Opis:
Article 51 of the UN Charter, in affirming the inherent right of self-defence of each UN Member State 'against which an armed attack has occurred', clearly indicates that the concept of armed attack plays a key role in delineating the right of self-defence. The concept in question was not, however, defined in the UN Charter, and no universally acceptable definition has yet emerged either in practice or in doctrine. One of the fundamental questions to be addressed in this context is who must engage in armed activity for it to qualify as an armed attack. This question is of particular relevance today because of the threat of international terrorism and the expansion of the concept of armed attack through the inclusion of an act of terrorism. The article discusses in some detail the emerging legal framework for attribution of actions undertaken by non-state actors to states.

Opis:
China has experienced the rapid emergence and development of private higher education in the recent decades. This article focuses on the current situation in several key areas, such as development of non-state education, globalization influence at chinse non-state education and social stratification in this sector. It shows regional diversity and random planning in private higher education and also stress situation low-income groups. Moreover it presents acquisition of labour market qualification by mentioned groups. This study concludes that proper financing and management in an urgent thing to do and in the future it will benefit from to Chinese society through multiple roles.

Aim. The paper is aimed to investigate the students’ opinion about the social responsibility carried out by higher education institutions (HEIs) in Ukraine. Nowadays social responsibility has become one of the key characteristics of modern HEIs. Ukrainian universities are trying to become 'civic universities', i.e., institutions which contribute to the development of the local community. The students, as key stakeholders of the university activities, also take part in this process. Methods. To investigate the social responsibility of the Ukrainian HEIs, the case study method is used in the present paper: the case of Mariupol State University and its social functions within the city are highlighted. The online survey was applied to investigate the level of students’ awareness of the university social functions and the role played by the university in the local community. Materials published by the university and the results of the survey have been analysed to test the hypothesis that students consider Mariupol State University to be a socially responsible university which cooperates with the local community. Results. The students’ opinion on the social functions carried out by Mariupol State University is that this local university has strong ties with the local community and authorities and perform its social mission. However, the social functions of the university, according to the students, are limited by teaching and research activities. Few students consider social responsibility of the university in a wider context. Conclusion. On the example of the MSU the paper shows that modern universities in Ukraine perform social functions and try to become truly civic universities to contribute to the development of the local communities in cooperation with different stakeholders. Nevertheless, students as a key stakeholder of the university activities still consider social responsibility of the university primarily aimed at teaching and research.

Kwasi Wiredu is one of the most outstanding contemporary African philosophers. He was born in Ghana and currently is a lecturer working in the United States. In his political works he uncovers different shortcomings of the concept of liberal democracy and suggests constituting democracy in Africa on the basis of indigenous political traditions, which in his mind are of democratic nature. Wiredu is of very negative opinion about the condition of contemporary 'majoritarian' democracies since their political mechanisms are rather adversarial in character. On the contrary, he perceives politics in many traditional African societies as very conciliatory. Thus the Ghanaian thinker supports the idea of introducing into modern African politics such traditional political institutions as deliberation (palaver) and consensus. Wiredu also suggests substituting present-day political parties for political associations. Such associations would have specific goals and Wiredu believes that in a nonparty state the government would not be created on their basis. Although Wiredu's critical approach especially towards the realities of ongoing political changes in Africa is well understood and justified, his concept has many drawbacks. This article is aimed at showing and analyzing some of them and make readers realize how difficult it is to transfer some political solutions, which once could have been very useful in some small homogenous communities, into present-day multi-ethnic societies.

Opis:
The prospect of weapons of mass destruction (WMD) terrorism poses a danger for contemporary societies. However, the incidents related to an application of weapons of mass destruction (that is, nuclear, chemical, biological and radiological weapons) by non-state actors are relatively rare. The aim of the paper is to present recent incidents and to estimate the threat from particular types of WMD. The author focuses both on the question of motivation to undertake these operations and on the problem of technological capabilities. To sum up, the risk of a massive WMD terrorist attack should be perceived as quite moderate due to the technological barrier, but selective attacks carry a greater potential risk because of their higher probability and significant psychological effect.

This article aims to address the issue of alleged hybrid warfare attacks on Lithuania, Latvia, and Poland. The scope of the article covers the Belarus operations conducted in 2021. Firstly, the author addresses the issue of pushing migrants from a descriptive perspective. Secondly, he debates whether Belarus operation was conducted within the scope of hybrid warfare, hybrid threat, and lawfare? The author concludes that the Republic of Belarus has operated lawfare falling within the hybrid threat spectrum. It means that the situation is not to be classified under the law of armed conflict from the perspective of international and non-international armed conflicts and ius ad bellum violation. Thirdly, the author claims that Belarus has violated international law, so certain legal redress is appropriate and justified. Belarus's actions may result in a court proceeding before the International Court of Justice and before other international institutions.

This paper presents the television coverage of a terrorist attack during the 2008 election campaign in Spain. The starting point is that in media systems known as polarised pluralist, issues are usually framed through the lenses of electoral competition, portrayed from the point of view of political parties. Analysis shows that even in the case of important issues such as terrorism, the dynamics of polarised pluralism bias its coverage, offering different versions of events to citizens. Niniejszy artykuł prezentuje relacje telewizyjne po ataku terrorystycznym, który miał miejsce podczas kampanii wyborczej w Hiszpanii w 2008 roku. Punktem wyjścia jest stwierdzenie, że w systemach medialnych określanych jako „spolaryzowany pluralizm” poszczególne tematy ujmowane są przez media w ramy konkurencji wyborczej i przedstawiane z perspektywy stanowisk poszczególnych partii politycznych. Analiza pokazuje, że nawet w przypadku kwestii wyjątkowo istotnych, takich jak terroryzm, dynamika spolaryzowanego pluralizmu wykrzywia przekaz w taki sposób, iż do odbiorców kierowane są odmienne wersje wydarzeń

