    Opis:
    In May 2015 Pope Francis published the encyclical entitled Laudato Si’ about the proper understanding of the issue of ecology. The subject is understood by the Holy Father as one that is most natural, usual and simple, but at the same time obliging everybody, rousing and engaging both in the worldly, popular and everyday sense and in the essentially religious one, which means spiritually and morally absorbing. From the whole of Pope Francis's argument presented in the encyclical it undoubtedly follows that care of the world, also the temporal one, that is ecological life and work, is both a natural and at the same time God's commandment for man, and this means: for each man, both for a believer in God as the Creator of the world, and for a non-believer, but one who is sensible at the basic level of natural law. The Pope suggests adding the theological understanding of ecology to the common one. As a result in Pope Francis's encyclical Laudato Si’ we have received a realistic, but at the same time mystic, evangelical approach to ecology, one in the light of Christ, with the simplicity of the truth, of love of life, also of the worldly life, and with the light of beauty – the beauty of God, man, the earth and the universe. Hence, integral ecology is – according to Pope Francis – a commandment given by God to believers and to non-believers, both to the impersonal world, and to the human, personal one. True ecology stems from the reality of creation, from the love of God and man, from man’s participation in the work of creation, and finally from the sense of self-preservation of the human being.

    Ojciec Święty Franciszek ogłosił w maju 2015 r., encyklikę pt. Laudato Si o właściwym rozumieniu zagadnienia ekologii. Temat ten jest przez Papieża Franciszka rozumiany jako najbardziej naturalny, zwyczajny, prosty, ale zarazem zobowiązujący każdego, porywający i angażujący zarówno w sensie doczesnym, potocznym i codziennym, jak i z istoty swojej religijnym, a więc angażującym duchowo i moralnie. Z całości wywodów encykliki Papieża Franciszka wynika niewątpliwie to, że troska o świat, także doczesny, czyli życie i działalność ekologiczna, jest naturalnym i zarazem Bożym przykazaniem dla człowieka i to dla każdego człowieka, zarówno wierzącego w Boga, jako Stwórcę świata, jak i niewierzącego, ale mającego wrażliwość na podstawowym poziomie prawa naturalnego. Papież proponuje dodać do powszechnego ujmowania ekologii rozumienie teologiczne tego zagadnienia. W rezultacie w Encyklice Papieża Franciszka Laudato Si otrzymaliśmy ujęcie ekologii w najważniejszych tematach, realistyczne, ale i zarazem mistyczne, ewangeliczne, w świetle Chrystusa, z prostotą prawdy, miłości życia, także ziemskiego i ze światłem piękna − piękna Boga, człowieka, ziemi i wszechświata. Ekologia integralna jest zatem, według Papieża Franciszka, przykazaniem Bożym dla wierzących i dla niewierzących, zarówno co do świata nieosobowego, jak i ludzkiego, osobowego. Ekologia prawdziwa wyrasta z rzeczywistości stworzenia, z miłości Boga i człowieka, z uczestnictwa człowieka w dziele stworzenia i wreszcie ze zmysłu samozachowawczego istoty ludzkiej.

