Artykuł prezentuje obowiązki i prawa adwokata kościelnego, który występuje w procesie o stwierdzenie nieważności małżeństwa, prowadzonym przez sąd kościelny. Omówione zostały nie tylko powinności i uprawnienia obrońcy, jakie przewiduje prawo kanoniczne, ale także sposób ich realizacji z uwzględnieniem norm etycznych, które są istotnym źródłem powinnego zachowania, a w przypadku adwokata kościelnego stanowią jego kodeks etyczny. Osobne miejsce poświęcono kwestiom finansowym związanym z pracą adwokata oraz zasadom jakie powinny obowiązywać we wzajemnych relacjach uczestników procesu, w tym szczególnie we współpracy adwokata z sądem kościelnym.
The article presents the duties and rights of an advocate who applies in a process of the nullity of marriage, conducted by a church court. Not only are the duties and rights of a defender provided for by canon law discussed, but also the manner of their implementation, taking into account ethical standards, which are an important source of due behavior, and in the case of a church lawyer, constitute his code of ethics. A separate place was dedicated to financial issues related to the work of an advocate and the rules that should apply to mutual relations of process participants, especially in the cooperation between the advocate and the church court.

Niniejsze opracowanie zajmuje się zasadniczo genezą oraz aktualnymi prawnymi podstawami procesu dokumentalnego o nieważność małżeństwa. Proces dokumentalny był stosowany już w prawie przedkodeksowym, choć określano go jako proces skrócony. Obecna nazwa tego postępowania znalazła się w Kodeksie z 1983 r. Tak jak dawniej, również w obowiązującym ustawodawstwie, proces dokumentalny jest procedurą nadzwyczajną i ma zastosowanie tylko w ściśle określonych okolicznościach. Zgodnie z kan. 1688 MIDI, proces dokumentalny można zastosować, jeśli z dokumentu, który nie podlega żadnemu sprzeciwowi lub zarzutowi, wynika w sposób pewny istnienie przeszkody zrywającej lub brak formy prawnej, jeśli z taką samą pewnością wiadomo, że dyspensa nie została udzielona albo że pełnomocnik nie posiadał ważnego pełnomocnictwa. Proces dokumentalny jest prowadzony przez trybunał jednoosobowy, a więc przez biskupa diecezjalnego, wikariusza sądowego albo wyznaczonego sędziego. Nowością od wejścia w życie MIDI jest wskazanie urzędu biskupa diecezjalnego, który może wydać wyrok w tym procesie. Postępowanie sądowe sprowadza się do przyjęcia skargi powodowej, wyznaczenia obrońcy węzła oraz wezwania stron. Po przeprowadzeniu dowodzenia na podstawie dokumentu nie przewiduje się publikacji akt. W ramach dyskusji sprawy swoje uwagi przedstawia jedynie obrońca węzła, po czym sędzia wydaje wyrok.
This study fundamentally applies with the genesis and the present legal basis of the documentary process for nullity of marriage. The documentary process was already used in pre-coded law, although it was determined as a summary process. The current name of this procedure was found in the 1983 Code. As in the past, also in the current legislation, the documentary process is an extraordinary procedure and applies only in strictly defined circumstances. According to can. 1688 MIDI documentary process can be applied if a document subject to no contradiction or exception clearly establishes the existence of a diriment impediment or a defect of legitimate form, provided that it is equally certain that no dispensation was given, or establishes the lack of a valid mandate of a proxy. The documentary process is conducted by a sole judge, and it is the diocesan bishop or the judicial vicar or a judge designated. New since the entry into force of MIDI is the indication of the office of the diocesan bishop, who can give a judgment in this process. Court proceedings are reduced to the receiving of libellus, the appointment of the defender of the bond and the citation of the parties. After proof on the basis of the document, no publication of the act is envisaged. As a matter of discussion of the case only defender of the bond presents his observations, after which the judge pronounces the sentence.

