To meet the challenges in cybersecurity, the state and its bodies must develop classified instruments that will enable the acquisition of data without the active involvement of private sector entities. These programs are installed on a user’s device without their consent to collect and send information about the operating system and any information contained therein. It is not the purpose of this article to analyse the admissibility of using tools typical for criminal activities in the digital world for ensuring state and citizen security. My interest here is to consider what substantive, procedural and institutional guarantees must be met to ensure a balance between the protection of human rights and basic procedural guarantees (such as the presumption of innocence) and the effectiveness of activities in cyberspace.

W 1984 r. wykładowcy z Zakładu Teorii Pracy Operacyjnej Departamentu Szkolenia i Doskonalenia Zawodowego Ministerstwa Spraw Wewnętrznych opublikowali cztery opracowania dotyczące szkolenia, wychowania, organizacji pracy i kontroli tajnych współpracowników. W publikacjach tych, przeznaczonych dla funkcjonariuszy Służby Bezpieczeństwa, wychowanie zostało zdefiniowane jako „świadoma, celowa i systematyczna działalność pracownika operacyjnego, która kształtuje (zaszczepia) oraz utrwala określone pozytywne postawy i cechy osobnicze [TW] niezbędne – w danej sytuacji polityczno-operacyjnej – do skutecznej współpracy z SB”. W prezentowanym tekście omawiam założenia tej koncepcji.
In 1984, lecturers at Zakład Teorii Pracy Operacyjnej Departamentu Szkolenia I Doskonalenia Zawodowego [the Department of Operational Work Theory of the Department of Training and Professional Development] of Ministerstwo Spraw Wewnętrznych [the Ministry of Internal Affairs] of the Polish People's Republic published four studies concerning the training, education, work organization and control of secret collaborators, the so-called TW. According to these publications, dedicated to Security Service officers, education was “the conscious, purposeful and systematic activity of an operational employee, which shapes (instills) and consolidates certain positive attitudes and personal characteristics of secret collaborators necessary – in a given political and operational situation – for effective partnership with the Security Service.” In the presented text the assumptions of this concept are analysed.

Publikowane dokumenty związane ze sprawą kpt. Czesława Gucika, funkcjonariusza Referatu ds. Bezpieczeństwa Komendy Miejskiej i Powiatowej MO w Tarnowie, rzucają nieco światła na codzienne problemy funkcjonowania lokalnej jednostki SB na przełomie lat sześćdziesiątych i siedemdziesiątych XX w., na stosunki między funkcjonariuszami, konflikty personalne, animozje i wzajemne podziały. Protokół zebrania Oddziałowej Organizacji Partyjnej przy Referacie ds. SB Komendy Miejskiej i Powiatowej MO w Tarnowie z 20 marca 1971 r. jest zapisem oskarżeń kierowanych pod adresem kpt. Gucika o różnego rodzaju wykroczenia służbowe i niemoralne postępowanie oraz zarzutów stawianych kierownictwu służbowemu, takich jak niereagowanie na znane większości funkcjonariuszy, nie tylko SB, „grzechy” Gucika i lekceważenie innych problemów. Drugi dokument to wyjaśnienia Gucika, świadectwo zastosowania przez niego taktyki obrony przez atak, czego efektem było oczernienie tych funkcjonariuszy SB, którzy zajęli najbardziej nieprzychylne wobec niego stanowisko.
Published documents related to the case of Capt. Czesław Gucik, an officer of the Security Department of the Municipal and District Headquarters of the Citizens’ Militia in Tarnów, shed some light on everyday problems in the functioning of the local Security Service (SB) unit in the late 1960s and early 1970s: on relations between officers, personal conflicts, animosities and mutual divisions. The protocol from the meeting of the Branch Party Organisation at the Security Department of the Municipal and District Headquarters of the Citizens’ Militia in Tarnów of 20 March 1971 is a record of accusations directed at Captain Gucik of various types of official misconduct and immoral behaviour. Accusations were also made against the service’s directors, such as the failure to react to Gucik’s “sins”, known to the majority of officers, not only in the SB, and also about the disregard of other problems. A second document includes Gucik’s explanations, which are a testimony to his use of defence-by-attack tactics, which resulted in the denigration of those Security Service officers who took the most unfavourable positions toward him.

