W niniejszej pracy przedstawione zostały najważniejsze zagadnienia związane z ochroną znaku towarowego, na czele z problematyką prawa ochronnego na znak towarowy oraz roszczeń wynikających z jego naruszenia. Rozważono naturę i treść prawa ochronnego na znak towarowy w polskim ustawodawstwie. Dalej została przeprowadzona analiza naruszeń prawa ochronnego ze szczególnym uwzględnieniem przysługujących uprawnionemu z tej racji roszczeń. Przemyślenia w tym zakresie uzupełniono wnioskami prawnoporównawczymi, odnoszącymi się do orzecznictwa polskiego. Rozważania oparto przy tym przede wszystkim na regulacji zawartej w ustawie Prawo własności przemysłowej z dnia 30 czerwca 2000 r. Z uwagi na rozmiar i charakter pracy, pominięto w zasadzie przepisy ustawy o zwalczaniu nieuczciwej konkurencji z dnia 16 kwietnia 1993 r., które są fundamentem tzw. uzupełniającej ochrony znaków towarowych. Ponadto uwagę skupiono przede wszystkim na zagadnieniach materialnoprawnych, raczej nie wchodząc w tematykę praw-noprocesową.
In this study I present the main issues related to the protection of the trademark, with the main fokus on the problems of the right of protection for a trademark and the claims resulting from its infringement. I consider the nature and content of the right of protection for a trademark in the Polish legislation. Further analysis was carried to stress out the violations of the right of protection with special emphasis entitled to the holder of this reason claims. The reflections have been supplemented with comparative law conclusions , relating to Polish law. Considerations were based primarily upon the regulation contained in the Act of Industrial Property Law of 30 June 2000. Due to the size and nature of the work, the principle of the provisions of the Law on Unfair Competition of 16 April 1993., which are the foundation of the so-called supplementary protection of trademarks are not included. In addition, attention was paid mainly to substantive issues, rather than not going into the subject of the law-processing.

The article presents the issues of legal regulation of termination of pregnancy in the context of the jurisprudence of the Constitutional Court (CC), in particular the ruling in the case K 1/20.The discussion opens with an analysis of models of abortion practices regulations, as well as the solutions adopted in the Polish legal system, with a short historical introduction. It is emphasized how important is the issue, which results from the fundamental differences in worldviews between the supporters and opponents of the permissibility of the practice of termination of pregnancy, which is expressed in the name given to this medical practice.The right to life as an element of the human rights system is discussed, both in terms of international law and the provisions of the Polish constitution.Next, the Polish provisions on the admissibility of termination of pregnancy are presented along with a historical outline, with particular emphasis on the ruling in the case K 26/96. Based on the above discussion, the resolution in the case K 1/20 was discussed, in which the CC found the so-called embryopathological premise for termination of pregnancy to be incompatible with Polish Constitution. A polemic with the justification of the decision is presented, including the errors of interpreta-tion committed by the CC with regard to the constitutional and international form of the right to the protection of life. It is indicated that in the Polish legal system only the right to protection of life exists, not the right to life, which is referred to both by the CC and most of the doctrine.Despite the fact that this resolution does not remove the norm from the legal system, the author draws attention to the practical consequences of issuing it, in particular the occurrence of the so-called ‘chilling effect’ and unjustified activity of the law enforcement authorities.The final part of the article presents conclusions on how to legally regulate the termination of pregnancy.

