    The main aim of diplomacy of the future is to settle various international disputes effectively and safely. In this paper, the author has selected and analyzed crucial sources of international law to refer to the meaning, genesis, and legal context of the principle of peaceful settlement of international disputes to illustrate its influence on modern diplomacy. Furthermore, the author endeavored to name and to characterize the main alternative dispute resolution (ADR) methods, which are being used to form modern international relationships. In the final part of the paper, the author tries to determine the main political, cultural, technological, and sociological factors that may soon affect the way, in which policymakers and diplomats are resolving global disputes as well as shaping international relations.

    Opis:
    The aim of this paper is to present and critically appraise the norms of international law relating to the enforcement of arbitral awards against States. It canvasses the main international instruments governing the recognition and enforcement of foreign arbitral awards (notably the New York Convention). It then elucidates the doctrine of sovereign immunity in customary international law – and an attempt to codify it – as a hurdle to enforcement of such awards in domestic courts. The analysis investigates whether the doctrine acts as a safeguard against jeopardizing peaceful relations between States while promoting international commerce, foreign direct investment and trade relations between State and foreign non-State actors. Diplomatic protection is examined as an alternative to international and national adjudication.
    Celem tego artykułu jest przedstawienie i krytyczna ocena norm prawa międzynarodowego odnoszących się do wykonywania orzeczeń arbitrażowych wydanych przeciwko państwom. Zarysowane zostały główne instrumenty międzynarodowe rządzące uznawaniem i wykonywaniem zagranicznych orzeczeń arbitrażowych (z których znaczącym jest Konwencja Nowojorska). Następnie, naświetlona jest doktryna immunitetu państwa w zwyczaju międzynarodowym – oraz próba jej skodyfikowania – jako przeszkoda dla wykonywania takich orzeczeń w sądach krajowych. Analiza bada czy ta doktryna służy jako zabezpieczenie przed zagrażaniem pokojowym relacjom między państwami jednocześnie promując międzynarodową wymianę gospodarczą, bezpośrednie inwestycje zagraniczne i relacje handlowe między państwami a zagranicznymi podmiotami prywatnymi. Opieka dyplomatyczna została oceniona jako alternatywa dla międzynarodowych i krajowych postępowań sądowych i arbitrażowych.

    .This paper will highlight, among other things, the most significant features of the peaceful set- tlement of disputes in international legal practice. In order to point out the connection between peaceful dispute resolution and preventive diplomacy, it will be necessary to point to certain theoretical views. Nevertheless, the early institutionalization of the holders of these activi- ties, as well as the prominent role of internal organs for maintaining international relations, in these or similar situations, over time, there have been certain changes caused primarily by the spread of influence in addition to the state, and to other entities of international law. It is the emergence of international organizations that modifies both the holders and the activities available to them, all with a view to preventing conflict. Using a comparative and historical method, we will try to point out, on a specific example, analyzing the crisis in the former Yugoslavia, that some of the traditional peace-diplomatic means have been transformed into preventive diplomatic activities and what peculiarities did they contain. A particular example will point out their weaknesses as well as the consequences they have caused for the legal, and economic and other systems of the former Yugoslavia.