Zaprezentowana w najważniejszych elementach reforma procesu w sprawie orzekania nieważności małżeństwa, zawarta w motu proprio Mitis Iudex Dominus Iesus papieża Franciszka, wpisuje się jednoznacznie w nową ewangelizację i stanowi w odniesieniu do małżeństwa i rodziny jej ważny element o charakterze prawnym i prawno-duszpasterskim.Poprzez reformę kanonicznego procesu małżeńskiego nowa ewangelizacja nabiera jeszcze większej mocy i nowego ducha. Stanowi jednocześnie wyraz troski najwyższego ustawodawcy kościelnego o dobro duchowe małżonków rozwiedzionych i trwających w nowych związkach, którzy pragną uregulować swój status cywilny na forum kościelnym, a tym samym poznać prawdę o swoim małżeństwie kościelnym. To oni – jako ubodzy, czyli rozwiedzeni – zostali postawieni w centrum reformy procesu o orzekanie nieważności małżeństwa. Papież, promulgując nowe kanoniczne prawo procesowe o nieważność małżeństwa, kieruje się zasadą salus animarum suprema lex (por. kan. 1572), która zawsze towarzyszyła Kościołowi i która ma na względzie przede wszystkim zbawienie dusz.Ta najważniejsza i fundamentalna zasada prawa kościelnego znajduje realizację w konkretnych przepisach zreformowanego procesu, w którym wierny i jego duchowe dobro zdają się być wartościami nadrzędnymi. W tym kierunku idzie reforma i nowe regulacje papieża Franciszka, aby uprościć procedury sądowe, a poprzez to przyspieszyć prowadzenie procesów kościelnych o nieważność małżeństwa i w ten sposób służyć wiernym rozwiedzionym, żyjącym w nowych związkach. Zmiany te mają też ułatwić kontakt wiernych z trybunałami kościelnymi, co w konsekwencji ma się przyczynić do rozwiązania wątpliwości sumienia, które utrudniają życie wielu ludziom. We wprowadzonych zmianach – jak podkreśla papież – nie chodzi o naruszenie zasady nierozerwalności małżeństwa, ale, przeciwnie, o jej zestawienie z konkretnymi przypadkami małżeństw zawieranych w sposób nieważny. Prowadzenie procesu o nieważność małżeństwa ma się dokonywać z całkowitym uwzględnieniem natury małżeństwa, którym jest poszanowanie prawdy. Dążenie do niej gwarantuje sprawiedliwy wyrok, który staje się realizacją prawa miłości. Aby nowe przepisy przyniosły oczekiwane rezultaty i spełniły zakładane cele oraz zostały wprowadzone i zastosowane w prawdzie i sprawiedliwości, wymagają całościowego, krytycznego „zamyślenia” nad dotychczasowym funkcjonowaniem sądownictwa Kościoła oraz otwarcia na novum, jakie przynoszą. Nadto, potrzebują wolności serca i umysłu biskupów, w znaku kolegialności – nie z zasady, lecz faktycznej, a także nowych struktur sądowo-duszpasterskich (poradni prawnych i rodzinnych), również zmiany mentalności w podejściu do spraw i problemów sądownictwa kościelnego biskupów diecezjalnych oraz pracowników samego sądownictwa kościelnego.
The reform of a process on the recognition of nullity of marriage, contained in the motu proprio Mitis Iudex Dominus Iesus of Pope Francis, clearly fits the new evangelization and it is, in relation to marriage and family, an important legal and pastoral element. Through the reform of canon marriage process the new evangelization gets even more power and a new spirit. It is also an expression of concern of the supreme legislator in the Church for spiritual good of divorced and remarried spouses who wish to regularize their marital status in the Church, and thus learn the truth about their marriage. They - as poor, or divorced - were put in the center of the reform of the process on the recognition of nullity of marriage. The Pope promulgating the new canonical procedural law relating to nullity of marriage follows the principle salus animarum suprema lex (can. 1572), which has always accompanied the Church and mainly into consideration salvation of souls. This important and fundamental principle of church law is implemented in specific regulations of the reformed process in which the faithful and their spiritual well-being seem to be paramount. The reform and new regulations of the Pope Francis go in this direction to simplify judicial procedures and thus speed up the processes on nullity of marriage, in order to serve the divorced and the remarried. The changes are also designed to facilitate contact between the faithful and church tribunals, which in turn is expected to contribute to solve a problem of conscience which makes life difficult for many people. As the Pope emphasizes, the changes introduced do not breach the principle of the indissolubility of marriage. On the contrary, this principle is juxtaposed with specific cases of invalid marriages. Conducting the process on nullity of marriage should take place in full respect of the nature of marriage, which is to respect the truth. The quest for it guarantees fair judgment, which becomes the realization of the law of love. The new rules, to bring the expected results, to meet its objectives, and to be introduced and applied in truth and justice, require a comprehensive, critical "consideratin" on the current functioning of the Church judiciary and openness to novelty they bring. Moreover, they need freedom of heart and mind of bishops, in a sign of collegiality - not in principle, but real, as well as new legal and pastoral structures (legal and family clinics), and also a change of mentality in the approach to the issues and problems of ecclesiastical judiciary system of diocesan bishops and employees of the Church judiciary.

