Disciplinary proceedings are these of repressive nature wherein penalties which limit the freedom and rights of a guilty person can be adjudicated. Such pro-ceedings are diversified and have no pattern for developing models of the disci-plinary responsibility of particular professions, including professions of public confidence. By focusing on the diversification of disciplinary proceedings, in-cluding the rules of such proceedings in particular models, the authoress opts for uniforming rules of the proceedings. She considers it necessary and possible to define basic rules of disciplinary proceedings which can be referred to while developing a code of disciplinary proceedings or different models of proceed-ings for particular occupation groups or professions. The article postulates rules which, according to the authoress, seem to be fundamental while not necessarily fit for all types of disciplinary proceedings. She notes that her suggestions are to be a proposal for the further discussion on developing standards of reliable pro-cedures in disciplinary proceedings.

The article presents the institution of an administrative agreement from the perspec-tive of legal solutions in force in selected European countries. The increase in the number and diversity of tasks performed by the administration and the multitude of conducted proceedings encourage the search for alternative forms of settling a case in relation to an administrative decision. The administrative agreement is one of them. The analysis of foreign regulations confirms that the institution in question belongs to the modern procedural laws. The scope of regulation varies, as do the individual solutions concerning the admissibility and mode of concluding the contract, its subject matter, the mechanisms for removing defects, the grounds for contestability of the contract and its enforceability. It turns out that in individual European orders two patterns of regulation dominate: French and German, although they are subject to significant modifications. The performance of certain public tasks by private parties on the basis of an administrative agreement provides for certain guarantees not only for the parties to the agreement but also for the beneficiaries of those tasks. This particular type of contract allows adequate protection of the public interest. The prevalence of the administrative agreement in Europe prompts the author to formulate a conclusion on the need to include this institution in the home system. The attempt made in the 2017 reform of the Administrative Procedure Code to include in it an administrative agreement was unsuccessful. The provisions on an administrative agreement that were then drafted were intended to give a deeper meaning to mediation, a new institution in administrative proceedings, which is currently not popular. Mediation was to precede the conclusion of an administrative agreement. However, there are no significant obstacles to returning to work on the regulation of this institution, which is so widely used in other European countries, and which is clearly lacking in its home Code

The study discusses main issues arising from the regulation of witnesses’ incapa- bility of perception and communication of observations under Polish administra- tive and tax proceedings. The proper collecting of evidences is the core matter of administrative and tax proceedings. In cases where hearing witnesses is necessary, identifying a group of persons capable of testifying is a key element in order to guarantee proper factual findings. Polish procedural law, administrative and tax law in detail, defines this circle by establishing groups of people who are inca- pable of testifying. The key group of persons incapable of testifying consists of those who are unable to perceive or communicate their own observations. That wording, used in the regulation of the Polish Code of Administrative Proceedings and Tax Ordinance, is inexact. In order to specify the group covered by the scope of this provision it is necessary to use not only textual, but also substantive interpre- tation. It is important to highlight that an interpretation of Polish administrative and tax proceedings in the area of capability to testify includes international treaties and the Universal Declaration of Human Rights, the UN Convention of Rights of Persons With Disabilities, and the UN Convention of Rights of The Child. The interpretation should also include science and medicine results.

Interrogation is a process-criminal act, without which it could not proceed, and finally no criminal proceedings could be concluded. The further course of investigation depends on the facts determined in its course. These facts determine the adoption or confirmation of forensic versions verified at subsequent stages of the proceedings. Therefore, documenting this activity is very important, and – at the same time – hard evidence, so that its course is not effectively undermined by the parties to the proceedings. Knowledge of the techniques of logging, the choice of the moment of its commencement, the transfer of the presented emotions and behaviors of the participants to the most accurate content is a necessary knowledge.

The article analyzes the concepts of «coercion», «measures of criminal procedural coercion», «measures to ensure criminal proceedings» and their relationship. The measures of procedural coercion, which the court can most often apply to the participants in court proceedings in a criminal case, as well as the procedure for postponing the trial in connection with their (measures of procedural coercion) are studied. Proposals for improving the criminal procedure legislation of Ukraine in this direction have been formulated. Measures of criminalprocedural coercion are procedural means of state-legal coercion defined by the criminal-procedural law, applied by the authorized bodies conducting criminal proceedings, in the order clearly defined by the law concerning persons, for the purpose of achievement of efficiency of criminal proceedings. The concept of “measures to ensure criminal proceedings” in its own right the content and scope do not cover the category of precautionary measures and other mea sures procedural coercion. In our opinion, the concept of «criminal measures procedural coercion “and” measures to ensure criminal proceedings «are not identical: under the current CPC of Ukraine measures procedural coercion is a component of criminal security measures proceedings, and, consequently, to some extent, a narrower concept. They are correlated between themselves as a whole and part. However, before proceeding to the analysis of each of the measures of coercion we have identified, let us pay attention to the important procedural provisions that the judge is obliged to remember when applying this or that measure. The court may impose measures of procedural coercion on the person, which in turn will postpone the trial.

