    The authors refer to several aspects of the most recent proposal to amend the Executive Penal Code, published by the Ministry of Justice in autumn 2021 and widely consulted as part of the legislative process. The draft is a voluminous document, 52 pages long, and covers a wide range of issues with varying degree of detail. The article is not intended to offer a comprehensive analysis of the whole project – we confine ourselves to a few threads that, in our opinion, are the most important, as well as require commentary due to their possible consequences for the system of penal executive law and the protection of the rights of persons deprived of their liberty. These are the issues related to the implementation of sentences in the electronic monitoring system, the problem of complaints and judicial control in enforcement proceedings, the institution of “preventive measures” in penitentiary institutions, principles of transferring offenders sentenced to life imprisonment to semi-open and open institutions, authorization of the Minister of Justice to issue a regulation on determining the surface area of living cells, modification of the content of Art. 117 of the Penal Code as a consequence of the decision of the Constitutional Tribunal concerning the treatment and rehabilitation of convicted addicts and the principles of functioning of psychiatric institutions with reinforced and maximum security.

    The issue of “dangerous” prisoners is of utmost importance, mainly regarding the restrictions imposed on offenders of this category. The restrictions in question introduce significant limitations of the statutory rights of individuals and alter the purposes of the penalty of deprivation of liberty. For this reason, it is necessary to align the Polish law, and above all penitentiary practice, with the international standards of human rights protection. This paper analyses both the Polish legislation and practice in terms of the qualification and treatment of “dangerous” prisoners . The paper points to the obscurity of certain legal regulations and the broad limits of discretion in applying and extending “dangerous prisoner” status. Furthermore, the paper evaluates the concept of distinguishing the category of “dangerous prisoners” and the operation of “N” wards from the perspective of the impact that such heightened isolation exerts on the individual, but also on the society and the penal institution .

The first part describes the Polish situation with regards to constitutional principles of human dignity and freedom from unfair treatment. This leads to the conclusions contained in the third section about respecting these articles in contemporary Polish penitentiary law and prisons.

    One consequence of the amendment to the Executive Penal Code from 5 January 2011 was the status of a specially protected prisoner. Tis study is based on research aimed at determining the individual and systemic consequences of creating this new category of prisoners. I assumed that these consequences in both aspects would be negative and this assumption was fully confrmed by the empirical material. Te research took place from 2014 to 2017 and consisted of 3 elements: a detailed description of the legislative process, an analysis of statutory, and executive provisions and  an examination of prison practice, whereby interviews were conducted with individuals covered by special protection. Te interviews reveal that these people are treated no differently than those who pose a serious threat to the safety of others and to order in the prison (so-called “N” prisoners) .
    Następstwem nowelizacji k.k.w. z 5 stycznia 2011 r. było wprowadzenie statusu więźnia szczególnie chronionego. Opracowanie jest relacją z badań, których celem było ustalenie, jakie są indywidualne i systemowe konsekwencje stworzenia tej nowej kategorii więźniów. Założenie, że konsekwencje te są w obydwu wymiarach negatywne, w pełni potwierdziło się w świetle materiału empirycznego. Badania prowadzone były w latach 2014–2017 i składały się z trzech części: szczegółowego opisu procesu legislacyjnego, analizy przepisów ustawowych oraz wykonawczych, a także badań praktyki więziennej poprzez przeprowadzenie wywiadów z osobami objętymi ochroną. Z wywiadów wynikło, że postępowanie wobec tych osób niczym nie różni się od traktowania tych, którzy stanowią poważne zagrożenie dla bezpieczeństwa innych osób oraz dla porządku w zakładzie karnym (tzw. kategoria „N”).