The right to appeal resulting from natural justice serves to guarantee a fair judgment. Also after the reform of the marriage process carried out by Pope Francis in 2015, the appeal remains the primary appeal, which can be used by the private and public parties involved in the case. This article discusses the norms and principles that should be maintained when an appeal in the ordinary trial for nullity of marriage is made by the defender of the bond. His public office not only authorizes him, but in certain conditions also obliges him to use the institution of appeal. After presenting the legal basis of the law and the duty of the defender of the bond to appeal, the procedure of its submission, the applicable time limits and the nature of the justification that must take place after filing the appeal are discussed. In the last part, the reflection concerns problematic issues associated with the application of the new norm contained in can. 1680 KPK standards, the judges’ attitude towards the application and the court costs incurred in connection with the submission of an appeal.

Obrońca węzła pełni znaczącą rolę w kanonicznych procesach małżeńskich. Jego zadaniem jest reprezentowanie Kościoła i stanie na straży bonum publicum, którym jest nierozerwalność ważnego węzła małżeńskiego. Z woli prawodawcy jest gwarantem poprawności zastosowania procedur sądowych i powinien przedstawiać wszystko, co w sposób rozumny przemawia za ważnością małżeństwa. Obecność defensora w proce-sach stała się jeszcze bardziej znaczącą po zmianach, które do prawa kanonicznego wprowadził papież Franciszek w Liście apostolskim motu proprio Mitis Iudex Dominus Iesus. Dotyczy to zwłaszcza jego zadań w kontekście odstąpienia przez prawodawcę od obowiązku apelacji po pozytywnym wyroku trybunału I instancji oraz w procesie skróconym przed biskupem diecezjalnym. Prawo apelacji i zaskarżania wyroku, które mu przysługuje, stanowi skuteczny środek ochronny przed wydaniem niesprawiedliwego wyroku.
Defender of the bond acts a significant role in the canonical process of marriage. His task is representing the Church and protection of this kind the public good, which is indissolubility valid marriage bond. By the will of the legislator he is the guarantor of the correctness of the application of judicial procedures and he should present every-thing, what in the way of rational supports the validity of marriage. The presence of the defender in the process has become even more important after the changes to the canon law which were introduced by the pope Francis in the Apostolic Letter motu proprio Mitis Iudex Dominus Iesus (The Lord Jesus, Gentle Judge). This applies especially to some tasks of defenders in the context of the withdrawal of the legislator from the obligation to appeal after a positive judgment of the court of first instance and in the shorter and more streamlined process, judged personally by the diocesan bishop, for certain rare and exceptional cases. The defenders right to appeal and the appeal against the judgment is an effective preventive measure before issuing an unfair judgment.

