    Opis:
    The experience of creation and functioning of the urban cadastre as a structural element of modern highly developed state abroad is analyzed. It is found out that in the European Union virtually absent analogues of the urban cadastre in our understanding. However, there are widespread cadastral systems, that solve problems of registration and storage of information on real property, as well as planning restrictions and easements. In the states of the former Soviet Union (especially the Russian Federation, Kazakhstan, Belarus) town-planning cadastre is developed in forms that are close to the Ukrainian model. Since the formation of the urban cadastre system in Ukraine is in its infancy, so there is a possibility of using the experience of foreign countries with their achievements and mistakes that can be avoided.

    The paper focuses on land – use planning (zoning) (hereinafter referred to as “planning”) as a part of Building Law, specifically on the issue of regional reserves and their definition in the land use plan (hereinafter referred to as “plan”). There are examples of determination of areas of regional reserves for mineral extraction. At the same time, attention is also paid to potential environmental conflicts that may present regional reserves and the possibilities of their solution. The paper also deals with some links between the institute of regional reserves and the mining claim.
    Artykuł koncentruje się na planowaniu przestrzennym (podział na strefy) (zwanym dalej „planowaniem”) jako części prawa budowlanego, w szczególności na kwestię regionalnych rezerw i ich definicji w planie zagospodarowania przestrzennego (zwanym dalej „planem”). Istnieją przykłady określania obszarów regionalnych rezerw dla wydobycia minerałów. Jednocześnie zwraca się uwagę na potencjalne konflikty środowiskowe, które mogą stanowić rezerwy regionalne i możliwości ich rozwiązania. Artykuł dotyczy także niektórych powiązań między instytucją rezerw regionalnych a roszczeniami górniczymi.

    This article is a proposition to use modern CAD (Computer Aided Design) solutions to design industrial infrastructure, and show many benefits of their practical use, avoiding numerously mistakes while the investment process, at the same time increasing the quality of created products during reducing the costs associated with their production. The paper proposes a method of stocktaking of the current state and methods of spatial layout analysis of planned investment using smart databases to configure the individual manufacture slots. The method of material flow analysis in the virtual model of the production line was presented, tools for the analysis of the production line were indicated, especially focused on collision identification, work schedule creation and parametric analysis of designed installations.

    Podstawą działań w sprawie przeznaczenia terenów na określone cele i ustalenia zasad ich zagospodarowania powinien być rozwój zrównoważony. Nawiązuje to do ustawy Prawo ochrony środowiska i ustawy o planowaniu i zagospodarowaniu przestrzennym. Przy sporządzaniu większości dokumentów planistycznych na różnych poziomach zarządzania przestrzenią kraju jest konieczne przygotowywanie opracowań środowiskowych. Ten wymóg jest zapisany w unormowaniach prawnych dotyczących ochrony środowiska i zagospodarowania przestrzennego. Najważniejsze opracowania z zakresu ochrony środowiska dołączane do dokumentów systemu planowania przestrzennego w Polsce to: - opracowania ekofizjograficzne, - prognozy oddziaływania planu na środowisko, - raport o oddziaływaniu na środowisko dla przedsięwzięć mogących znacząco oddziaływać na środowisko, - decyzja o środowiskowych uwarunkowaniach zgody na realizację przedsięwzięcia. Przygotowywane dokumenty związane z ochroną środowiska zajmują ważne miejsce w systemie planowania przestrzennego w Polsce. Nowelizacja Prawa ochrony środowiska wprowadziła również obowiązek postępowania oceniającego oddziaływanie planowanego przedsięwzięcia na obszary Natura 2000. Obowiązek wykonywania opracowań poświeconych prognozowaniu przekształceń środowiska przyrodniczego przy sporządzaniu dokumentów planistycznych przyczynia się do zwiększenia znaczenia planowania przestrzennego jako jednego ze sposobów przeciwdziałania dalszej degradacji środowiska. Konieczne jest stałe doskonalenie dokumentów środowiskowych jako instrumentów ochrony środowiska pomocnych władzom samorządowym. Niezbędne staje się określenie zasad powoływania rzeczoznawców, którzy biorą udział w tworzeniu raportów i prognoz dotyczących oddziaływania na środowisko.
    Sustainable development should constitute the foundation for actions addressing land use for specific purposes and defining the principles for its management. This statement is related to the Environmental Protection Act and the Spatial Planning Act. Such a strong exposition of the sustainable development issue implicates the necessity of a close linking of spatial planning with the protection of the natural environment. Environmental studies should accompany development of spatial planning documentation on different levels of spatial management of the country. This requirement is expressed in legal regulations concerning environmental protection and spatial planning. The most important studies concerning environmental protection that are attached to the documentation of spatial planning systems in Poland include: - ecophysiographic studies, - prognosis of environmental impact assessment of the plans - environmental impact assessment report for investments that may have a meaningful effect on the environment - decision on the environmental conditions for the investment realisation permit The developed documentation related to the environmental protection plays an important role in spatial planning in Poland. Amendment of the Environmental Protection Act has introduced the obligation of conducting the procedure of environmental impact assessment in relation to the Nature 2000 sites. The obligation of developing prognosis documents concerning transformations of the natural environment that accompany the spatial planning documentation contributes to strengthening the importance of spatial planning as means of preventing further degradation of the environment. A continuous improvement of the environmental documentation is needed since it may serve as an environmental protection tool useful for the local governments. The rules for appointing experts who develop reports and prognosis documents concerning environmental impact assessments need to be determined.

