Among the numerous pieces of information pertaining to the social life of the population of the Kingdom of Poland and Galicia a number of notes and articles about the necessity to undertake the construction of schools were published. The authors would frequently mention the outrageous conditions in which children were forced to study, the lack of flats for teachers, and the failure to follow the rules of hygiene in schools. It was argued that combating illiteracy could bring positive results by securing the proper conditions for raising and educating all school-age children. Discussions in the press covered examples of local initiatives aimed at building schools, as well as ways of making the local communities of villages and towns more active.

The Roman People’s Assemblies differed depending on the fact whether all the citizens or only the plebeian gathered at them. Concilia plebis could vote plebisscita, which were at the beginning not binding for everyone. Finally, the leges and plebisscita became equal on the grounds of the lex Hortensia. The earlier laws had also dealt with this matter: the lex Valeria Horatia gave binding power to the plebiscites voted during the secession on the Mons Sacer, and the lex Publilia Philonis – to the plebiscites accepted by the Senate. The decisions of the assemblies which were not of the general character were called privilegia. In the case of such legal acts as adrogatio, testamentum calatis comitiis or detestatio sacrorum there was no rogatio and accordingly no lex was voted.

Persons repressed in the Polish People’s Republic may base their claims for damages only on the provisions of the Act on the Recognition as Invalid of Judgments Issued Against Persons Repressed for their Activities for the Independent Existence of the Polish State. It is excluded to pursue claims in this respect on the basis of civil law or the Constitution. The basic condition for pursuing a claim is the declaration of invalidity of the decision issued by the authorities of the Polish People’s Republic. These rules apply both to those repressed because of the armed struggle and because of the resistance to collectivisation. These claims are not part of the inheritance, but are based on the principle of singular succession.

Together with the change in the political situation in Poland after World War II, the communists set new tasks for the justice system — fighting against political opponents and protecting the system. Their implementation was to be ensured by discretionary judges and prosecutors. To this end, persons trained according to models that rejected European legal culture were introduced to the judicial authorities. Military lawyers were educated at the Officer Law School, established on 19 May 1948 by the Minister of National Defence. It was a secondary law school, which provided only a minimum of knowledge to graduates.

The paper presents the profile of an outstanding researcher of the country-wide and a deserved activist of the People’s Movement who was closely related to the prominent figure of this movement i.e. Wincenty Witos. So far, information about life and activity of that scholar was scarce and came only from dictionary publishers. This text, however, puts special focus not only on Professors’ scientific achievements, but also on his dramatic fate during the Stalinist period. Similar to many persecuted people at those times, in order to resume his research career he had to conceal his past as a People’s Movement activist, agrarian and supporter of liberal-democratic system.

The article interprets the novel Gwiazda Piołun by Władysław Lech Terlecki. Its main character is based on the real life figure of Stanisław Ignacy Witkiewicz – author, painter, philosopher. The author of the article indicates the relationships between the accounts of Witkacy’s death and its fictional version. Terlecki’s story of a painter who escapes from war, only to commit suicide eventually, became a pretext for discussing the events from September 1939 and March 1968.

The religiosity of Poles has been undergoing a far-reaching transformation for several years. All the research shows that less than half of the Polish society could be described as “the believers – practitioners”. The vast majority of Poles are people whose faith has individualized and is not strongly associated with the institution of the Catholic Church. In addition – as indicated by the described research – the moral assessment of another person is not related to the fact of his religiousness. The people live – to use Weber’s terms – in the disenchanted world in which they do not need clerics as interpreters of the reality.

The censor’s office was of crucial importance to the polity during the Republic, being an indispensable element of maintaining the balance. Censors were elected by the centuriate assemblies, which also voted a lex centuriata for them. As there is no doubt concerning the censorial ius contionandi, it seems that the censors never convened the comitia. It does not mean that they lacked competence: it was customary that they convoked the people only for the purpose of the lustratio ceremony ending the census. The censors’ influence on the comitia resulted from their power to decide on a citizen’s membership in a certain property class, centuria and tribus. Censorial notes enabled them to interfere with the citizen’s social status.

