    Opis:
    Human trafficking crosses borders between regions, countries and continents. Taking into account this fact, it is clear that the effort to improve the fight against this unwanted phenomenon requires international cooperation between Member States. This post presents an analysis of the current legal status of the fight against trafficking in human beings in the Slovak Republic in accordance with the rules of the Council of Europe. To make the fight against trafficking in human beings, the authors of the article proposed in the Slovak Republic special legislation aimed at combating trafficking in human beings with an emphasis to deal with the coordination area, but also in the identification of victims of trafficking in human beings and the provision of aid to these victims.

    Opis:
    This article concerns the changes laid down in the Act of 23 March 2017 amending ustawa o postępowaniu w sprawach nieletnich (the Juvenile Delinquency Proceedings Act) in the Polish Criminal Code, and ustawa Kodeks postępowania karnego (the Act on the Criminal Procedure Code). My remarks concern the merits of extending the catalogue of offences under Art. 240 Par. 1 of the Criminal Code by the addition of Art. 197 Par. 3 and 4. My analysis looks at the two main aspects of the problem. First I assess whether the amendment should concern Art. 240 Par. 1, bearing in mind its previous wording and its role in the Criminal Code. Secondly, I consider the situation of a rape victim, which has changed very considerably because of the withdrawal of the requirement that the victim must apply for prosecution to start. Finally I attempt to reconcile the need to achieve the preventive role of criminal law with the victim’s interest by presenting my own proposals for new legislation.
    Artykuł dotyczy zmian wprowadzonych ustawą z 23 marca 2017 r. o zmianie ustawy – Kodeks karny, ustawy o postępowaniu w sprawach nieletnich oraz ustawy – Kodeks postępowania karnego. Rozważania odnoszą się do zasadności rozszerzenia katalogu czynów zabronionych zawartych w art. 240 § k.k. 1 o art. 197 § 3 i 4 k.k. Analiza została przeprowadzona dwuaspektowo. Po pierwsze, dokonano oceny, czy wprowadzone zmiany zostały umieszczone w prawidłowym miejscu, z uwagi na dotychczasowe brzmienie art. 240 k.k. i jego rolę w systemie prawa karnego. Po drugie, odniesiono się do sytuacji ofiary przestępstwa zgwałcenia, mając na uwadze fakt, że została ona już znacznie zmieniona po zniesieniu wnioskowego trybu ścigania sprawców tego przestępstwa. Wreszcie, podjęto próbę pogodzenia konieczności realizacji funkcji prewencyjnej prawa karnego oraz interesu ofiary przez podniesienie w tym zakresie postulatów de lege ferenda.

    Artykuł zawiera opis i analizę wybranych zmian w podejściu do kontrolowania przemocy domowej z uwzględnieniem najnowszych propozycji legislacyjnych. Koncentruje się na najistotniejszych nowelizacjach i wprowadzanych kolejno instytucjach oraz procedurach zwiększających z jednej strony zakres ingerencji państwa w stosunki między osobami najbliższymi, a z drugiej możliwości korzystania z ochrony przez osoby dotknięte przemocą. Poszczególne nowelizacje wzbudzały, podobnie jak obecnie proponowane zapisy, wiele kontrowersji, zarówno natury prawnej, społecznej, kulturowej, jak i etycznej.
    The text includes a description and analysis of selected changes in the approach to controlling domestic violence, taking into account the latest legislative proposal. The text focuses on the most important, selected amendments and successively introduced institutions and procedures which on the one hand increase the scope of state interference in relations between close relatives, and on the other hand increase the possibility of persons affected by violence utilising the available protection. The individual amendments have aroused, and their proposed provisions are still arousing a great deal of controversy of a legal, social, cultural and ethical nature.