The purpose of this article is to present the operational capabilities of the OSCE in regulating armed conflicts and their application in the former Eastern bloc countries. In order to show the role of the OSCE in the regulation of armed conflicts, OSCE operational capabilities have been structured in a conceptual grid including: OSCE regulatory tools – in the form of missions, field offices and field coordinators; regulatory mechanisms and emergency mechanisms applied in the light of the peaceful pathways of OSCE involvement in the regulatory process. The common feature of operation at each phase is the broadly understood maintenance of stability or achieving stability. There are armed conflicts against which the OSCE has selectively used regulatory activity, omitting certain phases of the conflict, and those against which the application of regulatory tools has not led to lasting stabilisation. The results presented in the paper confirm the correctness of considering the above theories against the background of the conflict cycle concept. Institutional and legal analysis and comparative analysis were used in this paper.

Perymetrem mechanizmów ingerencji przez Służbę Bezpieczeństwa w autentyczność percepcji duchowieństwa są socjotechniczne zabiegi przy manipulacji techniką operacyjną. Z problemem kreowania wizerunku przychodzi mierzyć się na niwie narracji historycznej w obrębie aspektu operacyjnej inwigilacji kapłana, która relatywizuje jego społeczną rolę, jaką ma do spełnienia w realiach PRL. Zjawisko to odcisnęło swoje piętno, erodujące ład sytemu ustrojowego, jak też konsolidujące siły mu przeciwne w czasach kryzysów władzy. Formuła analitycznej kompilacji ma na celu określenie etykiet przypisanych duchownym z użyciem schematu rozpracowywania przy rozwijaniu rudymentów pracy funkcjonariuszy SB. Upatrywanie czynników destabilizacji społecznej wśród księży warunkowało epatowanie propagandą „tropienia wroga”. Zestawiane przez autora studium przypadków stanowi propozycję interpretacyjną dla hermeneutyki źródeł. Badanie zabezpieczenia operacyjnego księży, weryfi kują odsłaniane instrukcje aparatu represji.
The perimeter of the mechanisms of interference by the Polish People’s Republic security service in the authenticity of the perception of the clergy are socio-technical manipulations of operational techniques. The problem of image creation has to be dealt with in the fi eld of historical narration within the aspect of operational surveillance of the individual priest, which relativises his social role to be fulfi lled in the realities of the former Polish state. This phenomenon left its mark, eroding the order of the political system, as well as consolidating the forces opposing it in times of crises of power. The formula of the analytical compilation is aimed at defi ning the labels ascribed to the clergy with the use of a scheme of dissection while developing the rudiments of the work of the security service offi cers. The identifi cation of the factors of social destabilisation among priests was conditioned by the propaganda of ‘tracking down the enemy’. The case studies compiled by the author constitute an interpretative proposal for the hermeneutics of sources. The study of the operational security of priests verifi es the uncovered instructions of the apparatus of repression.

Autorzy tekstu podważają tezy recenzji, bagatelizujące trwający 16 lat dialog operacyjny ks. Gulbinowicza z SB. Wzmacniają kwestionowane przez Polaka i Suleję tezy z książki „Dialog należy kontynuować…”, w oparciu o niewykorzystane wcześniej materiały źródłowe, wskazując, że obraz niezłomnego hierarchy, który funkcjonował przez lata w sferze publicznej, wymaga skorygowania.
This text is a reply to a review of the source volume “Dialog należy kontynuować…” Rozmowy operacyjne Służby Bezpieczeństwa z ks. Henrykiem Gulbinowiczem z lat 1969–1985. Studium przypadku, selected, prefaced and edited by Rafał Łatka and Filip Musiał (Warsaw–Cracow, 2020), which is actually introduction to the volume by Wojciech Polak and Włodzimierz Suleja. The authors of this text contest the theses of the reviews which challenge Father Gulbinowicz’s 16-year-long operational dialog with the Security Service (Służba Bezpieczenstwa, SB). They reinforce the contested Polak’s and Suleja’s claims from “Dialog należy kontynuować…”, on previously unused source materials, indicating that the image of the relentless hierarch that had functioned for years in the public sphere needs to be corrected.