Temat dotyczy problematyki istotnej zarówno z teoretycznego jak i praktycznego punktu widzenia. Problema-tyka tematu dotyczy refleksji odnoszącej się do obowiązującego od 15 kwietnia 2016r. nowego systemu rozpatrywania zgłoszeń znaków towarowych, tzw. systemu sprzeciwowego, który znacznie ułatwia i przyśpiesza rozpatrywanie podań o udzielenie prawa ochronnego na znak towarowy. Ukazanie problematyki powyższego tematu należało jednak poprzedzić rozważaniami dotyczącymi podstawowych zagadnień związanych z instytucją znaku towarowego. Wskazane zostały najważniejsze korzyści płynące z rejestracji nazwy/logo firmy jako znaku towarowego, formy w jakich powinna nastąpić ich prawna rejestracja, a także zasięg jej terytorialnej ochrony. Swoistą klamrę spinającą przedmiotową problema-tykę jest podsumowanie w którym zostały zawarte wnioski wynikające z przeprowa-dzonej analizy, a także wskazanie sposobu ochrony nazwy/logo firmy w przypadku braku dokonania jego rejestracji jako znaku towarowego. Temat należało uznać za trafny i w pełni uzasadniony, ponieważ stanowi w zakresie objętej nią problematy-ką tematykę nowatorską na gruncie prawa polskiego
This subject deals with the issues significant both from a theoretical and practical point of view. The issue concerns the topic regarding a new system that examines trademark applications - appli-cable from 15 April 2016 - also known as the opposition system, which greatly simplifies and speeds up the processing of applications for the right to protect a selected trademark. In presenting the issues above, it was necessary for this subject to preceded all of this by other considerations about basic issues related to the institution of the trademark. There were pointed the most important advantages of registration of name / logo as trademark, forms in which their legal registration should occur, as well as the extent of its territorial protection. A kind of brace holding together previously presented objects is a summary that in-cludes conclusions from the analysis, and an indication of how to protect the name / logo of the company in the absence or failure of a trade mark registration process. Subject should be regarded as accurate and fully justified because it is - in the field covered – a truly novel subject under the Polish law.

An epidemic caused by the coronavirus SARS-CoV-2 has been existed in Europe and worldwide for several weeks now. On 11 March 2020, the WHO declared it a global pandemic. At the time of writing, Europe, in particular Italy, is the largest outbreak of coronavirus. Italy is attempting to tackle the virus with increasingly drastic legal measures. On 31 January 2020, its Council of Ministers declared a state of emergency related to the sanitary risk of coronavirus infection. Italy has started the fight against the virus using two legal instruments: the first is the Council of Ministers’ declaration of a six-month state of emergency on 31 January 2020, and the second is a decree-law (decreto legge) issued by the Prime Minister temporarily restricting the freedom of movement throughout the state. In exceptional cases, the Italian Government has the right to issue normative legal acts. Recent legislative acts issued in Italy have undoubtedly limited the fundamental rights granted by the Constitution of 1947. These limited rights include the right of movement, but also freedom of assembly, the right to work, freedom of economic activity and freedom of conscience and religion. As a result of the legal solutions introduced, fundamental human rights are subject to justifiable restrictions in order to protect the constitutionally guaranteed right of the community to health care. In situations of epidemiological threats, protecting the lives and health of citizens is essential. Any restrictions on rights and freedoms are intended to protect these goods. However extensive these restrictions may be, in a democratic state this must be introduced under strict control and for a specified period of time linked to the duration of an epidemic.

The subject-matter of the article is the identification and analysis of the constitutional foundations of the legal provisions regulating the administrative procedure of public administration bodies in the Slovak Republic and analysis of decisions made by the Slovak Constitutional Court and Supreme Court. The administrative procedure represents an immanent process in which state and public administration bodies make decisions on rights, legitimate interests as well as obligations and duties in the field of state and public administration. The author aims to identify the most important provisions of the Slovak Constitution and to demonstrate their significance for the decision-making activities of domestic public administration bodies and at the same time to find out if the constitutional and legal basis is sufficient enough to make amendments regarding the decision-making processes of Slovak public administration bodies. The author's research hypothesis, resting on an enquiry to identify if the constitutional amendment is satisfactory and acceptable, is followed by an investigation of mutual relations between the current state of our society and its conditions being in a state of its rapid development and the contents of the constitutional amendment. It is argued that the Constitution as the basic piece of legislation must be adopted with accepted text so that potential changes would not entail having to change the Constitution.

Self-protection is the power granted to a subject to directly achieve, on an out-of-court level, for his own benefit, a certain effect in the legal sphere of the perpetrator of a harmful conduct. The right to retain the confirmatory deposit, a singular case of out-of-court termination of the contract for non-fulfillment, can be attributed to the category of self-protection, counted among the "withdrawal of self-protection". The study systematically reconstructs the requirements of the case and the protection regime of the figure, in the light of the sources and evolutionary hermeneutics of doctrine and jurisprudence, identifying its complex function and the nature of an alternative remedy.

