By many measures, 2011 provided long-awaited proof of a rebound in the Asia-Pacific private-equity (PE) business after the protracted downturn of 2008 through 2010. While in the United States and Europe, the industry's recovery remained muted in the face of debt worries and weak employment data, the Asia-Pacific region's total PE investment values have returned to 2006 levels, or some $65 billion. China alone accounted for almost 45% of the new activity, indicating that the expansion has not been uniform. But even more mature markets, such as Japan and Australia / New Zealand, showed some signs of life. On the whole, the region is now in its strongest position since the global economic crisis. Moreover, although the Asia-Pacific region now accounts for 21% of the global PE industry, that level is still lower than its share of global GDP, which has reached 28%. The region's low PE penetration rate also confirms the likelihood of room for further growth. The nature of the opportunity is changing quickly and will require industry players to develop new flexibility and capabilities. For example, although China continues to show long-term promise, its slowing growth and rising sophistication will create openings very different from those that arose in even the recent past. Throughout Asia, local players are acquiring new skills that make them sharper competitors and more valuable partners.

Opis:
The issues related to private evidence and documents in Polish criminal proceedings have for a long time been providing an impetus for many debates and disputes. In his text, the author analyses the opinions hitherto expressed in legal doctrine, and based on them he indicated how, in his opinion, the notions of “private evidence” and “private document” ought to be understood in accordance with the Code of Criminal Procedure. To this aim, he commences his consideration with an analysis of the notion of “evidence”, while stressing that it needs to be distinguished from such terms as “[a piece of] information” or “trace”. Further on, he discusses the distinction into “public [official]” and “private” evidence, and also presents his own definition of “private evidence” sensu stricto and sensu largo. Subsequently, the author proceeds to consider the notion of document in legal system, in particular in penal legal system, to eventually focus on the intended understanding of the notion of “private document” and the notion “reading aloud” included in Article 393 paragraph 3 of the Code of Criminal Procedure.

The aim of this article is to examine the structure and the functions of neologisms included in the private letters of Henryk Sienkiewicz. The analysis of the lexis presented in this paper reveals that the writer tended to use the word-formative neologisms, semantical neologisms and functional neologisms most frequently. The expressive function of this neologisms is the prevailing one.

Aim. The paper attempts to explore the impact ofrivate tutoring in light of the equity-related concerns especially in the context of the Indian society. Private tutoring is a phenomenon that has been an intrinsic part of the Indian education system since the 1980s. Methods. The paper is an outcome of the Masters of Philosophy dissertation work of the scholar submitted to National University of Education Planning and Administration, Delhi, India. Results. The structure of private tutoring is such that it mimics the regular school curriculum and modifies itself to match the needs of the school and the children. Any changes in the regular school curriculum bring a change in its supplement as well. It thus behaves like a shadow of the regular schools. Though private tutoring was believed to enhance learning opportunities of weak students, it has now become a 'parity of prestige' issue. Conclusion. The expansion of tutoring has begun to deepen the inequalities already prevalent in the stratified schooling system and society at large.

Summary In this article I address the controversial issue of the use of “private opinions” in criminal proceedings. I examine the problem largely in connection with the amendment to Art. 393 § 3 of the Polish Code of Criminal Procedure, which was introduced on 27 September 2013. The amendment has made it possible to use private documents specially compiled for application as evidence during proceedings. I start by referring to specific procedural principles pertaining to the Polish system of criminal proceedings. My next step is to discuss the relations which may occur in criminal proceedings between a “private opinion” and an opinion drawn up by a court expert. I also conduct a brief review of “private” experts and their role in criminal proceedings. This brings me to my conclusion, in which I put forward my proposals for prospective amendments to the existing provision.
Autor w tekście zajmuje się niezwykle sporną tematyką dotyczącą wykorzystywania w procesie karnym tzw. opinii prywatnych. Analiza zagadnienia związana jest przede wszystkim ze zmianą art. 393 § 3 k.p.k. Nowelą z 27 IX 2013r., który to przepis pozwala na wprowadzenie do procesu także dokumentów prywatnych zebranych wprost dla celów postępowania karnego. Autor rozważania rozpoczyna odnosząc się do określonych zasad procesowych, istniejących w systemie prawa karnego procesowego. W dalszej kolejności omawiane są relacje jakie mogą zachodzić w procesie karnym między tzw. opinią prywatną a procesową opinią biegłego. Krótkiej analizie poddane jest też zagadnienie roli procesowej tzw. biegłych prywatnych. W efekcie autor wyciąga określone wnioski i przedstawia postulaty de lege ferenda

