Opis:: The role that civil society plays in protection of historic monuments and sites is defined in Polish strategic documents. No procedures for cooperating with historic preservation officers have been, however, established. This article looks at an organisation named “Social Guardians of Monuments and Sites” and says why it is necessary to use its services in view of the existing system being inefficient. Additionally, it also explains reasons behind this inefficiency and explores various cooperation possibilities. Moreover, the article points out that even when the services responsible for protection of monuments and sites are reformed, cooperation with the above-mentioned organisation will be still needed and justified. This results not only from considerable disproportion between responsibilities and possibilities of both institutions but also from effectiveness of the government body being questionable. Furthermore, the structure of historic preservation services should be based on cooperation requirements - it should be simple, clear, and should allow for using already gained experience.

Opis:: This article focuses on the latin legal maxim read as „ratio legis est anima legis.” it needs to be emphasised that, unless they are well-considered, no approval will be granted to acts which are invalid from legal and formal perspective or under which legally incorrect substantive solutions are to come into force. the author of this article claims that polish central government may prove useful in the field of protecting historic monuments and sites. Furthermore, the article also explores experiences through which the German government went in the areas pertaining to constitutional law and organisation of German (federal and lance) historic preservation administration. In the conclusion, the author summarizes his deliberations on the polish model of administrative bodies responsible for conservation and protection of historic monuments and sites.

Opis:: The Act of 23 July 2003 on the Protection and Guardianship of Monuments has never been flawless and the historic preservation milieu has been aware of the consequently deteriorating monument protection system. This article explores the following problems existing in the area of cultural heritage: description and evaluation of cultural heritage, document production rules, sources of financing works carried out to heritage, effectiveness of legal processes, professional development of members of staff, organisational structure of historic preservation offices, and cooperation opportunities on different levels of state and local government administration bodies dealing with protection of monuments and sites. While reading questions provided in this article, one may be willing to ponder on directions of expected changes and ways of introducing them in Poland.

Opis:: Before 1945, protection of monu-ments and sites and nature conservation had beena single field. After this year, however, they were separated and hence, both fields are nowadays independent of each other and develop in different directions. It has been emphasised for a number of years that cooperation and symbiosis between protection of monuments and sites and nature conservation need to be improved. It has been even suggested that both fields, for which different offices and two ministries are responsible, should be joined. This aim needs to be achieved not only due to the ways in which these fields function but also in order to increase their importance. New legal acts which emphasise the significance of cultural and natural heritage in managing and shaping the surrounding areas have come into force. Moreover, descisions pertaining to protection of cultural and natural heritage became more important and the changes to the body of law and ownership rights resulted in these decisions being risen to higher rank. As cultural and natural heritage protection intertwine each other, it is necessary to introduce integrated protection in both fields. This necessityis emphasised not only in a considerable number of legal acts and international documents but also in practical solutions applied in offices whose members of staff are responsible for nature conservation and protection of historic monuments and sites. Integrated protection can be also a successful attempt at strengthening the increasingly ineffective monument protection system. Increased cooperation between these two fields as well as their connection can be a strong impetus to develop practical aspects in protection of cultural and natural herit-age. It can additionally result in creating new tools which government bodies would be able to use for protecting historic monuments and sites – it must be emphasised that this protection, in order to be effective and successful, needs to be adapted to the changing reality and needs to be ready to face challenges posed by the modern world.

Opis:: This article briefly describes the history of historic preservation service in Poland after the year 1918. The author attempts to set out justifiable reasons behind the fact that historic preservation service is subordinate to the Minister of Culture and National Heritage. This subordinance was established between World Wars and right after the transformation in 1989, i.e. in the years 1991–1996. After this time, solutions used in socialism were readopted and hence, it was not possible to standardise protection of historic monuments and sites in Poland. The main message emerging from this article is that the bodies of historic preservation service should be subordinate to the General Historic Preservation Officer. Consequently, the structure will become less ambiguous: currently, in terms of merits, Regional Historic Preservation Officers are responsible to General Historic Preservation Officer. In administrative aspects, however, they are subordinate to governors of particular regions.

Opis:: Under the Act of 23 July 2003 on the Protection and Guardianship of Monuments, a coherent model for caring for historic monuments and sites on both central and local levels was introduced. This concept is intertwined with monitoring and flow of information. The system of managing documents is aimed at optimising actions pertaining to the protection of cultural heritage. As there is a clear hierarchy of these documents, which can also correlate with each other, there are sound reasons behind establishing a coherent protection policy – from municipal/communal level to the central one. National, regional, district, and municipal/communal programmes pertaining to care for historic monuments and sites are strategic tools which shape policy, direct actions towards specific aims, and reflect the will. In a number of cases, however, no programmes have ever been developed. Administrative and legal supervision is still the predominant model in the protection of monuments and sites. The period of 2003 - 2016 was the time to „become familiar” with the new tool applied in heritage protection and management. One should learn from these experiences and promote the idea of devising a coherent strategy aimed at protecting historic monuments and sites by implementing programmes on all administrative levels.

Opis:: Changes made to the administration system in Poland in the years 1989–1990 were aimed at decentralising state government and increasing the importance of local government bodies. The author of this article reckons that this idea has not been reflected in the Polish body of law yet. There are no legal regulations provided in the provisions of law – not only in terms of the legal situation of historic preservation offices but also with regard to deciding what should fall under the authority of local government bodies. Scope of duties of local government historic preservation officers working in separate offices should be similar to the one that individual departments have. Moreover, authority should no longer be granted on discretionary basis. A principle should be therefore formulated that everything what comes within the competence of historic preservation officers must comply with statutory legislation. If a local government body wants to be delegated either full or partial authority, it should prove that it has both organisational and financial capacity to exercise it. We should therefore work towards a complete solution which would be practical and possible to adopt on both state and regional scale.

Opis:: Regional Historic Preservation Officers are of the opinion that monument protection system in Poland needs to be modified. According to them, however, these changes need to be preceded by in-depth analysis of the existing situation, e.g. the condition in which historic monuments and sites are preserved in Poland, the sources of financing works carried out to monuments and sites, the role that historic preservation offices play in administration combined with regional governors, and the current financial and HR situation in specific government bodies. Changes made to the monument protection system should result in improving the conservational state of historic monuments and sites as well as improving functioning of historic preservation service in competence-, organisation-, and finance-related aspects. Furthermore, as a consequence, local government bodies and the society should become more aware of their responsibilities pertaining to historic monuments and sites. The role of local government historic preservation service should be also taken into consideration. According to Regional Historic Preservation Officers, the changes should be aimed at the following: strengthening the office of General Historic Preservation Officer who will shape historic preservation policy in Poland and coordinate actions taken by state and local historic preservation service; subordinating Regional Historic Preservation Officers directly to the General Historic Preservation Officer (within structures of the Ministry of Culture and National Heritage); improve the organisational and financial situation in Regional Historic Preservation Offices and adapt it to their needs; developing a model of local government historic preservation service in terms of their competences, organisational structure, and subordinance (control- and meritrelated) to Regional Historic Preservation Officers. It is necessary to make legislative changes to the monument protection law not only by issuing clear, uniform, and adoptable regulations but also by correlating regulations pertaining to protection of historic monuments and sites with other existing acts of law. It is also essential to perform comprehensive analysis of the list of Polish monuments and sites (register and record of historic monuments and sites) as well as develop and implement a financial support system for taking care of historic monuments and sites and include properties owned by the state treasury into this system. It must be also emphasised that there is a strong need for increasing social importance of guardianship of monuments and sites and making the society aware of limitations and benefits pertaining to monument protection.