Opis:
The right to the protection of personal data, which is part of the right to privacy, is a fundamental human right. Thus, its guarantees were included in the high-level regulations of the European Union as well as the legal norms of the EU Member States. The first Polish law regulating the protection of personal data was adopted in 1997 as the implementation of EU Directive 95/46. The law imposed a number of obligations on public and private entities which process personal data in order to protect the rights of data subjects and, in particular, to guarantee them the ability to control the correctness of processing of their personal data. Therefore, the law obliged data controllers to process data only on the basis of the premises indicated in the legislation, to adequately secure data, and to comply with the disclosure obligation concerning data subjects, including their right to correct false or outdated data or to request removal of data processed in violation of the law. However, as complaints directed by citizens to the supervisory body-the Inspector General for Personal Data Protection-showed, personal data controllers, especially those operating in the private sector, did not comply with the law, acting in a manner that violated their customers’ rights. In the hitherto existing unfair business practices of entrepreneurs, the violations of the data protection provisions that were the most burdensome for customers were related to preventing them from exercising their rights, including the right to control the processing of data, as well as the failure to provide the controller’s business address, which made it impossible for subjects whose data were used in violation of the law or for the inspecting authorities to contact the company, a lack of data security and a failure to follow the procedures required by law, the failure to secure documents containing personal data or their abandonment, a lack of updating customer data, the use of unverified data sets and sending marketing offers to deceased people or incorrect target recipients, and excessive amounts of data requested by controllers. The violations of the rights of data subjects recorded in Poland and other EU Member States-among other arguments-provided inspiration for the preparation of a new legal act in the form of the EU General Data Protection Regulation (GDPR) (which entered into force on 25 May 2018). The extension of the rights of people whose data are processed was combined in the GDPR with the introduction of new legal instruments disciplining data controllers. Instruments in the form of administrative fines and the strongly emphasised possibility to demand compensation for a violation of the right to data protection were directed in particular against economic entities violating the law.

Niniejszy artykuł koncentruje się na analizie kręgu podmiotów uprawnionych do kierowania skarg konstytucyjnych. Dla tego zagadnienia szczególnie ważna jest funkcja skargi konstytucyjnej. Stanowi ona instrument ochrony praw i wolności jednostki. Trybunał, z uwagi na lakoniczność regulacji dotyczącej tej kwestii, musiał doprecyzować ten aspekt swojej działalności. Nie budzi wątpliwości, że podmiotami tego uprawnienia są przede wszystkim osoby fizyczne z uwagi na fakt, że to one są również podmiotami praw, których skarga konstytucyjna stanowi gwarancję. Kontrowersje związane są zwłaszcza z przyznaniem czynnej legitymacji skargowej podmiotom zbiorowym, w szczególności podmiotom prawa publicznego.
The article focuses on the analysis of objective scope of right to put forward a constitutional complaint. Of particular importance, for this issue, is the function of constitutional complaint. It is an instrument of human rights protection. Due to the brevity of statutory and constitutional regulation of this problem, Constitutional Tribunal had to determine this aspect of its activity. It is glaringly obvious that individuals are the biggest group of complainants because constitutional rights inhere mainly to a natural person. It is crucial that constitutional complaint is a guarantee of exactly that entitlements. Disputes have arisen with the granting a proactive complainants legitimation for collective bodies, especially public ones.

This paper addresses the issue of child protection in the Italian legal system from a pedagogical perspective. This viewpoint recognizes the significance of law as an integral part of the pedagogical discourse. On the one hand, legal provisions directly impact the design of educational services, defining boundaries and opportunities for educational actions and for the related pedagogical documentation. On the other hand, the legal discourse itself offers a specific standpoint on the main challenges faced by educators, teachers, and pedagogists in their work. This includes issues related to families, child protection and custody, FAPA orders, foster care and adoption, family emergencies, and the role of court consultants. In this context, the paper discusses the most relevant legal aspects concerning child protection in the Italian legal system. It provides a pedagogical commentary on both legal rules and one of the services that exemplifies the critical and fruitful relationship between law and pedagogy: Neutral Space (on supervised visitation). This service is planned and overseen by educators on behalf of the Social Services. By examining this topic, the paper explores how the legal regulations not only establish boundaries and possibilities for educational action but also contributes to a deeper understanding of the pedagogical nature of the service. By adopting this approach, the paper aims to shed light on how the juridical framework not only influences educational practices but also facilitates a more comprehensive integration of pedagogy within the service.

The article looks at the history of childhood in the society, the country of Germany, and abroad. Today’s view of children as legal persons, recognizing their endowment with competencies and resources but also their ontological dependence, is a rather ‘new’ perspective in human history. Therefore the article first focuses onto the UN-Child-Right’s-Convention which was ratified in Germany in 1992. Second, a closer look at the development of the legal foundations of child protection in Germany shows how child protection in Germany was developed. The reader will get an overview about the child protection system in Germany, afterwards. The article ends with some recommendations to establish a child-rights-focused perspective in the child protection system in Germany.

