    The article presents the legal concept of orphan works in the context of the Polish Law on Copyright and its social and cultural impact on the effectiveness of scientific research, especially in the field of humanities. The purpose of introducing legislative solutions relating to orphan works is to save the cultural heritage from oblivion, and also to restore the continuity of scientific research. The article also raises the question of the contemporary idea of Open Access, which is considered as another plane for new humanities — as a place of common ground to exchange knowledge without barriers.

    Opis:
    Analysis of principles of copyright and positions of representatives of philosophical thought evolving over the centuries, appointed to justify the establishment of copyright, leads to the conclusion that there has not always existed the possibility to orphan a work. The creation of the problem of orphan works is closely connected strictly with chang- ing paradigms of orphan works. There is the correlation between the age of work and the scale of orphan works – the older the work, the more likely that you will not be able to establish proper communication with the holder of the copyrights. Resulting from the Berne Convention the principle of non-formalism in copyrights protection is a chal- lenge for the modern science of intellectual property rights. It remains an open question about the possibility of dynamic interpretation of treaty solutions by taking into account, in particular, a teleological interpretation and recognition ensuring the fullest possible protection of authors of works as that of the main aim of the creators of an internation- al agreement from the nineteenth century. The changing conditions of exploitation of works in the age of development of technology could be invoked to justify the introduc- tion of certain formalities to ensure effective mechanisms of copyrights protection and to prevent the phenomenon of orphan works.

    This article discusses the problem of orphan manuscripts and writings in the collection of documents deposited with the Jagiellonian University. The author mentions the difficulties in the access to this heritage, due to the unclear status of these works. In this context she analyzes and presents biographies and views of all Jewish philosophers who received Ph.D. degree at the Jagiellonian University in the years 1918 through 1939, many of whom probably did not survive World War II.

    W Internecie niesłabnącą popularnością cieszą się internetowe fora obrazkowe (tzw. imageboardy lub chany), których cechą charakterystyczną jest mechanika oraz podkultura dążące do anonimizacji użytkowników, hermetyzacji społeczności i zapewnienie efemeryczności publikowanych treści. To wszystko w trwały sposób uniemożliwia lub poważnie utrudnia ustalenie autorstwa utworu opublikowanego po raz pierwszy na chanie. Niniejszy artykuł stanowi próbę odpowiedzi na pytania, w jakim zakresie utwory publikowane na chanach są chronione przez prawo i w jakim zakresie możliwe jest dalsze z nich korzystanie.
    The popularity of image forums (so-called imageboards or chans) is growing on the Internet. These forums are distinguished by the mechanic and subculture aimed at anonymisation of users, encapsulation of the community and providing evanescence of published content. All these factors permanently prevent or substantially restrain a possibility of establishing the authorship of works that were published for the first time on chans. Present article is an attempt to explain to what extent works published on chans are subject of protection of the law and to what extent further use of these works is licit. The author considers the following three conceptions. Firstly, it can be assumed that those works all fully protected by law and the free use is inadmissible. Secondly, it is also justifiable to treat those works as orphan works or abandoned works. It can be finally assumed that works published on chans were released under a license similar to the Creative Commons license.

    Opis:
    The role of copyright or related rights collecting societies in legal solutions regarding orphan works. The paper analyses in what way collective management organizations can be useful to solve the problem of so-called orphan works. The issue of orphan works (works whose authors or other rightholders are not known or cannot be located or contacted to obtain copyright permissions) is today one of the most important elements of the debate on the future of copyright law. As the number of orphan works keeps growing it becomes a serious problem which requires to be resolved by creating an appropriate legal framework. It seems that the best way of addressing the problem would be to entrust the management of orphan works with specialized entities i. e. copyright or related rights collecting societies. Namely it is worth to consider the extended collective licensing system that proved to be effective in the Nordic countries. However, the Directive 2012/28/EU on certain permitted uses of orphan works which sets out common rules on the use of orphan works is not based of that system. The absence of mutual recognition implies that an extended collective license is valid only in the national territory in which the statutory presumption applies. It would seem that at least diligent search should be entrusted to copyright or related rights collecting societies. They have access to databases on the works, objects of related rights and rightholders and they interact with similar organizations in other Member States. In the Polish copyright law provisions referring to the collective management of copyright do not fulfill its function. Professional, strong, effective and representative copyright collecting societies with well-defined area of activity are needed to solve the problem of orphan works. This requires amendment to the Copyright Law.
