Services sum up to 70 % of EU’s GDP, and just 20 % of cross-border trade of the European Union – partly due to the unjusti! ed regulatory and administrative burdens implied on different levels of member states administration. The existence of those barriers has stimulated the works on the directive freeing the service sector and implementing a number of rules that may potentially become milestones of integration, compared only to such “history making” moments as Single European Act or Maastricht Treaty."The freedom to provide service outside the country of establishment’ principle, previously known as the ‘country of origin’ rule, carries this revolutionary impetus. It will allow a service provider be settled in one EU member state and deliver a service (personally or by delegated employees) in another one with all the legal consequences, especially: some aspects of taxation and social security contributions. Unsurprisingly, it has become one of the most controversial legal acts debated in the last decades Europe-wide. This principle may, to a large extend, undermine the foundations of welfare state, especially in the Western part of continental Europe, as it may force the regulated capitalism oriented countries (like Scandinavian ones) to verify their social policies accordingly to competition pressure coming from lower social standards member states. This may, as it is speculated in this paper, fuel the harmonising of social policies on Community level. Free movement of services was introduced fifty years ago, however it has been usually interpreted from the consumers’ perspective: free access to the service by service consumer relocation or trans-border trading. Service provider relocation was tolerated only when accompanied with establishment in the consumer’s country. The Service Directive, following the logic of previous European Court of Justice verdicts, introduces – on the secondary law level – the freedom to be established in another country than the country where the service is provided. This practical challenge is examined theoretically on the grounds of neofuncionalist rationale, as the discussed directive, by its supporters called: the greatest improvement of the internal market since its creation, can act as an empirical proof of neofunctionalism theory applicability. Implementing this approach, especially the revitalised spillover mechanism, is an efficient theoretical vehicle showing satisfactory exploratory power, as well as allowing speculations about the future development on the edge of politics and economy within European integration process. It also highlights the behaviour of supranational actors creating ‘stress among the states’ to progress the integration into the desirable direction (cultivated spillover). The deliberations in this paper are rooted in exempli! cations of so far practices infringing the free movement of services rule, as well as enriched with some argumentation for and against this form of directive (transformative decisions and legitimacy / democracy de! cit). The arguments used are deeply rooted in ! nal version text of the directive accompanied by interpretation of major principles. In the conclusive part author summarises that theoretical legacy of neofunctionalism – in the case of the Service Directive – seems to be adequate and the deductive argumentation based on it positively veri! es the potential of the theory.

Niniejszy artykuł prezentuje, jak dwie aktualnie dominujące teorie integracji politycznej - neofunkcjonalizm i liberalizm międzyrządowy - odnoszą się do zagadnienia bezpieczeństwa międzynarodowego. W tym celu zostały opisane obie koncepcje teoretyczne i umiejscowiono je w szerszym kontekście teorii stosunków międzynarodowych. Przedstawione zostały także podstawowe założenia metodologiczne rzeczonych teorii. Główny problem badawczy poddano dwustopniowej analizie, której zasadniczym celem była próba odpowiedzi na pytania, jak do kwestii bezpieczeństwa międzynarodowego odnoszą się teoretycy neofunkcjonalizmu i liberalizmu międzyrządowego oraz jakie elementy tych teorii można dostrzec w praktyce integracji politycznej państw. Jako że obie koncepcje zostały sformułowane w reakcji na proces integracji europejskiej, to właśnie Unia Europejska stanowi najważniejszy punkt odniesienia dla rozważań dotyczących tej praktyki. This article presents how two currently dominant theories of political integration - neo-functionalism and intergovernmental liberalism - address the issue of international security. To this end, the author describes the two theoretical concepts and their place in the broader context of the theory of international relations and presents the basic theoretical principles of these theories. The main research problem was analysed on two levels, with the principal purpose of answering the questions of how international security concerns are approached by theorists of neo-functionalism and intergovernmental liberalism and what elements of these theories can be seen in the practice of political integration of states. Since both concepts have been formulated in response to European integration, it is the European Union that is the most important reference point for the reflection on this practice. The crises that hit the EU after 2008 brought about disintegration tendencies. That requires not only further in-depth research on the state of the Union, but also theoretical conceptualisation facilitating an explanation of the processes of disintegration. In this article four theoretical approaches to carry out this type of analysis are proposed, which in a multilateral way may help to explain the problems of the regional disintegration in Europe, but also in other regions of the world. Author’s approach is based on existing theoretical concepts: neofunctionalism, constructivism, institutionalism and realism. Author seeks the complementarity between the theoretical approaches in order to explain the phenomenon of disintegration.