    Artykuł poświęcony jest zagadnieniu czynnego prawa wyborczego jako podstawowego prawa politycznego przysługującego w oparciu o przepisy i standardy prawa między¬naro¬dowego. Spojrzenie „prawnoczłowiecze” na prawo do głosowania przedstawione zostało w oparciu o dwa zagadnienia, ukazujące niewłaściwe wywiązywanie się Polski z ciążących na niej zobowiązań międzynarodowych. Pierwsze – kwestia pozbawienia prawa wyborczego osób ubezwłasnowolnionych – to problem najbardziej palący dla rodzimego ustawodawcy i ustrojodawcy. Drugie – zapewnienie prawa głosu osobom odbywającym karę pozbawienia wolności – ma wymiar bardziej praktyczny. Nie można bowiem poprzestać na nadaniu jednostce prawa udziału w głosowaniu w przepisach prawa np. rangi konstytucyjnej, ale należy przede wszystkim obudować je niezbędnymi gwarancjami korzystania z niego przez wszystkich uprawnionych. To bowiem nadaje mu w pełni realny „prawnoczłowieczy” wymiar.
    The article discusses the issue of the right to vote as a basic political right expressed in rules and standards of international law. Right to vote as a crucial human right has been presented based on two examples, showing lack of or problematic compliance of Polish electoral law with international human rights law. As first is analyzed the question of disenfranchisement of persons being incapacitated – this is the most important dilemma for the domestic legislator. The second – implementation of the voting rights of persons held imprisonment – is more practical. For it is not enough to grant voting rights in the legal acts eg. in the constitution. It is essential to build the necessary guarantees, which allows to use it by all eligible voters. Only then we can say that right to cast a vote has an actual “human right” dimension.

    The article aims to present the prisoner’s right to the freedom of conscience and religion in the European system of human rights. A detainee is a subject of special human rights because he or she is deprived of the right to liberty. Public authorities are obliged to strictly observe the law related to the sphere of convicts and their views. The right of people deprived of liberty is to exercise their free thought, conscience and religion. No one should be subjected to coercion which would limit their freedom of religion, except as stipulated by the legislator. Public authorities are obliged to provide prisoners with the opportunity to participate in religious events, to contact a priest, to manifest religious beliefs and to be administered medical care. Discipline and security issues may justify the imposition of restrictions of liberty on the grounds of security and public order. Taking advantage of religious freedom must not violate the principles of tolerance or disrupt the established order in prison.
    Artykuł ma na celu przedstawienie praw więźnia do wolności sumienia i wyznania w systemie europejskim praw człowieka. Osoba znajdująca się w miejscu detencji jest szczególnym podmiotem praw człowieka, ponieważ jest pozbawiona prawa do wolności. Władza publiczna ma obowiązek bezwzględnego przestrzegania prawa związanego ze sferą przekonań i poglądów więźnia. Prawem osoby pozbawionej wolności jest realizowanie jej swobodnej myśli, sumienia i wyznania. Nikt nie może podlegać przymusowi, który ograniczałby jego wolność wyznania lub przyjmowania religii, z wyjątkiem zastrzeżeń przewidzianych przez ustawodawcę. Władze publiczne zobowiązane są do zapewnienia więźniom możliwości uczestnictwa w wydarzeniach religijnych, kontaktu z osobą duchowną, uzewnętrzniania przekonań religijnych oraz zapewnienia opieki medycznej. Kwestie dyscypliny i bezpieczeństwa mogą powodować ograniczenie wolności ze względu na bezpieczeństwo i porządek publiczny. Korzystanie z wolności religijnej nie może naruszać zasad tolerancji ani zakłócać ustalonego porządku w zakładzie karnym.

