Opis:
Polish Patient Ombudsman (PPO) was established to protect individual and collective patients’ rights. Contrary to original plans, it was established as an organ of central government administration. Therefore, the name may be confusing, as it suggests that PPO belongs to the group of entities similar to traditional ombudsmen. In fact, it implements government policy. This lack of independence is associated with the necessity of giving PPO the power to impose penalties for breach of the so called “collective patients’ rights”. Accordingly, PPO can be considered as a kind of “subtype” of the Ombudsman only from the perspective of competencies in relation to violation of the individual patient’s rights. The article analyzes the origins of the Patient Ombudsman institution in Poland, its place in Polish polity and its legal prerogatives in comparison to other bodies that offer protection of patient’s rights. The authors analyze in detail the competence of the Patient Ombudsman in case of violation of individual and collective patients’ rights.

The article discusses the issue of protecting personal interest, such as privacy, within the view of hospitalized patients. The focus of attention is a patient's right to his private and family life to be respected, and the lack of foregoing due to limitations caused by a decision of a head of a hospital. The current situation in 24-hour medical service centers is presented, as well as the possibilities which the legislator has given to their managers in terms of limiting the right of a patient to privacy. The problem of enforcement of the right to privacy in a situation of its infringement is also described.

Background: The COVID-19 pandemic has had an impact on the observance and limitation of patients’ rights all over the world, including Poland. Material and methods: We analysed in detail the Polish legal acts relevant to healthcare in terms of their impact on the patients’ rights. Our analysis is based on the Bill of Patients’ Rights that was in force in Poland before the announcement of the state of epidemic (March 20th 2020). The legal acts were analysed by use of the exegesis of legal texts and comparative legal literature rules. Results: The patients’ right to family life and presence of relatives during the performance of healthcare services and to additional nursing care has been directly limited. Rights that have been limited indirectly include the right to healthcare services (limited by the use of telemedicine) and the right to dignified death and pastoral care (patients often die alone). The limitations also have an indirect impact on the right to confidentiality and respect for privacy and dignity. Conclusions: Our analysis identified limited patients’ rights in Poland without entitlement to pursue claims thereunder.

Objectives: In Poland, 95% of medical personnel had not received legal education before they completed their studies. Having been given these facts, we have started questioning legal awareness of people providing medical services. Aim of the study: The study aimed at evaluating the knowledge of allergists and pulmonologists. Material and Methods: The group consisting of 328 allergists and/or pulmonologist completed the questionnaire. Results: The participants possess the best knowledge in providing information to patients about their health status (CV1). Sixty nine % of responders replied correctly, and the difference was significant (p < 0.001) in comparison with next aspect referring to the principles of providing medical services following guidelines created by think-tanks and also possibilities to take autonomous decisions by physicians (CV2). The correct answers in relation to CV2 were given by 57% of responders. The third compared aspect was physicians' awareness of patients' right to giving a consent or refusal before undertaking the medical procedure CV3. Only 55% of physicians gave correct answers and the difference was significant compared to CV1 (p < 0.001) as well as CV2 (p < 0.05). Younger doctors showed to have better knowledge than their older colleagues (p < 0.05). Working in urban workplaces proved to be more associated with better knowledge than in rural ones (p < 0.05). Discussion: Insufficient knowledge results in a low quality of provided services and puts the doctors at risk of being liable. The rates indicate that doctors are not aware of the fact that only legal regulations are binding, while standards not published by the Minister of Health are not legally valid. Half of the respondents have the wrong belief that the opinions expressed by experts make the doctor feel exempt from liability. Probably there are specialities, like occupational medicine which are specially linked with awareness of valid legal rules.

Introduction: Patients’ rights must be respected at every stage of therapy, including during biological drug therapy. For clinicians, it is key to be involved in the decision-making process with regard to the choices of medication and possible drug substitution. In Poland, the law encourages automatic drug substitution and does not recognise disparities in biological drugs. Aim: The main aim of the paper is to describe the present legal situation depicting the scope of autonomy of a hospitalised patient. Methods: An analysis was conducted of the Polish regulations, the doctrine and administrative decisions and European Medicines Agency guidance documents. Results: In Poland, patients who require therapy with advanced technologies such as biopharmaceuticals, may obtain access to a medicine within a special drug reimbursement programme in a hospital. Hospitals are supplied with the drugs necessary for drug therapy programmes via public procurement. This means that hospital procurement procedures decide which drug a patient will receive. It is not the decision of the health care provider. In view of this, the Polish Patient Ombudsman, in a decision confirmed by the Provincial Administrative Courts, pointed out that the selection of a drug for therapy should depend on current medical knowledge rather than on the result of a tender carried out by a hospital. Conclusions: Polish solutions based on the lack of an obligatory requirement to consult a substitution with a treating physician deviate from the standard practices followed in numerous EU countries and the US.

