    The permanence of Seri basketry has been explained by twentieth-century anthropologists as a result of its introduction into the local, regional, national and international markets and by the link of this activity to pre-Hispanic symbolism. As a result of thinking through things (Henare, Holbraad y Wastell 2007), a methodology on which this paper is based, the Seri baskets dictated the premises of their own analysis. In this paper I describe the Seri basketry manufacturing processes and techniques in order to highlight two mechanisms: the permanence of a production method (collecting, burning and peeling of the torote branches), and the technical variation that generates distinction in individual production (processing fibers, dyeing, weaving and creating designs). In both these mechanisms exogenous and endogenous elements and motifs are integrated in the baskets’ shapes and designs, thus producing innovation which is experienced by Seri women in El Desemboque, Sonora, as a process of personal creativity. Permanence and technical variation are connected through a female family memory, an expression of the fact that chang is a condition for continuity. Based on the description of the Seri basketry manufacturing processes and techniques, this article aims to examine the relevance of the anthropological question of permanence and its premises (cf. Carneiro da Cunha 2009) to the organization of Seri knowledge and practice.

    We study the behavior of a continuous flow near a boundary. We prove that if φ is a flow on $E = ℝ^{n+1}$ for which $∂E = ℝ^n × {0}$ is an invariant set and S ⊂ ∂E is an isolated invariant set, with non-zero homological Conley index, then there exists an x in E\∂E such that either α(x) or ω(x) is in S. We also prove an index theorem for a flow on $ℝ^n × [0,∞)$.

    Właściwe szacowanie trwałości zmęczeniowej dla wielu elementów konstrukcyjnych jest bardzo aktualnym problemem współczesnej techniki. Istnieje wiele kryteriów wieloosiowego zmęczenia dzięki którym możliwe stało się poznanie i rozwiązanie szeregu zagadnień związanych ze zmęczeniem i usystematyzowanie procedur i algorytmów szacowania trwałości zmęczeniowej. W pracy przedstawiono metodykę projektowania elementów maszyn w złożonym stanie naprężenia uwzględniając maksimum kowariancji jako czynnika decydującego o doborze algorytmu szacowania trwałości zmęczeniowej.
    Correct estimation of fatigue life of many elements seems to be a very important problem of modern technology. There are many multiaxial fatigue criteria which allow to study and solve problems connected with fatigue and systematize procedures and algorithms for fatigue life estimation. The paper presents methods of designing machine elements under complex stress state including the covariance maximum as a factor strongly influencing selection of the algorithm for fatigue life estimation.

    Hydrological information is essential for adequate water resources management as well as for water supply, energy supply, water allocation, among other services. However, this information does not always exist in quantity and quality to be used in hydrological or water management studies, and alternative methods are required to estimate minimum flows. Estimation based on homogeneous regions enables to transfer observation data from a known location to a location without data, but in the same region. Since the fluviometric stations in the state of Goiás (Brazil) are not uniformly distributed, the present work aimed at delimiting homogeneous regions of minimum flows, using the cluster grouping method with the K-means algorithm.Thus, 71 fluviometric stations with at least 5 years of continuous data were selected, obtained from the HIDROWEB system. In addition to the observed data, other variables were considered, such as drainage area, perimeter, specific minimum flows Q7,10, Q90, Q95 and average slope. The use of all these variables together with the observed data made it possible to determine,with great accuracy, 5 homogeneous regions of minimum flows based on the cluster analysis, enabling to obtain the minimum flows of reference for each region.In the selected homogeneous regions, it was possible to observe that the regions with the highest values of average slope presented smaller minimum flows, and the same could be observed under inverse conditions, i.e., lower values of average slope had higher minimum flows.It is also noteworthy that river monitoring is deficient in the center-south and center-north parts of the state of Goiás, making water resources management difficult. This fact indicates, therefore, the need to expand the river monitoring system throughout the state, especially in its southern and northern regions.

Ów paradoks nowego „nietrwałego” paradygmatu podlega ciągłej ocenie i dyskusji w ramach poszukiwania odpowiedzi na pytanie - co to jest architektura we współczesności?     An architect undertaking some creative activity ‘’today”, touches ‘’the future”, and tomorrow our interference directed towards ‘’the future” will be nothing else but ‘’the past”. Therefore, while thinking about architecture as a constant cultural message concerning the place, the architect-creator is obliged to collect and analyse the research material in order to take accurate project decisions. Nowadays, after the thorough analysis of research material, treating the result of our creative activities as a spatial message, we expect social allowance and acceptance for proposing new expressive forms, which create the processed message codes.

    The ‘culture of fear’ constitutes an important environment for mankind. It is an interplay of biological, socio-cultural and linguistic dimensions which, in fact, underlie human existence. The dominance of one subtype of culture with respect to fear, the dystopian culture, pulls mankind into a culture of aggression, competitiveness and intolerance (or into the win-lose perspective). On the other hand, eutopian culture pulls mankind into a culture of non-aggression, cooperation, tolerance and inclusiveness (or into the win-win perspective). In fact, one may easily envisage that a well-functioning human society should remain in a state of balance between the two types of culture and it is the dystopian type of culture that should be kept in check, while the eutopian culture should be favoured if the earth as the carrier of all life, the existing biodiversity, and humanity, are to be sustained.

