Opis:: Artykuł stanowi krytyczną analizę dwutomowej publikacji: Katalog zabytków sztuki. Województwo podlaskie (białostockie). Powiat bielski, wydanej w ramach serii: „Katalog Zabytków Sztuki w Polsce” przez Instytut Sztuki Polskiej Akademii Nauk. Artykuł ma na celu zaprezentowanie zawartości Katalogu oraz ocenę jego przydatności do dalszych, szczegółowych badań nad historią regionalną. Autor zwraca uwagę na wysoki poziom merytoryczny recenzowanej pracy, w której wykorzystano bogaty materiał źródłowy pozyskany dzięki kwerendzie przeprowadzonej w zasobach archiwów krajowych (np. Archiwum Państwowe w Białymstoku), zagranicznych (Rosyjskie Państwowe Archiwum Historyczne w Petersburgu) oraz w innych instytucjach kultury (np. Wojewódzki Urząd Ochrony Zabytków w Białymstoku). W opracowaniu Katalogu skorzystano również z licznych naukowych monografii, artykułów i opracowań obejmujących ponad 300 pozycji bibliograficznych. Do walorów Katalogu, oprócz aparatu naukowego, należy wysoka jakość edytorska. Katalog prezentuje bogaty materiał ilustracyjny opatrzony szczegółowymi opisami w postaci rysów historycznych siedemdziesięciu dwóch miejscowości wraz z charakterystyką znajdujących się tam obiektów zabytkowych zobrazowanych na 1427 kolorowych fotografiach. Autor poszerza informacje na temat niektórych obiektów zabytkowych opisanych w Katalogu, wykorzystując do tego archiwalia przechowywane w zasobie Archiwum Państwowego w Białymstoku. Są to m.in. XX-wieczne fotografie przedstawiające ratusz w Bielsku Podlaskim oraz dokumentacja aktowa dotycząca stanu technicznego Kościoła p.w. Matki Boskiej z Góry Karmel w Bielsku Podlaskim po pierwszej wojnie światowej. Omówiony artykuł recenzyjny w syntetyczny sposób prezentuje potencjalnemu czytelnikowi treść Katalogu. Podkreśla również jego naukową przydatność dla historyków sztuki i prawa oraz regionalistów.
This paper constitutes a critical analysis of a two-volume publication: Katalog zabytków sztuki. Województwo podlaskie (białostockie). Powiat bielski [A Catalogue of Artistic Monuments. Podlaskie (Białystok) Voivodeship. Bielsk County], published in a series “A Catalogue of Artistic Monuments in Poland” by the Institute of Art at the Polish Academy of Sciences. The author of this article presents the contents of the Catalogue and evaluates its usefulness for further, detailed research on regional history. He draws attention to a high substantive level of the reviewed work which was based on rich source material acquired by means of queries conducted in the Polish archives (e.g., State Archives in Białystok), foreign ones (Russian State Historical Archive in St. Petersburg), and other cultural institutions (e.g. Voivodship Office for the Protection of Historical Monuments in Białystok). The Catalogue also uses data from numerous scientific monographs, articles, and elaborations containing over 300 references. One of its assets, apart from the scientific content, is high editorial quality. The Catalogue presents rich illustrative material provided with detailed descriptions in the form of historical outlines of seventy-two settlements with the characteristics of included monuments, depicted in 1,427 colourful photographs. The author expands information on some of the monuments described in the Catalogue using archive materials stored in the National Archives in Białystok. These are e.g.: 20th-century photographs showing the town hall in Bielsk Podlaski and archival files on the technical condition of the Church of the Blessed Virgin Mary from Mt. Carmel in Bielsk Podlaski after the First World War. The potential reader of the discussed review article is offered a synthesis of the Catalogue’s contents. It also highlights its scientific usefulness for art historians and regionalists.