This paper’s aim is to describe the rules governing the assertion of civil law liability in the event of a competition law infringement. Given the planned adoption and implementation of a new EU legislative package concerning private enforcement, it is useful to determine what legal instruments and procedures are already available under Polish civil law that serve the protection of market players. This paper will specify the legal basis for the assertion of civil claims associated with competition law infringements and present its particularity. Considered will be the provisions of the Polish Civil Code as well as the provisions of the law on combating unfair competition and the law on unfair market practices. Discussed will be the full catalogue of civil law claims that can be asserted in relation to antitrust infringements as well as the specific purposes of civil law liability in this context. The paper will also assess the model of determining the effects of competition law violations and analyse whether private law principles for the calculation of loss can be applied in antitrust infringement cases. Finally, the paper will discuss the issue of settling the convergence of liability problem and the proposal concerning the introduction into the Polish legal system of class actions.

The author benefitted from the support of the private security sector as the Chief Officer of the City Police. When, after leaving the service, he was the President of the Polish Association of Employers Protection Branch “Małopolska”, one of the basic objectives of his activity was to ensure a high level of functioning of the private security sector as an important component of public security. Optimisation of the use of private security companies to ensure public security and order is one of the basic directions of his practical operation and research conducted by him. In the article, the author discusses the role of the private security sector and the tasks set for this sector. The genesis of security companies, their evolution and development in various countries of Europe and the world is covered. Much attention is devoted to the de-monopolisation of security in Poland, in which the security companies played a special role. The author outlines the most important objectives of private sector development in Poland as a specific type of economic activity. The basic concepts related to the functioning of security companies are explained, exposing their priority task, which is the protection of facilities, areas and equipment important for the functioning of the state. The author shows that the current level of terrorist threats implies the need for greater involvement of security companies in providing security to facilities constituting the critical infrastructure of the state. The role of specialist armed security formations in this area is highlighted. In the conducted research process, a positive answer to the main question is given, demonstrating that security companies are currently an important element of the public security system in Poland, and their use in this area should be constantly strengthened.

The Roman jurists avoided generalizations and abstract definitions. The law of delict originated in private vengeance. A delict was a private wrong and yet the actio poenalis served to penalize the wrongdoer. Theft is recognized as a criminal offence all over the world, but its scope differs considerably from that of its Roman ancestor. Very little of the Roman law relating to furtum has made its way into our modern legal systems. Mere furtum usus constituted theft also furtum possessionis and theft comprised what we have just referred to as embezzlement. Yet, certain instances of fraud were also taken to constitute theft. It was a physical contact between thief and the stolen property that could be described as contrectatio and the thief acted with the intention of making an unlawful gain.

Rynek funduszy private equity w Polsce rozwijał się bardzo dynamicznie od początku 1990 r., a w kolejnych latach udowodnił, że może być jednym z lepszych na świecie pod względem zysków ze zrealizowanych inwestycji. O ile rynek amerykański czy brytyjski uznawane są za wiodące w tym sektorze, o tyle rynek polski jest pod wieloma względami znakomitym rynkiem dla inwestycji funduszy private equity.  Polska zalicza się do znaczących rynków regionu Europy Środkowo-Wschodniej (ang. Central and Eastern Europe – dalej: CEE). Tylko w 2014 r. wartość inwestycji funduszy private equity stanowiła 19% całości inwestycji w krajach CEE (w 2013 r. było to 48%) oraz niecały 1% całości inwestycji w Europie (w 2013 r. było to nieco ponad 1%). W Polsce, najbardziej popularne okazały się branże konsumpcyjna (27% ) i telekomunikacyjna (25%). Finansowanie transakcji fuzji i przejęć z udziałem funduszy private equity staje się coraz bardziej widoczne na polskim rynku. Problematyka tego typu finansowania wśród polskich przedsiębiorstw wymaga przeprowadzenia głębszych analiz.
In Poland from early 90’s mergers and acquisitions market developed very dynamic and it proved next years that it can be one of the best developing market taking into account internal rate of return. It is worth mentioning, that leading merger and acquisition markets are in US and UK but also polish market is very profitable for that kind of business.  Poland belongs to one of the largest mergers and acquisitions markets in Central and Eastern Europe. Only in 2014 the value of private equity investments was 19% of the total investments in CEE (in 2013 it was over 48%) as well as almost 1% of the total investments in the whole Europe (in 2013 it was slightly above 1%). Unlike in 2013, the most popular sectors for investors were retail (27%) and telecommunication (25%). Financing mergers and acquisitions with the participation of private equity became more popular in Poland and worth taking into consideration by polish companies. However the subject of this kind of investments demands some deeper research and analysis.