    W artykule opisano proces ujawniania udokumentowanych złóż kopalin w aktach planowania przestrzennego, omówiono kompetencje organów administracji geologicznej w ramach współdziałania w procesie kształtowania ładu przestrzennego oraz kompetencje wojewody w zakresie ochrony złóż kopalin. Ponadto przedstawiono kluczowe orzeczenia sądów administracyjnych, które stanowią ważne uzupełnienie obowiązujących przepisów prawa w zakresie ochrony złóż kopalin. Stanowią one punkt wyjścia do udzielenia odpowiedzi na pytania: jak treść dokumentacji geologicznej złoża wpływa na zapisy aktów planowania przestrzennego oraz na co warto zwrócić uwagę przy opracowywaniu rozdziału dotyczącego ochrony złóż kopalin w dokumentacji geologicznej złoża. Odpowiedzi na te pytania zyskują szczególnego znaczenia w kontekście projektowanych zmian przepisów prawa, dotyczy to zarówno nowelizacji ustawy – Prawo geologiczne i górnicze (P.g.g. UD 280), jak również ustawy o planowaniu i zagospodarowaniu przestrzennym (u.p.z.p. UD 369). Natomiast niezależnie od tego, czy projektowane zmiany wejdą w życie, właściwe opracowanie rozdziału dotyczącego ochrony złóż kopalin w dokumentacji geologicznej, zwiększa szansę na zabezpieczenie złoża kopaliny i jego przyszłą eksploatację.
    The article describes the process of disclosing documented mineral deposits in spatial planning acts, addresses the competencies of geological administration bodies in the framework of cooperation in the process of shaping spatial order, as well as clarifies the competencies of the voivode with respect to the protection of mineral deposits. In addition, pivotal administrative court rulings are presented, which are a significant supplement to the existing laws on the mineral deposits safeguarding. They constitute a launching ground for providing answers to the following questions: how the content of the geological documentation of the mineral deposit affects the provisions of spatial planning acts, and what to consider when developing a chapter on the mineral deposits safeguarding in the geological documentation of a mineral deposit. The answers to these questions become particularly important in the context of the proposed modifications to the law, this applies both to the amendments to the Law – Geological and Mining Law (P.g.g. UD 280), as well as to the Law on Spatial Planning and Development (u.p.z.p. UD 369). On the other hand, regardless of whether the proposed amendments come into force, the proper elaboration of the chapter on the mineral deposits safeguarding in the geological documentation enhances the chances of securing the mineral deposit and its future exploitation.

    W artykule przedstawiono na tle aktualnych regulacji te nowe, które dopiero wchodzą w życie lub są projektowane w regulacjach planowania przestrzennego, rozwoju, budownictwa i inwestycji infrastrukturalnych, a także niektórych innych istotnych, jak: ochrony środowiska i przyrody, gospodarki odpadami, prawa wodnego, prawa energetycznego, mających wpływ na przyszłe inwestycje sektora wydobywczego. Autor uzasadnia tezę, iż dokumentacja geologiczna złoża oraz obliczenie zasobów niezbędne dla projektowania przyszłego wydobycia, a więc projekt zagospodarowania złoża, a także uwarunkowania dla budowy kopalni muszą uwzględniać regulacje, które będą obowiązywać w chwili udzielania koncesji wydobywczej i zatwierdzania planu ruchu zakładu górniczego. Artykuł przedstawia aktualne kierunki zmian w podstawowych dokumentach związanych z rozwojem kraju i regulacjami działalności gospodarczej, wskazując na rolę regulacji takich nowych instytucji, jak inwestycje celu publicznego, obszary funkcjonalne, nowe narzędzia dla reglamentacji inwestycji oraz szczególne regulacje w odrębnych ustawach dla specjalnych przedsięwzięć (przykładowo: autostrady o znaczeniu krajowym, sieci transgraniczne i interkonektory, czy elektrownia atomowa). Autor formułuje wnioski co do niezbędnych uzupełnień regulacji, zarówno w obszarze, o którym mowa wyżej, jak i dla kompatybilności w postanowieniach prawa geologicznego i górniczego.
    The article presents new regulations that are coming now into effect or that are being designed under regulations of spatial planning, development, construction and infrastructural investments as well as some other important ones such as: environmental and nature protection, waste management, water law and energy law which have an huge impact on future investments of the mining sector. Author justifies the thesis that the geological documentation of the deposit and the calculation of resources are necessary for designing future extraction and that the deposit development plan must take into account regulations that will apply at the time of granting the mining license and approval of the mining plant’s plan of operation. The article also presents current directions of changes in the basic documents related to the development of the country and business regulations, indicating the role of regulation of new institutions such as a public purpose investment, functional areas, new tools for investment regulation and special regulations in separate acts for special projects (for example: motorways of national importance, cross-border networks and interconnectors or a nuclear power plant). In the end, author formulates conclusions as to the necessary complements of the regulations of geological and mining law.
