    Contemporary research concept of the history of political and legal thought includes various sources of information about opinions on politics, state and law that appeared in the past. One of them is a parliamentary debate. The article concentrates on the discussion about the marriage law that took place in the Polish Parliament (Sejm) in 1818. At that time one of the most controversial law institutions was the divorce. The legislative bill divided Members of Parliament into three different groups. The first party supported the project of the new matrimonial law that was prepared by the government (The Council of State). The second group considered acceptance of the religious norms that were given by the Roman Catholic Church to be the most appropriate solution. The last one was formed by liberals who opposed voting in favour of the project, which – in their opinion – extremely invaded human privacy and freedom. The content of the debate also presents three major conceptions of the system of government that prevailed in the Kingdom of Poland.

    This article establishes how ordinary people understand classical categories of political thought. By interpreting qualitative data, we show how contemporary Polish society conceives such fundamental concepts of political philosophy as ‘the individual,’ ‘society,’ and ‘the state.’ Finally, we point out the implications of our findings for political science and political sociology, especially in regard to popular political culture.

    Związki zawodowe są jedną z form zrzeszania się w realiach państwa demokratycznego, których istotą jest organizowanie się pracowników w celu obrony swoich interesów. Funkcjonowanie tego typu zrzeszeń, opierających się na dobrowolnej, nakierowanej nie na osiągnięciu dochodu, pracy ich członków, służących nie tylko zaspokojeniu prywatnych celów, ma znaczenie nie tylko z punktu widzenia statusu prawnego jednostki, ale również sfery życia społecznego o pewnej autonomii wobec władz publicznych. Celem niniejszego artykułu jest wykazanie, że tworzenie oraz funkcjonowanie związków zawodowych stanowi istotny element naczelnej zasady ustroju społecznego współczesnych państw demokratycznych, określanej jako społeczeństwo obywatelskie.
    Trade unions are one of the forms of association in the realities of a democratic state, whose essence is the organization of employees to defend their interests. The functioning of such associations, based on the voluntary, non-income-oriented, work of their members, serving not only to meet private goals, is important not only from the point of view of the legal status of the individual, but also the sphere of social life with a certain autonomy towards public authorities. The purpose of this article is to show that the creation and functioning of trade unions is an important element of the guiding principle of the social system of modern democratic states, referred to as civil society.

    The article discusses the current state of edition of legal historical sources in Poland from the perspective of historians of political and legal thought. The authors begin by explaining the idea and scope of „source base”specific to their field of research. Three following issues are discussed later: (a) translation of foreign sources into Polish; (b) critical (re)edition of classic Polish texts in political thought; (c) edition of 20th century documental sources by the Institute of National Remembrance and The KARTA Centre. The authors make a number of comments and requests concerning the subject of discussion.

    Contemporary research concept of the history of the political and legal thought includes various sources of information about opinions on politics, state and law that appeared in the past. One of them comprises the debate of the parliament. The article concentrates on the discussion about the boundary line of land property that took place in the Polish Parliament (Sejm) in 1818. The bill of act divided Members of Parliament into two different groups. The first party, dominant, supported the project of the new law that was prepared by the government (Rada Stanu). They thought that it is important to give legal certainty to owners of land property. The second group was formed by Members of Parliament who opposed voting in favour of the project, which in their opinion extremely invaded human privacy and freedom. The content of the debate also presents major conceptions of the system of government and the social order that prevailed in the Kingdom of Poland.

    Opis:
    Knowledge of history, and especially knowledge of the history of political thought, plays a key role in shaping the political and legal culture of a society and its political elites. That is because this kind of learning enriches society’s self-knowledge and, as such, aids in making appropriate political choices and pursuing appropriate ways of engaging in politics. Such knowledge is of particular importance in the case of Polish society which is characterised by a low level of political and legal culture, which manifests itself, amongst other things, in a lack of care about the collective good, excessive egoism and individu- alism, a mistrust towards state authorities, low levels of social trust, and an inability to engage in collective action. Therefore, it is contemporarily necessary to develop in Poland an active form of citizenship and to strengthen the democratic attitudes of the Poles through drawing on the country’s past and the best values and democratic and humanistic ideals that can be found in the history of its political thought.