Banki w ramach prowadzonej działalności mogą wykonywać czynności z zakresu działalności inwestycyjnej, co oznacza działalność banków na rynku finansowym polegającą na świadczeniu usług pośrednictwa finansowego poprzez alokację kapitału z wykorzystaniem dostępnych technik, metod oraz instrumentów. Działalność banku może zostać ograniczona tylko do niektórych czynności inwestycyjnych wykonywanych na rzecz podmiotów niefinansowych, w tym klientów zamożnych. Proces świadczenia usług przez banki w segmencie zamożnych klientów jest określany jako private banking. Celem artykułu jest analiza aktualnych wyzwań oraz trendów charakteryzujących private banking na świecie, a także prezentacja możliwych kierunków rozwoju oraz zmian, w obliczu których w najbliższej przyszłości mogą stanąć zarówno osoby zamożne, jak i banki zajmujące się ich obsługą. Wśród głównych priorytetów banków w obsłudze klientów zamożnych powinny się znaleźć między innymi działania związane z dywersyfikacją oferty, edukacja i budowanie długoterminowych relacji z pokolenia na pokolenie oraz wykorzystanie nowoczesnych kanałów komunikacji, np. mediów społecznościowych.
Banks as part of conducted activity can conduct activities from the scope of the investment activity. The investment activity of the bank can be limited only to some duties performed for clients, in it of wealthy clients. The process of the service delivery in the HNWI determined by banks is private banking. The main aim of the article is an analysis of apt challenges and the trends of private banking in the world, as well as presentation of possible directions of the development and changes, in the face of which in the immediate future can stand up both wealthy clients, as well as banks dealing with their service. Amongst major priorities of banks in the service wealthy clients action associated with the diversification of the services, the education of the clientele and focusing on long-term relationships (generation after generation) and interaction on social media should be number one priorities for private banking.

While the literature on determinants of sovereign default is voluminous, the links between private indebtedness and the probability of public bankruptcy have not been studied extensively. In this paper we aim to fill this gap and to shed more light on the influence of the size and structure of private debt on sovereign default probability. We focus on developing and emerging market economies over the years 1970–2012. The main conclusions are that both the size and the structure of private borrowings affect the probability of a sovereign default.

The article presents the potential advantages and disadvantages of introducing the euro in Poland, on the basis of macro- and microeconomic theories. In particular, the author examines the implications of the move for private consumers. Berbeka presents the results of empirical analyses and surveys of residents in the 12 European Union member states that introduced the euro in 2002. In the final part of her article, the author discusses the findings of polls into the feelings and expectations of Poles with regard to the country’s planned accession to the euro zone. In the EU-12 euro-zone countries, the adoption of the euro has led to varied economic and psychological implications, including an increase of prices and social frustration. Many consumers were initially disoriented and needed time to adapt to the new situation. These psychological costs negatively influenced the public’s perception of the benefits of the euro. In Poland, the euro will probably benefit around 30 percent of the population in the initial period, while the rest will primarily feel the costs of the move, Berbeka says. Negative psychological effects are likely to provoke price hikes. Considering the worries that Polish consumers expressed in the surveys and their skeptical attitude toward the euro, the process of replacing the zloty with the single European currency should be properly organized. It should be accompanied by a public awareness campaign to highlight possible difficulties.