    Przedmiotem analizy jest ewolucja zmian, jakie zaszły przez 170 lat w Zakładzie Karnym w Rawiczu. Dwa najważniejsze cele pracy to: identyfikacja najważniejszych zmian, jakie dokonały się w funkcjonowaniu Zakładu Karnego w Rawiczu, oraz ocena funkcjonalności tych zmian względem postępów w zakresie realizacji wybranych zadań. Z racji określonej specyfiki oraz skupienia się na konkretnym odcinku czasowym niniejszy artykuł oscyluje w granicach czasowych od powstania Zakładu Karnego w Rawiczu w roku 1819 do 1989 roku, kończącego w Polsce okres rządów komunistycznych. Zmiany, jakie nastąpiły w ZK w Rawiczu, miały związek z dostosowywaniem owej jednostki do bieżących potrzeb elit rządzących. W dużej mierze skupiały się one na przemianach infrastrukturalnych względem danej grupy docelowej (np. więźniów politycznych) oraz były naturalnie powiązane z prawem stanowionym przez organy rządowe, co przyczyniało się do rozwoju jednostki w określonym kierunku. Wskazane zmiany oraz aktualne na tamte czasy prawodawstwo danego zaborcy przyczyniły się niewątpliwie do rozwoju placówki oraz sprawniejszego (w kontekście aktualnych dla tamtych czasów realiów) jej funkcjonowania.
    The subject of the analysis is the evolution of changes that have occurred over 170 years in the Penitentiary in Rawicz. There are two aims of the work: the identification of the most important changes that took place in the Rawicz Penitentiary, together with the explanation of how they influenced the evolution of the institution. Due to the topic specificity and focus on a specific time period, the analysis oscillates within the time limits from the establishment of the Penitentiary in Rawicz, i.e., 1819, up until 1989, i.e., the year ending the period of communist rule in Poland. The changes that took place in the Penitentiary in Rawicz were related to the adaptation of this unit to the current needs of the ruling elites. To a large extent, they focused on infrastructural changes in relation to a given target group (e.g., political prisoners) and were naturally linked to the law enacted by government bodies, which contributed to the development of the unit in a specific direction. The indicated changes and the current legislation of the partitioning powers at that time undoubtedly contributed to the development of the facility and its more efficient functioning (in the context of the realities of those times).

    During the Covid-19 pandemic, most of the rights of prisoners were clearly limited. These restrictions temporarily affected, among others, visits, out-of-prison employment, prison furloughs and access to religious services. The introduced restrictions significantly increased dissatisfaction among prisoners, which manifested in prison riots in Poland (e.g. in Chełm) and abroad. It should be noted, however, that the full exercise of all the rights and freedoms of prisoners in the conditions of pandemic is not possible, even if compliance with the WHO guidelines set out in the document of 15 March 2020 is ensured. These guidance has been followed rightfully in practice by most Polish prisons and pre-trial detention centres and there have been no reports of serious coronavirus disease outbreaks.
    Wytyczne WHO a wykonywanie kary pozbawienia wolności w czasie pandemii Covid-19 w Polsce na przykładzie zakładu karnego w Chełmie W czasie obowiązywania pandemii Covid-19 większość uprawnień skazanych odbywających karę pozbawienia wolności zostało wyraźnie ograniczonych. Obostrzenia dotyczyły m.in. okresowego wstrzymania widzeń, zatrudnienia poza więzieniem i udzielania przepustek oraz dostępności do posług religijnych. Wprowadzone ograniczenia zdecydowanie wpłynęły na wzrost niezadowolenia wśród osadzonych, wyrażającego się w formie buntów więziennych w Polsce (np. w Chełmie) i zakładach karnych za granicą. Jednak należy zauważyć, że pełna realizacja wszystkich praw i wolności skazanych w warunkach pandemicznych nie jest możliwa mimo przestrzegania wytycznych WHO zawartych w dokumencie z 15 marca 2020 r. Wytyczne te w większości zostały prawidłowo wykorzystane w praktyce więziennej polskich zakładów karnych i aresztów śledczych i nie zanotowano w nich występowania poważnych ognisk choroby wywołanej koronawirusem.

The programme’s objectives are discussed here, along with its methodology and evaluation process.The research material comprises various documents developed as part of the planning, implementation and evaluation of the programme, including workshop plans and evaluation and observation sheets generated in 2016–2018. The innovative prisoner social rehabilitation programme is discussed in detail in this article on the basis of the building and consolidation of parental bonds. Most social rehabilitation programmes of this type are informed by the social rehabilitation methods listed in Art. 67 § 3 of the Penal Code (1997), in which maintaining contact with family and the outside world is listed next to learning, work, cultural and educational activities, sport and therapy. The “Theatre, Mummy, Daddy and Me” programme is based on contemporary cognitive and behavioural approaches in psychology and therapy, and addition also draws on a multi-systemic approach to environmental therapy.In the context of the need to secure children’s rights and protect prisoners’ rights, it is the obligation of penitentiary institutions to secure contact between the incarcerated parents and their children.

