    This article present the origin of the word “administration” is also considered and values shaping and diversifying administration are analysed based on some examples. After this part is characterises forest administration which well illustrates organisation of administration. The concepts of property and management play an important role in distinguishing administration.

    Discussions on the importance and opportunities of the public-private partnership have been taking place for many years. The article presents an analysis of public-private partnership which is usually considered a form of realisation of public tasks. It is less frequently regarded as a tool for introducing changes in the public administration as such. In their article, the authors emphasise the specific role that public-private partnership can play in designing public sector policies, and its application related to the lack of funds for effective realisation of public tasks. Public-private partnership allows then for changes in the public management model, by transforming public administration towards administration that is responsible for the whole society.

    Opis:
    This publication focuses on defining the legal nature of the constructions of public-private partnership and administrative agreements under different legal systems, with particular emphasis on Polish regulations. Due to complex changes within the concept of public administration, alternative methods of its operation gradually appear. Unification of European legal structures and global socio-economic innovations are an impulse for the analysis of methods that allow adapting to the marketization of public tasks. The aim of the author is to assess the effectiveness of a hybrid forms of public-private partnership and administrative agreement combining the features of private and public law, based on the evaluation of doctrine and jurisprudence. Solutions taken from Polish legal acts on local government and the practice of public institutionsreflect the challenging problem of multilayeredness of obligations undertaken by aforementioned form. Extracting the conclusions from market research and cited government reports allows to formulate postulates de lege ferenda and accurate diagnosis of the activities of modern administration.

    The scope of this article is the field of legal science. Its purpose is to familiarize the reader with the legal term ‘public-private partnership’. The Polish Constitution does not define this term. On the other hand, the term included in the Act, amended a few times, still raises reservations. The author, using the language-logical method, performs a detailed analysis of this term. She also shows possible directions for the amendment of legal norms in the discussed subject-matter.
    Podejmowana w artykule problematyka dotyczy dziedziny nauk prawnych i ma za zadanie przybliżyć czytelnikowi prawne pojęcie partnerstwa publiczno-prywatnego. Konstytucja RP nie definiuje tego pojęcia. Z kolei pojęcie zawarte w ustawie, kilkukrotnie nowelizowanej, nadal budzi zastrzeżenia. Autorka w niniejszym artykule, stosując metodę językowo-logiczną dokonuje szczegółowej analizy pojęcia. Wskazuje także możliwe kierunki znowelizowania norm prawnych z omawianej tematyki.

    Celem tekstu jest opis uwarunkowań działań komunikacyjnych Zarządu Miejskiego i organizacji miejskich w Olsztynie. Analizie poddano strukturę administracyjną i przykłady porozumiewania się w organizacji. Zakłada się, że czynnikiem warunkującym porozumiewanie się był wielowarstwowy system zależności władzy i płynna granica między sferą prywatną i publiczną. Odzwierciedlało się to w zarządzaniu dobrami materialnymi oraz podczas konstrukcji struktur, norm i reguł administracyjnych. Działania te realizowano podczas wymiany ludności i tworzenia nowych kodów kulturowych. Istotne znaczenie miał niski stan bezpieczeństwa, zniszczenie infrastruktury, niepewność co do własności nieruchomości i przebiegu granicy państwowej. Zaznaczał się silny wpływ Armii Czerwonej oraz nieukształtowana opinia publiczna. W tekście wykorzystano jakościową analizę zawartości dokumentów urzędowych ze zbiorów Muzeum Warmii i Mazur oraz wybrane zasoby Archiwum Państwowego w Olsztynie i prasę lokalną.
    The aim of this text is to describe the determinants of communication activities of the Municipal Board and municipal organisations in Olsztyn. The administrative structure and examples of communication in the organisation are analysed. It is assumed that one of the determinants of communication was the multi-layered system of power relations and the fluid boundary between the private and public spheres. This was reflected in the management of tangible goods and in the construction of administrative structures, norms and rules. These activities were carried out during population exchanges and the creation of new cultural codes. The low state of security, the destruction of infrastructure, the uncertainty of property ownership and the course of the national border were all important factors. There was a strong influence of the Red Army and unformed public opinion. The text uses a qualitative content analysis of official documents from the collection of the Museum of Warmia and Masuria and selected resources from the State Archive in Olsztyn, and the local press.

    In recent years, noticeable is the growing interest in the subject of third sector organizations. Freedom of action and involvement of citizens in social life is the foundation of democracy. The activity of citizens of democratic states can be seen in the actions of third sector organizations for the public good. A manifestation of this participation in the creation of a public good is the multiplicity and diversity of existing NGOs in the country. The paper aims to identify the relations between actors from different sectors, in particular, between NGOs and public administration, and also to present findings in the field of NGOs cooperation with the first sector (public administration) and the second sector (business).

    Public-private partnership (hereinafter: PPP) is not developing according to expectations in Poland. In comparison to other European nations, the success rate of initiated proceedings is still very low. Between 2009 and the first quarter of 2020, only 25% of initiated proceedings were realized. While there is a large number of potential factors influencing the poor outcome of PPP proceedings in Poland – including a small average project size as well as faults in the regulatory framework – this article addresses administrative barriers standing in the way of successful public-private partnership development. The use and necessity of independent advisors will be addressed, as well as the availability of governmental support mechanisms. Administrative solutions for PPP facilitation from Germany will be showcased, such as the PPP Task Force of the German Ministry of Transport, Building and Housing (BMVBW), as well as the creation of Partnerschaften Deutschland AG (PD). The article then aims to showcase the applicability of German administrativ e models to the Polish PPP market on the basis of a comparative case study.
    Partnerstwo publiczno-prywatne (dalej: PPP) nie rozwija się w Polsce zgodnie z oczekiwaniami. W porównaniu z innymi państwami europejskimi wskaźnik powodzenia wszczętych postępowań jest nadal bardzo niski. Między 2009 r. a pierwszym kwartałem 2020 r. doszło do realizacji jedynie 25% wszczętych postępowań. Chociaż istnieje wiele potencjalnych czynników wpływających na zły wynik postępowań PPP w Polsce – w tym niewielka średnia wielkość projektu, a także wady w ramach regulacyjnych – w tym artykule omówiono bariery administracyjne stojące na drodze do udanego rozwoju partnerstwa publiczno-prywatnego. Uwzględnione zostanie wykorzystanie i konieczność funkcjonowania niezależnych doradców, a także dostępność rządowych mechanizmów wsparcia. Zaprezentowane zostały rozwiązania administracyjne dotyczące ułatwień PPP z Niemiec, takich jak grupa zadaniowa ds. PPP niemieckiego Ministerstwa Transportu, Budownictwa i Mieszkalnictwa (BMVBW), a także utworzenie Partnerschaften Deutschland AG (PD). Artykuł ma na celu zaprezentowanie możliwości zastosowania niemieckich modeli administracyjnych na polskim rynku PPP na podstawie porównawczego studium przypadku.