Since the beginning of the pontificate of Pope Francis we have heard in his preaching the calling to reform the structures of the church. Bergoglio presented his pastoral-evangelical idea of the functioning of the Church in the exhortation Evangelii Gaudium. Naturally the reform made by the Bishop of Rome also applies to the canon law. Directed by voices of hierarchy gathered at the Synod of Bishops 2014 and the spiritual good of the faithful, who are waiting for an explanation of their canonical situation, 15 August 2015 Pope Francis promulgated the Motu proprio Mitis Iudex Dominus Iesus, to accelerate and simplify the process of annulment of the marriage. Pope wanted the heart of the faithful were not too long enslaved by darkness of doubt because of delays in the judgment. In the center of his reform Pope put the diocesan Bishop, who together with the Bishop of Rome becomes the guarantor of the unity of the Catholic faith and discipline. According to the principles of the reform, the bishop not only organizes and is responsible for the court structure in the local church, but he also has to personally fulfill the task of the first judge of the faithful, for whom he was established a shepherd. The new laws allow the bishop to establish a single judge and introduces the institution of processus brevior, which is provided for particular obvious situations. The only judge in this process is the bishop. It seems that the reform process of marriage, made in the spirit of historical continuity, will bring much spiritual fruit and contribute to the perception of the person the diocesan bishop not only as pastor bonus, but at the same time as iustus iudex.
Od początku pontyfikatu papieża Franciszka słyszymy w jego przepowiadaniu nawoływanie do reformy struktur kościelnych. Swoją pastoralno-ewangeliczną koncepcję funkcjonowania Kościoła Bergoglio przedstawił w adhortacji Evangelii Gaudium. Naturalnie, reforma dokonywana przez Biskupa Rzymu dotyczy również prawa kanonicznego. Kierowany głosami hierarchów gromadzonych na Synodzie Biskupów w 2014 roku oraz dobrem duchowym wiernych, którzy oczekują na wyjaśnienie swojej sytuacji kanonicznej, papież Franciszek 8 września 2015 roku promulgował Motu proprio Mitis Iudex Dominus Iesus tak, by przyspieszyć i uprościć proces stwierdzenia nieważności małżeństwa. Wolą Papieża było ty, by serca wiernych nie były zbyt długo zniewolone przez mroki wątpliwości z powodu opóźnień w wydaniu wyroku. W centrum swojej reformy Ojciec Święty postawił postać biskupa diecezjalnego, który wraz z Biskupem Rzymu staje się gwarantem katolickiej jedności w wierze i dyscyplinie. Według założeń reformy, biskup nie tylko organizuje i odpowiada za strukturę sądowniczą w swoim Kościele lokalnym, ale ma również wypełniać osobiście zadanie pierwszego sędziego wiernych, dla których został ustanowiony pasterzem. Nowe ustawodawstwo daje biskupowi możliwość ustanowienia sędziego jednoosobowego oraz wprowadza instytucję processus brevior, który przewidziany jest w sytuacjach szczególnie oczywistych. Jedynym sędzią w tym procesie jest sam biskup. Wydaję, że reforma procesu małżeńskiego, dokonana w duchu ciągłości historycznej, przyniesie wiele owoców duchowych i przyczyni się do postrzegania osoby biskupa diecezjalnego nie tylko jako pastor bonus, ale jednocześnie jako iustus iudex.

Apelacja jest instytucją dobrze znaną i często stosowaną w procesach kościelnych. Ustawodawca przewidział jednak również apelację wpadkową, którą może zgłosić strona przeciwna, po tym jak zostanie powiadomiona o apelacji głównej. Przedmiotem niniejszego artykułu stała się analiza funkcjonowania tej instytucji w zwyczajnym procesie spornym, a także w procesach o nieważność małżeństwa. Rozważania te obejmują zarówno zagadnienia teoretyczne, związane z właściwym rozumieniem instytucji wpadkowej, jak również sytuacje szczególne, takie jak możliwość zmiany stanowiska przez stronę procesową, wniesienia tytułu nieważności małżeństwa przez stronę pozwaną czy możliwości zgłoszenia apelacji wpadkowej przez obrońcę węzła małżeńskiego.
An appeal is an institution that is well known and is often used in litigation. However, the legislator also provided an incidental appeal, which may be filed by the defendant after being notified of the main appeal. The subject of this article is the analysis of the functioning of this institution in the ordinary litigation process, as well as in proceedings for nullity of marriage. These considerations include both theoretical issues related to the proper understanding of the incidental appeal, as well as special situations: the possibility of a litigation party changing its position, challenging the title by the defendant or the possibility of an incidental appeal by the defender of the marriage bond.

