The Personal Data Protection Act was enacted in 1997; it imposed some obligations on all the administrators of personal data regardless if acting as private or public establishments. The Act was intended to guarantee the safety of personal data and to ensure the right to controlling the data processing. However, since the enacting of the Act, there have been reported instances of its infringement, especially by private entrepreneurs. The numerous appealed complaints show that the entrepreneurs neglect their duty of ensuring the safety of personal data (e.g. documents or media with such personal data), which results in unauthorised revealing the data to third parties. An especially serious case of the infringements of the Act and the rights of the persons concerned is selling the data without a person’s consent. In many cases the administrator only seemingly informs about the purposes of processing the data and then, in this or any other insidious way (among them an inacceptable presumption of consent), beguiles the necessary acceptance. The occurrences of neglecting duties imposed by the Act are to be considered not only as infringement of law, but also as unethical actions resulting in undermining customers’ confidence in entrepreneurs. For example: The unprotected data can be viewed and used by unauthorised parties to the detriment of the persons concerned (e. g. identity theft). The selling of the data is also a source of an unjustifiable profit for an entrepreneur and makes controlling of the processing of personal data impossible. Even if there are no negative consequences for the customer, the cases of infringement the Personal Data Protection Act bring about to undermine confidence not only in the entrepreneur (the source of personal data) but also in private establishments in general.

Wyposażenie strażaka w środki ochrony indywidualnej jest warunkiem koniecznym podczas działań gaśniczo-ratowniczych. Do tego typu środków zalicza się m.in.: środki ochrony oczu i twarzy, głowy, słuchu, układu oddechowego, a także odzież. Podstawową cechą ubrania specjalnego jest wielofunkcyjność, która oznacza zdolność maksymalnie skutecznej ochrony użytkownika przed zróżnicowanymi zewnętrznymi niebezpieczeństwami wystęPUjącymi w środowisku pracy strażaka. Jeśli odzież zapewnia w bardzo szerokim zakresie skuteczną ochronę strażaka przed różnorodnymi zagrożeniami, mówi się wtedy o ubraniu specjalnym, które stanowi podstawowe ubranie ochronne strażaka. Składa się ono najczęściej z dwóch części: kurtki oraz spodni. Aby ubranie specjalne zabezpieczało użytkownika w tych wszystkich niesprzyjających warunkach, niezwykle ważną kwestią jest odpowiedni dobór materiałów i konstrukcji ubrania specjalnego, które będzie zapewniać odpowiedni komfort pracy, poprzez spełnienie szeregu wymagań dotyczących parametrów związanych z termoregulacją organizmu, wodoodpornością, paroprzePUszczalnością czy wytrzymałością mechaniczną. Duże znaczenie ma również komfort użytkowania, aby ubranie nie podrażniało skóry, nie ograniczało ruchów albo swoim ciężarem nie przyczyniało się do dodatkowego wysiłku. Wszystkie wymagania dotyczące wyrobów z grupy sprzętu ochrony osobistej (ang. PPE – Personal Protective Equipment) podlegają aktom prawnym i zostały szczegółowo opisane w normach. W krajach należących do Unii Europejskiej standardy zostały ujednolicone i zawarte są w tzw. normie europejskiej (en). Odzież ochronna powinna kompleksowo zabezpieczać przed zagrożeniami, co oznacza, ochronę od zewnątrz jak i od wewnątrz. W dużym uproszczeniu, przez ochronę od zewnątrz rozumie się warstwę ubrania jako barierę przed oddziaływaniem ciepłe w różnych postaciach wodą, substancjami chemicznymi, natomiast ochrona wewnętrzna jest rozumiana jako oddychalność. Podczas akcji ratowniczych strażakom towarzyszy stres, pośpiech i wzmożony wysiłek fizyczny. Aby nie doprowadzić do przegrzania organizmu, wytwarza on ciepło i pot. Zbyt szczelna warstwa materiału może powodować niebezpieczne skutki. Jednymi z nich są poparzenia, które tworzą się na skutek braku ochrony przed żarem, w wyniku namakania przez pot materiału znajdującego się bezpośrednio w kontakcie ze skórą. Kolejnym niebezpiecznym następstwem jest stres wywołany przegrzaniem organizmu. Jest on spowodowany zaburzonym mechanizmem schładzania. Kiedy nie ma możliwości odprowadzenia wydzielanego przez organizm ciepła, jego ilość wciąż wzrasta, podnosi temperaturę, do tego stopnia, że w najgorszym wypadku prowadzi do śmierci na skutek udaru cieplnego.
During the firefighting-rescue operations ,providing the firefighter with the personal protection equipment /PPE/ is a necessary condition. The ppe includes: the eyes, face, head, hearing, respiratory protection systems, as well as protective clothing. A multifunctionality is a basic characteristic of special clothing, which signifies the most effective protection of the user against diversified hazards in firefighting environment. If clothing provides an effective protection in various hazards, it is thought about the firefighter’s basic protective clothing. It most often consists of two parts: the jacket and the pants. To ensure the user’s safety in all unfavorable conditions, the extremely important issue is a proper selection of materials as well as the special clothing design. The clothing must meet a number of requirements related to the parameters connected with the thermoregulation of the organism, water resistance, vapor permeability, or mechanical strength. The comfort of the user is also a significant feature. The clothing shouldn’t prickle the skin, limit the movements or cause additional effort because of it’s weight. All requirements concerning products from the group of the personal protective equipment are the subject to legal acts and in details have been described in the European Standards (EN). The protective clothing should comprehensively protect against hazards which means protection from the outside as well as from the inside. To PUt it simply, the protection from the outside layer is interpreted as the barrier against the influence of heat in various forms, against water and chemical substances, however the internal protection is understood as the permeability. During the rescue operations, a stress, a hurry and a heightened physical effort all the time accompany the firefighters. In order not to lead the organism to the overheating, the body produces the warmth and sweat. Too hermetic material layer can cause dangerous effects. One of them are burns, which are formed as a result of the lack of the protection against the heat, as a result of soaking the material in contact with the skin by the sweat. Another hazard is the stress, being the result of the overheating of the organism caused by the disturbed cooling mechanism. When there is no possibility to drain off the body heat, its quantity continues to increase, the temperature is raised to the level which mechanism , in the worst case, leads to death due to the heat stroke.

