    Dans le présent article nous souhaiterions présenter le rôle du père à l’appui de l’enseignement de Saint Jean Chrysostome. L’évêque de Constantinople se consentre particulièrement sur le sujet des tâches principales du père au sein de la famille. Pater familias occupe d’après le Saint Jean un rôle principal dans l’éducation. D’après Jean Chrysostome l’éducation reste entièrement dans les compétences du père. L’évêque souligne en particulier l’importance de l’éducation des enfants. Le père est leur maître et il prend la responsabilité pour l’avenir des enfants. C’est le père même qui doit préparer l’âme de l’enfant pour que ce dernier puisse accuillir le Dieu. D’après le Saint Jean Chrysostome, pater familias est également responsable de former chez l’enfant des certaines vertus chrétiennes de bases, telles que : courage, sagesse et pureté. Le rôle le plus important dans le processus de l’éducation repose sur l’obligation de présenter un bon exemple aux yeux des enfants. Cette obligation reste dans les compétences du père, celle de la mère ainsi que celle de tous ce qui participent dans l’éducation de l’esprit et de coeurs enfantins.

    RESEARCH OBJECTIVE: The aim of the article is to examine the relations within an upper middleclassfamily – as depicted by Virginia Woolf in a collection of autobiographical essays, Moments ofBeing – and compare these against the patriarchal model. The ultimate aim is to expose and locate,as early as the last decade of the Victorian era, the signs that a transformation was about to occur. THE RESEARCH PROBLEM AND METHODS: The Victorian paradigm of the patriarchal rolesof pater familias and mater familias has been analyzed. In conformity with philological methods,appropriate literary evidence is provided. THE PROCESS OF ARGUMENTATION: The article first focuses on the concept of the Victorianpater familias and mater familias. It presents an analysis of the Stephens family who feature in Momentsof Being. A traditionally conservative perspective with regard to the male family members isjuxtaposed with the contrasting viewpoint voiced by the author of the collection. RESEARCH RESULTS: The analysis of the autobiographical essays reveals certain shifts in theroles of the Victorian pater familias and mater familias in late-Victorian times. Furthermore, certainrifts in familial relations are uncovered and investigated with reference to differing attitudes to theissue of female education. CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: The analysis exposed severalfissures in the patriarchal model and located these at an earlier date than commonly accepted. Italso demonstrated that the first signs of the transformations that would occur in British society wereparticularly noticeable in the novel attitudes to the question of female education. This may encouragefurther research of contemporary perspectives on institutional instruction.

    The texts of the Apostolic Fathers are a clear testimony to the fact that the responsiblility for the moral and religious education of children is borne not only the ecclesial community, but above all it rests on the parents. They are before God and the community of believers in Christ are responsible for their educational activities in relation to their children. The main objective of these activities was shaping attitudes in the young man widely understood piety known in the biblical tradition as the fear of God. In this work, it is also important cooperation of young people conscious of great goals to achieve common. The effects of the educational process undertaken by Christian parents became apparent in the attitude of the heroic witness during the persecution.

    Opis:
    Researchers of the Roman-Catholic Church’s liturgy usually consider its historical, cultural, and theological dimension, whereas its legal dimension is barely noticed. It can be observed when applying the Roman law methodology. Specific institutions, legal constructions and formulae become apparent in the specific gestures, words, and order of the liturgy. All this indicates that the latter carry specific legal meaning, and hence, specific commitments, which are legally binding. The research problem pursued by the author: Does the rite of ordination in the Roman- Catholic Church contain receptions of Roman law and are they noticeable? has been concluded positively. In her analysis of ordination, the author points out the undoubtedly Roman legal acts, such as mancipacio, nexum, and stipulacio. Moreover, using a legal-comparative methodology, she shows the hierarchy of the status of the bishop and the presbyter in the Church based on the model of a Roman family structure (pater familias) and indicates the change in the status of the presbyter in relation to the bishop after the latter’s laying on of hands (mancipacio). All of the above enables an analysis of other Church rites to examine the receptions of Roman law, shows the liturgy rituals as acts that are legal in essence and as such are legally binding, creates premises to put forward a hypothesis about the existence of a doctrine of liturgical law, and allows resolving cases using the method of Roman law.
    Die Forscher der Liturgie der römisch-katholischen Kirche ergründen am häufigsten deren historische, kulturelle und theologische Bedeutung und übergehen dabei stillschweigend deren rechtlichen Sinn. Der lässt sich mittels der Methodologie des römischen Rechtes nachweisen, infolgedessen konkrete Institutionen, Konstruktionen und Formeln des römischen Rechtes in einzelnen Gebärden, Worten und liturgischer Ordnung zum Vorschein kommen. Das alles weist darauf hin, dass in den letztgenannten konkrete rechtliche Bedeutung enthalten ist, und folglich auch bestimmte rechtlich bindende Verpflichtungen. Die von der Verfasserin durchgeführte Forschung bestätigte bei der Priesterweihezeremonie das Vorhandensein von solchen unbestrittenen Elementen des römischen Rechtsakten wie mancipacio, nexum, stipulacio. Eine rechtlich-komparatistische Methode verwendend und sich auf dem strukturellen Modell römischer Familie (pater familias) stützend schildert die Verfasserin im vorliegenden Beitrag die Statushierarchie vom Bischof und Presbyter in der Kirche und bestätigt die Änderung des Presbytersstatus dem Bischof gegenüber nach dem vom Bischof vollbrachten Handauflegen (mancipacio). All das ermöglicht, übrige kirchliche Zeremonien in Bezug auf Vorhandensein der Rezeptionen römischen Rechtes zu erforschen, liturgische Bräuche im Grunde genommen als Rechtsakten zu betrachten und lässt die Hypothese aufstellen, dass es eine gewisse auf römischem Recht beruhende Doktrin gab, welche praktische Rechtsfälle mittels römischen Rechtes zu entscheiden erlaubt.

    Opis:
    The fresco painted by Giotto Bondone showing the Renunciation of Worldly Goods by St. Francis undoubtedly arouses aesthetic and spiritual feelings. Nevertheless, the scene presented by Giotto also bears some legal characteristics. Thus, it may become a subject of some interesting discussions in the legal sense. First of all, its convention resembles to some extent a dispute before court where the parties and a judge take part in the proceedings. The characters presented, particularly father, son and the bishop, indirectly refer to such important legal institutions as patria potestas and audientia episcopalis. The subject of the dispute is also significant. In the analyzed scene, it relates to the inheritance of property rights and a demand to be obedient to the paternal authority. The relationship between the secular and spiritual power also constitutes a certain problem. Moreover, the issue of divine and human justice is raised. Therefore, the fresco of the Italian master bearing an artistic value might become a subject of a legal reflection and in this way fit the suggested approach: art in the law and law in the art .

    Historically, two opposing approaches to the institution of marriage developed. According to the first view, marriage was perceived as a kind of an agreement aimed at settling property matters between the spouses. The other belief holds that marriage is something more than just an agreement since it serves social and emotional functions which are so significant that their legal protection is advisable. Legal developments in ancient Rome, which were based on the first concept, are so distant from the solutions prevailing nowadays that their specific character is worth emphasizing. The purpose of this article is to introduce those provisions. This may subsequently give rise to a careful consideration concerning modern solutions and their legal reflection.