Operational control is one of the most important powers of the state police services, including, since 2018, the State Protection Service (Służba Ochrony Państwa – SOP). The analysis of the title issue presented in the article leads to the conclusion that the shape of the operational control, which is a novum in the security service, which is the SOP, does not differ from the solutions used in regulating the operational powers of other Polish services, both in terms of the principles and procedure of applying control operational, and the (technical) ways of using this power in practice.

Po wprowadzeniu stanu wojennego w MSW utworzono jednostkę operacyjną pełniącą funkcję sztabu, która koordynowała działania przeciwko podziemnej Solidarności oraz innym nielegalnym grupom. Biuro Studiów SB MSW powołano w marcu 1982 r., zaczęło ono funkcjonować latem 1982 r. Nadano mu szczególne prerogatywy i mogło ono nadzorować aktywność innych jednostek SB oraz pomagać im w planowaniu i realizacji zadań. Jego oficerowie byli również zaangażowani w rozpracowywanie środowisk antysystemowych. Z dostępnej literatury i dokumentów wynika, że prowadzili złożone gry i kombinacje operacyjne, które obejmowały nawet formowanie kontrolowanych organizacji podziemnych. W niniejszym artykule przedstawiono okoliczności powołania tego biura, jego organizację wewnętrzną i podstawowe zadania, które przed nim postawiono. Opisano również chronologię tworzenia jego ogniw terenowych, czyli inspektoratów 2 SB WUSW.
Following the imposition of martial law, an operational unit was established within the Ministry of the Interior to act as a team to coordinate activities undertaken against the underground Solidarity movement and other illegal groups. The Study Office of the Security Service of the Ministry of the Interior was established in March 1982 and became operational in the summer of 1982. It was given special prerogatives and could supervise the activities of other Security Service units as well as assist them in planning and carrying out their tasks. Its officers were also involved in uncovering anti-system circles. The available literature and documents show that they led complex games and operational combinations that even included the establishment of controlled underground organisations. This article outlines the circumstances surrounding the establishment of this office, its internal organisation and its basic tasks. The chronology of the establishment of its field cells, for instance the inspectorates No. 2 of the Provincial Offices of the Interior of the Security Service, is also described.

In recent years, numerous measures to modernize local roads in rural areas have been undertaken. Unfortunately, during renovations, especially at the poviat and commune level, errors are often made as a consequence of irregularities arising at the design stage. The article presents an assessment of the quality of local road renovations carried out in the last fifteen years, in the context of maintaining operational parameters over time, using a visual method based on the term “risk”. The research was carried out for twenty-six sections of roads that were renovated or rebuilt in the Kłobuck and Częstochowa poviats. The categories of the most common errors were identified and actions were proposed to correct them and prevent new ones. Among the negative trends, the improper placement of road technical devices and the lack of appropriate marking of integral areas were distinguished. It was found that a positive aspect in the aspect of traffic safety, recently, is the widespread use of modern road marking systems and road signs, as well as greater care for proper maintenance of drainage devices. The use of modern solutions during the modernization of roads, despite co-financing from the Government Fund, is still limited by the financial deficit of local governments.