    The article is devoted to the issue of the principle of permanence of parliamentary work. It contains a general description of the principle in question and at the same time shows its importance for the functioning of state authority in Poland. Thanks to the analysis, the reader learns how permanence affects the implementation of some of the powers of the Sejm and Senate related to the performance of legislative, control and creative functions. He also gains knowledge on the extent to which it affects the relations between the Sejm and the Senate with other bodies, especially with the President and the Council of Ministers. The field of considerations designated in this way conceals the main research goal, which is to present the basic systemic consequences resulting from the introduction of the discussed formula of the work of representative bodies.
    Artykuł poświęcony jest problematyce obowiązywania zasady permanencji prac parlamentu. Zawiera on ogólną charakterystykę przedmiotowej zasady i ukazuje jednocześnie jej znaczenie dla funkcjonowania władzy państwowej w Polsce. Dzięki przeprowadzonej analizie Czytelnik dowiaduje się, w jaki sposób permanencja wpływa na realizację niektórych sejmowych i senackich kompetencji związanych z wykonywaniem funkcji ustawodawczej, kontrolnej i kreacyjnej. Zdobywa też wiedzę na temat tego, w jakim stopniu oddziałuje ona stosunki łączące Sejm i Senat z innymi organami, zwłaszcza z Prezydentem i Radą Ministrów. Tak wyznaczone pole rozważań kryje w sobie główny cel badawczy, którym jest zaprezentowanie podstawowych konsekwencji ustrojowych wynikających z wprowadzenia omawianej formuły prac ciał przedstawicielskich.

    Opis:
    The aim of the study was to analyze the concept of a fixed establishment in the German VAT Act and its interpretation by the German financial courts and tax authorities. The German financial courts, when assessing the criteria for accepting the existence of a fixed establishment, are rightly referring to Regulation No. 282/2011 and the case law of the CJEU. Nevertheless, in some cases, the judiciary allows for the existence of a fixed establishment in Germany even if the taxpayer uses someone else’s staff and does not even have any personnel facilities. In the opinion of the Authors, this is an interpretation that goes far beyond any justification, neither in EU law nor in the case law of the CJEU.
    Celem opracowania jest analiza koncepcji stałego miejsca prowadzenia działalności gospodarczej na gruncie niemieckiej ustawy o VAT oraz wykładni tego pojęcia dokonywanej przez niemieckie sądy finansowe i organy podatkowe. Niemieckie sądy finansowe, dokonując oceny kryteriów pozwalających na przyjęcie istnienia stałego miejsca prowadzenia działalności gospodarczej za punkt wyjścia, słusznie przyjmują Rozporządzenie 282/2011 oraz orzecznictwo TSUE. Niemniej jednak w niektórych przypadkach sądownictwo dopuszcza występowanie stałego miejsca prowadzenia działalności gospodarczej na terytorium Niemiec nawet wówczas, jeśli podatnik korzysta z cudzego personelu albo nie dysponuje żadnym zapleczem personalnym. W opinii autorów jest to wykładnia zbyt daleko idąca, nieznajdująca uzasadnienia ani na gruncie prawa unijnego, ani orzecznictwa TSUE.

    Prezentowane opracowanie zawiera krytyczne uwagi na temat pozycji posła-pracownika. Punkt odniesienia stanowi w tym przypadku interes pracodawcy. Obowiązki, nałożone na pracodawców zatrudniających pracowników piastujących mandat posła (senatora) wydają się nieproporcjonalne do obecnych uwarunkowań społeczno-gospodarczych. Widoczne jest to zwłaszcza na przykładzie małych pracodawców. Wątpliwości budzi nie tylko dyferencjacja statusu pracowniczego posłów zawodowych oraz niezawodowych, jaka występuje w zakresie ochrony szczególnej, ale także sam zakres powyższej ochrony oraz obowiązek dopuszczenia pracownika do pracy po zakończeniu pełnienia mandatu. W omawianym zakresie zastanawia też możliwość odpowiedniego stosowania przepisów kodeksu pracy oraz innych ustaw i rozporządzeń, regulujących sytuację pracowniczą. Dość wątpliwie ze względu na obowiązek udzielania zwolnień od pracy wypada również pozycja posłów nie korzystających z urlopów bezpłatnych. Pomimo występującej w literaturze krytyki przedmiotowych unormowań prawnych (powoływane w opracowaniu stanowisko Jakuba Steliny), przeniesionych z poprzednio obowiązującej ustawy, jak dotychczas nie doszło do zmiany wątpliwych przepisów.
    Presented paper contains comments and analysis related to the position of the Member of Parliament (Deputy, Senator) as an employee from the point of view of the employer’s interest. The Deputies who exercise the mandate and remain in labour relations with their previous employer could be divided into two categories: those who have got the unpaid leave (granted on employee’s request) and those who are actively performing their employee’s being entitled to a leave of absence for the entire working day or any part thereof, as required to perform duties connected with mandate. It is connected with the assessment of duties, which encumbered the person employing employee who have held the Deputy’s mandate (Senator’s mandate). Doubts that arise in relation to these charges also update the questions about the legal status of the Parliament’s Member (professional or nonprofessional). The study also presents the viewpoint at the position of the Member of Parliament as a representative of the public interest when this status is linked to the status of the employee. It implies the question of the boundaries of acceptable conjunction of the above mentioned status with the employee’s duties and responsibilities.