Opis:
The article discusses the findings of the multilevel government school (MLG) which has been advancing since the beginning of the 21st century, studying regional elections. The concept defining regional elections as second-order elections has been recognized as critical, although it is reformulated by the MLG school to respond to changes in modern regional politics in Europe. Important recent political developments include the entrenchment of regional governments, the increase in the number of electoral appointments, expanded competencies of voters, the rise of non-state-wide parties and the empowerment of sub-national organizational levels of parties. Current MLG research focuses on identifying and explaining the cases where second-order election predictions do not appear to hold for regional elections, identifying states where it is still the case and, finally, identifying factors that increase or decrease this effect. An interesting theoretical development regarding regional elections as second-order elections is that this concept is supplemented and enriched by the theories of regional authority and territorial cleavages. The final part of the article reviews studies on regional elections and the applicability of the second-order concept to Central and Eastern European countries.

A meeting point for scholars working on the processes of formation of coalition governments in European parliamentary systems is the analysis of the Spanish case. Since the restoration of democracy in the late 1970s parliamentary minority has not come to form any coalition government. Instead of it there have been parliamentary negotiation processes, in which stable parliamentary agreements have been reached to ensure continuous support for the government in office. One point worth noting is that, in these negotiations, the main national parties – UCD, PSOE or PP – have chosen to negotiate only with nationalist parties or non-state-wide parties. This article attempts, in the light of spatial analysis, to provide new arguments for understanding such negotiation processes.

The article presents the analysis of the role of non-state actors in shaping global security. It points out the functions performed by states and the observation that their role is gradually diminishing in favor of non-state actors. The article also presents the classification of these actors (governmental and non-governmental organizations, corporations, militias, think-tanks, diasporas, political parties and the Catholic Church) differentiating their significance for international security.
Artykuł przedstawia analizę roli, jaką pełnią różni aktorzy niepaństwowi w kształtowaniu bezpieczeństwa globalnego. Zwraca uwagę na funkcje, jakie obecnie pełnią w tym procesie państwa oraz wskazuje, że ich rola stopniowo maleje na rzecz aktorów pozapaństwowych. Artykuł jednocześnie dostarcza klasyfikację tychże aktorów (organizacje rządowe, pozarządowe, korporacje, grupy zbrojne, think-tanki, diaspory, partie polityczne czy Kościół katolicki), różnicując ich znaczenie dla bezpieczeństwa międzynarodowego.

The feature that most attracts private parties from different states to referring their dispute to an arbitral tribunal is the flexibility of the procedure. However, the differences between arbitration and court litigation are not only procedural, but they concern the substance of the parties’ cases. This is because in the realm of international arbitration the law applicable to the merits of the case is determined according to other provisions than the statutory conflict of laws rules. Depending on the arbitration law of the seat, the entire private international law statute can be captured in a single provision – “absent the parties’ choice, the arbitral tribunal shall apply the rules of law which it determines to be appropriate”. It follows that arbitral tribunals, unlike state courts, are not bound by the conflict of laws rules of the forum. What’s more, the merits of a dispute submitted to arbitration may be governed not only by some national body of law (e.g. the Polish Civil Code) but also by a non-state, non-national set of provisions – “rules of law” (e.g. the UNIDROIT Principles of International Commercial Contracts). The aim of this article is to analyze how the parties and tribunals may make use of their autonomy in determining the law applicable to a dispute. Furthermore it examines whether there are any limits thereto in light of the Rome I Regulation.

This paper presents the results of simulation research of an off-line-trained, feedforward neural-network-based state estimator. The investigated system is the mechanical part of an electrical drive characterised by elastic coupling with a working machine, modelled as a dual-mass system. The aim of the research was to find a set of neural network structures giving useful and repeatable results of the estimation. The mechanical resonance frequency of the system has been adopted at the level of 9.3-10.3 Hz. The selected state variables of the mechanical system are load, speed and stiffness torque of the shaft.

The paper is devoted to building a probabilistic method of analyzing the operation of a certain production supply system. The analysis is carried out for non-extreme states of the level in store, into which two separate streams of production (the product) are directed. A system of partial differential equations describing this case was derived which is satisfied by the joint density function defining the probabilities of states of the three-dimensional process characterizing the system’s functioning.

Państwo Islamskie, jak sugeruje sama nazwa, nie chce być postrzegane jako organizacja terrorystyczna, ale jako kalifat, państwo muzułmańskie. W ostatnich latach wiele zmilitaryzowanych aktorów niepaństwowych głosiło potrzebę oraz dążenie do utworzenia państwa muzułmańskiego, jednak żadnemu z nich to się nie udało. Państwo Islamskie można traktować jako pierwszą organizację, która nie tylko ogłosiła powstanie państwa, ale także stworzyła struktury państwowe, a co więcej − spełniła w pewnym stopniu warunki państwowości wymienione w Konwencji o Prawach i Obowiązkach Państw z Montevideo z 1933 r. Czy jednak w świetle prawa międzynarodowego nowy twór polityczny można uznać za państwo?
Islamic State, as the name suggest, is going to be perceived and treated not as a mere terrorist organization, but rather as a caliphate, Islamic state. In the last decades many violent non-state actors have propagated the idea of caliphate but none of them have never accomplished the idea. Islamic State can be treated as the first organization, which declare and what is more important create state structures, responsible for administrating conquered territory. To some extent Islamic State fulfills thecriteria for statehood listed in the Montevideo Convention on the Rights and Duties of States, 1933. But the basic question is whether  it can be recognized as a state in the light of international law?