    Opis:
    Przedmiotem rozważań zawartych w niniejszym opracowaniu jest ocena skuteczności prawa do skargi indywidualnej do Europejskiego Trybunału Praw Człowieka (ETPCz), realizowanego przez osoby pozbawione wolności. Należy podkreślić, że w warunkach izolacji więziennej skarga ta może być jedynym skutecznym środkiem ochrony prawnej dla osób uwięzionych. W opracowaniu wykorzystano w pierwszej kolejności najbardziej istotne orzecznictwo ETPCz, ze szczególnym uwzględnieniem serii spraw przeciwko Ukrainie, które doprowadziły ETPCz do wydania wyroku quasi-pilotażowego. Ten kolejny przypadek pojawienia się systemowego problemu, uniemożliwiającego skuteczne korzystanie przez więźniów ze skargi indywidualnej, o której mowa w art. 34 KE, prowadzi do konieczności zastanowienia się nad potencjalnymi sposobami usunięcia tego typu mankamentów. W opinii autorki, niezbędna mobilizacja państw-stron KE w tym zakresie mogłaby być osiągnięta w drodze nadania swoistego priorytetu skargom pochodzącym od osób pozbawionych wolności i to poprzez formalne zobligowanie administracji więziennych odnośnie do wyposażenia więźnia, na jego prośbę, w potrzebne materiały uzasadniające skargę. Dodatkowo, do środków skutecznie oddziałujących na państwa w zakresie rzetelnego wypełnienia przez nie ich obowiązku wynikającego z art. 34 KE, można zaliczyć: a) korzystanie przez ETPCz z formy finansowej słusznego zadośćuczynienia, w przypadku, gdy jedyne stwierdzone naruszenie dotyczy prawa do skargi, oraz b) sięgnięcie po procedurę wyroku pilotażowego, a nie quasi-pilotażowego, w sytuacji, gdy są ku temu uzasadnione podstawy. Z dotychczasowej praktyki wynika, że jest to procedura bardziej „rygorystyczna” i jako taka, w przypadku przedstawionego problemu, byłaby pożądana.
    The aim of the paper is to assess the efficiency of an individual’s right to application to the European Court of Human Rights (ECHR) in case the applicant is imprisoned. It must be emphasized that in case of prison isolation an application may be the only efficient means of legal protection for prisoners. The paper first of all makes use of the most important ECHR judgements, especially a series of cases against Ukraine, which made ECHR issue a quasi-pilot judgement. This subsequent instance of a system-related problem precluding prisoners from exercising the right to application by an individual laid down in Article 34 of the European Convention on Human Rights (EC) results in a necessity for considering potential ways of eliminating the drawbacks. In the author’s opinion, essential mobilization of the States-Parties to the Convention might be achieved by giving applications by imprisoned individuals a priority by obliging prison administration to provide aprisoners, on their request, with materials necessary to substantiate an application. In addition, the measures effectively influencing the states in the field of thorough fulfilment of their obligations under Article 34 EC include: (a) the use of fair financial compensation by ECHR in case the only proved violation concerns the right to application, and (b) the use of a pilot judgement procedure, not a quasi-pilot procedure, in case there are justified grounds to do that. The practice shows that the procedure is more ‘rigorous’ and as such is more desirable in case of the discussed situation.