The notion of the social system in the field of sociology has been meeting the changing level of interest. One may follow the dynamics of the interest while studying the development of the social theory, especially in its functional and neofunctional version. This interest however is not determined only by the intrinsic dynamics of the social thought. It was also directly associated with nonscientific expectations, with the existing social situation. One may thus talk on the social climate of the system or anti-system way of thinking. The climate is to a large extent dependent on the social reaction to a crisis and the answer to the question: whether the solution to the crisis is sought within the frames of the system. In this context the notions of a crisis and a system seem to be clearly associated. The article refers to the social systems theory. The overriding aim of the article is to come up with the answer for the question on the current condition of the social system. Today when the issue of the crisis is so popular may one also talk about the crisis of the social system? The answer may not be unequivocal as the understanding of the crisis and the system in the sociological theory is ambiguous. The viewpoint presented in the article complying with this ambiguity includes also reference to the issue of the situation of the individual in the social system.

In order to better understand the Poland-EU conflict over the rule of law I interviewed selected Polish Members of European Parliament [MEPs] on EU integration in the peak of the controversy in 2018. Drawing from discourse analysis and “practice turn” in European studies I studied the MEPs narratives. They appeared to be deeply rooted in two discourses: neofunctionalism and intergovernmentalism, both considered as dominant narratives in the EU studies. As right-wing MEPs were convinced the EU was politically biased, protecting sovereignty played a crucial role in their narratives regarding the rule of law conflict. The European People’s Party [EPP] and Socialists and Democrats [S&D] MEPs emphasized the need to abide by EU rules, but their attitude towards imposing sanctions against Poland was mixed. In the rule of law conflict they didn’t firmly stand by its side as a polity protecting its laws. The notion of sovereignty showed cleavages in their narratives, usually full of belief in the supranational community of values.

The activities of the two chambers of the Polish parliament – the Sejm and the Senate – during the twenty years of Poland’s membership in the European Union can be analysed by taking two research approaches, the first of which is universalism, which addresses the civilisational need to build, harmonise, and unify. Universalism, which refers to the neo-functionalism paradigm, has characterised the European activity of both chambers of the Polish parliament. The other perspective is provided by neo-realist particularism, which takes an anti-idealist and anti-utopian stance. It is distinguished by national egotism expressed as an attachment to achieving the nation’s own interests. Today, particularism understood in this way is based on sovereign distinctiveness, independence, and self-reliance. The purpose of this article is to positively verify the hypothesis that the parliamentary dimension of Poland’s membership in the EU observed through the participation of the Sejm and Senate in the process of Europeanisation and de-Europeanisation simultaneously contributes to the dependence and independence of both chambers on the European Union and its institutions. The universalist and particularist approaches have allowed the author of this analysis to reach an empirically-confirmed conclusion that both chambers of the Polish parliament in the period under study had an influence on the following: (1) the political power of the government, reinforcing or sapping it during negotiations; (2) the effectiveness or ineffectiveness of coalition-building in the EU; (3) cooperation with or resistance to the dominance of the parliaments of large EU states; (4) varied responsibility for the integrative system as a united and harmonious whole; and (5) the union of the peoples of Europe or a Europe of Homelands.