Opis:
W motu proprio Mitis Iudex Dominus Iesus została uregulowana instytucja dochodzenia przedprocesowego. Mimo, iż instytucja ta była znana już w instrukcji procesowej Dignitas connubii, to wymagała dokładniejszego uregulowania. Jej celem jest pomoc małżonkom w poznaniu prawdy o ich małżeństwie. Zagadnienie konsultacji przedprocesowej jest ważne, ponieważ jego właściwe przeprowadzenie będzie miało znaczenie dla ewentualnego rozpoczęcia procesu o stwierdzenie nieważności małżeństwa. Ustanowienie instytucji badania przedprocesowego jest przede wszystkim wyrazem troski o małżonków, którzy żyją w separacji lub rozwiedli się i mają wątpliwość co do ważności sakramentalnego małżeństwa.
The briefer process is a new legal institution in canon law. It was introduced by a motu proprio Mitis Iudex Dominus Iesus as a prejudicial question. This was also described in Dignitas connubii. This will allow for wider dissemination of information concerning there provisions of spouses in their matrimony. The issue of pre-trial tutorship it is very important in the briefer process of the nullity of marriage.

The Pope Francis’ 2015 reform of declaring the nullity procedures introduced a new process which is briefer than the ordinary process and have brought the followers closer to the church structures. The new form of this procedure has contributed to it considerably: briefer process – processus brevior. The Supreme legislator appoints a bishop the sole competent person to make a judgement within this process. The purpose of this article was to indicate the entities competent to perform the function of a judge in the briefer process. The fundamental question was this: is the ordination of a bishop a requirement to hold such a function? and thus whether every ordinated bishop may be iudex in the processus brevior. Another question was whether a clergyman who was not ordained may conduct such a process. This article shows that the legislator’s will, despite the nomenclature used in Motu proprio, is completely different. The Bishop of Rome has linked the functions of a single judge in the briefer process to the office of the head of a particular church. It shows that the iudex function in processus brevior is not of sacramental nature. A particular church is above all a diocese headed by a diocesan bishop. The legal order in the Latin church anticipates that other territorial and personal structures are equal to a diocese. Their governors are equal by law to a diocesan bishop. If they have judicial powers in scope of marriages, they are competent to conduct a briefer process. In some cases the governors of the particular churches, which are equal by law to a diocese, are not elevated to the rank of a bishop. Not being ordinated to a bishop, however, does not make them incapable of being iudex in the processus brevior coram Episcopo!
Reforma procesu o stwierdzenie nieważności małżeństwa dokonana w 2015 roku przez papieża Franciszka przyczyniła się do skrócenia procedury procesowej oraz przybliżyła wiernych do struktur kościelnych. Znacząco do tego przyczyniła się nowa forma procedury: proces skrócony – processus brevior. Najwyższy Ustawodawca ustanawia biskupa jedynym kompetentnym podmiotem do sądzenia w tym procesie. Celem niniejszego artykułu było wskazanie podmiotów kompetentnych do pełnienia funkcji sędziego w procesie skróconym. Fundamentalnym pytaniem było: czy wymogiem do pełnienia tego zadania są święcenia biskupie, a zatem: czy każdy wyświęcony biskup może być iudex w processus brevior? Nasunęło się również inne pytanie: czy duchowni niemający święceń biskupich mogą prowadzić taki proces? Niniejszy artykuł ukazuje, że wola ustawodawcy, mimo nomenklatury używanej w Motu proprio jest zupełnie inna. Biskup Rzymski powiązał funkcje jednoosobowego sędziego w procesie skróconym z urzędem głowy Kościoła partykularnego. Pokazuje to, że funkcja iudex w processus brevior nie ma zakorzenia w charakterze sakramentalnym. Kościołem partykularnym jest przede wszystkim diecezja, na czele której stoi biskup diecezjalny. Porządek prawny w Kościele łacińskim przewiduje, że z diecezją zrównane są również inne struktury terytorialne i personalne. Ich rządcy są zrównani w prawie z biskupem diecezjalnym. Jeśli posiadają władzę sądowniczą w zakresie małżeńskim, są kompetentnymi podmiotami do prowadzenia procesu skróconego. W niektórych przypadkach rządcy Kościołów partykularnych zrównanych w prawie z diecezją nie są wynoszeni do godności biskupiej. Jednak brak święceń biskupich nie czyni niezdolnymi powyższe podmioty do bycia iudex w processus brevior coram Episcopo!

