil cases, provincial land surveyor, architect, etc. had been founded. Beside the provincial board, the Governor headed a significant part of other provincial agencies. The Governor, who was appointed by the Emperor at his discretion or on the proposal of the Ministry of internal affairs, was formally the head of the local provincial administration. He was the highest representative of the administrative and police authorities in the province, had broad administrative and supervisory credentials.

    Opis:
    Artykuł przedstawia główne etapy formowania struktury administracyjnej Krymu w ramach Imperium Rosyjskiego, cechy podziału terytorialnego i specyfikę organizacji zarządzania. Autor wykazał, że przez cały badany okres polityka administracyjna Krymu była prowadzona zgodnie z interesami politycznymi i gospodarczymi rosyjskiego rządu w regionie. Do początku XX wieku głównymi jednostkami terytorialnymi były tutaj: gubernia, powiat, włość, miasto, wieś. Miasta, które stały się najważniejszymi ośrodkami administracyjnymi, politycznymi, gospodarczymi i kulturalnymi, odegrały szczególną rolę w regionie. W polityce administracyjnej władz rosyjskich, podobnie jak w innych częściach Imperium, ścierały się centralizm i regionalizm: z jednej strony próby całkowitego połączenia wszystkich dziedzin życia z prowincjami wewnętrznymi, z drugiej strony – uwzględnianie specyfiki lokalnej, zwyczajów i tradycji narodów zamieszkując tę ziemię.