Autorka przedstawiła trzy podstawowe pojęcia odnoszące się do prakseologicznych aspektów przebiegu postępowania cywilnego. Pierwszym pojęciem jest szybkość postępowania jako postulat przeciwdziałania przewlekłości postępowania. Drugim pojęciem jest sprawność rozumiana jako połączenie szybkości i odpowiedniego zorganizowania czynności w toku postępowania dążącego do celu, jakim jest trafne rozstrzygnięcie sądu. Trzecim pojęciem jest efektywność, co do której zasadnicze znaczenie ma optymalne osiągnięcie tego celu przy zaangażowaniu odpowiednich kosztów.
The Author presented three basic concepts related to the praxeological aspects of the course of civil proceedings. The first concept is the speed of the proceedings as a postulate counteracting the excessive length of the proceedings. The second concept is the efficiency understood as a combination of speed and proper organization of activities in the course of the proceedings aiming at a correct decision of the court. The third concept is the effectiveness, for which it is essential to achieve the goal optimally with the involvement of appropriate costs.

The Polish Code of Criminal Procedure provides for three paths in which it is possible to agree with the accused the type and severity of the penalty imposed on him by the court, provided that taking evidence by the court is waived. The first possibility occurs during the stage of preparatory proceedings, being an agreement with the prosecutor, so that a lengthy evidence process is not carried out. The second option applies after the indictment has been brought to court, while the third one may be used by the accused until the end of the first interrogation of all the accused. It requires submitting a relevant application.

As far as the norms of the Code of Administrative Procedure (CAP) are concerned, there is no other category of entities other than a party to the proceedings who could request the authority’s action or whom the authority’s action might concern, as was the case in the regulation of the President of the Republic of Poland of 1928, preceding the CAP, regulating the institution of the person concerned. In the CAP regulation, in the scope of the category of parties to the proceedings, the legislator distinguished parties with disputed interests. The disputed interest is most often manifested in the fact that one of the parties requests the initiation of proceedings in order to obtain a specific entitlement, and the authority deciding in this regard must do so in such a way as not to infringe on the legal interest of other persons (third parties) who, due to the interest in question, in order to ensure its proper protection, use and enjoy the status of a party in the proceedings. For delimiting the above categories of the parties to proceedings, the doctrine and the case-law assume their division into parties with the so-called main rights and parties with the so-called reflexive rights. In the context of the underlined distinction of both sub-categories of parties to proceedings, the object of the analysis of this study is the question of whether or not, according to the provisions of the CAP, the differentiation of their procedural rights can be made. To this end, it was justified to refer to the institution of repealing or amending a final decision pursuant to Article 155 of the PAC, in view of the positions that are presented in the caselaw of the administrative courts in the context of this provision.

On 1 June 2017, a major amendment to the Code of Administrative Procedure came into force. The article deals with mediation incorporated into the Code as a new institution of administrative proceedings. The authors presented the advantages and disadvantages of mediation in public matters and discussed the theoretical foundations of this construction. They analysed the effectiveness of the mediation conducted in the proceedings before the administrative courts, pointing that entrusting mediation to professional mediators (by amending the Act of 7 April 2017) was justified. The new regulation provides for mediation that is voluntary, secret, and conducted by an impartial mediator. The amending act does not specify the preferred mediation strategies, leaving this issue to the mediators, but the analysis of the content of the new provisions leads to the conclusion that the evaluative type of mediation is the leading one. The amended provision of Article 13 § 1 of the Code allows mediation in any matter, provided its the nature is sufficiently suitable. In the Authors’ opinion, mediation should be allowed especially in matters that need to be resolved basing on the administrative discretion and in matters whose settlement requires the interpretation of terms that are not specified. In the authors opinion, mediation may be an effective instrument for eliminating administrative disputes but requires proper preparation of the clerks involved.

In the author’s opinion the proposed amendments are reasonable and admissible as concerns a legislator’s discretion. Such amendment would lead to making proceedings with petitions more transparent and may eliminate an inconsistency between an obligation to publish a scan of a petition and the lack of such obligation regarding a reply to the petition. Moreover, the author supports reducing the deadline for transferring a petition to a competent entity, e.g. to 14 days.