Opis:: At the beginning of this year the LexisNexis publishers issued a book, which excellently fills the gap that emerged from the time of the binding Statute of 23 July 2003 on the protection of historical monuments. This is the first book of its sort to render available, analyse and subject to a constructive assessment the accomplishments of the judicature as regards the range of the protection of historical monuments and adjudication pronounced upon the basis of the statue in force. The author, who presents the young generation of lawyers, is one of the few researchers dealing with the legal aspects of the protection of historical monuments. The book offers a lucid presentation of the mechanics of the impact of law, and allows the reader to understand the nature of law and the ways in which it should be deployed so that undertakings associated with the protection of historical monuments would be effective. The adjudication of administrative courts discussed in the book depicts essential problems linked with an interpretation of regulations upon the stage of their application. The cited examples contain important directives, which the conservation organs should follow while interpreting the regulations of material law and choosing suitable administrative procedure. The titular publication will certainly prove useful for lawyers and employees of government and self-government administration. Presumably, it will also meet with great interest among conservators not attached to the administration as well as the owners of historical monuments.

Opis:: The national scientific conference on ”The Legal Protection of the Cultural Heritage in Poland – the Experiences and Challenges of the Twenty First Century”, held in Warsaw on 27 February 2009, was organised by the Chair of the Administration and Protection of the Natural Environment in the Faculty of Law and Administration at the Cardinal Stefan Wyszyński University in Warsaw and the Warsaw Seminar on Administration Axiology. The partners of the organisers were the National Heritage Board of Poland, the Centre for the Protection of Public Collections, and the Horyńska & Partners Law Firm. The conference was attended by more than 200 persons, including representatives of the conservation environment, lawyers and museum experts. The papers were followed by the acceptance of the text of the end declaration. The rank which the organisers of the meeting granted to it and the presence of the most outstanding Polish lawyers specialising in the legal protection of the cultural heritage testify to the significance of the state of Polish legislation for conservation administration.

Opis:: The protection of cultural property at the time of an armed conflict comprises an extremely essential problem. International law foresees detailed guidelines concerning this issue in its Convention on the protection of cultural property in the case of an armed conflict, the Executive rules to this convention and the Protocol on the protection of cultural property in case of an armed conflict, signed at The Hague on 14 May 1954. These documents list the instruments and legal institutions protecting historical monuments during this particularly dangerous time. From the practical viewpoint, particular importance is attached primarily to a detailed definition of the object of protection. The instruments of protection include the specially noteworthy special protection, the International Register of Cultural Property under Special Protection, as well as the storage and transport of cultural property. Apart from the above mentioned detailed rules, which have not as yet been accepted by all countries, cultural property is protected according to assorted general principles. International law indubitably exerts direct impact on the contents of domestic law. Nonetheless, importance should be attached not only to law, but also to suitable social policies which ought to focus universal awareness on the necessity of preserving material cultural heritage for successive generations.

Opis:: During the 2nd World War Polish churches suffered great damage due to regular plunder by the Nazists. The author discusses regulations of the Penalty Code and Law on the protection of the cultural property and on museums with regard to robberies of works of art in the recent years. He quotes and compares recommendations of the Instruction of the Polish Episcopate on the protection of monuments of art and trends of the development of sacral art since 1966. Attention is paid to the fact that according to the Instruction, church administrators are not owners but only guardians and patrons of works of art found in the buildings that are under their care. Post-consiliar liturgy, i.e. turning the altar round to the congregation, has resulted in an extreme desire to modernize church interiors, which quite often was, against the idea of monuments protection. This, in the author’s opinion, is a misunderstanding, as the church law clearly opposes the introduction of any shoddy things into the decor of sacral interiors. Museum-like church interiors offer much temptation for thieves. Therefore, it is an urgent task to draw detailed inventories describing particular works of art in such a way that the church administrator could know what he possesses and what he is to protect on the one part, and on the other, to facilitate for himself and prosecution bodies to recognize and to recover robbed works of art. All works of art in sacral buildings should be put into a register of voivodship monuments conservator, which ensures their legal protection and — in the case of outstanding artifacts — financial aid of the state for their conservation. The author emphasizes the fact that the clergymen should be made aware of high cultural values of works of art when they are still students at seminars. The full knowledge of the cultural value of monuments and, consequently, care and their protection, are the best guarantee of its safe-guarding against robbery and destruction.
