Opis:
In his original phenomenology of law Adolf Reinach distinguishes among experiences the so-called “social acts”. These include acts directed towards other persons that require that the latter acknowledge the communicated contents and assume certain attitudes. Among these acts Reinach mentions there are promises, orders, requests and questions. He argues the promise is the special act that creates the a priori grounds of law. It is to be noted that Reinach’s phenomenology of law is of static character (in the Husserlian sense of the word) and therefore it shares all its advantages and disadvantages. In my paper I would like to draw attention to another social act, which can also be attributed to certain law-making activities, especially from the perspective of the genetic phenomenology. It is questioning. At the same time when Reinach was working on his theory of law, his Munich friend, Johannes Daubert (1877–1947), also a student of Theodor Lipps and a friend of Edmund Husserl, who together with Reinach made an “invasion of the Munichs at Göttingen”, worked on the first phenomenology of the question. Although he did not refer his research to the phenomenon of law, we can ask whether, like Reinach’s deliberations about promises and obligation, it cannot be done. That this is possible to some extent, for example, is evinced by the Hannah Arendt and Klaus Held’s phenomenology of the political world. He points out that the public world as such arises from the primordial openness of man, understood as “zoon politikon”. This openness might be interpreted as the question which is not so much a single act as it is an attitude. The purpose of the paper is to outline how, while starting with the phenomenological reflection over various types of utterances, one can specify their certain forms and the acts constituting them as well as the attitudes which allow for a priori grounding the phenomenon of law from the perspective of static and genetic phenomenology.

Kategoria prawna bonum w porządku kanonicznym Celem niniejszego elaboratu jest wyróżnienie w kanonicznym porządku prawnym całościowej kategorii prawnej obejmującej poszczególne prawnorelewantne jednostki (lub ich zbiory), którym ustawodawca przyznaje szczególną wartość o charakterze społecznym i wspólnotowym i, w konsekwencji, gwarantuje legalną ochronę. Autor poszukuje teoretycznych rozwiązań w celu potencjalnego przypisania instytucjom prawnym określenia bonum (dobro). Artykuł zatem ma charakter fenomenologicznej refleksji dotyczącej przedmiotu prawa kanonicznego, który – ze względu na swoją specyfikę względem pozostałych systemów prawnych – przewiduje mnogość wspomnianych jednostek zasługujących – zważywszy na szczególną ich wartość in se – na odpowiednie wyróżnienie teoretyczne oraz praktyczne znaczenie.
The main aim of this paper is to propose an all-embracing legal category of good in the canon judicial system. Given the specificity of the present topic, such kind of scientific thought has a character of a phenomenological reflection including the right definition and a proper understanding of iura et officia in the canon legal system which permits to come to the correct and required conclusion. The author claims that there are in canon law in force such legal institutions, which can be considered necessarily worth to be protected because of their social and communitarian value and importance.

The subject of this article is an analysis of Szymon Rundstein’s theory of a legal norm. In the first part of his study, the author discusses primary trends in the theory of law in inter-war Poland. Indicating that normative concepts had few supporters, the author simultaneously notes that they attracted law practitioners dealing with legal theory. The second part is an attempt at reconstructing Szymon Rundstein’s views on legal theory. Having proposed his methodology, the author analyzes Szymon Rundstein’s statements regarding both a legal norm, a central category in his considerations, and a normative system. In conclusion, it has been pointed out that although Szymon Rundstein takes a very rigorous approach to the normative assumption about the “purity” of the theory of law, he appears to be fascinated with phenomenology and frequently alludes to psychological theories. Specifically, many references alluding to Leon Petrażycki’s tradition can be traced in his writings. Thus, Szymon Rundstein’s theory of a legal norm modifies the normative assumptions of Hans Kelsen and is an original concept that was developed under the influence of many theoretical-legal views. It undoubtedly has a lot to offer and requires „re-reading”.

The aim of the paper is to reconstruct the theoretical background and practical meaning of the so called war writings which emerged within the phenomenological movement during the First World War. The author exemplifies it by researching the works of two German representatives of this movement, Max Scheler and Kurt Stavenhagen. He focuses on their application of the phenomenological method to the analysis of Russian national identity, and historical as well as cultural foundations of Russian state. The paper’s main thesis is that the politicization and militarization of phenomenology consisted in both “personalization” and “sociologization” of the phenomenological approach to the problem of the state. While interpreting Scheler’s personalism as an exemplification of the approach to the state as a problem of social ontology, the author reconstructs the theoretical conditions of analyzing the Russian imperial state in terms of the “world.” The focus of the paper is particularly on the phenomenology of, as Scheler put it, Russian collective personality and Russian national consciousness or “soul” as well as on the question of legitimacy of Ukrainian resistance against Russian imperialism.

The paper aims to study the work of Leon Petrazycki and analyze modern Ukrainian scholars’ opinions on Petrazycki’s scientific achievements. This study focuses on Petrazycki’s work, his psychological theory, in particular, in view of our own perspective on the law and within the framework of our theological and sociological theory, which considers the law as a social life phenomenon and regards moral imperative of the Almighty God as the basis of law. Every civilization communicates moral imperative through sacred writings (the Ten Commandments in Christian Bible, six hundred and seven rules in Jewish Torah, seventy-two rules in Muslim Quran). It is within the framework of this moral imperative that the society and the state develop the law. The paper addresses the modern absurdity and at the same time antinomy of law, lying in the fact that there is more and more law in the society but less and less law in life of an individual due to the fact that states rapidly upscale rulemaking, but laws are becoming less accessible to an individual. This study draws on conceptual issues of Petrazycki’s theoretical heritage, fundamental principles of his psychological theory, as well as connection between law and morality, described by Petrazycki, which are the spiritual heritage of society. The most important issues of Petrazycki’s work, in our opinion, are studying the nature of law, balance of emotion and intellect, official and intuitive, desirable and actual components in law, as well as subjective and objective law, law policy and power. The paper reveals that assessment of Petrazycki’s work in modern Ukrainian legal studies is ambivalent: from sharply critical (Prof. P. Rabinovich), compliant with Russian (O. Timoshina (St. Petersburg)) approach and critical yet positive perception of Petrazycki’s psychological theory (S. Maksymov, O. Merezhko, M. Kuz, O. Stovba) to admiration for Petrazycki’s genius, whose work was ahead of his time (I. Bezklubyi, N. Huralenko, V. Dudchenko, O. Rohach, M. Savchyn, V. Tymoshenko). Thus, the research findings suggest that Petrazycki’s work belongs not only to the past, but also to the present and future of jurisprudence, sociology, psychology, economics. Further in-depth analysis of Petrazycki’s heritage will contribute to more accurate diagnosis of urgent legal issues in social development of modern Ukraine, real assertion of personocentrism as a postulate of contemporary theoretical jurisprudence and guidelines for public authorities, as well as practical solution to many controversial scientific and legal issues.