This study concerns the ethical problems of personal data protection at work. The aim of this project is the analysis of the law structures, which determine the range of protection personal data of the employee and the candidate to work and the rights of data collecting and processing by the employer. The employee privacy protection at work is the principle of labour law expressed in Article 11 of the Labour Code. However personal data protection problem is directly regulated by Article 22 of the Labour Code, which entitle employers to demand certain personal data from the employees and the candidates to work. The regulation determine the list of data, which may be the subject of legal actions by employer in the field of collecting and processing of personal data. The most important issue is connected with the treatment of sensitive information, such as health data, drug testing and genetic testing, sex life, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership. Personal data protection means the necessity of cooperation between the employee and the employer not only in the field determined by the law but on the basis of ethical values as well. Hence the employer’s obligation to keep from actions which directly interfere in employee’s protected personal effects. But the employee is obliged to give true information about himself in order to protect his health and life at work.

Due to the fact that EU regulations are directly applicable in the Member States’ legal systems, a number of obligations concerning personal data protection is based directly on the GDPR. Thus the governmental bill regulates such issues which have been passed to be regulated or modified by national law. In principle, the bill does not give rise to any legislative objections. However, the author points to some solutions which haven’t existed in the Polish legal system (e.g. one-instance proceedings before The Chairman of the Personal Data Protection Office), as well as to solutions which raise doubts regarding their conformity to the GDPR (such as a public authority’s decision being binding for common courts). Moreover it was pointed out that a whole evaluation of GDPR’s implementation would be possible with regard to all regulations in that matter, including a bill concerning amendments of specific statutes (which is in the process of governmental work).

The General Data Protection Regulation (RODO), which replaced Directive 95/46/EC on the protection of personal data adopted over twenty years ago, has strengthened the position of the national body supervising personal data protection. The supervision body should now be completely independent of the government administration and have appropriate resources to effectively implement the provisions of RODO. The competence of the Polish supervision body are set forth in the Act of 10th May 2018 on the protection of personal data. In place of the General Inspector for Personal Data Protection (GIODO) a new body has been appointed – the President of the Personal Data Protection Office (PUODO). The Act also presents in detail the principles and course of control proceedings of PUODO, including, in the first place, the rights and duties of the entity subject to control.

The article deals with auditing of personal data processing by the body responsible for protection of personal data – the Inspector General for Personal Data Protection (GIODO). The analysis of this issue is preceded with a presentation of the system of personal data processing audit, on the basis of the act on personal data protection. The system comprises not only GIODO audits, but also audits conducted by entities that participate in data processing, data protection officers, persons whose data is concerned, and numerous organs of legal protection that, during their activities, make an assessment of the compliance of data processing with the regulations on data protection. In her article, the author discusses GIODO audits – their scope, stages, audit competence of inspectors, and audit documentation, as well as legal measures that aim to restore the state compliant with the law, and consequences for persons responsible for irregularities. Moreover, the article presents the issue of GIODO audits from a broader perspective, comprising issues related to the duties of data protection officers and their appointment, which have been recently regulated anew.