Poland is a country of the so-called “young democracy” type. As provided for in art. 2 of The Constitution of the Republic of Poland dated 2 April 1997, “The Republic of Poland is a democratic state of law, fulfilling the principles of social justice”. Art. 4 of The Constitution of the Republic of Poland gives superior authority to the Nation. This authority can be exercised “through representatives or directly”. But Poland does not have much experience with the institution of a people’s initiative, nor with other forms of direct democracy. The Polish national law provides for two types of people’s initiative. One type is a people’s initiative of putting a bill before the parliament as provided for in art. 118 subpar. 2 of the Constitution of the Republic of Poland and the Act dated 24 June 1999 on the use of a legislative initiative by citizens. The second type is a people’s initiative of putting forward a motion to hold a legislative referendum regulated by the Act dated 14 March 2003 on holding a national referendum. The legislature did not provide for, however, a people’s initiative for the purpose of amending the constitution or its abrogation. The subject of this paper is the institution of a people’s initiative of putting forward a motion to hold a legislative referendum.
Polska jest państwem tak zwanej młodej demokracji. Art. 2 Konstytucji Rzeczypospolitej Polskiej z dnia 2 kwietnia 1997 r. stanowi, iż „Rzeczpospolita Polska jest demokratycznym państwem prawnym, urzeczywistniającym zasady sprawiedliwości społecznej”. Art. 4 Konstytucji RP daje władzę zwierzchnią narodowi, który może ją sprawować „przez swoich przedstawicieli lub bezpośrednio”. Jednakże polskie doświadczenia z instytucją inicjatywy ludowej, jak również z innymi formami demokracji bezpośredniej są niewielkie. Polskie prawo ogólnokrajowe przewiduje dwa rodzaje inicjatywy ludowej. Jest to inicjatywa ludowa w sprawie złożenia ludowego projektu ustawy w parlamencie przewidziana art. 118 ust. 2 Konstytucji RP i ustawą z dnia 24 czerwca 1999 r. o wykonywaniu inicjatywy ustawodawczej przez obywateli. Drugim rodzajem jest inicjatywa ludowa w sprawie złożenia wniosku o przeprowadzenie referendum ustawodawczego uregulowana ustawą z dnia 14 marca 2003 r. o referendum ogólnokrajowym. Ustawodawca nie uwzględnił jednak inicjatywy ludowej w sprawie zmiany konstytucji lub jej abrogacji. Tematem niniejszego opracowania będzie instytucja inicjatywy ludowej w sprawie złożenia wniosku o przeprowadzenie referendum.

Foreign visits by state delegations constitute a regular component of international relations. The case of Poland in the Stalinist era was no different in this respect, even though the foreign visits were usually limited to the democracies of their fellow comrades. Among such numerous visits made by the Polish officials of the time, one is of special interest to us. This was a party-governmental visit to the People’s Republic of China and the Mongolian People’s Republic, held from 24 September until 13 October 1954. The pretext for the “friendly visit” were the celebrations of the fifth anniversary of the rise of the People’s Republic of China, held on 1 October 1954. The invitation was issued by the Central Government of the People’s Republic of China, and addressed exclusively to representatives of the Communist states and parties. The four–member Polish delegation was headed by the Secretary General of the Central Committee of the Polish United Workers’ Party (henceforth as PUWP) Bolesław Bierut and it also included a Member of the Political Office (Politburo) of the Central Committee of PUWP, deputy prime minister Jakub Berman, deputy prime minister Stefan Jędrychowski and the vice-president of the Council of the State Stefan Ignar. It was the first visit by top-ranking Polish Communist officials in China, which would not have been possible without the prior reshuffle in the Soviet Union’s political regime after the death of Joseph Stalin. This article presents the course of events of the above–mentioned, exotic visit as reported by the press articles in “Trybuna Ludu” [People’s Tribune] – the major press title of the Central Committee of PUWP. Our analysis of these press reports, sent with a two-day delay via a correspondent of the Polish Press Agency, shows which facts relating to the event were highlighted by the journalists.

The aim of the following article is to present how the Armed Forces of the Polish People's Republic reacted to the second pilgrimage of John Paul II to Poland. It outlines multiple processes, mainly of social origin, which occurred during the preparations for the visit, its course and after its completion. Moreover, the author depicts political and cultural circumstances in which soldiers and conscripts had to serve. At the same time, numerous manipulation techniques that were used to discredit the Catholic Church have been included.