Opis:
Canon 1680 MIDI provides new appealing rules, which cause many new issues requiring detailed clarification. First of them is reference to cases ended in first instance with so-called positive or negative sentence. Further is an appealing duty by the defender of the bond. Very interesting and requiring to detail issue is the appeal for deferment. Also, many difficulties with the interpretation raises appeal in the briefer process before the bishop.

Zasada kontradyktoryjności jest warunkiem zaistnienia iudicium. Do powstania każdego proce- su, w tym również kanonicznego procesu o nieważność małżeństwa, potrzebne jest bowiem czyjeś twierdzenie wyrażające wolę realizacji swojego uprawnienia z jednoczesnym zaistnieniem twierdzenia przeciwnego, które również w swej treści wyraża wolę realizacji tego samego uprawnienia. W tym czasie, gdy te dwa sprzeczne ze sobą twierdzenia zaistnieją jednocześnie przed sędzią kościelnym, powstaje spór, który następnie może przekształcić się w iudicium. Taką wolę rozumienia procesu kanonicznego jako kontradyktoryjnego, wyraża również Papież Franciszek w MIDI, przypominając dotychczasowe unormowania i reformując jedynie te procedury, które tego wymagały zgodnie z duchem czasu. Wprowadzenie tych zmian ma na celu pozbycie się z treści iudicium jedynie tego, co się zdewaluowało, przy czym trzon kontradyktoryjności pozostaje niewzruszony. Papież Franciszek pisze w MIDI: „…troska o zbawienie dusz, która – zarówno dzisiaj, tak jak w przeszłości – pozostaje najwyższym celem instytucji, ustaw i prawa, skłania Biskupa Rzymu do przedstawienia biskupom niniejszego aktu reformy”. Takie właśnie uzasadnienie staje u podstaw reformy Franciszkowej procesu kanonicznego opartego na zasadach procesowych.
The principle of contradiction is a condition for the existence of an iudicium. For any trial, including canonical marriage nullity, one needs a statement expressing the will to exercise his right with the opposite claim, which also expresses the will to exercise the same right. At this time, when these two contradictory statements arise simultaneously before the church judge, a dispute arises, which then can turn into an iudicium. Such will to understand the canonical process as contradictional system is also expressed by Pope Francis in MIDI recalling the hitherto norms and reforming only those procedures that required it to move with the times. These changes are intended to remove from the content of the iudicium only what was devalued while the core of principle of contradiction remains inviolable. Pope Francis writes in MIDI: “..the zeal for the salvation of souls that, today like yesterday, always remains the supreme end of the Church’s institutions, rules, and law, compels the Bishop of Rome to promulgate this reform to all bishops”. Such justification underlies the Franciscan reform of the canonical process based on procedural principles.

Papież Franciszek w motu proprio „Mitis Iudex Dominus Iesus” wprowadziła nową instytucję badania przedprocesowego. Ma ona służyć wiernym w dotarciu do prawdy o stanie prawnym ich węzła małżeńskiego. Artykuł dotyczy roli i zadania nowej instytucji w kontekście kanonicznego procesu o nieważność małżeństwa. Autor ukazuje istotną różnicę między dochodzeniem pastoralnym a dochodzeniem, które ma miejsce w procesie karnym. Ponadto wskazuje się na zadania ordynariusza miejsca i określenie osób, które mogą wypełniać funkcje w ramach badania przedprocesowego. Istotną tematyką jest także przybliżenie i opisanie okoliczności, które mogą wskazywać na zastosowanie procesu skróconego przed biskupem.
The Pope Francis in Motu Proprio "Mitis Iudex Dominus Iesus" ~ introduced a new institution of pre-judicial inquiry. It is to assist the Christian faithful in getting to the truth about legalstanding of their bond of marriage. The article concerns the role and tasks of the new institution in the canon process on the nullity of marriage. The writer shows the substantial differencebetween pastoral inquiry and the inquiry in criminal investigation. Moreover, the tasks of the local ordinary are presented, and people who can function within the pre-judicial inquiry aredefined. Giving background and describing the circumstances which may indicate the application of the briefer matrimonial process before the bishop are also relevant issues of the article.