Nowadays, effective protection of personal data is one of the fundamental issues of a democratic state under the rule of law. Therefore, the legislator should be very precise about the principles and standards of data processing. In the last few decades, in particular, the development of new technologies, digitalisation and the increase in the need for electronic communication has become evident, which leads to the adoption of appropriate regulations for the handling of personal data. In addition, the EU legislator has introduced the General Data Protection Regulation (GDPR) in order to harmonise the regulations of EU Member States regarding the protection of personal data. This provides a framework for the proper functioning of legal provisions across the European Union regarding the handling of personal data of its citizens.The aim of the article is to identify the legal changes resulting from the Personal Data Protection Regulation, with a particular focus on the persons to which they apply and then to analyse the regulation of ‘the right to be forgotten’. In the first part of the article, attention is drawn to the way personal data are processed and the scope of obligations incumbent on data controllers. This is because data controllers are, together with the personal data protection officer, responsible for recording data processing activities, including ongoing monitoring and responding to situations of inaccurate data processing. The second part focuses on the right to be forgotten and the assessment of this entitlement in the perspective of Regulation 2016/679. The research methods include an analysis of legal acts, at the same time using the subject literature.

The article is devoted to the coverage of the issue of criminal - legal protection of intellectual property at the present stage of state development. Some issues of optimization of the ratio of criminal – legal and civil – legal protection of intellectual property, the issue of differentiation of criminal – legal protection of personal non-property and / or property rights of intellectual property to literary, artistic and other work (copyright) and personal non-property and / or property intellectual property rights for performance, phonogram, videogram and program (transfer) of broadcasting organization (related rights). Unambiguous interpretation, logical wording in determining the signs and boundaries of socially dangerous acts and a clear relationship with other legal norms inevitably affect the correctness of law enforcement, provided that the legal constructions cover legal relations enshrined in the form of criminal offenses, delimiting criminal behavior from other actions and inaction . However, the effectiveness of the mechanism and legal effectiveness of criminal – legal protection of intellectual property, the quality of the relevant criminal – legal prohibitions and their qualified and active application should be recognized as more significant in terms of functional purpose and impact on legal relations. Thus, of course, the process of combating crimes against intellectual property directly depends on the degree of effectiveness of law enforcement agencies, both international law and legislation of Ukraine, as well as methods and techniques of intellectual property protection, which also contributes to the modern development of civil law, criminal law and procedural institutions of regulation and protection of intellectual property rights in view of the dynamics of such crimes, their type of affiliation, as well as persons who may be involved in their commission. At the same time, there is no doubt that even perfect criminal law prohibitions cannot completely replace the professionalism of a law enforcer, his technical equipment, his knowledge of regulatory legislation and high-quality investigative and operational-investigative activities.

In 2016, while testifying before a UK parliamentary committee, William Binney, former technical director of the US National Security Agency, stated that by implementing bulk surveillance programmes, “your government and my government has permitted what terrorists have wanted all along but could never achieve. That is to cause us to restrict our freedoms while also tripping up our efforts to stop them”.Despite the passage of years, controversy about the proportionality of the use of surveillance programmes involving indiscriminate and bulk data collection continues unabated. There are numerous arguments that such measures should not be used in democratic states. Despite the recurring reports of abuse and questionable usefulness of such solutions, there is also no shortage of arguments put forward by proponents of the use of untargeted measures proving the need (or even necessity) for their use for public security purposes.The issue presented here is also the subject of ongoing interest on the part of legislators and the judiciary. The article aims to provide an overview of the evolution of the ECtHR’s position on the use of electronic surveillance, in particular its untargeted forms. However, the article is intended not only to recapitulate the reasoning as set out in recent case law – including the 2021 judgments of the Grand Chamber in Big Brother Watch et al. v. United Kingdom and Centrum för rättvisa v Sweden – but also to prompt further discussion on the relevance of the Court’s position as set out in relation to the most important legal issues relating to mass surveillance. It is the author’s intention that in this way it will be possible to answer the question of whether the current standard set by the ECtHR can be considered sufficient to protect against the risk associated with the spread of modern surveillance measures and their increasing use by public authorities.