Artykuł przedstawia działalność Grupy Operacyjnej KBW „Lubaczów”, która w 1947 r., po zakończeniu akcji „Wisła”, prowadziła działania przeciwpartyzanckie przeciwko OUN i UPA. W wyniku intensywnych poszukiwań oddziałom KBW udało się w ciągu nieco ponad trzech miesięcy wykryć i zlikwidować ośrodek kierowniczy OUN w Polsce, na czele z krajowym prowidnykiem Jarosławem Staruchem „Stiahem”, jak również wszystkie większe grupy partyzanckie na terenie pow. lubaczowskiego. W ten sposób faktycznie położono kres istnieniu zorganizowanego podziemia ukraińskiego. W oparciu o analizę mało znanych dokumentów archiwalnych autor pokazuje, iż celem KBW nie była jedynie likwidacja podziemia ukraińskiego. Równolegle bowiem prowadzono aresztowania członków polskiego podziemia niepodległościowego, a także czystki personalne w szeregach partii politycznych i organizacji społecznych regionu. Pod egidą KBW stworzono liczne placówki ORMO i wzmocniono powiatowe struktury PPR. Podstawowym celem GO „Lubaczów” było więc umocnienie władzy komunistów w powiecie lubaczowskim.

Artykuł koncentruje się na polemice z obszernym wstępem, który Rafał Łatka i Filip Musiał zamieścili na początku omawianego wydawnictwa źródłowego. Autorzy tekstu podważają tezę o mocno obciążającym dla Henryka Gulbinowicza charakterze rozmów z funkcjonariuszami SB. Podkreślają też, że ksiądz prowadził ze służbami rodzaj gry i to on określał ramy swoistego dialogu. Gra ta niekoniecznie toczyła się bez wiedzy prymasa Stefana Wyszyńskiego. Autorzy artykułu zgadzają się natomiast w pełni z twierdzeniem redaktorów książki, że ks. Gulbinowicz nie był nigdy osobowym źródłem informacji SB.
The article focuses on the polemic with a comprehensive introduction by Rafał Łatka and Filip Musiał to the analysed source edition. The authors of the present text question the thesis about the highly incriminating character of Henryk Gulbinowicz’s conversations with functionaries of the Security Service (SB). They also emphasise that Gulbinowicz played a certain game with the Service, and it was he who defined the framework of the specific dialogue. This game was not necessarily played without the knowledge of Primate Stefan Wyszyński. The authors of the article, however, fully agree with the opinion of the book’s editors that Henryk Gulbinowicz was never a personal source of information to SB.

Opis:
The material scope of the research problem presented in the text encompasses the issues concerned with operational surveillance that the Polish civilian counter-intelligence service, i.e. the Internal Security Agency (in Polish abbreviated as ABW – Agencja Bezpieczeństwa Wewnętrznego), is authorised to. The main purpose of the analysis is to assess the changes introduced as a result of the passing of the so-called Surveillance Act in 2016. The Act was supposed to introduce new regulations with regard to the powers concerning operational surveillance and obtaining of ICT data, granted to particular secret and police services. The said changes were enforced by the judgment of the Constitutional Tribunal, which in 2014 found numerous violations of the provisions of the Constitutions of the Republic of Poland caused by the existing regulations authorising the services to engage in particular operational and investigative actions. In order to elaborate the material scope of the research problem, and to present the conclusions, the following research questions have been presented in the text: Do the legal regulations concerning the powers vested in the Polish civilian counter-intelligence service within operational surveillance infringe individual rights and freedoms (e.g. the right to privacy, protection of personal information, privacy of correspondence), and if so, then to what extent? Functional and pro-constitutional interpretations have been applied to assess the provisions regulating the powers of the Internal Security Agency with regard to operational surveillance and obtaining of ICT data. The functional interpretation focuses on the function of selected legal solutions, whereas the pro-constitutional interpretation focuses on the assessment of legal solutions in the context of the principles of a democratic state ruled by law, as well as human rights and freedoms. As regards the pro-constitutional interpretation, the tool used for assessment is the test of proportionality, i.e. the rule used for interpreting legal norms according to the degree and legitimacy of the interference in individual rights and freedoms.
Zakres przedmiotowy problemu badawczego w tekście obejmuje tematykę kontroli operacyjnej, do której uprawniony jest polski kontrwywiad cywilny, czyli Agencja Bezpieczeństwa Wewnętrznego (pol. skrót: ABW – Agencja Bezpieczeństwa Wewnętrznego). Głównym celem podjętej analizy jest chęć oceny zmian, które dokonano w związku z przyjęciem tzw. Ustawy inwigilacyjnej w 2016 roku. Ustawa ta miała wprowadzić nowe regulacje w zakresie uprawnień dotyczących kontroli operacyjnej i pozyskiwania danych teleinformatycznych poszczególnych służb specjalnych i policyjnych. Zmiany te wymuszane zostały orzeczeniem Trybunału Konstytucyjnego, który w 2014 roku stwierdził liczne naruszenia przepisów Konstytucji RP przez dotychczasowe przepisy uprawniające służby do stosowania poszczególnych czynności operacyjno-rozpoznawczych. W celu uszczegółowienia zakresu przedmiotowego problemu badawczego i prezentacji wniosków końcowych w tekście przedstawiono następujące pytanie badawcze: Czy i w jakim stopniu regulacje prawne dotyczące uprawnień polskiego kontrwywiadu cywilnego w zakresie kontroli operacyjnej naruszają prawa i wolności jednostki (np. prawo do prywatności, ochronę informacji o sobie i tajemnicę korespondencji)? Do oceny przepisów regulujących uprawnienia Agencji Bezpieczeństwa Wewnętrznego w zakresie kontroli operacyjnej i pozyskiwania danych teleinformatycznych wykorzystano interpretację funkcjonalną i prokonstytucyjną. Interpretacja funkcjonalna skupia się na funkcji wybranych rozwiązań prawnych, natomiast interpretacja prokonstytucyjna na ocenie rozwiązań prawnych w kontekście zasad demokratycznego państwa prawa oraz praw i wolności człowieka. W przypadku interpretacji prokonstytucyjnej, narzędziem oceny jest test proporcjonalności, czyli reguła interpretacji norm prawnych wedle stopnia i zasadności ingerencji w prawa i wolności jednostki.