    Opis:
    The scope of the constitutional freedom of scientific research and dissemination of the fruits thereof covers not only the right to undertake scientific activity undisturbed by state intervention but also the guarantee of ownership rights to the results of such cre-ative human activity, as „intangible goods” of human creators. The researcher should be protected regardless of whether the form of research outcomes’ formulation demonstrate abilities to be express as independent work or a contribution to independent work. The legal basis for the freedom of scientific research understood in this way may be found in Art. 73 in conjunction with Art. 64(1) and (2) and Art. 21(1) as well as Art. 32 of the Constitution of the Republic of Poland. The systematic interpretation of these provisions makes it possible to formulate a constitutionally binding standard for the protection of the rights of the creator and gives the basis for formulating public legal right with relevant content like above it is drawn. The implementation of understood in this way pub-lic legal right may be asserted claims directly before a court.
    Konstytucyjna wolność badań naukowych oraz ogłaszania ich wyników obejmuje swym zakresem nie tylko wolne od ingerencji państwa uprawnienie do podejmowania działal-ności naukowej, ale także gwarancję praw własności do owoców tej aktywności twórczej człowieka jako służących mu „dóbr niematerialnych”. Ochrona taka powinna przysługi-wać badaczowi niezależnie od tego, czy sposób wyrażenia wyników badań wykazuje zdol-ność do ustalenia jako samodzielny utwór lub dzieło wkładowe doń. Podstaw prawnych tak zdefiniowanej treści wolności naukowej poszukiwać należy w art. 73 w zw. z art. 64 ust. 1 i 2 i art. 21 ust. 1 oraz art. 32 Konstytucji RP. Te przepisy poddane systemowej wy-kładni formułują wiążący ustawodawcę konstytucyjny standard ochrony praw twórcy, tworząc jednocześnie podstawy do wyinterpretowania z nich odnośnej treści publicz-nego prawa podmiotowego. Realizacji tak rozumianego prawa podmiotowego jednost-ka może dochodzić bezpośrednio przed sądem.

    В настоящее время проблема безопасности приобрела более широкое значение чем когда-либо. Возник социальный запрос на формирование самостоятельного междисциплинарного научного направления – теории безопасности (безопасностьведения, секьюритологии). В докладе раскрывается содержательная сущность междисциплинарного подхода к пониманию проблем: общей теории безопасности; теории безопасностьведенеческого (секьюритологического) дуализма; теории управления безопасностью социальных систем; идеологии безпасностьцентризма, безопасностьтворения как основоформирующих факторов современной философии теории безопасности. Безопасностьтворение рассматривается как двухвидовый процесс обеспечения безопасности социальных систем: система защиты и система противодействия неблагоприятным факторам (целенаправленное выгодное управление ними); материализация опасности – как процесс градации: риск, вызов, угроза благоприятному существованию и развитию объектов обеспечения безопасности: личности, общества, государства, международного сообщества и человеческой цивилизации в целом.
    Currently, the security problem has a broader meaning than ever. There is a social demand for development of an independent multi-disciplinary scientific field – the theory of security. This thesis presents the essence of multi-disciplinary approach to understanding problems and factors basic to modern philosophy of security theory: basic theory of security; theory of dualism in security management; theory of social systems security; ideology of security centrism; security control. Security Control is viewed as a dual process of security provision to social systems: protection system and counteraction system (purposeful benefit management) against adverse factors; and hazards build up – risk, challenge, threat – to the existence and favorable development of security of objects: individuals, society, state, international community and human civilization.

    Opis:
    The article in the eight paragraphs analyzes the issue of audiovisual work, in particular focusing on movie feature, providing the court rulings, in majority the Polish ones. The first section focuses on the clarification of the concept of an audiovisual work, using the textbook knowledge, the knowledge resulting from the polish Act of 4th February 1994 On Copyright and Related Rights and contained in the judgments of Polish courts, concluding that there is no leading definition of audiovisual work in the Polish legal system. Furthermore it considers the issue of co-authorship – who and to what extent has the right to call itself the creator of the audiovisual work. In this respect, it undertakes to clarify the contribution parts which pull together up the final image of an audiovisual work. In the next two sections it analyzes the beneficent of the audiovisual piece and defines the principles governing the relationship of beneficent and the author and the issue of remuneration for the authors work. In the fifth section it introduces the concept of collective management organizations, which is an organization that mediates the process of payment of accumulated remuneration to the creator. Section Six focuses on the issues of copyright protection and potential infringement, and states the rulings of courts, which allows reader to obtain a more practical understanding of the problem. Paragraph seventh evokes a complicated Polish case (the creator of „Stawka większa niż życie” vs. the creator of „Halo Hans!”). Finally paragraph eight focuses on a few cases executed in the field of copyright law in audiovisual work area in the United States.