    Opis:
    The article presents an innovative programme for the re-adaptation of inmates confined in correctional facilities which focusses on building and consolidating their bonds with their children. In Poland, contemporary social rehabilitation programmes are based on measures listed in the Polish Executive Penal Code of 1998 (Executive Penal Code, 1997, Art. 67 § 3). Apart from studying, working, cultural and educational activities, and therapeutic interventions, the Code also mentions contact with family members and relatives. These rehabilitation programmes include the right of convicts, under international and national law, to maintain contact with their families, while methodologically they are compliant with the most current cognitive-behavioural approach to therapy and corrective measures. They also draw on the multi-systemic approach, in a general sense. In the context of safeguarding children’s rights, contact between parents and children is the responsibility of the parents, but in the case of prisoners it is the responsibility of the correctional institution to ensure that prisoners can exercise their rights while serving a custodial sentence. The article takes advantage of the methodologies of document analysis and participant observation. It discusses the programme for the social re-adaptation of prisoners, which involves encouraging and consolidating relationships between parents and children while maintaining a focus on particular rehabilitation objectives, resocialisation methods, and outcome evaluation.
    Celem artykułu jest prezentacja innowacyjnego programu readaptacji skazanych w zakładzie karnym nakierowanego na budowanie i wzmacnianie więzi z dziećmi. Program „Teatr, Mama, Tata i Ja” realizowany jest od 2015 r. do chwili obecnej przez zespół Teatru Lalki i Aktora „Kubuś” i pracowników Aresztu Śledczego w Kielcach dla osób odbywających karę pozbawienia wolności. Współczesne programy resocjalizacji wykorzystują podstawowe środki resocjalizacji wymienione w polskim Kodeksie karnym wykonawczym z 1998 r. Obok nauki, pracy, zajęć kulturalno-oświatowych i sportowych oraz oddziaływań terapeutycznych regulacje prawne wskazują na kontakty z rodziną i osobami bliskimi. Programy te uwzględniają prawo skazanych do utrzymywania kontaktów z rodziną na mocy prawa międzynarodowego i krajowego, a w zakresie metodycznym są adekwatne do najbardziej aktualnego podejścia kognitywno-behawioralnego w terapii (cognitive-behavioural therapy) i działaniach korekcyjnych. Realizacja kontaktów dzieci z rodzicami jest obowiązkiem rodziców w kontekście zabezpieczenia praw dziecka, a po stronie instytucji korekcyjnej leży obowiązek zapewnienia skazanym realizacji ich praw w czasie odbywania kary pozbawienia wolności. Artykuł ma charakter empiryczny, wykorzystuje bowiem metody analizy dokumentów oraz obserwacji uczestniczącej.

    Ramy analizy przeprowadzonej w tym artykule obejmują trzy wieloaspektowe problemy badawcze. Pierwszy z nich wiąże się ze złożoną strukturą przedmiotu zakazu złego traktowania i stopniem jego absolutności: bezwzględnością i bezwarunkowością. Drugi dotyczy materialnego zakresu praw osób skazanych na bezwzględną karę dożywotniego pozbawienia wolności. Natomiast trzeci problem dotyczy struktury i charakteru, treści (przedmiotu) oraz środków wykonywania obowiązków Państwa-Strony, skorelowanych z tymi prawami. Powyższe trzy problemy badawcze koncentrują się na orzecznictwie organów EKPC w zakresie kary bezwzględnego pozbawienia wolności na gruncie art. 3 EKPC. Przegląd tego orzecznictwa pokazuje, że organy w Strasburgu w pierwszej kolejności oceniły dopuszczalność skazania nieletniego sprawcę na powyższą karę, następnie odniosły się do kwestii dopuszczalności deportacji osoby z Państwa-Strony EKPC do państwa, w którym istnieje rzeczywiste ryzyko skazania na taką karę i wreszcie ustaliły warunki skazania na taką karę dorosłego sprawcę. Ze względu na ograniczone ramy artykułu dwie pierwsze kwestie orzecznictwa zostały pominięte. Odpowiedzi na postawione pytania badawcze wydają się mieć nie tylko wartość teoretyczną, ale także praktyczną, ponieważ umożliwiają ocenę zmian w polskim prawie karnym z 2019 r. w zakresie dożywotniego pozbawienia wolności bez możliwości warunkowego zwolnienia.
    The framework of the analysis conducted in this article is based on three multifaceted research problems. The first one is related to the complex structure of the prohibition of ill-treatment and the degree of its absoluteness: the prohibition is unqualified and unconditional. The second concerns the material scope of the rights of persons sentenced to absolute imprisonment. The third problem deals with the structure and nature, content (subject matter) and means of performing the obligations of the State Party, correlated with these rights. These three research problems focus on the ECHR on absolute imprisonment under the Art. 3 of the ECHR. A review of the case-law shows the Strasbourg bodies first assessed the compatibility of sentencing a minor offender to the above sentence, then addressed the issue of the admissibility of deportation a person from a State Party to the ECHR to a State, where there is a real risk of being sentenced to such a sentence and finally determined the conditions for sentencing the adult offender to such a sentence. Due to limited framework of the article, the first two issues are not discussed in the article. The answers to these research questions seem to have not only theoretical but also practical aspect as they make it possible to assess the changes in Polish criminal law of 2019 with regard to life imprisonment without the possibility of parole.