The article presents selected problems of the activities of the Polish political police in 1919-1939. The author disscused organizational changes and the operational work model of this formation and presented methods of activity, especially confidential intelligence, surveillance and observation. Much attention was devoted to issues of cooperation with informants and informers. Applicable principles in this respect were discussed. Attention was paid to the selection of secret colleagues. The problem of assessing the credibility of the materials they provide was highlighted. The basic tasks of the political police were discussed, taking into account existing security threats. It was noted that their the scope of tasks changed depending on the guidelines of state authorities.

A company’s financial result is a multidimensional and diverse category of primary importance for the continuation and development of the business entity’s activity. The varied expectations of individual groups of enterprise stakeholders regarding the quality of information contained in the reported data imply that managers often face various types of market and contractual ‘challenges’ affecting the directions and scale of the intentional shaping of the company’s financial results. The main purpose of the paper is to present the relationships between real earnings management practices and the operational financial security of industrial listed companies. The research was carried out on a sample of 72 public enterprises classified into twelve industries whose shares were traded on the Warsaw Stock Exchange for at least twelve years in the period 2003-2018.
Wynik finansowy przedsiębiorstwa jest wielowymiarową i zróżnicowaną kategorią o podstawowym znaczeniu dla kontynuacji i rozwoju działalności podmiotu gospodarczego. Zdywersyfikowane oczekiwania poszczególnych grup interesariuszy przedsiębiorstwa względem zakresu i jakości informacji zawartych w raportowanych danych powodują, iż menedżerowie niejednokrotnie stają w obliczu różnych rodzajów rynkowych i kontraktowych „wyzwań” wpływających na kierunki i skalę intencjonalnego kształtowania wyniku finansowego. Zasadniczym celem artykułu jest ukazanie relacji między praktykami z zakresu realnego zarządzania zyskiem a operacyjnym bezpieczeństwem finansowym przemysłowych spółek giełdowych. Badania empiryczne przeprowadzono na próbie 72 publicznych przedsiębiorstw zaklasyfikowanych do grona dwunastu branż przemysłu, których akcje były przedmiotem obrotu na Giełdzie Papierów Wartościowych w Warszawie przez co najmniej dwanaście lat w przyjętym horyzoncie odniesienia 2003-2018.