In the author’s view, Article 71 of the Act on the National Remembrance Institute (IPN) it is a good legislative product which does not require changes. The possible establishment of supervision of the Inspector General for Personal Data Protection of the processing of personal data by the IPN would be a disproportionate obstacle to the Institute’s work, especially since the existing legal instruments of data protection and the rights of persons whose data are processed, has already formed an effective and tight system. According to the author, those regulations are consistent both with Article 51 of Poland’s Constitution and with EU law and the provisions of Article 8 of the Charter of Fundamental Rights, due to connections between the work of the Institute and the issue of protection of national security, that is a matter which remains the sole responsibility of Member States.

The provisions of the bill indicated in the opinion raise doubts from the in terms of their compliance with the directive and complementarity with the Regulation of the European Parliament and of the Council (EU) 2016/679. Among others the adoption of the act in the designed form will result in the fact that, within a specified time, the obliged entities will not be able to apply any of the basic security principles specified in the act, what creates a risk for the actual data security. The project disperses regulations regarding the security of personal data in many normative acts. There are no sanctions for breach of personal data security obligations, what may be considered as a lack of implementation of the requirement set out in the Directive.

Most of the legal solutions proposed in the bill are in line with the standards of Directive 2016/680 in the context of the security of collection, storage, transmission and access to personal data, and guarantees data security. However, in a number of places, the reviewed bill includes solutions that do not guarantee the security of personal data. These are, among others, Article 19 of the bill, which has not been used to increasing the data security, or Article 17 of the bill, which does not protect against reverse pseudonymisation. Gaps regarding data protection lacunas also appear in the bill, inter alia, in its Article 41, which is too narrow in terms of the scope of data processing and authorization to processing.

Opis:
Celem pracy jest wskazanie roli i znaczenia dowódcy ochrony w zapewnianiu bezpieczeństwa podczas ochrony osób. W artykule przedstawiono hipotezę: rolą dowódcy podczas zapewniania bezpieczeństwa osób jest planowanie, organizowanie i kierowanie podległymi mu pracownikami ochrony. Osoba dowódcy ochrony ma istotne znaczenie w zapewnianiu bezpieczeństwa ochranianych osób. W pracy zastosowano jakościową metodę badawczą: analiza i krytyka powstałych na ten temat prac naukowych. Z przeprowadzonych badań wynika, iż dowódca ochrony, jako najbardziej doświadczony pracownik posiadający odpowiednią wiedzę i cechy charakteru, przydziela pracownikom ochrony odpowiednie zadania podczas zapewniania ochrony osób, a także ustala zasady ich współdziałania. Od decyzji dowódcy zależą podjęte działania, a także rodzaj i forma sprawowania ochrony. Zadania, które wykonuje dowódca ochrony, mają ogromne znaczenie w zapewnianiu bezpieczeństwa ochranianej osoby. Przeprowadzone w artykule badania pozwalają na potwierdzenie hipotezy. Dowódca ochrony jest odpowiedzialny za zaplanowanie sposobu ochraniania ważnej osoby, zorganizowanie ochrony, a także kierowanie działaniami pracowników ochrony. Rola dowódcy ochrony w zapewnianiu bezpieczeństwa jest istotna, dlatego wato skupić się na predyspozycjach danej osoby na to stanowisko. W pracy przedstawiono zadania dowódcy ochrony. Analiza tych aspektów pozwala na poszerzenie wiedzy z zakresu zadań dowódcy ochrony podczas ochrony osobistej, jego predyspozycji psychofizycznych oraz stylów dowodzenia. Pozwala to na skuteczniejsze zapewnienie bezpieczeństwa ochranianej osoby.
The aim of the work is to indicate the role and importance of the security commander in ensuring safety while protecting people. The article presents the hypothesis: the role of the commander in ensuring the safety of people is planning, organizing and managing his subordinate security personnel. The person of the security commander is important in ensuring the safety of the protected persons. The work uses a qualitative research method: analysis and criticism of articles on the subject. The conducted research shows that the security commander, as the most experienced employee with appropriate knowledge and character traits, assigns security personnel appropriate tasks while ensuring the protection of persons, and also determines the rules of their cooperation. The actions taken, as well as the type and form of protection depend on the commander’s decision. The tasks performed by the security commander are of great importance in ensuring the safety of the protected person. The research carried out in the article allows to confirm the hypothesis. The security commander is responsible for planning the method of protecting an important person, organizing security and managing the activities of security personnel. The role of the security commander in ensuring security is important, therefore it is important to focus on the suitability of a given person for this position. The work presents the tasks of the security commander. The analysis of these aspects allows to broaden the knowledge of the tasks of the security commander during personal protection, his psycho-physical predispositions and command styles. It allows to ensure more effectively the safety of the protected person.