INTRODUCTION On the basis of the amendment of the Act of 6 November 2008 on Patients' Rights and Patients' Rights Ombudsman (PRO), provincial committees for the adjudication of medical cases were appointed. The aim of this study was to analyze the data describing the operation of the committees from the beginning of their operations, i.e. 1 January 2012, till 30 April 2013. METHODS It was a cross-sectional study covering data gathered and made available by the PRO. The information obtained included the number of: applications submitted (excluding requests for case re-examination ), returned applications and the reasons for refund requests, applications that are currently being dealt with by the committee, investigations completed, requests for reconsideration, completed proceedings with a request for case reexamination as well as committee meetings, including organizational meetings. RESULTS In the period from 1 January 2012 to 30 April 2013, the committee received 791 applications. Among the completed proceedings, determining the occurrence of a medical event resulted in 60 cases, whereas as a result of dealing with requests for a reconsideration of medical cases, 23 cases in total were determined. Throughout 2012, the committee received 404 applications. Among the completed proceedings, determining the occurrence of a medical case resulted in 22 cases, whereas as a result of dealing with requests for a reconsideration of a medical event there was a total of 11 cases. CONCLUSIONS An increase in the number of applications can be noticed, which confirms that the idea of establishing the committee is beginning to deliver the results assumed by the legislature . This provides benefits to both patients and the medical community. Good cooperation between physicians and lawyers is crucial for the development of legal awareness of physicians.
W S T Ę P Na podstawie nowelizacji ustawy z dnia z dnia 6 listopada 2008 r. o prawach pacjenta i Rzeczniku Praw Pacjenta powołano wojewódzkie komisje ds. orzekania o zdarzeniach medycznych. Celem niniejszego opracowania była analiza danych opisujących działania komisji od początku ich działalności, tj. od 01.01.2012 r. do 30.04.2013 r. M A T E R I A Ł I M E T O D Y Projekt przeprowadzono w modelu epidemiologicznego badania przekrojowego, na podstawie danych zebranych i udostępnionych przez Rzecznika Praw Pacjenta. Otrzymane informacje obejmowały: liczbę złożonych wniosków (bez wniosków o ponowne rozpoznanie sprawy), liczbę zwróconych wniosków, powody zwrotów wniosków, liczbę wniosków będących aktualnie przedmiotem prac komisji, liczbę postępowań zakończonych, liczbę wniosków o ponowne rozpatrzenie sprawy, liczbę zakończonych postępowań z wniosku o ponowne rozpatrzenie sprawy oraz liczbę posiedzeń komisji, w tym posiedzeń organizacyjnych. WYNIKI W okresie od 01.01.2012 r. do 30.04.2013 r. do komisji wpłynęło łącznie 791 wniosków. Spośród zakończonych postępowań ustaleniem zaistnienia zdarzenia medycznego zakończyło się 60 spraw, natomiast wskutek rozpoznania wniosków o ponowne rozpatrzenie sprawy za zdarzenie medyczne uznano łącznie 23 sprawy. Z tego w całym 2012 r. do komisji wpłynęły łącznie 404 wnioski. Spośród zakończonych postępowań ustaleniem zaistnienia zdarzenia medycznego zakończyły się 22 sprawy, natomiast wskutek rozpoznania wniosków o ponowne rozpatrzenie sprawy za zdarzenie medyczne uznano łącznie 11 spraw. WNIOSKI Obserwuje się wzrost liczby składanych wniosków, co potwierdza fakt, iż idea powołania komisji zaczyna przynosić zakładane przez ustawodawcę efekty. Daje to korzyści zarówno pacjentom, jak i środowisku medycznemu. Współpraca w ramach komisji personelu medycznego z prawnikami jest niezwykle istotna dla kształtowania świadomości prawnej lekarzy.
